Abstract

Hukum yang dibuat oleh pemerintah cenderung kepada hukum tidak bermoral. Alih-alih ditujukan untuk keadilan dan kepastian di masyarakat, hukum yang dibuat justru hanya untuk melindungi kaum-kaum pemodal dan kolega pemerintahan. Masyarakat kerapkali dirugikan hak-hak konstitusionalnya akibat hukum yang diundangkan pemerintah. Hal ini dapat diketahui dari banyaknya perkara judicial review di mahkamah konstitusi yang diputus dengan amar putusan mengabulkan baik sebagian maupun seluruhnya. Padahal, Hukum yang bermoral selalu dibuat oleh lembaga yang bermoral juga. Jika nyatanya banyak hukum yang mereduksi hak-hak masyarakat, maka dapat dikatakan bahwa pembentuk hukum sebenarnya tidak memiliki moral yang baik untuk membuat hukum. Pancasila sebagai bintang penuntun (leistar) sebenarnya telah memberikan pedoman untuk membentuk hukum yang bermoral yang partisipatif dan aspiratif melalui mekanisme demokrasi permusyawaratan. Hukum disebut bermoral jika bermuara dan berlandaskan pada ideologi pancasila. Oleh sebab itu perlu adanya aktualisasi kembali, penghayatan kembali dan pemahaman kembali ideologi Pancasila bagi para pembentuk hukum dan bagi lembaga pembentuk hukum agar menghasilkan hukum yang bermoral, sehingga hukum yang dibentuk nantinya dapat menciptakan keadilan sosial bagi seluruh rakyat Indonesia.

Abstract

The ASEAn economic community which will take place at the end of 2015, for Indonesia can be an opportunity, but it can also be a very formidable challenge. This is related to the objective reality of Indonesia compared to other ASEAN member countries, namely that Indonesia has the most extensive area and the most population. With these conditions, Indonesia has many opportunities in the ASEAN Economic Community, including as a potential global market and an investment destination country.

Abstract

The facts show that the fulfillment of the rights to water for some of the world's population, including Indonesia, has not yet been achieved. This fact encourages efforts to meet water levels to be included as one of the Millennium Development Goals (MDGS) goals as the 10th tarhet. The target is set to reduce by half of the world's population who do not have access to clean water and sanitation by 2015.

Abstract

Large-scale, long-term land tenure operations by transnational business entities that run food crop cultivation businesses for export. The phenomenon of land grabbing for global food security in the 21st century has emerged since 2008-2009, along with skyrocketing global food prices. It cannot be denied that high population growth is positively correlated with consumption levels.

Abstract

Tidak dapat dipungkiri bahwa proses pengambilan kebijakan dalam suatu negara seringkali melibatkan konflik-konflik kepentingan. Konflik tersebut pada gilirannya berujung pada terjadinya pro dan kontra di kalangan berbagai kelompok kepentingan. Hal ini bisa dilihat dari berbagai macam polemic di media massa, debat di event-event public, maupun beragam aksi demonstrasi yang dilakukan oleh para pendukung atau penentang kebijakan. Dalam konteksi Indonesia, pro dan kontra tersebut dapat dilihat misalnya dalam proses legislasi UU No. 20/2003 tentang Sistem Pendidikan Nasional dan UU No. 7/2004 tentang Sumber Daya Air.

Abstract

The criminal system is the entire rule for imposing criminal sanctions, where the main criminal rules are in the Criminal Code (KUHP). Between the Criminal Code and criminal law outside the Criminal Code there must be a synchronization, in this case Article 103 of the Criminal Code says that the provisions in Chapters I through Chapter VIII Book 1, apply to criminal legislation outside the Criminal Code, unless it is deviated. In Law No. 18 of 2004 concerning Plantations, the subject of criminal law in the provisions of the midwifery of the law states everyone, which means applies to everyone in general, but everyone in the criminal provisions is not explicitly formulated in the general provisions of the law and direct damages connecting criminal law subjects with administrative law subjects by typing criminal law subjects together with administrative law subjects. Starting from the description above, the authors formulated a problem namely how the regulation / formulation of the subject of plantation criminal acts and how the future formulation policy regarding the subject of plantation criminal acts. Arrangement / formulation of the subject of plantation criminal acts in Law No. 18 of 2004 that is, every person in the regulation / formulation in the general provisions does not explain the limitations or scope of each person, based on Article 103 of the Criminal Code, the enactment of general principles in criminal law, where the subject of criminal acts in the law is natuurlijke person.

Abstract

Modernization and development have brought many disasters to the environment and humanity, in this case, the environment is interpreted conventionally. The environment is considered as an object. This perspective views and places the environment as an object that connotes commodities and can be exploited to merely support development. The environment as a system is certainly subject to a natural legal system it is destined. The system can run in a balanced manner, if the quality of the components inside it continues to run stable. As a living system, the environment is a life that consists of past life, present life, and future life.

Abstract

God has provided Indonesia's abundant biological natural resources. But on its way, damage and pollution occurred here and there. Strategic steps are needed to stop the rate of movement of damage to living natural resources. Early birth of Law No. 5 of 1990 concerning Conservation of Living Natural Resources and their Ecosystems is a breath of fresh air for the protection of Indonesia's biological natural resources. But until now there is still plastered data on ecosystem damage that disturbs the living natural resources. Therefore, a review of existing policies (specifically the criminal law policy / penal policy) is hoped to be able to help overcome the damage to the living natural resources. criminal system formulated by Law No. 5 of 1990 concerning Conservation of Biological Natural Resources and their Ecosystems belong to the conventional category because they still follow the pattern used by the Criminal Code (KUHP), which only recognizes legal subjects in the form of individuals (not corporates), does not know the special minimum system , and is oriented towards differentiating offenses qualifications (crime and violations).

Abstract

The 1945 Constitution of the Republic of Indonesia as the state constitution mandates the earth, water and natural resources contained in it to be controlled by the state and used as much as possible for the prosperity of the people, this should be a guideline for the government in formulating policies regarding the use of natural resources . However, the Rosidi case was deemed to have injured community justice and restricted access to forest products. This is interesting if related to the readiness of the legal system in Indonesia in dealing with the ASEAN economic community.
