Abstract

Konflik siber modern menghadirkan tantangan serius bagi penerapan Hukum Humaniter Internasional (HHI), terutama dalam melindungi masyarakat sipil dan infrastruktur kritis dari serangan digital. Artikel ini membahas bagaimana prinsip-prinsip HHI, seperti prinsip pembedaan, proporsionalitas, dan kehati-hatian, diuji dalam konteks dunia maya yang berkembang cepat. Dengan menganalisis berbagai studi kasus serangan terhadap infrastruktur penting, penelitian ini menyoroti kesenjangan regulasi yang ada serta kompleksitas dalam menetapkan batasan hukum di ranah siber. Penelitian ini juga menekankan pentingnya pengembangan standar hukum baru yang adaptif untuk memastikan perlindungan efektif terhadap individu dan fasilitas vital di era digital. Hasil kajian ini diharapkan dapat memberikan kontribusi dalam upaya internasional merumuskan norma dan instrumen hukum yang lebih responsif terhadap karakteristik unik konflik siber.

Abstract

Humanitarian law education for military members is a fundamental pillar in efforts to build the professionalism of soldiers while preventing human rights violations during armed conflict. This study analyzes the urgency and effectiveness of humanitarian law education in the military environment, highlighting educational approaches, implementation challenges, and real impacts on the field. Departing from the assumption that a lack of understanding of humanitarian law is one of the root causes of violations that occur in war, this study presents a critical examination of training programs in several countries that have successfully implemented them systematically, such as Switzerland, Norway, and Colombia. Using a qualitative approach and literature study methods, this article constructs the argument that humanitarian law education not only instills legal norms, but also shapes the moral integrity and combat ethics of a soldier. The results of the study show that a structured, realistic, and contextual humanitarian law education program is able to significantly reduce the potential for violations. In Indonesia, humanitarian law education still faces structural and cultural challenges, such as a lack of integration in the basic military curriculum and a limited number of competent instructors. Therefore, this article recommends a comprehensive reform of the military curriculum, teacher capacity building, and strengthening post-training evaluations. Overall, this article emphasizes that humanitarian law education is an indispensable prerequisite for creating a professional, humanistic, and international standard military force. Through the formation of a strong understanding of the law since basic education, it is hoped that soldiers will be able to balance the success of combat missions with adherence to universal humanitarian values.

Abstract

Konflik bersenjata yang terus terjadi di berbagai belahan dunia menegaskan pentingnya penerapan hukum humaniter internasional guna melindungi martabat manusia, khususnya warga sipil dan pihak-pihak yang tidak turut serta dalam pertempuran. Dalam konteks tersebut, personel militer memegang peran sentral dalam memastikan norma-norma kemanusiaan dijunjung tinggi di medan tempur. Sayangnya, pelanggaran terhadap prinsip-prinsip hukum humaniter masih kerap ditemukan, baik karena kelalaian maupun kurangnya pemahaman akan etika hukum perang. Hal ini menimbulkan kebutuhan mendesak akan pendidikan hukum humaniter yang komprehensif di lingkungan militer. Penelitian ini bertujuan untuk mengkaji urgensi pendidikan hukum humaniter bagi anggota militer serta menelaah efektivitas program pelatihan di beberapa negara yang telah berhasil menerapkannya. Studi ini menggunakan pendekatan kualitatif dengan metode studi pustaka (library research), yang didukung oleh analisis deskriptif terhadap dokumen resmi, laporan organisasi internasional, serta jurnal akademik yang relevan. Data dianalisis menggunakan teknik interpretatif-kritis untuk mengevaluasi korelasi antara pendidikan hukum humaniter dan penurunan tingkat pelanggaran di medan perang. Hasil penelitian menunjukkan bahwa negara-negara yang secara sistematis mengintegrasikan hukum humaniter ke dalam kurikulum pelatihan militer, seperti Swiss dan Jerman, mengalami penurunan signifikan dalam insiden pelanggaran perang oleh tentaranya. Pendidikan yang menekankan pada simulasi situasional, studi kasus, dan refleksi moral terbukti mampu membentuk kesadaran kemanusiaan yang lebih kuat pada diri prajurit. Temuan ini memperlihatkan bahwa pendidikan hukum humaniter tidak hanya membekali personel militer dengan pengetahuan normatif, tetapi juga mendorong internalisasi nilai etis dalam setiap tindakan operasional mereka. Kesimpulannya, pendidikan hukum humaniter merupakan elemen krusial dalam membentuk militer yang profesional dan humanis. Untuk itu, dibutuhkan penguatan program pelatihan yang adaptif terhadap dinamika konflik modern, termasuk penggunaan teknologi dan keterlibatan aktor non-negara, agar prinsip-prinsip kemanusiaan tetap tegak di tengah kekacauan perang.

Abstract

As the world's largest archipelagic country situated at the junction of three major tectonic plates and the Pacific Ring of Fire, Indonesia faces high natural disaster risks. This requires defense equipment that can be operated effectively by various TNI branches in disaster response operations. The research employs a quantitative approach with descriptive and causality methods. Data analysis utilized multiple linear regression with SPSS version 29. Validity and reliability testing of instruments, as well as classical assumption tests, were conducted to ensure the validity of research results. The findings show that: (1) Human resource qualifications at PT. PAL Indonesia positively influence TNI interoperability with a regression coefficient of 0.150 and significance value of 0.059 (significant at α=0.10); (2) Technology transfer has a positive influence with a regression coefficient of 0.262 and significance value of 0.007; (3) Stakeholder coordination has the most dominant influence with a regression coefficient of 0.488 and significance value of 0.000; (4) The three variables simultaneously have a significant influence on TNI interoperability with F=72.028 and R²=0.647, meaning 64.7% of the variation in TNI interoperability can be explained by these three variables. Descriptive analysis results indicate that work experience of PT. PAL Indonesia personnel has the highest value (4.21), while the number of experts has the lowest value (3.81). For the technology transfer variable, cooperation with foreign industries has the highest value (4.25), while production licensing has the lowest value (3.85). For stakeholder coordination, joint evaluation has the highest value (4.22), while routine communication has the lowest value (3.89). For the interoperability variable, equipment supporting joint operation capabilities has the highest value (4.05), while standardized data formats between branches has the lowest value (3.75).
