Abstract

This study discusses a comparison of criminal law regulations against cybercrime in Thailand and Indonesia, as well as the challenges faced in their enforcement. This normative research uses a legislative approach to evaluate the effectiveness of the legal frameworks of both countries in preventing and dealing with cybercrime. Thailand relies on the Computer Crime Act (CCA) which focuses on various types of cybercrime, while Indonesia has the Information and Electronic Transactions Law (ITE Law) which regulates more broadly aspects of digital transactions and information dissemination. The study found that although the legal framework in both countries is quite comprehensive, limited human resources and technical skills are major challenges in law enforcement against cybercrime. Cyber law enforcement requires very high technical skills, and many law enforcement agencies in both countries still lack personnel who have competence in information technology and cybersecurity. Another important aspect of this study is international cooperation which is key in tackling cross-border cybercrime. Thailand and Indonesia, like other countries, deal with cybercrime that often involves perpetrators and victims in various countries. In this regard, international conventions such as the Budapest Convention on Cybercrime play an important role. The Convention provides an international legal basis for cooperation in combating cybercrime, including procedures for requesting legal assistance and extradition. In addition, international organizations such as Interpol also play an important role in the coordination and exchange of information between countries to deal with cybercrime. The results of this study show that further efforts are needed in terms of inter-agency coordination, law enforcement training, and public education to improve protection against cybercrime in Thailand and Indonesia. Closer international collaboration, both through bilateral and multilateral forums, is also very important to increase the effectiveness of cyber law enforcement.

Abstract

This research evaluates the interpretation and implementation of the principles of jus in bello: distinction, proportionality, military necessity, and precaution in the Russia–Ukraine and Israel–Palestine conflicts. The analysis results reveal the frequent violations of the principles of distinction and proportionality due to claims of strategic necessity, as well as the failure of precautionary measures in minimizing civilian casualties. Although the enforcement framework of IHL through the UN, ICJ, and ICC is strong normatively, its effectiveness is hindered by politics and resources. In conclusion, the enforcement of jus in bello requires more effective international coordination, clear new weapon regulations, and the cultivation of HHI compliance among the military.

Abstract

This research analyzes the application of International Humanitarian Law principles (distinction, proportionality, humanity, military necessity) in the Russia–Ukraine conflict (2014–2025), identifies serious violations (bombing of civilian facilities, prohibited weapons, forced deportation), and explores contemporary military ethical reflections related to the use of autonomous drones, cyber operations, and the Internet of Battlefield Things. The results show distortions in the implementation of IHL in operational "grey zones," the low effectiveness of international law enforcement, and the emergence of new moral dilemmas in war technology. In conclusion, adaptive enforcement mechanisms and adequate ethical frameworks are needed to safeguard civilian protection in modern conflicts.

Abstract

Trust law, which originated in England with its unique legal characteristic inherent to the common law system, has, under influence of globaligzation, been adopted and applied in civil law jurisdiction. One of its defining features, dual ownership, poses significant challenges when implementing trust law in countries with civil law systems. However, research indicates that civil law jurisdiction such as India, Japan, and Indonesia have adopted the trust concept by incorporating domestic legal principles, such as the principles of obligation, contractual frameworks, and the application of the jus-in-personam theory, to address the fundamental differences with the dual ownership principle. These adaptations, tailored to the respective legal systems of civil law countries, have enabled the application of trust law without relying on the dual ownership principle.

Abstract

This study aims to analyze the legal provisions regarding the crime of lese-majesté in Thailand with the law regarding attacks on the honor of the President in Law Number 1 of 2023 in Indonesia, as well as their implementation and impact on freedom of expression and human rights. This research employs a normative legal study (juridical-normative) with a statutory approach. Furthermore, the nature of this research is descriptive-analytical. The data sources used in this normative juridical research are secondary data, which include primary legal materials, secondary legal materials, and tertiary legal materials.. First, this study discusses the description of the legal provisions regarding the crime of lese-majesté in Thailand which has very strict criminal sanctions, with provisions for violations against the President in Indonesia which are relatively looser, but still have the potential to limit freedom. Second, the differences and similarities in the application of the law in both countries lead to the use of the law as a tool to protect the dignity of the country's leaders, although with different levels of strictness. Third, the impact of the application of this law on freedom of expression and human rights shows that although both countries aim to protect the honor of the country's leaders, the application of the law can limit freedom of speech and opinion, which has the potential to restrict human rights. Overall, despite differences in the application of the law, both in Thailand and Indonesia, both face challenges in balancing protection of the honor of state leaders with human rights, especially freedom of expression.

Abstract

Child exploitation is a significant global issue, particularly in Southeast Asia, including Indonesia and Thailand. This study aims to examine the legal regulations in Indonesia and Thailand regarding child exploitation and to understand the urgency of legal protection for child victims of sexual exploitation in both countries. A normative juridical research method is employed to analyze how these countries handle child exploitation cases, focusing on legal standards and their implementation. The study compares the laws in both nations and evaluates their application in child exploitation cases. The findings indicate that Indonesia's legal framework for addressing child exploitation refers to Article 76I in conjunction with Article 88 of the Child Protection Law (UUPA) and Article 12 in conjunction with Article 13 of the Law on Sexual Violence Crimes (UUTPKS). In Thailand, child exploitation is regulated under the Thailand Penal Code and the Child Protection Act of 2003. When applying Indonesian law to offenders of child exploitation crimes occurring in Thailand, it is essential to consider the United Nations Convention on the Rights of the Child (CRC) of September 2, 1990. Legal protection for child victims of sexual exploitation in Indonesia varies according to the provisions of the Child Protection Law. Abstract

The renewal of family law carried out by various Muslim countries generally includes three main aspects, namely marriage, divorce, and inheritance. In the context of marriage, one form of renewal that is implemented is marriage registration. This stage is considered important because it aims to create order in marriage in society, maintain the sanctity of marriage, and specifically protect women's rights in domestic life. This paper discusses the reform of Islamic law, especially in the field of family law, in the legal systems of India and Pakistan. These two countries are discussed together because they have the same historical background, namely that it was once a territory under British rule before Pakistan seceded and became the Islamic Republic of Pakistan. Through a literature study, the study found that India and Pakistan implemented family law reform with a moderate approach, not as liberal as some other Muslim countries. The main findings of this paper reveal that the reform of Islamic family law in both countries has many similarities. This is most likely influenced by their history as a unit before independence and the similarity in the majority of its population adhering to the Hanafi school.

Abstract

Mixed marriages involving Indonesian citizens (WNI) and foreign citizens (WNA) raise legal issues related to the citizenship status of the resulting children. Law Number 12/2006 on Citizenship of the Republic of Indonesia has regulated the mechanism of citizenship of children resulting from mixed marriages, but its implementation still faces various obstacles. This research aims to analyze the legal certainty for children from mixed marriages with a normative juridical approach that examines laws and regulations and related case studies. The results show that although regulations have provided space for limited dual citizenship status up to the age of 18, there are various obstacles in implementation, such as lack of public understanding, bureaucratic complexity, and differences in legal principles between Indonesia and the foreign partner's country. Therefore, policy reform, increased coordination between government agencies, and broader education for the public are needed to ensure optimal legal protection for children from mixed marriages.

Abstract

This research examines the complex intersection of Golden Visa policies, immigration mechanisms, and citizenship laws in between Portugal, Spain, and Indonesia. As investment migration programs gain popularity, they present unique challenges to existing legal frameworks designed to protect nation’s sovereignty and maintain stable domestic markets. The need of comparative legal analysis methodology, scrutinizing the legislative and regulatory approaches of the three countries, thus explores how Indonesia could balance the economic benefits of golden visa schemes with the imperative to prevent transnational crimes and mitigate adverse effects on local markets. The evolution and current state of golden visa policies in Europe, might affect the analysis of existing citizenship laws and their application to Citizenship by Investment in Indonesia.

Abstract

Carbon tax aims to reduce greenhouse gas emissions and promote environmental sustainability. This study compares carbon tax policies in Indonesia and Singapore, which are considered successful through consistent regulation and industry involvement. To analyze the legal aspects, this study uses a normative juridical method with a polluter pays principle approach. Although it has the potential to increase state revenue and encourage environmentally friendly technology, this policy faces challenges in the form of low public understanding and industry resistance. Education, inclusive policies, and international cooperation are the keys to the successful implementation of carbon tax in Indonesia.
