Abstract

Consideration Of Judge In Religious Court Of Curup On Permitting The Polygamy Of Husband Who Do Not Eligible For Polygamy In According To Indonesia’s Positive Law. Religious Court in its task of giving a decision on the application for polygamy, guided by the rules, namely Law No. 1 of 1974, Government Regulation No. 9 of 1975 and the Compilation of Islamic Law. Examples of cases that occurred in 2013 in case No. 142 / Pdt.G / 2013 / PA CRP.and Case Number: 542 / Pdt.G / 2013 / PA CRP. This paper is discussing a review of Islamic law against the decision of the permission for polygamy who do not eligible, consideration of the judge in deciding the permission of polygamy and the power of law permits polygamy who are not eligible. This type of research is normative empirical, and data analysis with qualitative methods. Collecting data using techniques of documentation, interviews and observation. The results of this study indicate first, in Islamic law, the decision on case number 142 / Pdt.G / 2013 / PA CRP and case number 542 / Pdt.G / 2013 / PA CRP were determined by a panel of judges have compatibility with the context of ijtihad, and the results of its legal can be carried out without shutting down the previous law. The result of this decision is a form to fill a legal vacuum. Then, the Religious Court judges of Curup perform legal breakthrough (contralegem), because it does not apply Article 4 (2) of Law No. 1 of 1974 in the examination of the case. So the legal reasoning used by the judge in deciding the case number 142 / Pdt.G / 2013 / PA CRP and case number 542 / Pdt.G / 2013 / PA CRP is weak because it does not correspond to the reasons for the permissibility of polygamy in the legislation.

Abstract

The marriage dispensation is filed by the parents of the man and woman to the Religious Court which is his residence, the Religious Court after examining in court and believes that there are possible matters to grant the dispensation, the Religious Court provides the marriage dispensation with a determination. The Panel of Judges provides the stipulation under article 7 paragraph (1) of Law Number 1 Year 1974, with the consideration to avoid the occurrence of greater mudharat such as pregnancy before marriage.The child marriage under age due to pregnant factors base on Islamic law concerning with themarital status and the status of children born after six months of marriage have nasab, guardianship, inheritance and livelihoods of both parents. However, if the child is born before six months of marriage, it has no nasab, guardianship, inheritance and livelihood relationships from his father, unless there is recognition and proof of the child's biological relationship.

Abstract

Marriage in Indonesia is regulated in Law no. 1 of 1974 concerning marriage, and  Government Regulation  of the Republic  of Indonesia No. 9 of 1975 on the  Implementation of Act No.1 of 1974. then  for the  people of Islam  also apply Presidential Instruction No.1 Year 1991 on Compilation of Islamic Law as a complement of the Law No. 1 Year 1974. In the case of the position of this research object, that the applicant as a woman (wife) feels never divorced with her husband. However, her husband believes  that she has divorced  her, so the husband marries  another woman. So the wife declared the marriage illegitimate, because it violates the provisions, namely when the husband is married to the second wife, the husband did not ask permission to the first wife, in addition  to no permission of polygamy from the Religious Courts. So the first wife applied for a cancellation of marriage to the Religious Court in order  for the second marriage to be canceled. The type of research used  is qualitative research, which referred to qualitative research is a research procedure that produces descriptive data in the form of words  or verbal from the people and behavior  observed. Based on the formulation of the problem and research objectives, the  approach method used  is the  juridical  approach. Juridically this research may  include  research on legal principles,  legal system,  legal synchronization, legal history, and  comparative law. Research location  at Lebong  Religious Court. The data used in this study consist of primary data and secondary data. The data obtained from both the literature  and the interview will be analyzed by using qualitative analysis method, a research procedure that produces analytical descriptive data.  The result  of the  research found  that the  judges  of Lebong  Religious Court on Marriage Cancellation with decision number 0059 / Pdt.G / 2015 / PA Lbg was rejected by the panel  of judges so that the marriage of the Plaintiff’s husband with the Defendant was still legally valid and the Defendant still got his wife rights. In the contents of the decision filed a petition for the cancellation at the Lebong Religious Court, which was then registered in the case  Number  0059 / Pdt.G / 2015 / PA.Lbg. which consists  of three  judges did not all agree  with the decision. One judge argued  differently from the majority of judges. Opinions differ from minority judges included in the content of the verdict called dissenting opinion.

Abstract

This study  discusses  the  implementation of the  determination of Integrated  Marriage  of The  formulation of this research  are:  Firstly, how  is the society’s response to the enactment of Government Regulation  No. 19 of 2015  on Non-Tax State  Revenue in the  Ministry of Religious Affairs? Second, what  factors cause  the  community to carry out  marriage  in the Central  Marriage on KUA Kecamatan Ratu Agung?The  type of this research  is descriptive  research  with sociological juridical approach. Data collection using interview technique, observation, documentation. This study concludes  that: Firstly, the public welcomes  a positive response to the enactment of Government Regulation  No. 19 of 2015.  The regulation  is considered as the government’s new breakthrough to discipline the marriage  cost so as to minimize illegal levies. In addition, people  with limited economic ability who want to get married  is greatly helped  by the existence  of this provision.  If previously the cost of marriage is felt by them is quite high, with this provision they can perform the marriage  for free with the condition must be implemented in the Office of Religious Affairs and  at work hours.  Of course  this gets a positive response from the community, because it is very helpful especially for the middle to lower society. Secondly,  the factors that cause  the community to carry out marriage  in the marriage  hall at the Office of Religious Affairs of Ratu Agung District are economic factors and  work permits.  In general, informants  stated  that getting married  in the Office of Religious Affairs without  cost so as to ease  the financial burden. Abstract

The custom is the code  of conduct in life that includes real aspect that has  been set as custom wedding, this research is the  study  of shapes of marriage beleket (mating  honest) Rejang  Rejang  Lebong  in customs. In this study researchers using this type of research libraries  (Library Research). I.e. using techniques of data  collection undertaken by way of reading  and  reviewing  some literature  or books  as well as legislation  relating to problems in thorough, as for activities conducted in the analysis  of the data,  namely:  1. Looking for books  to find understanding and  laws regulating marriage beleket (mating  honest) custom Rejang. 2. Choose  the verses  of Qur’an and  Hadith about  marriage as well as books  of Fiqh related. 3. create a systematic verses  of Qur’an and  Hadith  and  Fiqh books.  4. The Data obtained in the analysis  of inductive  qualitative  basis.The results  of this research indicate that: 1. marriage beleket/honest is a form of marriage in the family requires the Rejang, bid pay money  to be honest or to the girl leket and in mating beleket/jujurnya big money  this honest and  much more  cakkercik (besides money). honest marriage is a form  of marriage eksogami, children  then  enter  klen or bloodlines father, because marriage is a marriage that ensured beleket bloodlines patrlineal.2. in the the purpose of Marriage beleket is equal  to marriage in accordance with the concept of marriage in Islam i.e. marriage must be Sekufu described in the Qur’an in Sura An Nur, verse 26 An Nur, verse 3 and Al Hujurat verse 13. In the procession of honest marriage/marriage beleket Rejang Rejang Lebong in customs were in accordance with the marriage in Islam and  not against  syari ‘, but with a result of beleket in the form of marriage gitie tikea (replace the mat)  should be abandoned because it is in the form of the larger tikea gitie mafsadahnya from on maslahah obtained, according to the word of God Saw in Qur’an Sura Al-Baqarah verse and Hadith the Messenger of Almighty, 234. Abstract

Researcher discusses the problems effectiveness of mediation in Class 1A Religious Court of Bengkulu.  In the first study that has  been conducted by researchers at the  Class 1A Religious Court of Bengkulu  City found  information about  the low success of the mediation conducted by a judge mediator and the sheer  number divorce  cases in Class 1A Religious Court of Bengkulu.  Based on the description above,  the formulation of the problem: How is the effectiveness of mediation in preventing divorce conducted by the Religious Court of Bengkulu City Class 1A. And the factors that become supporting and inhibiting the success of mediation in Class 1A Religious Court of Bengkulu  City . In this thesis  the author uses  the method used  in the study of this law is the juridical sociological. Results from this study is the author  concluded that the mediation is conducted in the Religious Court of Bengkulu City Class 1A by following the reference of PERMA No.01 of 2008 has not been effective although there are successful but still very low, many factors are the cause of which is the level of compliance in the community through  the process of mediation is still very low, culture  of people who argue that divorce  is not a disgrace to individuals  and families and the quality of the judges  appointed as a mediator is still uneven and  there  are  only four (6) judges  who  have  attended mediation training organized by the  Supreme Court Republic  of Indonesia.

Abstract

The formulation of this research  are: First, how the management of zakat at Badan Amil Zakat Nasional  (BAZNAS) of Bengkulu Province?  Second, what is the role of the Regional Office of the Ministry of Religious Affairs of Bengkulu Province in the management of zakat at the National  Amil Zakat Agency of Bengkulu Province?  Third, how is the synergy between  the Regional Office of the Ministry of Religious Affairs of Bengkulu  Province  and  BAZNAS of Bengkulu  Province  in the manage- ment of zakat? The research  method used is evaluative  method.The study concluded that: first of zakat management at the National Zakat Agency Bengkulu province include charity fund rais- ing, distribution and utilization of zakat. Second, the role of the Regional Office of the Ministry of Religious Bengkulu province in Zakat Management Agency National  Zakat Bengkulu province  is the founder, partner, facilitator, coordinator and motivator  for the management of zakat that is professional  and trustworthy,  strive to increase  the role of zakat to be a professional  institution, transparent trusts and guidance to the empowerment of zakat functionally includes preparation of the materials empowerment of zakat,  preparation of materials  institutional  accreditation zakat,  preparation of materials  certification  institutional  charity, management Unit Gatherer zakat and collect data with regard to the management of zakat on Unit Gatherer zakat in the Office of Religious Affairs Regency  / City. Abstract

The results of this study are 1) Proof of crime, domestic  violence in the perspective of Islamic law using 4 evidences namely  iqrar  (existence  of recognition), Bayyinah  (testimony),  Qasamah (oath),  and  Qarinah (signs or guidance), 2) proof (Article 184 of the Indonesian Criminal Code)  using 6 Legal evidence  of witness testimony,  expert  statement, letter, guidance, and description  of the defendant 3) similarity of proof of crime Domestic Violence between  Islamic law And the positive law of the two laws equally uses testimony of witnesses or testimonies,  evidence  of guidance, testimony of the accused  or acknowledg- ment,  and  oath,  4) the difference  in the way of proofing  the crime of domestic  violence  between  Islamic law and  positive law lies in the witness (testimony)  , And proof of crime in Islamic law does  not use proof of letter, expert  witness or expert  witness testimony,  4) criminal acts Domestic Violence (KDRT) in the jurisdiction Police Resort Musi Rawas caused  by economic factors, drug problems, frequent  drinking, gambling,  and infidelity

Abstract

Abstract: Analysis Of Legal Considerations On Household Violence As A Factor Causes Of Divorce (Case Study Of Religious Courts Verdict In Manna Class II No. 0018/Pdt.G/2014/PA.Mna dan No. 0466/Pdt.G/2014/PA.Mna). Based on reports of the National Commission for Women gathered from Religious Court, it shows that the Religious Court is the first door to reveal the household violence. This study will address whether the acts of household violence may be a reason to file for divorce? And what is to be considered by Manna Religious Court in deciding a divorce case by reason of household violence? This research is a qualitative juridical normative approach to legislation and case study approach. The result shows thathousehold violence can be used as an excuse to initiate divorce (Law No. 23 Year 2004 concerning the Elimination of Household Violence Article 5, 44, 45). It can be linked to the Marriage Act jo Government Regulation No. 9 of 1975, and the Compilation of Islamic Law (Presidential Decree No. 1 of 1991 Section 19 (b) and (d) of Government Regulation No. 9 of 1975 and Section 116 (b). Manna Religious Court in deciding a divorce case by reason of household violence, namely the decision number: 0018 / Pdt.G / 2014 / PA.Mna, the contested divorce, the legal basis for its consideration, namely, Article 39 paragraph (2) of law No. 1 Year 1974 Jo. Section 116 (g) Compilation of Islamic law. Accordingly, the plaintiff had been grounded and is not against the law. However, the decision in its consideration of the judges did not mention about the mediation process.

Abstract

Pemenuhan hak anak pasca perceraian ini pihak ayah sebagaian besar tidak melaksanakan kewajibannya untuk menafkahi anaknya dan tidak adanya sanksi hukum bagi ayah yang tidak melaksankan kewajiban tersebut. Hal inilah yang melatar belakangi permasalahan yang diangkat, yaitu bagaimana sanksi hukum bagi ayah yang tidak melaksanakan kewajiban nafkah terhadap anak pasca perceraian dan bagaimana ketentuan kewajiban nafkah ayah terhadap anak pasca perceraian dalam perspektif hukum Islam dan hukum positif di Indonesia. Jenis penelitian ini adalah library research, dengan bahan hukum primer dan bahan hukum sekunder, selanjutnya dianalisa sesuai yang diharapkan berdasarkan analisis deskriptif normatif. Dari hasil penelitian menunjukan bahwa sanksi hukum bagi ayah yang tidak melaksanakan kewajiban nafkah terhadap anak pasca perceraian perspektif hukum Islam terdapat disparitas, yaitu pendapat ulama' Hanafi menyatakan nafkah anak yang telah lampau menjadi hutang ayah meskipun ia, dalam keadaan miskin, sehingga pada saat ia sudah mampu, ayah wajib menggantinya. Jika ayah dalam keadaan mampu, tetapi menolak memberikan nafkah kepada anak, maka hakim wajib memaksa ayah untuk mau membayar. Menurut mazhab Syafi'i, Hambali dan Maliki berpendapat nafkah anak yang sudah lampau menjadi gugur kecuali jika ada putusan dari hakim. Sedangkan menurut hukum positif di Indonesia bahwa sanksi hukum bagi seorang ayah yang melalaikan kewajiban nafkah kepada anak dapat dikenakan sanksi perdata maupun pidana. Ketentuan hukum Islam mengenai kewajiban ayah terhadap anak pasca perceraian yaitu lebih dibebankan kepada ayah dan seorang ibu tidak wajib memberikan nafkah kepada anaknya. Sedangkan menurut ketentuan hukum positif di Indonesia mengenai kewajiban ayah terhadap anak pasca perceraian lebih diprioritaskan bagi seorang ayah, namun apabila ayah pada kenyataannya tidak mampu, maka ibu ikut memikul biaya tersebut.
