Abstract

This paper points out the issues of personal history versus mainstream/official history, the changing meaning of photographs, the concept of truth/fact, and personal identity in Ana Menendez’s novel Loving Che. The unnamed main character in this novel tries to construct her identity based on her mother's diary and letters as well as the photographs her mother sent to her. She and her mother, Teresa de La Landre, were separated due to a political dispute in Cuba. Teresa managed to get her father and baby out of Cuba and fled to Miami. When Teresa's father arrived in Miami, only then did he realize that Teresa did not go with them to Miami. She stayed in Cuba to wait for her lover, as he told his granddaughter. The main character wondered if she was Che Guevara's daughter, as implied in Teresa's letters and diary. By using Roland Barthes' Semiotic theory and feminist approach, this paper investigates how a photograph can be given different meanings when it is given a different context or background story. Furthermore, how the image of the revolutionist Che Guevara changes from the image based on the fact we read from mainstream history books into the melancholic and romantic image of the same man in the novel when it was given a more personal approach toward the man in the photograph

Abstract

Cyberbullying on social media is a serious problem that can negatively impact the mental health and well-being of victims. Lack of supervision in the family, school, community, and individual environments causes cyberbullying. Article 433 paragraph (1), and paragraph (2) of Law No. 1 of 2023 concerning the Criminal Code (KUHP) provides a new legal basis regarding defamation through social media and will be enforced in 2026. Artificial intelligence (AI) can be an innovative solution in addressing this problem. The purpose of the study is to analyze the legal protection of victims of cyber bullying on social media according to Law No. 1 of 2023 and explore the potential integration of AI in its handling. The research method used is normative juridical, using a legislative approach and an analytical approach. The results of the study show that although Law No. 1 of 2023 provides a clear legal framework, its implementation is still hampered by a lack of resources and understanding in the community. On the other hand, AI integration has proven to be effective in detecting and analyzing bullying behavior on social media, providing support to victims, and speeding up the investigation process by authorities. This study concludes that legal protection for victims of cyber bullying can be improved through the integration of artificial intelligence. Therefore, collaboration between the government, social media platform providers, and technology experts is needed to create more effective and responsive solutions to the problem of cyber bullying in society

Abstract

The legal gap in Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Services Sector is a significant challenge to the effectiveness of supervision of the Financial Services Authority (OJK) in Indonesia. Issues such as unclear definitions, lack of specific provisions, ambiguity in inter-agency relations, and minimal strict law enforcement have resulted in doubts about the implementation of OJK's duties. To overcome these problems, efforts are needed to harmonize through the formulation of clear definitions, the regulation of more specific provisions, and increased coordination between institutions. In addition, providing law enforcement powers and facilitating the preparation of derivative regulations are also important to strengthen OJK's independence. With these alignment steps, it is hoped that OJK can operate more effectively and contribute to the stability of the financial services sector in Indonesia

Abstract

This research discusses the challenges and weaknesses in partnership agreements between PT. Boswa Megalopolis and the community of Aceh Jaya Regency, focusing on aspects of power imbalance, unclear provisions, and minimal legal protection for plasma farmers. Through an analysis of contributing factors such as social and economic structures, availability of information, and the limited role of the government, the need for regulatory reform and practical guidelines is identified to improve justice in partnerships. Furthermore, strengthening mediation institutions and implementing community-based partnership models are proposed as strategies to create sustainable partnerships. These findings are expected to provide insights for policymakers and stakeholders in creating a more just and sustainable partnership system in the oil palm plantation sector.

Abstract

This research discusses the dynamics of new province formation in Indonesia from the perspective of political, social, and economic factors. The formation of new provinces aims to enhance public services, strengthen regional identities, and promote local economic growth. However, this process also presents challenges, such as the potential for social conflict, resource allocation issues, and difficulties in governance management. Political factors, such as regional autonomy policies and the role of political elites, influence the decisions regarding regional expansions, while ethnic identities and community participation are crucial in the social context. In terms of economics, the potential for natural resources and challenges in regional financial management are key concerns. In conclusion, the success of establishing new provinces relies on implementing inclusive and sustainable policies that involve the community in decision-making processes and enhance the capacities of local governments to create welfare and stability

Abstract

This research examines legal vacuums in the management of state assets derived from Cooperation Contracts (KKKS) in the upstream oil and gas sector in Indonesia. Despite a legal framework established by Law No. 22 of 2001 and Government Regulation No. 35 of 2004, field practices reveal discrepancies between regulations and implementation, leading to difficulties in the recording and reporting of assets, as well as the determination of depreciation values and operational costs. The impact of this legal vacuum not only affects state revenue and transparency but also has significant social and economic implications. Through case study analysis, this research suggests improvements to existing regulations, capacity building for KKKS, and strengthening oversight mechanisms to optimize the management of state assets in the upstream oil and gas sector.

Abstract

Evictions as a social phenomenon have several negative impacts on the community, such as not only losing their homes but also affecting jobs, daily livelihoods, children's schools, women and social impacts such as losing long- established kinships. Evictions on a large scale accompanied by inappropriate relocation programs will cause economic and socio-cultural impoverishment for the community, which also leaves a traumatic impact. In the legal aspect, evictions can also result in violations of the basic rights of their own citizens. The purpose of this study is to develop a psychological measurement tool in assessing assertive behavior in eviction victims in DKI Jakarta. The measuring instrument was developed based on Jakubowski and Lange's (1978) assertiveness construct. After testing its validity and reliability, this assertiveness measuring instrument has a high reliability and validity coefficient because it is close to 1. In testing the validity, only a few statement items are invalid, and there are some items that are discarded because they do not have a standard t-value of 1.96, as well as a loading factor that also does not exceed the expected value. This is possible because the dimensions in assertiveness are indeed dimensions that really measure individual assertiveness.

Abstract

The development of digital economy in Indonesia is growing rapidly along with the increasing use of internet and technology in various sectors. Fintech services are one of the main drivers of this development, especially in increasing financial inclusion. This study aims to explore the impact of fintech services on investment decisions among millennials. This study uses quantitative method with survey as the data collection technique, involving respondents who are active users of fintech platforms. The data collected was analysed using linear regression. The results of the analysis show that ease of access, low cost, transparency and time flexibility significantly influence their investment decisions. In addition, the study identified the importance of financial education in improving users' literacy and confidence in investing. The findings emphasise the important role of fintech in encouraging millennial participation in financial markets, as well as the need for appropriate regulation to protect consumers and support the industry's sustainable growth

Abstract

This research discusses the legal vacuum regarding the accountability of law enforcement officials, specifically the police, in the management of seized goods that have experienced damage or loss. The main focus of this research is to identify weaknesses in existing regulations and their impact on legal certainty and the protection of the rights of the owners of the goods. By analyzing the ambiguities in the laws and examining real case studies, this research finds that the legal vacuum leads to material losses for the owners and decreases public trust in law enforcement agencies. As a solution, the research recommends legal reforms through the establishment of clearer regulations regarding the obligations of seized goods managers to provide compensation, as well as strengthening administrative procedures and strict monitoring to create a fair and transparent legal system

Abstract

The study examines the legal uncertainties surrounding the time limits for determining suspect status within Indonesia's criminal justice system. The lack of clarity in the Criminal Procedure Code (KUHAP) regarding these time limits poses significant challenges to the human rights of suspects, particularly the constitutional guarantee of legal certainty. Without clearly defined timeframes for determining suspect status, investigations can extend indefinite period, leaving suspects uncertain whether their cases will proceed to prosecution or be dismissed. This situation subjects them to prolonged psychological, social, and economic strain and increases the risk of potential abuse of authority by investigators. Additionally, the study highlights the difficulties in establishing legal certainty concerning the time limits for suspect status and evaluates the necessary reforms to the Criminal Procedure Code to ensure fairness and safeguard the rights of suspects. One proposed solution is to implement a definitive time limit for the investigation process and the determination of suspect status, alongside strengthening internal and external monitoring mechanisms to mitigate the risk of authority misuse
