Abstract

Land lease agreements and shophouses without a term in Indonesia often cause complex legal problems, especially when the lease object is sold by the owner. This study analyses the case in Decision Number 362/Pdt.G/2013/PN Mdn, which highlights the conflict between the new owner and the tenant in an indefinite lease situation. Using normative juridical research methods with a descriptive approach and qualitative analysis, this study explores the validity and legal protection of indefinite lease agreements, as well as the application of the law by the panel of judges in the case. The results of the study show that although the Civil Code justifies indefinite lease agreements, this practice has the potential to create legal uncertainty. The principle of "koop breekt geen huur" that is supposed to protect tenants is not always applied consistently, especially in the case of indefinite agreements. Court rulings tend to favour new owners' rights over tenants, raising questions about the balance of legal protection. This situation emphasises the need for further legal clarity and a more balanced approach in resolving conflicts between the rights of tenants and new owners in the context of a transition of ownership of leased property.

The rapid growth of the fisheries industry in Indonesia highlights the urgent need to formulate and implement legal policies that are in line with sustainability principles. This abstract discusses efforts to "Harmonize Fisheries Law for Indonesia's Marine Welfare," with a focus on achieving long-term goals involving economic, ecological, and social aspects. The paradigm shift from overexploitation to sustainable management requires integration and consistency between applicable legal regulations. This research highlights the importance of addressing interregulatory conflicts, increasing supervision, and implementing effective sanctions to support sustainability principles. Abstract

Mudharabah financing is a financing product that is run based on the principle of profit sharing in the sharia banking system, where the sharia bank is the shahibul maal (capital owner) and the customer is the mudharib (business manager). In Indonesia, mudharabah financing has shown significant development as an alternative financing that complies with sharia principles. However, there are various problems that hamper the effectiveness of this financing product. This analysis aims to identify and analyze problems that occur in mudharabah financing in Indonesian sharia banks, as well as provide recommendations for solving them.
