Abstract

Penelitian ini membahas permasalahan hukum terkait praktik klinik kecantikan ilegal dengan studi kasus Ria Beauty Clinic. Meningkatnya pertumbuhan industri kecantikan di Indonesia tidak diiringi dengan kepatuhan terhadap regulasi hukum, khususnya dalam bidang kesehatan dan perlindungan konsumen. Praktik medis tanpa izin, penggunaan tenaga medis tidak profesional, dan ketiadaan informed consent menjadi sorotan utama dalam kasus ini. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan terkait, seperti Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Hasil penelitian menunjukkan bahwa praktik Ria Beauty Clinic melanggar berbagai ketentuan hukum kesehatan dan dapat digugat berdasarkan perbuatan melawan hukum (onrechtmatige daad). Penelitian ini merekomendasikan peningkatan pengawasan dan edukasi hukum bagi pelaku usaha di sektor kecantikan untuk melindungi hak-hak konsumen dan mencegah praktik yang merugikan masyarakat.

Abstract

Public service is a form of realization in conducting government administration. In this case, the public complaint service carried out by the Secretariat General of the DPR RI as a support for the DPR RI institution has tried to carry out its duties as much as possible. However, it cannot be denied that the condition of the complaint service certainly has obstacles or challenges in implementing and achieving effectiveness according to the principles of good governance. Therefore, the purpose of this research is to find out the extent to which the conditions of public complaints services have been carried out, see the effectiveness in accordance with the principles of good governance, and evaluate any challenges that become obstacles in realizing the principles of good governance. This research uses an empirical juridical method with a socio legal research approach conducted at the Public Complaints Section at the Secretariat General of the DPR RI, and obtains primary and secondary data to be analyzed with a qualitative descriptive method. The results and discussion show that the current governance condition of the implementation of public complaints services has been running well according to the legal basis that regulates it, its effectiveness with the principles of good governance has also been realized even though through several challenges, but these challenges become a form of evaluation for future service progress to be more optimal.

Abstract

Studi ini menyelidiki pilihan strategis antara perlindungan paten dan doktrin rahasia dagang melalui kasus ikonik Formula 7× Coca-Cola. Meskipun paten memberikan eksklusivitas selama dua puluh tahun, paten tersebut memerlukan pengungkapan penuh, sedangkan rahasia dagang dapat bertahan tanpa batas waktu asalkan kerahasiaannya terjaga. Dengan menggunakan metode yuridis normatif, penelitian ini meneliti sumber-sumber Indonesia, internasional, dan perusahaan, merekonstruksi perlindungan historis yang diadopsi oleh The Coca-Cola Company, dan mengevaluasi kompatibilitasnya dengan risiko era digital kontemporer. Temuan penelitian mengungkapkan bahwa (1) kontrol kontraktual, fisik, dan digital berlapis telah memungkinkan Formula 7× mempertahankan eksklusivitas komersial selama lebih dari satu abad; (2) hukum Indonesia telah memberikan perlindungan yang sebanding, namun penegakan dan kepatuhan dalam usaha kecil hingga menengah masih lemah; dan (3) matriks keputusan yang menyeimbangkan risiko rekayasa balik, siklus hidup produk, dan biaya pengungkapan menawarkan kepada perusahaan alat praktis untuk memilih antara paten dan rahasia dagang. Studi ini menyumbangkan kerangka kerja berskala yang dapat memandu para pembuat kebijakan dan pelaku bisnis dalam memperkuat keunggulan kompetitif sambil menyelaraskan dengan norma-norma kekayaan intelektual internasional yang terus berkembang.

Abstract

The rapid growth of the concert industry in Indonesia has not been matched by adequate consumer protection practices. Consumers often face issues such as ticket fraud, sudden cancellations without compensation, changes in event venues, and misleading promotional content. This research identifies the gap between legal consumer protection frameworks and their actual implementation in the concert sector. Using a normative juridical method with a prescriptive-analytical approach, this study analyzes how consumer rights are neglected in transactions involving concert services. The findings reveal that many organizers fail to act transparently or responsibly, leading to significant material and immaterial losses for consumers. Moreover, existing complaint mechanisms remain ineffective and lack enforcement power. The study implies an urgent need for specific regulations to govern concert organization practices, including refund procedures, clear communication, and fair dispute resolution. Strengthening institutional capacity and regulatory oversight is essential to ensure accountability and safeguard consumer interests in the entertainment industry.

Abstract

This study discusses the legal status of electronic money (e-money) Flazz in non-cash transactions in Indonesia from a banking law perspective. The research method applied is normative with a statutory approach and doctrinal analysis of related regulations, including Bank Indonesia Regulation No. 20/06/PBI/2018 concerning Electronic Money and Bank Indonesia Law No. 6 of 2009. The findings of this study show that Flazz as electronic money is legally recognized in the payment system in Indonesia, equivalent to other non-cash payment instruments such as debit cards and QRIS. Although Banking Law No. 10 of 1998 does not specifically regulate e-money, the new regulation from Bank Indonesia has provided a clear legal basis. Flazz provides benefits in daily transactions, although there are limitations in transaction value and its use abroad. Regulations also ensure security and protection for Flazz users.

Abstract

In the Indonesian constitutional system, one of the manifestations of democracy and popular sovereignty is the freedom of opinion and expression guaranteed by the 1945 Constitution, freedom of opinion and expression is a human right (Article 28). This right is regulated by international law and national law. However, the fact is that the implementation of freedom of opinion and expression in social media causes a lot and does not pay attention to human rights and the legal interests of others. In this research, the research approach used is normative juridical using secender data as the main data (primary legal materials, secender legal materials, tertiary legal materials) supported by primary data (observations and interviews), the research data is analyzed descriptively qualitative. The results showed (1) Freedom of opinion and expression in social media in Indonesia in the form of digital platforms such as social media has many misunderstandings in its implementation (2) The implementation of freedom of opinion in social media in Indonesia must be limited by the responsibility to maintain ethics, not harm others, and conflict with applicable laws in Indonesia.
