Potert Pemikiran adalah jurnal pertama di Sekolah Tinggi Agama Islam Negeri (STAIN) Manado yang sekarang bertranformasi menjadi Institut Agama Islam Negeri (IAIN) Manado. Saat itu, Potret Pemikiran melingkupi cangkupan ilmu secara umum, yaitu ilmu politik, hukum, ekonomi, pendidikan, serta agama hingga tahun 2018. Sejak tahun 2019, Jurnal Potret Pemikiran fokus dan jangkauannya terkait Pemikiran Islam di bidang: Filsafat, Tasawuf, Politik Islam dan sosial Keagamaan, serta terjadi perubahan gaya selingkung yaitu menjadi APA 6th Edition (American Psychological Association).

Abstract

This study explores the diversity of salat (ritual prayer) practices among international students at the Islamic University of Indonesia (UII) who come from various Islamic legal madhahib (madhahib, madhahib of Islamic jurisprudence). These differing practices, particularly in salat al-farḍ (obligatory prayers), often raise questions among local students within a predominantly Syafi’i jurisprudential environment. The research aims to examine how international students perform salat and whether they adopt inclusive or exclusive attitudes in responding to local religious norms. Employing a qualitative approach grounded in Bhikhu Parekh’s theory of multiculturalism and comparative Islamic jurisprudence, this study draws on coordination with UII’s Office of International Affairs, closed and open interviews, observations, literature reviews, and Focus Group Discussions (FGDs). Data was analyzed through processes of reduction and interpretive analysis. The findings reveal significant variations in prayer practices, including the recitation of Surat al-Fatiḥah (the Opening Chapter of the Qur’an)—particularly the basmalah (the phrase “In the name of God, the Most Merciful, the Most Compassionate”)—hand positioning, the practice of qunut (a supplicatory prayer), and attitudes toward additional movements during prayer. Theoretically, this study extends comparative madhhab jurisprudence by situating lived ritual differences within a multiculturalism framework, thereby conceptualizing jurisprudential diversity not merely as a practical accommodation, but as a normative foundation for religious inclusivity in contemporary Muslim academic settings.

Abstract

Religious pluralism in multi-religious communities requires effective social mechanisms to maintain harmony. This study examines how local wisdom functions as an operational mechanism of religious pluralism in Banjarpanepen Village, a multi-religious community in Banyumas, Central Java, through Azyumardi Azra's socio-cultural perspective. This qualitative case study was conducted over four months in 2025 using semi-structured interviews, participant observation, and documentation. Informants were selected through purposive sampling representing diverse religious backgrounds (Islam, Christianity, Buddhism, and Belief Adherents), including religious leaders, customary elders, village officials, and active community members. Data were analyzed using Miles and Huberman's technique, with validity enhanced through triangulation. Local wisdom practices) including Grebeg Suran, Purnamaan, Nyadran, and Slametan (function as operational mechanisms that strengthen interfaith harmony, regulate social interactions, and build community solidarity. Religious leaders, customary elders, and village officials play complementary roles in maintaining harmony through both formal and informal networks. Banyumasan cultural values of nrimo and respect for others provide the ethical foundation for peaceful coexistence. Findings validate Azra's framework of moderation, cultural openness, and socio-religious networks, demonstrating that Nusantara Islam pluralism is not merely normative discourse but lived through adaptive and inclusive daily social practices, positioning village pluralism as a practical expression of institutionalized cultural harmony.

Abstract

Linguistic approaches constitute fundamental methodology in Qur'anic legal verse interpretation, yet systematic analysis of their application in contemporary exegesis remains limited. This study analyzes the linguistic approach employed in Muhammad Ali al-Shabuni's Rawai' al-Bayan Tafsir Ayat Ahkam, focusing on Surah An-Nur as a case study. Employing qualitative document analysis with Yin's five-stage analytical framework, this research examined nine legal themes across Surah An-Nur, mapping linguistic dimensions against classical lughawi exegesis standards. Al-Shabuni employs a selective multi-dimensional linguistic methodology integrating four primary dimensions: lexical analysis (al-tahlil al-lafzi), syntactic analysis (wujuh al-i'rab), morpho-phonological analysis (wujuh al-qira'at), and rhetorical-semantic analysis (latha'if al-tafsir). Distribution analysis reveals lexical and rhetorical approaches appear consistently across all themes, while morphological and syntactic analyses emerge selectively where grammatically consequential for legal interpretation. This functional selectivity demonstrates pedagogical innovation rather than methodological limitation, strategically deploying linguistic analysis to illuminate legally relevant textual features. Al-Shabuni's approach exemplifies sophisticated linguistic methodology, balancing scholarly rigor with pedagogical accessibility, and offers a replicable model for contemporary Islamic legal education that maintains fidelity to classical tradition while adapting to modern educational contexts

Abstract

This study examines how a semi-pesantren (Islamic Boarding School) educational model shapes Qur’anic literacy among inmates at Lembaga Pemasyarakatan Bitung, Indonesia. While studies on prison religious education are growing, limited research explains how Qur’anic literacy is developed pedagogically in correctional settings and how it relates to rehabilitation in practice. Using qualitative field research with a descriptive-analytical approach, data were collected through in-depth interviews, participant observation, and documentation, and then analyzed thematically. In this study, Qur’anic literacy refers to foundational competencies in recognizing hija’iyyah letters, reading Qur’anic text, and participating in guided religious learning. The findings show that the semi-pesantren model combines tafriq and taushil methods for letter recognition and reading development with structured learning in taḥfīẓ, fiqh, ‘aqidah, Islamic history, and basic Arabic. This integrated model supports the gradual development of Qur’anic reading and writing skills while also encouraging religious discipline, moral reflection, and constructive behavioral change within the prison environment. The article’s theoretical contribution lies in proposing a context-based framework that links Qur’anic literacy formation to faith-based rehabilitation through an adaptive semi-pesantren model in correctional institutions.

Abstract

Indonesian notarial law does not explicitly define the evidentiary hierarchy of authentic deed copies issued by Notary Protocol Holders following a transfer of custodial responsibility, creating legal uncertainty that threatens community civil rights. This study reassesses the evidentiary standing of such copies and delineates the normative boundaries of the Notary Protocol Holder's authority within the Indonesian civil evidence framework. A normative legal methodology is employed, integrating statutory, conceptual, and comparative approaches, drawing on primary legal materials including the UUJN and Civil Code, and comparative reference to Dutch and German notarial law. The protocol holder's authority, grounded in Articles 62 and 64 of the UUJN, is strictly custodial and confined to verbatim reproduction of the archived minute. Where formal requirements are satisfied, protocol-issued copies are capable of maintaining evidentiary equivalence across the three dimensions of external, formal, and material evidentiary power; however, this equivalence is not legislatively presumed, rendering continuity contingent on demonstrable procedural correctness. The normative gap disproportionately affects vulnerable groups, including women in inheritance disputes, indigenous communities, and low-income parties. Legislative amendment of the UUJN to affirm evidentiary equivalence explicitly, enhanced protocol administration standards, and progressive digitalization of notarial archives are necessary conditions for a more inclusive and legally certain civil evidence system in Indonesia.

Abstract

Studies on Islamic philanthropy have predominantly focused on zakat as an instrument of economic empowerment, while its application as a social protection mechanism in the domain of disability healthcare remains largely underexplored. This study addresses that gap by examining how zakat is institutionally operationalized and socio-religiously understood as social protection for children with cerebral palsy in a context of limited healthcare access. A qualitative intrinsic case study was conducted examining the Jombang Sehat program administered by BAZNAS Jombang Regency, East Java, Indonesia. Data were collected through semi-structured in-depth interviews with program coordinators, physiotherapists, and caregivers of eight enrolled children, complemented by non-participant observation and program documentation review. Data were analyzed using reflexive thematic analysis. Four themes were identified: (1) the institutional operationalization of home-visit physiotherapy and nutrition as a sustained protective intervention; (2) measurable improvements in motor function and nutritional status among beneficiary children; (3) the socio-religious framing of the program within maqasid al-shariah, particularly hifzh al-nafs and hifzh al-nasl; and (4) the formation of social capital and community care networks among beneficiary families. The findings demonstrate that zakat, when deployed with institutional intentionality, can perform preventive, promotive, and transformative social protection functions simultaneously. The study repositions zakat from charity to community-based social protection and establishes BAZNAS as a non-state structural protection actor for disability populations underserved by formal health systems.

Abstract

The empowerment of rural Muslim women represents a strategic issue in sustainable development in Eastern Indonesia, yet studies that simultaneously integrate digital infrastructure transformation with the role of Islamic philanthropy remain extremely limited. This study aims to analyse changes in the socio-economic roles of Muslim women in Kahayya Village, Kindang District, Bulukumba Regency, South Sulawesi, Indonesia, in the context of the introduction of basic infrastructure comprising roads, electricity, and internet access, as well as the presence of BAZNAS's Zakat Community Development (ZCD) programme as a community-based Islamic philanthropic instrument. This study employs a qualitative case study design. Data were collected through in-depth interviews with 15 informants, participatory observation across six field visits, and document review of BAZNAS ZCD programme reports. Analysis was conducted thematically using the Gender and Development (GAD) framework brought into dialogue with the maqasid al-shariah perspective. The findings reveal that infrastructure transformation significantly drives a shift in women's roles from the domestic sphere toward productive economic participation, improved access to education, and broader social engagement. The BAZNAS ZCD programme demonstrably strengthens this empowerment process through Islamic value-based entrepreneurship mentoring, which not only increases mustahiq income but also reinforces women's position in decision-making at the family and community levels. This study concludes that the synergy between digital infrastructure development and Islamic philanthropy constitutes a contextually grounded and sustainable empowerment model for rural Muslim women in Eastern Indonesia, provided it is supported by strengthened digital literacy and adequate cross-sectoral coordination.

Abstract

This study examines the legal protection of Indonesian migrant workers as a vulnerable group against online scam–based human trafficking through a normative and regulatory analysis that integrates human rights and socio-religious perspectives. The research is motivated by the rapid transformation of trafficking practices into digitally mediated forced criminality, which exposes migrant workers to recruitment through fraudulent online platforms and exploitation in transnational cyber-scam operations. Using a normative juridical method combined with an interdisciplinary socio-legal approach, this study analyzes national legislation, international instruments, and ASEAN regional mechanisms to identify regulatory gaps, assess state responsibility, and evaluate victim protection frameworks. The findings reveal three major issues: fragmentation between migration, anti-trafficking, and cybercrime laws; limitations in international and regional cooperation, particularly in victim identification and the application of the non-punishment principle; and the absence of culturally and religiously responsive protection mechanisms. The study further demonstrates that Muslim Indonesian migrant workers experience intersectional vulnerability as migrants, low-wage laborers, and religious minorities, while Islamic community networks function as informal yet effective protection and rehabilitation systems. This research proposes a rights-based and socio-religious model of legal protection that integrates digital governance, normative harmonization, and the institutional recognition of faith-based organizations within national and regional referral mechanisms. The study contributes to the discourse on the protection of vulnerable groups, regulatory transformation, and transnational cyber exploitation by offering a holistic legal framework that responds to the evolving nature of technology-facilitated trafficking.

Abstract

Indonesia's notary law framework remains normatively fragmented, as the Notary Law (UUJN) requires physical presence while the Electronic Information and Transactions Law (ITE Law) recognizes electronic signatures as legally binding instruments. This contradiction prevents notaries from issuing authentic electronic deeds, creates legal uncertainty, and structurally excludes vulnerable populations including remote communities, migrant workers, and micro-enterprise operators from accessing civil legal services. This study examines the normative legitimacy of electronic signatures within the Indonesian notary system, identifies the structural consequences of regulatory fragmentation on vulnerable populations, and proposes a justice-oriented harmonization framework for inclusive digital notarial services. Employing normative juridical methodology with statutory, conceptual, and comparative approaches, this study analyzes Indonesian legislation alongside regulatory experiences from the Netherlands, Brazil, Rwanda, Singapore, and Turkiye. The findings reveal three critical issues: normative contradiction between the UUJN and the ITE Law regarding remote appearance and authentication standards; the absence of explicit statutory recognition of cyber notary mechanisms; and disproportionate structural barriers to civil legal access for vulnerable populations produced by regulatory ambiguity. Harmonization requires legislative amendment, institutional infrastructure development, and justice-oriented governance design that ensures digital notarization expands rather than reproduces existing structural inequalities in access to legal services.

Abstract

Religious and ethnic diversity in multicultural urban contexts often produces complex social dynamics, particularly in the formation of social stratification. This study examines these dynamics in Gang Luna Tolerance Village in Bandung City by explicitly applying Pierre Bourdieu’s theoretical framework—habitus, forms of capital, and social fields to analyse how religion and ethnicity structure everyday interactions and status hierarchies. Using a descriptive qualitative approach, data were collected through in-depth interviews with community leaders, residents from diverse religious and ethnic backgrounds, and local policymakers, as well as participant observation and document analysis. The findings reveal that religious habitus and the distribution of social and cultural capital play a significant role in shaping stratification patterns, while the arena of intergroup interaction in Tolerance Village encourages the negotiation of status positions. Although hierarchical differences exist, practices of religious tolerance embedded in community habitus strengthen harmonious relations and facilitate social mobility by expanding access to social capital. This study contributes to the sociology of religion by demonstrating how Bourdieu’s concepts explain the interplay between diversity and stratification in urban multicultural settings and offers insights for social policy development aimed at fostering inclusive, tolerant, and socially mobile communities in Indonesia.
