Abstract

Corpse removal is the process of moving the body of a person from one place to another. Sometimes, this is done at the request of the family, for cultural or religious reasons, or even for other reasons such as demolition of the burial site or redevelopment of the burial area. The purpose of this research is to find out the rule of law to answer the issue of grave transfer. This type of research is normative juridical research obtained from secondary data related to the object of research including related laws and court decisions. In this research, data analysis is carried out qualitatively, namely the selection of theories, principles, norms, doctrines and articles contained in the Law that are relevant to this research. Based on the results of the research, the criminal act of corpse removal has criminal law rules, namely in Article 180 of Law No. 1 of 1946 concerning the Criminal Code and in Article 271 of Law No. 1 of 2023 concerning the Criminal Code. The removal of corpses from the grave is also not justified by several Islamic scholars so that this is in line with criminal law. In the case that occurred in Donggala district based on the Donggala District Court Decision No. reg 11/Pid.B/2014/PN.Dgl the Panel of Judges sentenced the defendants to imprisonment for four months each

Abstract

The objective of this study was to determine the management of the handling of refugees in North Sumatra in the perspective of Human Security. Handling refugees internationally is regulated in international refugee conventions, The 1951 convention Relating the Status of Refugees, The 1967 Protocol Relating to the Status of Refugees, the Convention Relating to the Status of Stateless Person (1954), and Convention Governing the specific Aspects of Refugees Problems In Africa (1969). These conventions are a form of protection for refugees. However, the problem is that Indonesia has not ratified the 1951 convention and the 1967 protocol on refugees, so that Indonesia cannot directly determine the status of the foreign arrivals, but the UN agency UNHCR. Meanwhile, Indonesia, especially North Sumatra, is a transit point for foreign refugees to save themselves. Humanely, the Indonesian government cannot refuse or forcibly repatriate the refugees. Therefore, based on the Regulation of the Republic of Indonesia No. 125 of 2016 concerning the Handling of Overseas Refugees, policies have been formulated in handling refugees which include finding, sheltering, securing and monitoring immigration so that the management of the handling of refugees reflects a positive dimension of human security, namely paying attention to the safety of individual refugees. and at the same time provide protection to Indonesian citizens. The research method used is descriptive qualitative. The results of the study indicate that the management of the handling of refugees in North Sumatra has been carried out in a coordinated manner according to existing regulations.

Abstract

Anak-anak imigran sering mengalami hambatan dalam memperoleh hak-hak mereka, khususnya dalam sistem hukum dan keadilan. Tantangan ini mencakup minimnya pemahaman terhadap hukum negara tujuan, akses terbatas terhadap layanan hukum, serta kurangnya dukungan dalam penyelesaian masalah hukum. Faktor-faktor seperti perbedaan budaya, bahasa, dan akses terhadap informasi turut mempersulit anak-anak imigran mendapatkan bantuan hukum yang layak. Selain itu, perbedaan pendekatan, kebijakan, atau prioritas di antara mitra bisa menghalangi kolaborasi yang efektif dalam menyelesaikan tantangan advokasi hukum bagi anak-anak imigran. Kegiatan ini juga bertujuan memberikan akses yang lebih baik pada informasi hukum bagi anak-anak imigran dengan panduan dan sumber daya yang sesuai. Kegiatan pengabdian ini menggunakan berbagai metode seperti penyuluhan, kampanye pendidikan publik, dan pelatihan hukum untuk meningkatkan kesadaran akan hak anak imigran. Diskusi panel dan penggalangan dana membantu memperluas pemahaman masyarakat dan mendapatkan dukungan lebih luas dalam advokasi hak anak imigran. Tantangan utama bagi anak-anak imigran terletak pada akses terhadap perlindungan hukum yang setara, mencakup kesulitan dalam pengakuan identitas, penahanan yang tidak sah, dan akses terbatas terhadap pendidikan serta layanan kesehatan. Solusi untuk mengatasi tantangan ini melibatkan berbagai pendekatan, seperti penyuluhan, penggunaan teknologi informasi, pengembangan materi edukasi yang disesuaikan, serta kampanye publik dan acara penggalangan dana untuk meningkatkan kesadaran masyarakat

Abstract

The juridical legitimacy of men's position as leaders who have authority in the interpretation of the verses of the Qur'an has implications for violence against women in the household. Biased interpretations of religious texts and legal regulations that do not clearly regulate the protection of women victims of violence are typical problems in acts of domestic violence. This research focuses on documentation studies based on text studies. This method is used to explore data, facts and theories that make a belief true. Normative legal studies are carried out by focusing on the study of text interpretation, statutory regulations and Islamic law to find comparisons. This article aims to review the interpretation of verses from the Koran which have been very masculine by using the concept of mubindah. Through this article, the concept of mubjadi will change the horizon of thinking towards unequal men and women to be balanced, so that violence and injustice against women can be prevented.

Abstract

Program pengabdian masyarakat desa binaan Universitas Muhammadiyah Sumatera Utara dengan judul Pendampingan dan Penyuluhan Hukum Masyarakat Desa Jaring Halus Untuk Mewujudkan Desa Sadar Hukum di lakukan di Balai Desa Jaring Halus Kecamatan secanggang Kabupaten Langkat Provinsi Sumatera Utara. Kegiatan ini melibatkan masyarakat nelayan dan pelaku usaha sebagai peserta dan para dosen Fakultas Hukum, Dosen Fakultas Teknik dan Dosen Fakultas Ilmu Sosial dan Ilmu Politik Universitas Muhammadiyah Sumatera Utara sebagai pemateri. Metode pelaksanaan dalam kegiatan ini dilakukan melalui ceramah, diskusi interaktif dan pendampingan konsultasi masyarakat terkait persoalan hukum, teknik dan sosial. Hasil dari kegiatan ini adalah meningkatkan pemahaman masyarakat tentang persoalan hukum usaha perikanan, pendaftaran merek, label halal, isbad nikah dan bidang teknologi perikanan. Masyarakat terdampingi dengan adanya kegiatan pengabdian ini.

Abstract

Kekerasan seksual adalah masalah umum di banyak negara, terutama Indonesia dan Thailand. Kekerasan terhadap anak terus meningkat. Kekerasan terhadap anak adalah masalah yang sangat penting di kedua negara tersebut. Tujuan dari penelitian komparatif ini adalah untuk melihat bagaimana undang-undang di Indonesia dan Thailand melindungi anak dari kekerasan seksual terhadap anak. Penelitian ini memberikan penekanan khusus pada undang-undang yang berlaku di kedua negara tersebut. Penelitian ini menggunakan metode yuridis normatif untuk memahami bagaimana kedua negara menangani banyak kasus kekerasan terhadap anak. Metode ini mempelajari standar hukum yang berkaitan dengan analisis kode hukum kekerasan seksual terhadap anak di Indonesia dan Thailand. Meskipun ada undang-undang seperti undang-undang nasional dan undang-undang perlindungan anak di Indonesia, masalah implementasi dan kesadaran publik yang rendah membuatnya tidak efektif. Hukum perlindungan anak Thailand lebih terperinci dengan bantuan program sosial dan lembaga khusus. Penelitian ini membandingkan hukum di kedua negara dan menemukan faktor internal dan eksternal yang berkontribusi pada kasus kekerasan seksual pada anak. Hasil dari penelitian menunjukkan bahwa, meskipun ada kesamaan dalam perlindungan hukum, dukungan sosial dan efisiensi berbeda. Indonesia dan Thailand berusaha meningkatkan perlindungan anak dari kekerasan seksual dengan membuat peraturan, penguatan hukum, dan pelaksanaan yang lebih baik. Thailand, berbeda dengan Indonesia, mengambil pendekatan yang lebih menyeluruh dengan kerangka hukum dan program sosial yang kuat; namun, mereka menghadapi kesulitan dalam menerapkannya, jadi kesadaran publik perlu ditingkatkan. Diharapkan penelitian ini akan memberikan informasi tentang upaya untuk meningkatkan regulasi dan perlindungan hukum.

Abstract

This study aims to determine the criminal act of verbal sexual harassment from the perspective of the community in the XII hamlet, gg. Mentimun 19, Percut Sei Tuan and students of the Muhammadiyah University of North Sumatra. This study uses an empirical legal method. This study also explains the laws governing the criminal act of verbal sexual harassment with the sanctions received by the perpetrators. In this study, data was obtained that the general public aged 40 years and over considered verbal sexual harassment not a serious matter that must be followed up by law in accordance with applicable laws, while students and people aged 20-30 years considered verbal harassment as a criminal act of harassment that must be followed up with legal sanctions in accordance with applicable laws. One of the factors causing cases of sexual violence is gender inequality in society. Women are often targeted because their position is not equal to men. Thus, gender equality is not only a basic right, but can be the key to changing the dynamics of sexual violence. For this reason, important steps are needed to realize gender equality and justice as an effort to prevent sexual violence.

Abstract

Indonesia has a substantial population of migrant labourers. There is a significant population of Indonesian migrant workers' children residing in this country without legal authorization, enduring challenging living conditions. Education serves as the fundamental basis for shaping a child's character. Nevertheless, it has been discovered that the offspring of Indonesian immigrants lacking crucial documentation continue to be deprived of school, so severely limiting their prospects of pursuing education abroad. In order to accomplish this objective, it is imperative to expedite the development of character education and cultivate a strong feeling of nationalism through the educational system. This initiative aims to deliver character values education to Indonesian migrant children residing in the Klang Lama area of Malaysia. Malaysia has the potential to actively contribute to enhancing the conditions and rights of children belonging to Indonesian migrant workers residing in Malaysia, while also providing support for their education. This study employs empirical juridical methodologies, specifically focusing on research of an empirical juridical nature. National Education serves the purpose of cultivating skills and moulding the character and culture of a respectable nation, with the aim of educating its citizens to become individuals who possess unwavering faith and devotion to God, exhibit noble traits, maintain good health, possess knowledge, demonstrate capability, creativity, independence, and ultimately become democratic and accountable members of society.

Abstract

Adoption is a legal institution that has long-term civil implications for the identity status, family relationships, and rights of children as legal subjects. Differences in adoption regulatory approaches between countries directly impact the level of legal certainty and the quality of child rights protection. This study aims to analyze the comparative legal construction of adoption regulations in Indonesia and Thailand in ensuring legal certainty, as well as to examine the implementation of the principle of the best interests of the child as an effort to protect children's rights. This study uses a qualitative method with a normative-comparative legal approach through an analysis of related laws and regulations, doctrines with Indonesian regulatory laws, such as Law Number 35 of 2014 concerning Child Protection, Government Regulation Number 54 of 2007 concerning the Implementation of Child Adoption, the Compilation of Islamic Law (KHI), and Articles 1598/19–1598/37 of the Thai Criminal Code. The results of the study indicate that Indonesia has built an adoption system within an administrative social protection framework that does not fully guarantee substantive legal certainty, particularly regarding the civil status and inheritance rights of adopted children. In contrast, Thailand has developed a legal assimilation-based adoption model that fully integrates adopted children into the family legal structure, thus providing more comprehensive and long-term legal certainty and protection of children's rights. The application of the child's best interests principle in Thailand has been institutionalized as a substantive legal standard, while in Indonesia it remains declarative-administrative. This study recommends the need for reformulation of legal policies on child adoption in Indonesia to strengthen substantive protection and ensure long-term legal certainty for adopted children.

Abstract

Interfaith marriage is a social phenomenon that continues to grow in multicultural societies, but still raises legal debates regarding legal certainty and freedom of religion. This article aims to analyze the implementation of legal norms regarding interfaith marriage in social and institutional practices in Indonesia and Thailand, as well as to assess the extent to which legal regulations in both countries reflect a balance between legal certainty and freedom of religion. This study uses a normative legal research method with a regulatory, conceptual, and comparative approach. Data was obtained through a literature study of primary, secondary, and tertiary legal materials, which were then analyzed qualitatively. The results of the study show that in Indonesia, interfaith marriages face significant legal obstacles because the marriage law system still uses religion as the basis for the validity of marriage, as stipulated in Law Number 1 of 1974. This condition creates legal uncertainty and encourages couples to pursue alternative strategies, such as applying for a court ruling or getting married abroad. In contrast, Thailand implements a more secular and administrative marriage law system, where the validity of marriage is determined through civil registration without requiring religious similarity, although in Muslim communities the role of the Islamic Religious Council remains influential socially and religiously. This study concludes that the regulation of interfaith marriage in Thailand is relatively more capable of balancing legal certainty and religious freedom compared to Indonesia. Therefore, it is necessary to reformulate marriage law policies in Indonesia to be more adaptive and inclusive in order to respond to the social reality of a pluralistic society without neglecting constitutional and social values.
