Abstract

Bali Customary Law is a law or regulation written with unwritten conditions that contain commands and prohibitions for the behavior of indigenous peoples in matters governed by human relations with God, human relations with the environment, and human relations with humans, which in Bali is known as dialogue Tri Hita Karana. The imposition of traditional sanctions is a way to restore balance or neutralize the shock caused by traditional violations that have taken place in the Pakraman village environment. Such as the imposition of the Penyamil Customary Sanction which was handed down because the community committed acts that violated the existing provisions in Desa Pakraman Tanggahan Peken. Based on this, the issues discussed in this study include: What legal actions can be imposed by the Penyamil Customary Sanction in Pakraman Tanggahan Peken Village, Sulahan Village, Susut District, Bangli Regency? The problems that arise are examined using the theory of validity and effectiveness of the law in dissecting the formulation of problems regarding legal actions that can be subject to Penyamil Customary Sanctions in the Village of Pakraman Tanggahan Peken, Sulahan Village, Susut District, Bangli Regency. Data collection in this study used interview techniques, literature study techniques, questionnaire distribution and observation. In this study, the type of research used is a type of empirical legal research. Penyamil Customary Penalty Occurrence in Desa Pakraman Tanggahan Peken due to harsh/dirty words and misbehavior in a holy place or in a village meeting, and because of this error aperson who is violated is subject to Penyamil Customary Sanction which can be in the form of financial penalties or Maprayascita fines , depending on the mistakes made. The factors that influence the occurrence of violations of the Penyamil Customary Sanction due to community ignorance, emotional, and developments in the current era of globalization.

Abstract

The implementation of the regional head general election in the context of the election of the Regent and Deputy Regent in Badung Regency in 2020 then recorded the first history in the implementation of the regional head general election simultaneously in Bali Province, namely the determination of one candidate pair as the only participant participating in the regional head general election held in Badung Regency in 2020. This is certainly interesting to analyze so that in this paper it will be analyzed and described the relationship between elections with integrity and the determination of a single candidate in the general election for the regional head of Badung Regency in the simultaneous regional head elections in 2020. This writing uses normative legal research methods. Where in this paper, we use statutory studies and literature to analyze the determination of a single candidate in the regional head elections in Badung Regency in the context of the election of the Regent and Deputy Regent in 2020. The results of the analysis carried out were the determination of one candidate pair in the general election of the Regent and Deputy Regent in Badung Regency by the KPU of Badung Regency has been following the basic legal provisions of the implementation of regional head elections and the determination of one candidate pair in the regional head general election for the election of regents and deputy regents in Badung Regency in 2020 and has fulfilled the principles of elections with integrity, namely the general election of the head regions must continue to be implemented even though there is only one pair of participants participating in the regional head election competition so that the political rights of citizens to be able to elect their leaders based on the principles of democracy are fulfilled the elected leader is expected to be able to carry out the task us and its obligation to prosper and protect its people.Keywords: Election for regional heads, Election with Integrity, One Candidate Pair, Democracy

Abstract

Various electronic devices equipped with internet networks have opened up opportunities for emerging crimes in cyberspace. Online gambling is a form of traditional crime transformation that turns into a crime operating in cyberspace. In the formulation of legal policies in various countries, not all countries declare online gambling as a criminal act. There are countries that legalize online gambling, there are countries that are in the gray area, and some are banningonline gambling. In this study there are two issues discussed, namely the application of jurisdiction in the criminal acts of online gambling and criminal law policies against online gambling. The application of jurisdiction in criminal acts of online gambling must pay attention to the rules of international law, where a country cannot enforce its rule of law in another country. Provisions regarding online gambling jurisdiction are regulated in Article 2 of Act Number 11 of 2008concerning Electronic Information and Transactions. International cooperation in law enforcement on online gambling can be carried out as long as there are international agreements between countries and both countries alike establish online gambling as a crime. Criminal law policy on online gambling in Indonesia formulates online gambling as a criminal act as stipulated in Article 27 paragraph (2) of Act Number 11 of 2008 concerning Information and Electronic Transactions.

Abstract

The purpose of the research to find out if Purge is one way to reach democracy today? Research uses normative research with an orientation that is not sourced on conceptual attitudes that must be taken but also a combination of legislation that is a fundamental belief. The result is that when the state does not act decisively against any form of crime or violation of the law therein there are two possibilities, namely rebellion from the community and the release to the community to resolve properly. Purge's settlement is not contrary to democracy because Purge seeks to be a democracy more in the justice of society.Keywords: Democracy; law; Purge

Abstract

Pembangunan sumber daya manusia mempunyai peranan yang sangat penting bagi kesuksesan dan kesinambungan Pembangunan Nasional. Oleh karena itu pembangunan dan peningkatan kualitas sumber daya manusia mutlak harus diperhatikan dan dirancang dengan seksama berdasarkan pemikiran yang matang. Program wajib belajar 12 tahun merupakan kebijakan yang diambil Pemerintah untuk peningkatan kualitas Sumber Daya Manusia Indonesia. Perlu kiranya  dipikirkan hal­hal yang dapat menunjang serta masalah ­ masalah apa saja yang akan timbul, mulai dari perencanaan serta payung hukum yang jelas, sosialisasi pada masyarakat, sampai dengan pelaksanaan di lapangan, hal tersebut harus terencana  dengan  sebaik­baiknya.  Penulisan ini  mengkaji  sejauh  mana  regulasi  serta pengimplementasian pengaturan terhadap  hak konstitusional anak dalam pemenuhan wajib belajar 12 tahun di Provinsi Bali pasca diterbitkannya Peraturan Gubernur Bali No. 40 Tahun 2017. Metode yang digunakan dalam penulisan ini adalah sosiolegal menggunakan data sekunder yang berupa bahan hukum primer, sekunder, dengan menggunakan teknik analisis yaitu teknik deskriptif, evaluasi dan argumentasi serta kemudian mengelaborasi terhadap fakta­fakta yang terjadi.  Peraturan secara Nasional  yang terkait dengan pengaturan dibidang pendidikan diantaranya: Undang­Undang Nomor 20 Tahun 2003 Tentang Sistem Pendidikan Nasional, Tap MPR No.9 tahun 2007 Tentang Anggaran Dana Pendidikan, Undang­Undang Nomor 32 Tahun 2004 Tentang Otonomi Daerah, Peraturan Pemerintah Nomor 32 Tahun 2007 tentang Pembagian Kewenangan Antara Pemerintah Pusat dan Daerah Otonom, Peraturan Pemerintah Nomor 19 Tahun 2005 tentang Standar Nasional Nasional Pendidikan, Peraturan Daerah Nomor 1 Tahun 2004 Tentang Rencana Strategic Pembangunan Provinsi, Peraturan Daerah Nomor 1 Tahun 2007 Tentang Anggaran Pendapatan Belanja Daerah Provinsi serta Permendiknas No 17 Tahun 2017 tentang Prosedur dan Tata Cara Penerimaan Peserta Didik Baru Tahun Ajaran 2017/2018. Pengimplementasian pengaturan terhadap  hak konstitusional anak dalam pemenuhan wajib belajar 12 tahun di Provinsi Bali pasca diterbitkannya Peraturan Gubernur No. 40 Tahun 2017 sudah terpenuhi. Dimana diterbitkanya Peraturan Gubernur tersebut untuk mengatasi kendala dari pengimplementasian Permendikbud Nomor 17 Tahun 2017. Dengan adanya Pergub tersebut calon siswa yang tercecer dari ketentuan zonasi dalam Permendiknas bisa tercover lagi dengan membuka pendaftaran gelombang kedua. Serta Pergub tersebut telah mengakomodir terpenuhinya hak Konstitusional anak dalam pemenuhan wajib belajar 12 tahun di provinsi Bali dimana diberikan peluang bagi anakanak yang berasal dari keluarga kurang mampu diterima di sekolah­sekolah negeri menurut ketentuan yang berlaku serta bagi siswa yang berprestasipun diberikan peluang untuk diterima disekolah­sekolah negeri

Abstract

Cyber Notary is a concept by using the development of existing technological sophistication, by using the power of notary technology can carry out its duties and authority. With a teleconference if violations occur at the General Meeting ofShareholders (GMS), such as violations, legalization of electronic deeds, digitizing documents, and other similar matters. That way the existence of Cyber Notary requires that notaries not only be clever in the field of notary but also can master the technology in the application of Cyber Notary. Facilitating the occurrence of long distance transactions between the parties is the concept of Cyber Notary was born. Thus, the background as above is discussed regarding, Using Teleconference for General Meeting of Shareholders. What legal protection measures will be used for the parties who are holding a general meeting of shareholders with the teleconference media.This study uses normative law and several approaches, namely the legislative approach and the case approach. This study uses the analysis of legal materials using the techniques of description, evaluation and argumentation. This study found results, namely: 1. The implementation of the General Meeting of Shareholders with Cyber Notary in Law No. 40 of 2007 which describes the Limited Liability Company in carrying out a GMS by teleconfession.In the implementation of the GMS conducted by Cyber Notary in Law No. 40 of 2007 concerning Limited Liability Companies does not explicitly explain the substance of the GMS that can be carried out by teleconference. The making of aGMS deed carried out by teleconference by a Notary Public is valid as long as it meets the requirements of the GMS implementation. 2. The GMS consists of various parties including the Company Organs and Notaries. Legal protection for notaries is regulated in the provisions of article 66 of Law No. 2 of 2014 concerning the position of notary public (UUJN). Meanwhile, legal protection for the company's organs in connection with the making of the GMS Deed carried out by teleconference if a dispute arises in the future includes two matters, namely through a civil suit and Reporting or giving a complaint to the notary area supervisory assembly.

Abstract

Balinese perception of marriage in gelahang including positive, because it is seen as a reality that already exist in society, and never questioned. The inheritance system in the family that carries out the marriage in gelahang in Bali basically adheres to the parental principle, namely the inheritance system that inherits the family of the male and female families. The pattern of parenting in the family formed through marriage in gelahang generally chooses the pattern of democratic care that is characterized by the rights and obligations of parents and children is the same, in the sense that they are complementary. The process of execution of marriage in gelahang is not different from ordinary marriage process, and generally executed by the process of marriage, which was preceded by dating period. In the marriage at gelahang there are two relatively similar ceremonies, namely at the residence of the bridegroom and at the residence of the bride’s. The equation of marriage in gelahang with marriage nyentana namely: equally an alternative marriage, based on love the same love, there are religious witnesses (banten ceremony) and social witness (community) and both want to get offspring. While the difference is that marriage in gelahang status of men and women there is no change in status, so often called parental. The positions of born children are held jointly, unless there is another agreement. An important aspect of marriage in gembles that is rarely encountered is an agreement between husband and wife witnessed by the families of both parties, the agreement can be written and can be verbal.

Abstract

Disabilitas merupakan suatu ketidakmampuan tubuh dalam melakukan suatu aktifitas atau kegiatan tertentu sebagaimana orang normal pada umumnya yang disebabkan oleh kondisi ketidakmampuan dalam hal fisiologis, psikologis dan kelainan struktur atau fungsi anatomi. Ketika penyandang disabilitas berhadapan dengan hambatan maka hal itu akan menyulitkan mereka dalam berpartisipasi penuh dan efektif dalam kehidupan bermasyarakat berdasarkan kesamaan hak.Pengembangan bahasa isyarat bagi yang berkebutuhan khusus yaitu penyandang disabilitas sangat dibutuhkan dalam pengembangan dan pembinaan bahasa di Indonesia. Kekurangan ini tentunya memberikan hambatan serta menyulitkan penyandang disabilitas salah satunya dalam menikmati beritamaupun hiburan pada siaran televisi. Undang-UndangNomor 32 Tahun 2002 tentang Penyiaran menjamin bahwa hak memperoleh informasi adalah hak mutlak bagi setiap warga negara tanpa memandang kelompok. Jaminan ini harusnya juga diberikan kepada mereka yang memiliki kemampuan yang berbeda atau kaum disabilitas seperti tuna rungu. Pasal 39 ayat(3) UU Penyiaran No.32 Tahun 2002 menyatakan jaminan akan hak informasi dengan ketersediaan penerjamahan. Akan tetapi pasal dalam UU tersebut tidak tegas mewajibkanserta tidak adanya pengaturan sanksi bilamana tidak menerapkannya dengan baik terhadap kepastian pemenuhan secara maksimal bagi kaum disabilitas dalam menikmati siaran televisi. Berdasarkanpemaparantersebut di atas, makadapatdirumuskanpermasalahansebagaiberikut, 1. Pengaturan bagi kaum disabilitas dalam memperoleh informasi; 2. Urgensi perlindungan serta Affirmative Action terkait kepastian dalam pemenuhan hak menikmati acara televisi bagi kaum disabilitas. UU telah memberikan jaminan kepada penyandang disabilitas untuk mendapatkan informasi dan berkomunikasi melalui media yang mudah diakses; dan menggunakan dan memperoleh fasilitas informasi dan komunikasi berupa bahasa isyarat, braille, dan komunikasi augmentatif dalam interaksi resmi, serta mewajibkan Pemerintah serta Pemerintah Daerah utk menjaminnya.UU Penyiaran didalamnya belum secara tegas mengatur mengenai kewajiban stasiun televisi untuk menyediakan aksesuntuk kaum disabilitas tuna rungu untuk menikmati semua acara di televisi sangat urgen untuk memberikan pengaturan yang lebih menjamin pemenuhan hak menikmati acara televisi bagi kaum disabilitas tuna rungu dengan menentukan suatu Affirmative Action yang mewajibkan bagi stasiun TV untukmenyertakan Bahasa Isyarat dalam setiap siarannya.

Abstract

This study focuses on eliminating discrimination against Astra children from the perspective of child protection. There are two main issues discussed in this study, namely: (1) what are the forms of discrimination against Astra children? and (2) how to eliminate discrimination against Astra's children from the perspective of child protection.This research is a normative juridical law research, using a statutory approach. The results of this study are: the form of discrimination against Astra children is not being able to use the clan name of their biological father to not having rights as heirs. Elimination of discrimination against Astra's children from the perspective of child protection can be carried out in three ways, namely, one by giving recognition to Astra's children from their biological fathers, two by giving rights to children as mandated by law, three by assigning Astra children as adopted children.

Abstract

Registration and establishment of CV in Indonesia occurs in norms of conflict, both of which are regulated in Article 23 of the Criminal Procedure Code with Article 3 of the Minister of Law and Human Rights concerning ‘Application for CV registration. KUHD through clerks in the district court while Regulation of the Minister of Law and Human Rights by the Minister of Law and Human Rights through SABU (Business Administration System). The provisions of the Criminal Procedure Code have never been revoked or declared invalid. This study offers a way out in registering CV establishments conducted at the two institutions designated in the legislation, namely in accordance with the provisions of article 23 KUHD at the District Court Registrar Office where the CV is located and in accordance with Article 3 of Regulation of the Minister of Law and Human Rights Number 17 Year 2018 registered with the Ministry Law and Human Rights through the Business Entity Administration System (SABU) online.
