Abstract

Perkembangan desentralisasi dan otonomi daerah di Indonesia telah mengalami pasang surut mulai sejak jaman kolonial Belanda sampai saat ini. Sejak Indonesia merdeka hingga saat ini sudah ada 8 (delapan) Undang-Undang yang mengatur tentang Pemerintahan Daerah, mulai dari UU No. 1/1945, UU No. 22/1948, UU No. 1/1957, UU No. 18/1965, UU No. 5/1974, UU No. 22/1999, UU No. 32/2004, dan terakhir UU No. 23/2014. Masing-masing UU tersebut memiliki politik hukumnya sendiri  yang kemudian berimplikasi pada adanya perbedaan fungsi Gubernur dalam penyelenggaraan sistem pemerintahan di Indonesia. Ada 2 (dua) fungsi dasar yang melekat pada Gubernur. Pertama, yaitu fungsi desentralisasi. Dalam kaitannya dengan fungsi ini, Gubernur berkedudukan sebagai Kepala Daerah Otonom, yang memiliki kewenangan untuk menjalankan urusan rumah tangga daerah dengan sumber pendanaan APBD. Kedua, yaitu fungsi dekonsentrasi.  Dalam  kaitannya  dengan  fungsi  ini,  Gubernur  berkedudukan sebagai Wakil Pemerintah Pusat, yang memiliki kewenangan untuk menjalankan urusan pemerintahan (absolut maupun umum) dengan sumber pendanaan APBN.

Abstract

This research is intended to explore the strategy of policing in the prevention of fraud crime through  lectronic media. The focus of this paper is to provide an in-depth overview of the characteristics of fraud crimes through electronic media, factors that contribute to the implementation of policing strategies in preventing these crimes at the Central Jakarta Metro Police, as well as an ideal policing strategy in preventing these crimes. The theoretical perspective that will be used in this research is police science, especially to the perspective of preventive policing strategies as described in a simultaneous strategy for social problems. Based on the background of the phenomenon above, in order to realize public security and order, the author feels the need to develop various crime prevention approaches or strategies that use a combination of various forms of the above mentioned strategies. Therefore, the author feels interested in discussing the problem of policing the prevention of fraud crime through electronic media at the Central Jakarta Metro Police.

Abstract

This research entitled “Law Principle of One-Stop Integrated Service”. The preambule of the 1945 Constitution of the Republic of Indonesia mandated that the objective of the establishment of the Republic of Indonesia was to advance public welfare and educate the life of the nation. The mandate implies that the state is obliged to fulfill the needs of every citizen through a system of government that supports the creation of excellent public services in order to meet the basic needs and civil rights of every citizen of public goods, public services, and administrative services.The philosophical foundation of the obligation of every person to have permission to carry out their activities is contained in the provisions of Article 28J paragraph (1) of the 1945 Constitution of the Republic of Indonesia (Amendment), which aims to respect the human rights of other people in an orderly society, nation and state. In accordance with the provisions of Article 28 Paragraph (2) of the 1945Constitution of the Republic of Indonesia (Amendment), permission is a limitation of one's right to provide facilities to the community in the One Stop Integrated Service (PTSP) in the provisions of Article 28 H paragraph (2) The Republic of Indonesia in 1945 (Amendment), which reads "everyone has the right to receive facilities and special treatment to obtain the same opportunities and benefits in order to achieve equality and justice. The One Stop Integrated Licensing Service is a licensing service model that integrates the authority of the licensing agency, so that legal figures in the One Stop Integrated Licensing Service are legislation that regulates the mapermits,  among  others in  the  form of  regulations regions and  regional  head regulations. Based on the principle of bevogheid zonder verantwoordlijkheid, each permit issuer can be held accountable for the permit issued or rejected, so that the public or applicant can submit legal protection efforts through the judicial institution (State Administrative Court). Legal remedies carried out by permit applicants or the public are also a form of legal protection for permit issuers in measuring the validity of issuing decisions.

Abstract

The condition of transportation as one of the pillars of the movement of people from one place to another safely, comfortably, quickly, cheaply in accordance with the environment, with the increasing growth rate of motor vehicles (four-wheeled and two-wheeled) is not balanced with the physical road, so that more dense road transportation, especially in the city, with the socio-economic development of the community will affect parents who provide concessions to their children who have not met the age of driving a motor vehicle, especially two wheels. Thus it will affect the road traffic and will result in the occurrence of violations and accidents. The approach to be used is a normative juridical approach or statutory approach, namely research that examines laws relating to road traffic and transportation in accordance with Law No. 22/2009 concerning Traffic and Road Transportation. In addition to this approach, the authors also carried out a sociological approach which can empirically be known symptoms of changes in  community behavior towards social development in society related  to road users in Malang. Existence in legislation relating to road users in traffic  can  be obeyed  and minimize the occurrence  of violations, crime, safety and comfort, and accidents. Thus the violation of the law will be reduced and order will be well realized.

Abstract

Based  on  data  from  the  Central  Java  Provincial  Statistics  Agency,  the Company in Gresik Regency until 2015 reached 603 companies. The high development in the industrial sector certainly creates a variety of positive and negative impacts that will affect community activities and the sustainability of environmental ecosystems around them. So that there appears a compensation given by the company to the affected local residents where this compensation for the company is interpreted as a form of CSR (Corporate Social Responsibility). Given how the planning of the CSR program and the implementation of CSR programs that have been planned by the company, whether it runs effectively and runs in accordance with the program that has been planned together with the Local Government to prosper the community in the company's environment in Gresik Regency, Java Province East. The formulation of the problem in this research is first how the policy of the Gresik District Government in the regulation of CSR in Gresik Regency and secondly how the implementation of CSR policies in Gresik Regency in the context of regional development. This research is a study that uses empirical or sociolegal legal methods. The conclusion of this study is that the regulation on CSR in the law Number 40 of 2007 concerning limited liability companies and law number 25 of 2007 concerning investments still needs to be clarified and adjusted to other laws and regulations, including the Environmental Law and with related international legal instruments, including ISO 26000. This is intended to eliminate bias in the sense and standard of implementing CSR. In addition, the business community can implement the SCR more optimally, so that the objectives of implementing CSR on social and environmental aspects can be more successful and bring benefits, both for the company, society, environment and country.

Abstract

This research is motivated by the problem of resource management during the Police Operation by the Special Pioneer Company in handling terrorism in Poso, Central Sulawesi. This resource management covers human resources, facilities and infrastructure as well as the budget given to prepare and carry out the operations of the 2015 Seagull Police Operations. This is so that the implementation of the tasks of members is ready and reduces the risks and obstacles that occur. In human resources, the goal to be achieved is how to prepare qualified and healthy personnel, while the facilities and infrastructure as a tool to support how the implementation of tasks can run well because of the support of equipment and equipment that can facilitate members in achieving organizational goals. While the budget is a fund that is used to meet the needs in economic aspects as well as to provide goods by buying the goods needed. This study uses a qualitative method because according to the author this method is most appropriate for finding the facts in the field and for exploring more about the results obtained from the facts in the field. The subjects of this study were all members of Pamen, Pama, Bintara and Tamtama who were members of the 2015 Seagull Operation in Poso, Central Sulawesi. Data collection techniques used by the author include interviews, document completions and documentation in the process before, during and after carrying out the task. The results of research in human resources there are still personnel who do not comply with the guidelines or criteria needed by members so that there are still constraints in human resources, in facilities and infrastructure there are obstacles regarding accommodation, equipment and equipment that are not available up to the facilities and infrastructure that are needed it is not in accordance with its function, whereas in the budget the lack of or slow budget given and the source of the budget that is not appropriate is ineffective in the sub-section of the budget in the 2015 Seagull Operations by the Special Pioneer Group III Pioneer Company. Therefore, it is expected that in other future Police Operations it must be more focused and ready in the management of task resources so that what becomes an obstacle can be better addressed by maximizing the management of resources for successful and effective organizational goals.

Abstract

One important aspect of the organization was maintaining employee presence and reviewing the organizational commitments held by each individual. High commitment made individuals concerned  with  the  future  of  the  organization  and  tried  to  make  the  organization  a  better direction, on the contrary, individuals with low commitment would prioritize themselves or their groups and did not have the desire to make the organization towards a better direction. High work competency, an employee would be able to do much for the organization, conversely with low competency an employee would not be able to complete his duties as well as possible, which ultimately hamper the achievement of organizational goals. The distribution of employee workload that had not appropriate can make employees not have less than optimal performance. Compensation could be an incentive for someone to do an activity to  get the best results, compensation needed to be raised so that employees could carry out maximum performance. The purpose of this study was to analyzing and testing the effect of work competence and workload on organizational commitment through compensation to Civil Servants in the Regional Civil Service Agency of East Java Province. This research used  a quantitative approach with an explanative design. The results of this study provided several conclusions, including: 1.) Work competence had a significant positive effect on compensation; 2.) Workload had a significant effect on compensation; 3.) Work competence had a significant positive effect on organizational commitment; 4.) Workload had a significant positive effect on organizational commitment; 5.) Compensation had a significant positive effect on organizational commitment; 6.) Compensation became  an  intervening  variable  on  the  effect  of  work  competence  and  workload  on organizational commitment.

Abstract

Data from the City Blitar City Police Unit in 2016, as many as 1,799 or 15.9% of students committed traffic violations, from January to March 2017 as many as 438 or 11.3% of students committed  traffic violations. In addition to violations, 25 or 15.1% of traffic accidents involving students occurred. The accident caused 68 students to become victims. In 2017 January to March as many as 6 or 12.5% students were involved in traffic accidents. The accident caused 21 students to become victims. According to the data, it can be seen that the number of traffic violations in Blitar City is dominated by students, both students of junior high schools, senior high schools or vocational high schools. Then the Save Our Student (SOS) program was implemented to reduce the number of traffic offenses for students. The Save Our Student (SOS) Program is a Satlantas Polres Blitar Kota program in collaboration with schools, both Middle School (SMP), Senior High School (SMA) or Vocational High School (SMK) in Blitar City. The Save Our Student (SOS) Program is a program based on Law Number 22 Year 2009 concerning Road Traffic and Transport and the Safety riding program. The Save Our Student (SOS) program is not just a momentary program, but an ongoing program in an effort to reduce the number of traffic violations on students in the City of Blitar. The Blitar City Police Traffic Unit Police in implementing the Save Our Student (SOS) Program needs a communication strategy, where the success rate of a goal will be achieved along with how the communication strategy is carried out in implementing the Save Our Student (SOS) Program. The purpose of the program, which is to reduce the number of traffic violations among students and prevent traffic accidents with fatality fatalities will be achieved.

Abstract

The village has its original autonomy (geruine autonomy) emerging and its existence is not due to the delegation or the authority of the higher units of government, but is sourced and rooted in the original rights of the village concerned. The original rights are sourced from the rights of origin, customs and traditional rights of the village concerned. Village autonomy can be said to be an autonomy sourced from cultural wisdom, customs and common sense of the village. Abstract

Since 2019 the Government of Mojokerto City has made efforts to convert the performance appraisal system  manually  into  an  online  system.  This  effort  was  made  to  realize  effective  and  efficient governance  based  on  technology.  E-Performance  is  a  website-based  application  used  by  the Government  of  Mojokerto  City  to  manage  and  assess  employee  performance.  E-Performance  is  a staffing  system  that  can  determine  oversight  to  the  activities  of  civil  servants,  who  can  then  directly determine the amount of the additional income of civil servant. The purpose of this study is to analyze and  prove  the  effect  of  e-performance  appraisal  system  and  additional  income  of  civil  servant  on performance  in  the  Regional  Secretariat  of  Mojokerto  City  with  job  satisfaction  as  an  intervening variable.  This  research  uses  a  quantitative  approach  combined  with  an  explanatory  method.  The results  of  this  study  conclude  several  things,  including:  1.)  E-Performance  appraisal  system  has significant positive effect on performance; 2.) Additional income of civil servant has significant positive effect  on  performance;  3.)  E-Performance  appraisal  system  has  significant  positive  effect  on  job satisfaction; 4.) Additional income of civil servant has significant positive effect on job satisfaction; 5.) Job  satisfaction  has  significant  positive  effect  on  performance;  6.)  E-Performance  appraisal  system and  additional  income  of  civil  servant  have  significant  positive  effect  on  performance  through  job satisfaction.
