Abstract

General Background: Internships serve as a bridge between academic learning and professional practice, helping students develop applied competencies. However, the emergence of the Ferienjob internship program in Germany involving Indonesian students has raised concerns about its legal compliance. Knowledge Gap: Previous studies have focused on the legal protection and rights of interns, yet few have examined the legality of international internship agreements that deviate from Indonesian law. Aim: This study analyzes the legal validity of the Ferienjob internship agreement under Indonesian positive law. Results: Findings reveal that the Ferienjob contract made by X Agency violates Article 1320 of the Indonesian Civil Code, lacks a lawful cause, and fails to meet essential and objective requirements, rendering it invalid. It also breaches key provisions in the Manpower Law, Permendikbud No. 3/2020, and Permentrans No. PER.08/MEN/V/2008. Novelty: This study identifies Ferienjob as a commercialized job market scheme, not an educational internship. Implications: Stronger legal supervision and institutional accountability are essential to prevent student exploitation in overseas internship programs. Highlights: Ferienjob violates Indonesian civil and manpower laws. The contract lacks lawful cause and balance between parties. Requires stronger supervision to protect student rights abroad. Keywords: Ferienjob, Internship Agreement, Positive Law, Legal Validity, Student Protection

Abstract

General Background: Trees play a vital role in maintaining environmental balance, particularly along roadways, contributing to ecological stability and human well-being. Specific Background: In Sidoarjo, tree protection policies are implemented by the Environmental Service to regulate business activities, yet challenges remain in enforcement. Knowledge Gap: Despite existing regulations, including Regent Regulation No. 29 of 2018, the protection of tree functions has not been fully effective, highlighting gaps between national law, local regulations, and practical implementation. Aims: This study aims to examine the legal protection of tree functions in Sidoarjo and assess regulatory implementation. Results: Findings indicate that while national and local regulations, such as UU No. 32/2009 and Perda No. 8/2013, provide a legal basis, the execution of tree protection policies remains suboptimal due to overly comprehensive local regulations that dilute enforcement strength. Novelty: The study integrates normative juridical analysis with local policy evaluation, providing a critical perspective on the alignment of environmental protection laws with administrative practice. Implications: Strengthening regulatory coherence and enforcement mechanisms is essential to ensure sustainable urban environmental management and fulfillment of citizens’ rights to a healthy environment. Highlights: National and local laws provide a strong legal basis for tree protection. Enforcement of tree protection in Sidoarjo is not yet optimal. Overly comprehensive local regulations reduce practical enforcement strength. Keywords: Tree Protection, Environmental Functions, Sidoarjo, Legal Regulation, Roadways

Abstract

Background: Open trip mountain services organized by communities are increasingly popular but prone to breaches of contract, causing losses to climbers. Specific Background: Cases such as forced descent at Pos 2 Sembalun Lawang, Gunung Rinjani, highlight the lack of clarity regarding compensation rights in community-managed trips. Knowledge Gap: Existing literature rarely addresses the intersection of civil law principles and economic transaction theories in regulating compensation for open trip services. Aim: This study analyzes legal obligations and compensation mechanisms for climbers affected by breaches of contract using civil law perspectives and supply-and-demand theory. Methods: Normative legal research with statutory and economic theory approaches, supplemented by secondary sources, analyzed descriptively. Results: Participants are entitled to compensation when services fail to meet agreed standards. Theories of offer, acceptance, and trust clarify when agreements are legally binding and how liability arises. Dispute resolution can occur through mediation, arbitration, or court litigation, with distinct procedural considerations. Novelty: Integrating legal theory with economic principles provides a clearer framework for determining compensation and managing expectations in open trip services. Implications: Understanding these frameworks enhances legal certainty and protects climbers’ rights in community-organized outdoor tourism. Highlights: Legal responsibility arises upon confirmation of trip participation. Theories of offer, acceptance, and trust guide compensation claims. Multi-path dispute resolution supports fair and efficient outcomes. Keywords: Compensation, Breach of Contract, Open Trip, Civil Law, Community Tourism
