<![CDATA[The election of village heads is a process of selecting leaders democratically at the lowest level of government and is carried out directly. The study aims to find out how the selection process for the Head of Gareccing Village in the perspective of siyasah syar'iyyah using qualitative types of research, through juridical and normative syar'i approaches. The selection process for the Head of Gareccing Village starts from the stages of forming an election committee, registering candidates, voting, determining selected candidates, and inaugurating the elected village head, and the process has been carried out in accordance with applicable regulations. Political contestation that takes place every 6 (six) years is not colored by dirty practices, such as intimidation and money politics, so that public participation is quite high. Although in the history of Islamic constitutionality there has never been an example of a direct election mechanism such as the election of the Head of Gareccing Village, it does not mean that the mechanism is contrary to the principles of Islamic teachings. Because, from the time the Prophet Muhammad saw to his companions, there was no uniform mechanism in selecting leaders.]]>

<![CDATA[This study aims to examine the role of the Regional People's Representative Council (DPRD) of Gowa Regency in the implementation of Gowa Regional Regulation Number 50 of 2001 (Perda No. 50 of 2001). The research methods used fully use qualitative research. The results show that the Gowa Regency DPRD has the authority to supervise the implementation of every government policy, including the implementation of Perda No. 50 of 2001, and concretely, this role is carried out by supervising and ensuring that the government seriously performs its duties mandated by the Perda. From the perspective of siyasah jurisprudence, the government, including the DPRD, is obliged to prevent everything that can bring chaos, especially alcoholic beverages not only have the potential to damage health, but can also be the cause of actions that can disrupt order in society.]]>

<![CDATA[The activity of street vendors is a sector of abuse of public facilities in the community which is rife and even has the potential to cause disruption to cleanliness, order, comfort and harm to the community. For this reason, this research is a qualitative field research with an empirical normative approach and a theological approach. The results of the study show that street vendors in Somba Opu District are still using public facilities as a means to sell, so the Government of Gowa Regency is carrying out various arrangements with the obligation for street vendors to have permits, outreach, provide land, and maintain order so that street vendors do not again destroying the order of the city. In addition, the use of public facilities by street vendors is very inconsistent with Islamic values and ethics which are always honest, trustworthy or responsible, deceitful and keep promises.]]>

<![CDATA[The massive, systematic, and structured circulation of narcotics hints at the complexity of controlling and overcoming narcotics as a national problem, not to mention the emergence of religious plants that contain intoxicating substances, such as cow dung fungi. This research is qualitative research with normative juridical and syar'i approaches. The results showed that the community and the Gowa Regency government did not know that the type of fungus that grows on cow dung is included in the Narcotics group. The lack of information related to the content of cow dung fungi is caused by the government's slowness in carrying out educational measures and prevention efforts. Although the Qur'an and hadith do not specifically regulate the legal status of cow dung fungus, but its legal status can be determined using the qiyas method, using the rule that everything that intoxicates the law is haram. Because cow dung mushrooms contain intoxicating substances, the law is illegitimate.]]>

<![CDATA[Pandemi Covid-19 telah mempengaruhi segala aspek kehidupan masyarakat termasuk sistem peradilan. Eksistensi E-Court sebagai sistem peradilan diharapkan dapat menjadi solusi ditengah pembatasan aktivitas oleh pemerintah. Penelitian ini adalah penelitian kualitatif deskriptif dengan menggunakan pendekatan yuridis dan normatif syar’i. Hasil penelitian ini menunjukkan bahwa Pengadilan Tata Usaha Negara Makassar telah menerapkan sistem E-Court secara efektif, meskipun mengalami beberapa kendala, seperti terbatasnya tahapan persidangan yang dapat dilakukan melalui aplikasi dan sarana dan prasarana pendukung. Dalam konsep siyasah syar’iyyah, pemanfaatan E-Court merupakan instrumen untuk memberikan kemudahan, sekaligus sebagai upaya untuk mengurangi interaksi para pencari keadilan ditengah wabah covid-19, sehingga penerapan sistem tersebut telah bersesuaian dengan prinsip maslahat.]]>

<![CDATA[Children are an integral part of the younger generation and the potential of the nation's human resources in the future. Efforts to foster and protect children are a shared responsibility in ensuring physical, and mental growth and development. This research is a qualitative research field. The results showed that regulatively, the Makassar City Government already has regulations related to child protection, namely Makassar City Regional Regulation Number 5 of 2018 concerning Child Protection, but technically, the regulation has not regulated the protection of children from online game addiction. Efforts to protect children from the negative influence of online games are not only the responsibility of the government, but the role and commitment of the family and the environment are also determining factors, especially the presence of online games related to information technology which has become a primary need.]]>

<![CDATA[Local revenue is the right of local governments that is recognized as an increase in the value of net worth obtained from local taxes, and local levies, The results of segregated regional wealth management and other legitimate sources are intended to support fiscal decentralization and regional development. This type of research is qualitative research with a normative syar'i approach and an empirical juridical approach. The results of this study show that the contribution of Regional Original Income (PAD) of Bantaeng Regency between 2019-2020 in financing infrastructure development is still relatively small because it only ranges from 4-5% when compared to direct expenditure allocations.]]>

<![CDATA[The phenomenon of children facing the law or in conflict with the law requires special handling that is different from that of adults. Balai Permasyarakatan is one of the parties given the responsibility to be involved in conducting coaching. This study aims to find out how the function of the Balai Permasyarakatan Kelas 1 Makassar in conducting guidance for children who face the law. The research used is descriptive qualitative research with empirical normative and normative theological approaches. The results of this study show that the guidance of children facing the law by the Balai Pemasyarakatan Kelas Makassar is carried out through a personality guidance program, independence and supervision of child clients, especially those who obtain parole. The coaching program carried out by the Correctional Center has provided benefits, by fostering children who face the law before living a normal life in the community.]]>

<![CDATA[The rich biodiversity in Indonesia encourages conservative regional management through Nature Parks. The serious threat of biodiversity damage brings an important role for the Natural Resources Conservation Agency to carry out efforts to protect and control biodiversity based on Law Number 5 of 1990. Research is qualitative research. The results showed that the role of the Natural Resources Conservation Center (KSDA) in carrying out the conservation of biological natural resources and ecosystems in the natural tourism park of the Bawakaraeng Mountain Area based on Law Number 5 of 1990 has gone through the stages of protection, preservation, and utilization, and in its implementation, there are obstacles, such as human resources, facilities, and facilities, community, and culture. From the perspective of siyasah syar’iyyah, the protection of natural tourism parks cannot be separated from human treatment, so in fact humans including society and the government must provide a balance value between other creatures of Allah with the preservation actions that have been required by the Quran and hadith.]]>

<![CDATA[The rescheduling of the simultaneous regional elections in December 2020 reaped pros and cons, even considered unrealistic as positive cases of Covid-19 surged. This study aims to find out the problems of the implementation of the Makassar Mayoral Election in the midst of the Covid-19 pandemic. This research uses qualitative field methods with empirical juridical approach and syar'i approach. The results of this study show that the Mayoral Election, which was held amid the soaring number of positive cases of Covid-19, is a policy that can threaten mutual safety. Although the change of leadership is a constitutional mandate, but with a health emergency the implementation may be postponed. In the concept of al-maqasid al-sharia, keeping the soul is second only to the obligation to maintain religion, and the concept is in line with the state objectives that have been affirmed in the Basic Law.]]>
