Abstract

The position of Deputy Regional Head is regulated in Law No. 23 of 2014,. However, this Law does not explicitly regulate the duties of Deputy Regional Heads because almost all of their duties are attached to the duties of regional heads by using the term "assisting" regional heads. The problem is in the practice of governance in several regions, the regional head was impressed in fact, they tend to be reluctant to be assisted by their representatives. The data analysis method used in this study is descriptive qualitative. The method of study uses the method of literature study with a descriptive approach. The term used in Article 66 of Law no. 23 of 2014 concerning Regional Government, is the word "help", so this word has the potential to be twisted for subjective interests that are short-term in nature. Especially in the implementation of local government pragmatic interests can not be avoided so that it can cause tug of interest so that in the administration of government does not run effectively. It is expected that the presence of provisions governing the task of the deputy regional head will be an instrument of problem solving, in terms of overcoming the severity of the task tasks of the regional head in the administration of regional government.

Abstract

The research aimed at identifying the students understanding to the book in copyright protection, the factors that influence the students understanding to the book in copyright and improving the students understanding to the book in copyright protection. Kind of this research is qualitative description. The research used juridical empiricism approach that analyzed aspect of law related to the statue number 19 year 2002 about copyright and regulations that related to the statue and notice the phenomenon that happened to the students in faculty of social sciences that related with their understanding to the book in copyright protection. Whereas, data process and data analyze used qualitative analyze. The results of this research are: (1) The students understanding about the book copyright protection, so it can divide into four points, are the students know and followed the copyright statue, the students know but did not followed the copyright statue, the students did not know but followed the copyright statue and the students did not know and did not followed the copyright statue. (2) The factor that influence students understanding to the book in copyright protection, namely functional factor that from needed and experienced and personal factor or factors inherent of individual that had relation when to interpret the rule. (3) The effort are made for improved the understanding to the book in copyright protection with socialization and education, and synergy with other stakeholder in book utilization associated with the optimization the information technology in learning process.

Abstract

The development of rapid development in Sidrap district has not been matched by serious awareness of environmental impacts. Especially rubbish It is usually present as a risk for a city that moves into a big city. A large population with high growth rates results in increased volume of waste. In addition, the consumption pattern of the community contributes to creating increasingly diverse types of waste, including packaging waste that is dangerous and / or difficult to decompose by natural processes and can damage the surrounding environment. Management and handling of waste is absolutely necessary, with special attention because it involves a very vital environment. Many cities in Indonesia in developing Final Disposal Sites (TPAs) do not pay attention to the standards for making landfill and pay attention to Environmental Impact Assessment (EIA). Inevitably, many cases in big cities arise due to garbage, both household and industrial waste because they are not properly processed and managed. The waste produced by the residents of Sidrap was dumped at Patommo Kep concern's Final Disposal Site (TPA), which is currently being raised by many residents living in the area around the TPA. A pungent odor occurs during the day and night or when the garbage is flattened. Environmental pollution caused by garbage lately is growing rapidly. We have realized that the problem of waste is very disturbing to the health and balance of the environment. To handle it, it needs the active role of the community and the government, especially the respective regional governments. Based on this, this study seeks to examine whether waste management in Patommo landfill meets the applicable regulations in Perda No.7 of 2016

Abstract

The problem in this paper is how the legal protection of copyright law in the field of photography in the city of Palopo and what factors are obstacles to the implementation of copyright law in the field of photography in the city of Palopo. The research method in this paper is empirical normative. The results of the research in this paper are: First, the implementation of copyright protection arises automatically based on declarative principles after a work is realized in real form without reducing restrictions in accordance with statutory provisions. Based on Law Number 28 of 2014 concerning Copyright on Portraits can be done in 2 (two) ways, namely by preventing the registration of Copyright with the Directorate General of Intellectual Property Rights, and being repressive, namely filing a lawsuit to the Commercial Court if a violation of the Rights Copyright for Portraits. Second, the factors which hinder the implementation of the Copyright Act in Palopo City are economic, educational factors, and the lack of law enforcement in following up perpetrators of violations of photographic works because some photographers do not list their aspirations, so that perpetrators of violations never feel reddened for their actions

Abstract

Tujuan penulisan ini adalah untuk menganalisa kewenangan dan akibat hukum yang timbul berdasarkan kewenangan PPAT dalam pendaftaran tanah. Negara menerbitkan pengaturan hukum yang dapat menjamin hak kepemilikan dengan memperoleh kepastian atas hak tanah, seperti memiliki surat tanda bukti. Di dalam pelaksanaan administrasi pertanahan dan pendaftaran tanah yang tercatat di Kantor Pertanahan harus selalu sesuai dengan keadaan atau status sebenarnya mengenai bidang tanah yang bersangkutan, baik yang menyangkut data fisik mengenai bidang tanah tersebut, maupun mengenai hubungan hukum yang menyangkut bidang tanah itu, atau data yuridis ini, khususnya pencatatan perubahan data yuridis yang sudah tercatat sebelumnya, peranan PPAT sangatlah penting. Tulisan ini berfokus pada pertama, bagaimana kewenangan PPAT dalam pendaftaran tanah, dan kedua, akibat hukum apa yang timbul berdasarkan kewenangan PPAT dalam pendaftaran tanah. Tulisan ini bersifat kepustakaan atau penelitian hukum normatif yang menggunakan data sekunder untuk menganalisa fokus kajian tulisan ini. Hasil pembahasan tersebut menyatakan bahwa kewenangan PPAT dalam hal pendaftaran tanah termasuk dalam kewenangan delegasi, yang mana PPAT membuat akta sebagai bukti dilakukannya perbuatan hukum tertentu mengenai hak atas tanah. Akibat hukum dari kewenangan PPAT tersebut, bisa pada ruang lingkup Tata Usaha Negara, perdata, maupun pidana.

Abstract

This study aims to determine the licensing procedure for the establishment of drinking water depots and how to monitor drinking water depots carried out by the industry and trade. In this study the authors used the normative method. The data obtained by the author is from primary legal materials, namely laws and regulations regarding drinking water depots and tertiary legal materials. The data collection technique used is literature study. The data analysis technique used is descriptive qualitative. Based on the decision of the minister of industry and trade number 651 / MPP / Kep / 10/2004 regarding the technical requirements of drinking water depots and their trade, to establish a drinking water depot there are 3 requirements that must be met, namely industrial registration certificate and trading business registration certificate, water supply guarantee letter. standards from the regional drinking water company, and a hygiene-worthy certificate. Based on the verdict, supervision of drinking water depots, namely supervision of the use of raw water, production processes, machines and equipment as well as trading is carried out periodically or the time required. And supervision of the quality of drinking water depot production is carried out by a drinking water quality inspection laboratory appointed by the government. The result of this research is that in establishing a drinking water depot, only two requirements are needed, namely aindustry and registrationtrade businesscertificate ofregistration certificate, and a certificate of proper hygiene. As well as the lack of supervision carried out by related agencies and from the owner of the drinking water depot. What should be checked periodically, but not done by the drinking water depot and from the industry and trade office.

Abstract

This study aims to determine how a juridical review of the management of a sand mining business based on Law of the Republic of Indonesia Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining and whether the form of government supervision in managing sand mining business is based on the Law Law of the Republic of Indonesia Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining, is considered effective. This study uses a normative method by examining legal documents and other papers and their application to legal events through data collection techniques by means of literature studies and data analysis techniques used are descriptive qualitative. Based on the data analysis carried out, the juridical review of the management of the sand mining business is not in accordance with the application of the existing reality in the field where production operations that have a mining business license, but the determination of the sand mining business license area is not in accordance with the location of its designation. The form of government supervision in managing the sand mining business is deemed ineffective, causing problems regarding the mining business license area and mining business license, so it is necessary to increase coordination between the form of internal control supervision and the form ofcontrol supervision external

Abstract

This writing aims to determine the form of guarantee of religious freedom according to the 1945 constitution of the Republic of Indonesia and Human Rights (HAM) and from the perspective of Isalam law. This research is a qualitative descriptive study using normative, juridical approaches. Secondary data is taken from documents related to research. The data collection technique uses literature study, observation and documentation. The data analysis is done by reducing data, displaying data, verifying data, and providing conclusions. From the results of research and analysis, it is found that, 1) based on articles 28E, 28I, and 29. Limitation on freedom can only be done through the law as stipulated in Article 28J of the 1945 Constitution, (2) protection of religious freedom is guaranteed and protected by constitutional provisions in Indonesia. , law and human rights. Religious freedom has become a joint commitment even though there are two groups of thought, namely religious groups, and nationalist groups (nationalities) giving the opinion that freedom of religion and freedom to practice worship according to their religion and (3) guarantee of religious freedom from the perspective of Islamic law in line with Islamic law Not only provides recognition and guarantees, the Qur'an also obliges Muslims to give religious rights to non-Muslims according to their teachings. It is increasingly clear that Islam has guaranteed and protected freedom of religion and belief.

Abstract

This study aims to determine the enforcement of environmental law against environmentaldamage and the inhibiting factors in environmental law enforcement. This type of research isnormative research. Data collection techniques used were literature study. The data analysistechnique used is qualitative descriptive. The findings obtained from this study include: (1)Enforcement of environmental law on environmental uses three law enforcement instruments namelyfirstly administrative law enforcement. The second is the enforcement of criminal law, thisreiteration through three attempts, namely, Pre-emptive Actions, preventive measures and repressiveactions. Third is civil law enforcement where the lawsuit is filed through the court; (2) inhibitingfactors in environmental law enforcement are the meaning of words in the law that are difficult tounderstand and have other meanings, lack of forest police personnel, lack of facilities such asvehicles to conduct surveillance, lack of community understanding of the effects of illegal logging,and understanding of the community assume that the forest is a legacy from ancestors so that cuttingdown is not a crime.

Abstract

This research is a research that aims to determine the extent of the analysis of air pollutiondue to asphalt factories based on Government Regulation No. 41/1999 concerning air pollutioncontrol, as well as knowing the role of laws and regulations on air pollution. This research isnormative research. Normative research is research conducted through library research in findingtheoretical data sources that are useful for solving problems. The legal materials used based on theresearch approach are primary legal materials. Primary legal materials are legal materials that havebinding strength. such as laws, government regulations and Ministerial regulations. As well astertiary legal materials such as legal dictionaries, internet, and large Indonesian dictionaries. Whilethe data analysis used is to collect library data using a qualitative-descriptive approach. The resultsof the study can be concluded that the first rules regarding air pollution are contained in the field ofregulations based on the constitution to the ministerial regulations, among others, the 1945Constitution (article 33), Law NO. 32 of 2009 concerning Protection and management of theenvironment, Law NO.3 of 2014 concerning Industry, Government Regulation of the Republic ofIndonesia NO.41 of 1999 concerning Air Pollution Control, Government Regulation NO.107 of 2015concerning Industrial Permits, Government Regulation No. 27 of 2012 concerning EnvironmentalPermits, Ministerial Decree NO. 45 of 1997 concerning Air Pollutant Standard Index, Regulation ofthe minister of state for the environment No 12 of 2010 concerning the implementation of air pollutioncontrol in the area of the minister of state for the environment. The two supervision carried out by thegovernment on air pollution at the asphalt factory, among others; directing or recommendingimprovements, suggesting that waste is suppressed; and optimizing work to achieve plan goals. Theresearcher recommends that the government increase its supervision of the asphalt plant again inorder to create an environmentally friendly asphalt plant.
