TAKAMUL is a journal of Gender and Child Studies is published by Pusat Studi Wanita Universitas Islam Negeri Ar-Raniry Banda Aceh. First published in 2012, this journal is published twice a year in June and December. This is a scientific communication media for enthusiasts and observers of gender and children study. The editor receives articles of gender and children study from academics, researchers, practitioners, and postgraduate students. The articles will be published after a mechanism of selection, being examined by the expert, and editing process. This journal is open-access which means that everyone can access for individual or institution for free. A user will be allowed reading, downloading, copying, distributing, producing, creating a link from the article, or using for academic writing under the condition of publication ethics. This journal has been indexed by national and international indexing website, such as CrossRef. And this journal has Digital Object Identifier (DOI). Abstract

This paper comes from the notion that Islamic law involved with human history - in this context, with Jahiliyyah-law, is a cultural phenomenon and can be investigated by using a humanities approach and methodological tools. 1 With all the advantages and disadvantages, the study of social change by Islamic law on the law of Jahiliyyah as the background of its appearance, the one becoming the focus of the discussion in this paper, is attempted to keep away from the at- titude, the one Richard C. Martin called as fideistic scientific subjectivism or objectivism. 2 More importantly, the one portraying Islam position on mustadl'afin become a important awareness which is critical towards the social changes by Islamic law in the society.

Abstract

This article critically investigates the interpretation of some mufassirs (al-Qur’an interpreters) and moslem feminists about women affairs in sura al-Nisa’; some of other things are that of the origin of women creation, the leadership in the house dan polygamy. The significance of this investigation is to look critically at the thoughts of the mufassirs to find out their interpretation about al-Qur’an verses, which are apparently discriminatory towards women, and to discover the similarities and the differences between them in interpreting the same verses. This research was purely library research, and the analysis method used was the combination of inductive and comparative ones by using hermeneutic approach. From this research, it was found that in ad- dition to their similar interpretation, there are many different and controversial points of view among the mufassirs due to several factors like their background of thinking, socio-religious status, the methodology used, and the existence of bias in interpreting the texts.

Abstract

Understanding verses and hadiths that gender bias, often used as a legitimation for inequality relationships women and men. Forexample, the interpretation of the word nafs wahidah that could be interpreted as Adam or also of the same material with Adam. However, the important thing is, that it does not mean there are more superior than others. Understanding verses and hadiths that gender bias is also found in understanding the hadith about the creation of woman from the rib. The creation of woman from the rib here is not in the true meaning, but often harfiyah interpreted giving rise to the perception that women in Islam is a second being. This understanding arises because of an incomplete understanding of the meaning of the verse and the hadith, and also due to the only partial understanding.

Abstract

Nowadays, ignoring family often results separation inside the family, especially after the avail- ability of Law Domestic Violence (Domestic Violence Act). However, Islamic judiciance (Fiqh) looks differently toward this case so that it is necessary to study fiqh muqarran. Furthermore, this argument needs to be related to the phenomenon that occurs due to the Domestic Violence Act.

Abstract

This article discusses about the role and position of women scholars in Bireuen and Aceh Besar district in order to see the progress and what areas could be run by women scholars and to look at some obstacles faced in carrying out that role. The goals are to obtain some important infor- mation about the presence of women scholars in both areas, with their certain characteristics. The method used in collecting data that is unstructured interviews with a number of women scholars and comparative study to identify some similar aspects and find the differences between the two districts as the basis of women scholars in Aceh. From the results of this study indicate that although the role and position of women clergy (ulama perempuan) has changed from year to year, but the recognition of the public still places men (Tgk agam) as the dominant figure of scholars in all fields. It is well understood as a social construction that apply fully in the two dis- tricts. Besides, for the women themselves do not have enough confidence to be called as "ulama perempuan". This condition in fact will affect the community recognition. Normally, some roles that are common done by ulama perempuan such as teaching, preaching, teaching rituals of Hajj and implementation burial (jenazah). Meanwhile, in the areas of writing and involved in religious organizations and political parties are still very seldom. It shown that the formation of ulama perempuan from the boarding itself, and the government even non-government parties still do not maximized. So it is needed some serious efforts through socialization and more at- tention later on.
