Abstract

Istilah Gono Gini yang dikenal oleh budaya atau adat yang berkembang di Indonesia adalah harta bersama, Harta Gono Gini merupakan hasil harta bersama yang dimiliki oleh pasangan yang sudah menikah. Kompilasi Hukum Islam Pasal 85 menegaskan “adanya harta bersama dalam perkawinan itu tidak menutup kemugkinan adanya harta milik masing-masing suami atau isteri” dan Pasal 86 sebagai berikut: a) Pada dasarnya tidak ada percampuran antara harta suami dan harta isteri karena perkawinan. b) Harta isteri tetap menjadi hak isteri dan dikuasai penuh olehnya, demikian juga harta suami tetap menjadi hak suami dan dikuasai penuh olehnya. Pasal 97 Janda atau duda cerai masing-masing berhak seperdua dari harta bersama sepanjang tidak ditentukan lain dalam perjanjian perkawinan. Sedangkan di dalam UUD No 1 Tahun 1974 tentang perkawinan Pasal 35 di atur. a. Harta benda yang diperoleh selama perkawinan, menjadi harta bersama. b. Harta bawaan dan masing-masing suami dan isteri dan harta benda yang diperoleh masing-masing sebagai hadiah atau warisan, adalah dibawah penguasaan masing-masing sepanjang para pihak tidak menentukan lain. Pasal 37 Undang-Undang Perkawinan menyatakan bahwa bila perkawinan putus karena perceraian harta bersama diatur menurut hukumnya masing-masing. Jika dicermati Kompilasi Hukum Islam (KHI) Pasal 85 dan 97 tentang Harta Bersama tidak memberikan keseragaman Hukum Islam dalam penyelesaian Harta bersama apabila terjadi perceraian. lalu, UU Perkawinan No 1 Tahun 1974 Pasal 37, Jika dicermati juga maka Pasal 37 Undang-Undang Perkawinan dan penjelasannya, tidak memberikan keseragaman hukum positif tentang bagaimana penyelesaian harta bersama apabila terjadi perceraian, hal ini tentu menjadi problem sosial hukum. jika penyelsaian dan penetapan Harta bersama tersebut tidak efektif dan adil dalam pembagiannya. Maka, rentan konflik antara pasangan suami istri kemungkinan bisa terjadi.

Abstract

a teacher in conducting the learning planning process needs to understand the characteristics and initial abilities of students. Analysis of learners' initial abilities is an activity of identifying learners in terms of needs and characteristics to determine behavioral or goal and material specifications and qualifications.Interaction between teacher and students, students and others are no longer unilateral but are more emotional and sympathetic or interactive relationships through the teaching and learning process. Students are no longer an object of education but have been reduced to polarization of thinking by stating that students as students, a fun and exciting interaction process makes learning effective.

Abstract

Islamic law is one of the raw materials for the national legal systems in addition to the customary law and the law of the West.Therefore Islamic law can be used as raw material for the construction of the device, order and culture of origin of national law does not conflict with the values of Pancasila and the 1945 CONSTITUTION and in accordance with the needs of the people of Indonesia law.Can not be contradicted by evidence of any kind that Islamic law has an important and strategic position in national law drafting and pmbentukan Indonesia One of the efforts to incorporate Islamic law into the national laws of grammar through transformation.This paper discusses about the effort will be the transformation of Islamic law into the law of Indonesia governance. the formalization of Islamic law if done substantively, cannot be released and must be preceded by a reference to the judiciary with constitutional considerations and the history of the nation. The process is inseparable from the history of Islamic law in Indonesia, and the policy of Indonesian legal politics in placing the position of Islamic law in the national legal system.

Abstract

Al-Quran as paradigm is the basic of scientific tradition in Islam, because al-Quran have the ability as the mode of thought, mode of inquiry, which than generates mode of knowing.In the Islamic scientific tradition, al-Quran is used as the main point that regulate many aspect of life, particularly as a basic education paradigm. The paradigm of al-Quran used as the relationship between revelation, reason, and science. So, this the basic beliefs of Islam, give stability and confidence to themself to the straight path of life and also herd them to the day hereafter. There is a symbiotic relationship between the Qur'an and science. In addition, the Qur'an has to indicate the main points and reflect on the education system. To make the Qur'an as scientific tradition of Islam, then we must seek to understand its meaning; clear the mind, heart and soul in building a heart to understand the Quran; realize that the Koran is the source of knowledge; and using the methodology of the Qur'an as a means of scientific thingking.

Abstract

This study aims to explain about moral education efforts in Sambas High School Muhammadiyah students. This research is a field research using qualitative data analysis. the results of the study that the efforts made in the formation and moral development of students in Sambas Muhammadiyah High School used two approaches. First, through a habituation approach. Habitual activities in schools such as performing the midnight prayer in congregation, carrying out reading the Qur'an, reading prayers before learning and after study, habituating to shaking hands when students meet with the teacher. Second, through the exemplary approach. Teachers who teach at Sambas Muhammadiyah High School try to be good teachers and can provide good examples of their students. This example is done to create generations that have good morals.

Abstract

Hermeneutics is a method or philosophical theory to interpret symbols related to the text in order to know the meaning and meaning. it was first used in the study of the Koran in the 19th century AD by Islamic scholars, but many scholars questioned it. This is because it can doubt the authenticity and sanctity of the Koran. Besides that, hermeneutics has been used to interpret bible to find its truth value. The Qur'an serves every question and objection from its readers, who come from various cultural backgrounds and scientific disciplines. Because the scriptures cannot speak for themselves, they need understanding, reading, interpretation and repetition of reinterpretations that are generally carried out by experts in the same way. In addition, the distance between the birth of the text and the period of interpretation is very long. For this reason, a methodological "means" is needed to understand the text in question.

Abstract

Islamic education enters along with the early history of Islam in the form of civilization such as the Egyptian culture of the pyramids, sphinxes, obelisks, and hieroglyphics. the figures who have contributed to the field of education are Muhammad Abduh, Sayyid Ahmad Khan, and Muhammad Ali Jinnah. The application of education between Egypt, India, and Pakistan is almost the same, namely making compulsory education for their citizens. The existence of public and religious/Madrasah educational institutions as well as public and religious high schools / universities. Different curriculum. Application of the learning of the Qur'an and Hadith. Integrate between general science and religious science. professional teaching staff. Every country has a different education system influenced by sociology of society, the history of the establishment of a country, the needs of a country in accordance with the demands of the era and an increasingly globalized world.

Abstract

This nation is looking for and choosing an idea that can complete the basalak education, which is expected to be a solution and able to bring this nation to progress. In the midst of the ambiguity of society in the world of education, the new hope is with the coming of the era of character education sourced from the quran and hadith, through a character-based holistic concept and promoting nine pillars; love God and all his creation, independence and responsibility, honesty and trustworthy, diplomatic, respectful and polite, generous and helpful, confident and hardworking, leadership and justice, humble, tolerant, peaceful and united.
