Abstract

Ijtihad is an essential means in the renewal of Islamic law and has been the subject of intense debate. In the modern context, ijtihad is used to address the challenges and social changes in society. From the time of Prophet Adam to Prophet Muhammad (peace be upon him), Allah sent messengers to guide humanity towards the truth. When people encounter issues not explicitly addressed in the Quran and Sunnah, Allah grants the freedom to use reason (ijtihad) to solve those problems, provided that the principles of the Quran and Sunnah, as the primary sources of law, are followed. The need for ijtihad has continuously increased with the growing number of issues faced by Muslims after the death of the Prophet, especially as the Islamic territories expanded and issues became more complex. This paper will discuss the dynamics of ijtihad in the renewal of modern Islamic law and its challenges, using a juridical-historical approach. This research is a descriptive qualitative library research, utilizing various literary sources to analyze and explain the role of ijtihad in the renewal of modern Islamic law. The results of the study indicate that ijtihad plays a crucial role in the renewal of Islamic law, allowing it to remain relevant and responsive to the changing times, despite facing various challenges.

Abstract

The Bacan Sultanate was founded in 1322. Its first Sultan was Said Muhammad Bakir, or Said Husin, who ruled on Mount Makian with the title of Maharaja Who Reigns in the Kingdom of Moloku Astana Bacan, the Land of Komala Besi Lime Dolik. Like other sultanates in North Maluku, the Bacan sultanate, which grew and developed over a long period of time, had social stratification that was structured hierarchically. There are three social strata, of which there is only one main social stratum and the other two include the subjects of the sultanate.The culture of the Bacan Sultanate is full of religious activities, customs and art. One of the works or culture of the Bacan Sultanate that still exists today is babaturung skombor. Babaturung Skombor is a tradition of delivering and installing banners and curtains on the pulpit of the Sultan's mosque. This procession starts from the kedaton and then parades to the sultanate mosque on the 29th of Sha'ban and 28th of Ramadhan.This ritual has been carried out for generations in the Bacan sultanate. This procession starts from the palace of the Bacan Sultanate. In its implementation there are several stages. It starts with the assignment of traditional apparatus which is divided into two parts, namely World Bobato and Hereafter Bobato, each of which has a role in the procession

Abstract

Elections are a real manifestation of people's sovereignty within the framework of the Unitary State of the Republic of Indonesia. carried out by holding direct, public, free, secret, honest and fair voting based on the principles of Pancasila. Based on the Republic of Indonesia General Election Supervisory Agency (Perbawaslu) Regulation Number 4 of 2023 concerning Supervision of Data Updates and Preparation of Voter Lists in Elections, digital transformation is an addition to access to Bawaslu services in the performance of receiving reports, supervising the process in Elections, as well as a means of updating socialization and performance Bawaslu supervision. The problem formulation in this research is; 1) What is the form of Digital Supervision Transformation in Updating Voter Data, and 2) How does Siyāsah Tanfīdziyyah's perspective view the practice of digital surveillance transformation in updating voter data.The research method used is qualitative with the type of field research (field research) and this research is descriptive analysis. The data collection method in this research is based on library research and uses secondary data. The aim of this research is to determine the transformation of digital supervision in updating voter data carried out by Bawaslu of Lampung Province. Second, to find out Siyāsah Tanfīdziyyah's perspective on transforming digital election supervision by updating voter data and compiling voter lists carried out by Bawaslu. This research concludes that Bawaslu carries out supervision through digital media, including in the context of providing education to the public. Bawaslu's involvement in supervision attached to the KPU must be in accordance with Law Number 7 of 2017 concerning Elections in preparing programs and the priority scale for developing an open and participatory supervision system. The implementation of digital supervision transformation in updating data selection has not been fully maximized because several factors are needed. Siyāsah Tanfīdziyyah's review of the transformation of digital supervision of the general election stages related to updating voter data is a form of supervision to uphold the benefit of the people in accordance with the objectives of Maqāsid Syarī'ah.

Abstract

This article examines the use of social media in supporting the learning process at SMP Negeri 12 Tidore Islands. This research method is qualitative, data collection techniques are interviews, observation and documentation. The results of this research found that the use of social media really supports learning at SMP Negeri 12 Tidore Islands, students are very enthusiastic in collaborating on teaching materials with online media, students are more enthusiastic about following online tutorials, students find it easier to learn, teachers are providing education to students to use social media wisely, with social media, teachers and students can interact in learning activities anywhere and at any time, so they are not limited to space and time.

Abstract

The Laka Baka dance is seen as part of dance activities like those in other areas, while the spirit of values that exist implicitly is no longer the focus. The younger generation only views dance as an ordinary performance. There is even concern that if the values contained in it are not looked into in depth, it is certain that Laka Baka will lose its identity in the future. The Laka Baka dance is a cultural identity of the people of the Sula Islands whose existence has been around for a long time and has grown over hundreds of years. The Laka Baka dance teaches people about the value of patriotism and the spirit of community life with high motivation. The Laka Baka dance is a form of honorary dance which is always used in cultural events in the Sula Island community, because this dance is always used as a welcoming dance for guests of honor.

Abstract

This research investigates the impact of economic trade cooperation among ASEAN countries with the introduction of the official ASEAN currency. This regional currency is considered crucial in facilitating economic integration in ASEAN, even though it faces significant challenges, especially in terms of varying economic stability among member countries. By combining political and economic analysis, this study aims to provide a better understanding of the implications of the implementation of the ASEAN single currency on trade dynamics and overall regional stability.

Abstract

The mining issue in North Moluccas has given rise to legal issues which have a negative impact on the economic and investment climate. Mining problems include forest destruction, environmental pollution, land grabbing, illegal mining, permits that are not in accordance with their intended use, and land clearing issues with miners, which then give rise to conflicts of interest with the state and local communities. These issues have been demands of society for a long time, but have not been fulfilled and resolved by the company or the government. So that conflict increases from people's attitudes of protesting to resistance. There are several factors that influence this, namely; first, the factor of centralism in mining resource policy making in the government, where the community and local government are only the recipients and implementers of the policy. Second, mining company programs towards community empowerment, namely the company's lack of concern for the social environment, especially regarding compensation related to the welfare of local communities. The results of the research show that there are issues that cause the community to protest against the mining concession policy, namely: first, the neglect of the rights of local communities in the form of compensation during mining exploitation, second, the discriminatory treatment of mining companies in the labor recruitment process. local; and third, there is post-mining environmental destruction in protected forest areas in mining areas.

Abstract

Many traders sell dream catchers at Pasar Atas Kotabumi, North Lampung. The existence of buying and selling dream catchers has implications for sharia issues. The purpose of this research is (1) To examine the practice of buying and selling dream catchers in Pasar Atas Kotabumi, North Lampung. (2) To analyze the Islamic law review of the dream catcher sale and purchase agreement at Pasar Atas Kotabumi, North Lampung. The results of the research conclude that (1) The practice of buying and selling dream catchers at Pasar Atas Kotabumi, North Lampung, includes a greeting contract because the buyer makes payment first and then the goods can be owned. According to the results of research conducted by the author at Pasar Atas Kotabumi, North Lampung, the prices of dream catchers vary. Starting from the cheapest price, namely Rp. 40,000.00 up to Rp. 200,000.00. (2) The practice of buying and selling dream catchers in Pasar Atas Kotabumi, North Lampung, from the 7 (seven) sample people I interviewed, for those who believed that dream catchers were to ward off dreams, the law was haram. But for buyers who don't know the history of dream catchers and use these dream catchers only for decoration, the law is permissible.

Abstract

The purpose of this study is to analyze (1) how to instill democratic values in Civics learning at SMP Negeri 7 Kota Ternate. (2) What factors hinder the instillation of democratic values in Civics learning at SMP Negeri 7 Kota Ternate. The approach used in this study is qualitative. Data sources of School Principals, Curriculum affairs, Student affairs, Public Relations affairs, Civics teachers and students The results in this study show (1) The instillation of democratic values in Civics learning at SMP Negeri 7 Ternate City is the democratic value of tolerance, the democratic value of respecting differences, the value of open democracy in communicating, the value of confident democracy, the democratic value of responsibility, the democratic value of cooperation, the democratic value of togetherness and the democratic value of obedience. (2) What factors hinder the instillation of democratic values in Civics learning at SMP Negeri 7 Kota Ternate are factors from within the students themselves lack of motivation to learn Civics subjects, environmental influence factors also affect students' attitudes to learn Civics subjects, factors of lack of attention from parents of students studying at school and at home.

Abstract

Early marriage is a social phenomenon that often occurs in many countries, including Indonesia. The phenomenon of early marriage is like an iceberg, but in reality, if we trace the history of early marriage, there are certainly many causes. In fact, there are extramarital marriages carried out by the younger generation and this often occurs due to economic problems, level of education, cultural practices and loss of religious values. There is a negative stigma against women who marry at an early age. Marriage is a strong bond to become a sakinah, mawaddah and rahmah family, which is structured according to legal principles, both Islamic law and state law. Marriage law regulates the limits on those who may marry, material requirements, and age limit provisions contained in Law Number 1 of 1974 concerning Marriage as amended by Law Number 16 of 2019. This article will discuss official marriage in Islamic law.
