This study describes the permissibility of abortion viewpoint of Islamic law and the Act 36 of 2009 on health, but in fact the permissibility being abused by people who are not responsible. This study uses normative analysis of a case the Supreme Court judgment which has had permanent legal force. This study shows the behavior of abortion is used as an attempt to cover up the disgrace and are not included in the permissibility of Islamic legal standpoint and emergency medis. The number of cases of embezzlement of cars that occurred in the city of Depok by the buyer (lender) is detrimental for the leasing. Being thought of now is by increasing criminal acts of embezzlement of leasing cars as collateral. With the loss of the insurer by the actions of car buyers who commit fraud, another problem is the difficulty of law enforcement agencies in dealing with such cases. This is because the initial reporting by the injured party is a matter of civil law that they are due to violation of the treaty agreed, but with the embezzlement of objects that are still in power and the property of another person or institution that is based on the legal entity making the case bias, due to a shift in of civil law into criminal law offenses. In principle the sale of cars based on the agreement between the creditor and the pembiayaa by deed of sale where in this deed creditors have the right to goods in control, but the goods are still wholly owned by the guarantor.Keywords: Crime, Fraud, Security Leasing

The number of piracy cases are popping up in the environment community indicates malfunctioning of the Act or law in mengujudkan legal protection of copyright musical works. The Constitution has laid the foundation of checks and balances amongst the main state organs namely the executive, the legislative and the judicial power. This order as a guideline in the state and society, till the Village level and within groups in the village such as the Neighborhood and citizen groups. Servitut Rights and neighbors law answer challenges of development of human settlements sustainably and resilient. Servitut rights as a property rights regulated in Neighbor law book II Indonsian Civil Code of 1848 or in adat law term called easement (hak melalui tanah orang lain) which known by adat community entity is not older than the easement is recognized by customary law in almost adat law community entity throughout the territory of Indonesia. The servitut right is the easement of yard (erfdiensbaarheid) or burden to rest on the grounds that one for the benefit of the another yard such that the owner of the yard were crushed should let the owner of the yard oppressor to pass through, drain the water (clear) on it, take view out through the window etc. This devotion land does not end with the death or replacement of yard owners concerned (Article 674 of the Indon. Civil Code). There are still remnants of feudalism and colonialism in tribal society, reflecting the concrete cases in the community there is disturbance against the rights of servitut with vigilante, then the rule of law invoked repeatedly and generating permanent jurisprudence. Kedudukannya hak servitut tidak tergoyahkan dengan adanya UUPA 1960 yang mengatakan semua hak atas tanah mempunyai fungsi sosial dan hukum adat dijadikan dasar dari hukum agraria nasional. The position of Servitut rights is impregnable with the Basic Agrarian Law 1960 (BAL) that says all rights on land has social functions and customary law form the basis of the national agrarian law. In Article I point 6 of BAL No. 5 year 1960 proves Indonesia is in a row of civilized countries that accommodates this legal institution. Jurisprudence confirm customary law as a living law as well as the Civil Code 1848 according to Supreme Court Circuler of 1963 treat as unwritten customary law in order to prevent the legal vacuum and reaching the objectives of the law. Jurisprudence has been recognized as one of the legitimate source of law in the Republic of Indonesia. Indonesian Judges have shown its class in the world of justice, who did not want to look different in servitut rights issues which is an universal phenomenon. Almost all civilized countries of the UN members have recognized the existence of this institute servitut rights, both in the Code book as well as in its jurisprudence. Servitut rights institution is rooted in the common law ius commune since Roman Empire, which can not be ignored, despite overall individualistic Roman law, but in particular there are elements of social function. Servitut (lat.) is accommodated into the book of the law in almost all countries in the world, through colonialize, import law, voluntary transplants in the law of one self. Boedi Harsono, as nationalist and socialist thinker and R. Supomo as father of Indonesian customary law and by youth in 1928 is regarded as a national law with the smooth call it "right through another person's land" which is also known by the common law. The permanent Jurisprudence remains threngthen unwritten norm servitut rights or land rights through anothers person’s land showed the class of Indonesian Judges comparabele with justices of developed nations in assessing this servitut rights. Implementation build without displacing has been regulated in Law No. 4 year 1992 art. 22-32 and Act No. 1 year 2011 on Housing and Settlement Region art. 106-113 law institute land consolidation, which is compatible with the institute servitut right and reconfirmed the servitut. Implementation, if one developer alone could make the plot and make the land ready to build cosolidate up to 6,000 ha orderly development of land, so a province or a local government / city are challenged to be able to hold up to 6,000 ha of land consolidation to reduce the backlog and combating land speculators. For the assessment of achievement of the Governor / Regional Office of BPN how long had a special local street, public street or road of servitut rights through land consolidation and how many special streets that have been submitted become public streets.Keywords: Reinforcement, top notch institutions, rights servituut

Kepastian hukum dapat diwujudkan melalui penormaan yang baik dan jelas dalam suatu undang-undang dan akan jelas pula penerapannya. Kepastian hukum juga diperlukan dalam invetasi. Undang-Undang No. 25 tahun 2007 tentang Penanaman Modal pada tanggal 26 April 2007 Undang-undang ini telah disahkan untuk menggantikan Undang-undang No. 1 tahun 1967 tentang Penanaman Modal Asing dan Undang-undang No. 6 tahun 1968 tentang Penanaman Modal Dalam Negeri. Guna mengimplementasikan tugasnya sebagaimana disebutkan dalam UU Penanaman Modal, pada tanggal 12 April 2013 BKPM menerbitkan Peraturan Badan Koordinasi Penananaman Modal Republik Indonesia Nomor 5 Tahun 2013 Tentang Pedoman Dan Tata Cara Perizinan Dan Non Perizinan Penanaman Modal (Perka BKPM No.5 Tahun 2013) yang menggantikan Peraturan Kepala BKPM Nomor 12 Tahun 2009. Dalam Perka BKPM No.5 Tahun 2013 adalah sebagai panduan dalam layanan penanaman modal terkait prosedur pengajuan dan persyaratan permohonan perizinan dan nonperizinan penanaman modal yang ditujukan kepada pejabat di instansi penyelenggara Pelayanan Terpadu Satu Pintu (PTSP), para pelaku usaha serta masyarakat umum lainnya. Salah satu pemegang saham PT. Tunas Mandiri Lumbis mempermasalahkan penerbitan Ijin Prinsip Perubahan Penananaman Modal Asing Nomor 1723/1/IP-PB/PMA/2013, Nomor Perusahaan 24017, tertanggal 02 Desember 2013 di Pengadilan Tata Usaha Negara Jakarta. Ternyata dalam menerbitkan Ijin Prinsip Perubahan Penanaman Modal Asing harus memnuhi prosedur berdasarkan Undang-Undang Nomor 25 Tahun 2007 Tentang Penanaman Modal Pasal 25 ayat 4, Peraturan Kepala Badan Koordinasi Penanaman Modal Republik Indonesia Nomor 12 Tahun 2013 tentang perubahan atasa Peraturan Kepala Badan Koordinasi Penanaman Modal Nomor 5 Tahun 2013 tentang Pedoman dan tata cara perizinan dan non perizinan Penanaman Modal khususnya : Pasal 103 ayat (2), Pasal 103 ayat (3), Pasal 103 ayat (5) : Pasal 103 ayat (5) b : Pasal 103 ayat (6) , Pasal 103 ayat (6) a. Tidak adanya kepastian hukum dalam Ijin Prinsip Perubahan Penananaman Modal Asing Nomor 1723/1/IP-PB/PMA/2013, Nomor Perusahaan 24017, tertanggal 02 Desember 2013 sebagaimana Putusan Pengadilan Tata Usaha Negara Jakarta Nomor : 43/G/2014/PTUN-JKT, tanggal 17 Juli 2014 karena telah melanggar prosedur yang ditentukan oleh Undang-Undang Nomor 25 Tahun 2007 Tentang Penanaman Modal Pasal 25 ayat 4, Peraturan Pemerintah Nomor 38 Tahun 2007 tentang Pembagian Urusan Pemerintahan antara Pemerintah, Pemerintahan Daerah Provinsi dan Pemerintah Daerah Kabupaten/Kota, dan Peraturan Kepala Badan Koordinasi Penanaman Modal Republik Indonesia Nomor 12 Tahun 2013 tentang perubahan atas Peraturan Kepala Badan Koordinasi Penanaman Modal Nomor 5 Tahun 2013 tentang Pedoman dan tata cara perizinan dan non perizinan Penanaman Modal.Kata Kunci : Kepastian Hukum, Investasi, Penanaman Modal

Terrorism is one of transnational crime base on international conventions. One of national crime which consists of transnational aspects. Transnational crime convention only manage about how to run cooperation to eliminate national crime which across country borders. Terrorism hasn’t consider as International crime because there’s no unification about its definition. Terrorism still consider as a sensitive issue in each country related with rass, etnis, culture, religion, and geographical aspects. Employment comes from the workforce, which in Article 1 paragraph 2 of Law No. 13 2003 Manpower is "Manpower is every person who is able to work in order to produce goods and / or services, both for subsistence and for the community." While understanding of labor in accordance with Article 1 paragraph 1 of Law No. 13 2003 Manpower is "Employment is everything related to the workforce at a time before, during, and after the work period." In order to improve the standard of living it is necessary to the development of various aspects. No exception to the manpower development is done on the principle of integration through functional coordination across sectors and regional center. The year 2006 is seen in the most revolutionary in the history of the existence of religious courts in the Indonesian legal system. Delegation of authority to examine, decide and resolve syariah economic case to the Religious Court signaled recognition of the existence of religious courts as well as the realization of the desire of the majority, even all Muslims in Indonesia to resolve the dispute in accordance guidance Shari'a. However, in practice before the judicial reviewe Act No. 21 of 2008 concerning Islamic banking, which in practice contains legal uncertainty because of the problem stems from differences in interpretation in deciding which forum has the authority to resolve disputes Islamic banking at hand that is the Choice of Forum and the Choice of law which in turn raises the formulation of legal uncertainty.
