Abstract

The development of Artificial Intelligence (AI) raises legal issues in copyright protection, especially for scientific works produced without human involvement. Law Number 28 of 2014 concerning Copyright does not explicitly regulate the ownership status of the work. This study uses a normative legal method to examine the legal protection of scientific works produced by AI, by examining laws and regulations and principles of intellectual property rights. The results of the study are expected to provide input for the formulation of adaptive regulations and guarantee legal certainty in the era of technological development.

Abstract

This study aims to analyze the legal protection of consumers who are victims of fake doctors from the perspective of UUPK and its relation to malpractice. This research method is normative juridical with a statutory and conceptual approach. The results of the study indicate that patients who suffer losses due to the actions of fake doctors can claim compensation based on Article 19 of UUPK and file a civil or criminal lawsuit for alleged malpractice. In addition, fake doctors can be subject to criminal sanctions in accordance with Article 62 of UUPK and the Medical Practice Law. However, there are still obstacles in law enforcement, especially in the supervision of licensing of medical personnel in beauty clinics. Therefore, strengthening regulations and supervision is needed.

Abstract

This study aims to analyze the strategic role of Danantara in supporting economic reform through its participation in the Indonesian stock market. In the digital economy era, strengthening the capital market is a crucial component to accelerating inclusive and sustainable economic growth. Danantara, as an entity that integrates technology and finance, holds significant potential in accelerating the transformation of the economic structure by enhancing the investment ecosystem. The research methodology employs a qualitative-descriptive approach through literature review, participatory observation, and in-depth interviews with capital market industry players and Danantara’s management. The results indicate that Danantara acts as a bridge between retail investors and the small-to-medium business sector by providing a platform that expands access and transparency in stock trading. Moreover, Danantara contributes to economic reform by improving financial literacy and encouraging broader public participation in the capital market. This role directly strengthens national financial stability and promotes economic equity. However, challenges remain in the form of regulation, technological infrastructure, and cross-sectoral integration, which require further development. Thus, Danantara’s involvement in the stock exchange not only impacts market dynamics but also serves as a key element in a national economic reform agenda that is more modern and adaptive to technological advancements.

Abstract

Law Number 8 of 1999 concerns Consumer Protection in protecting and guaranteeing legal certainty for a business to carry out production with security, comfort, safety, good quality, and health. Maintaining health is essential for humans, especially during the COVID-19 pandemic and after the pandemic ends. The public consumes traditional medicine because of its effect, which can increase the body's immunity during the pandemic. Getting traditional medicine during the COVID-19 pandemic is very easy from online shops. This is what we used to do until the pandemic ended. The government the existence of Consumer Protection Law No. 8 of 1999 as a basis for protecting consumer safety rights and supervision of BPOM No. 8 of 2020, which monitors medicine and food distributed online. The discovery of traditional medicine preparations by BPOM Public Relations and BPOM's annual case report without a distribution permit online will violate consumer rights. The research method used is a normative juridical legal approach by examining statutory regulations, library materials, or secondary data as a basis for research accompanied by interviews related to the problems studied. The results of the research found that the provisions for the use of traditional medicines according to Law No. 8 of 1999 concerning consumer protection are linked to BPOM Regulation No. 8 of 2020 concerning the supervision of medicines and food distributed online in the current situation the COVID-19 pandemic is very necessary because in general it has been regulated in the UUPK by ensuring that the actions taken by BPOM in implementing the Law's policies are repressive and preventive. That is why the government issued a consumer protection law that benefits the population so that they have legal force against consumer losses committed by business actors. The responsibilities that consumers expect from business actors regarding UUPK No. 8 of 1999, namely being obliged to provide compensation to customers for damage, contamination, and use of products that consumers use.

Abstract

The regulation of the code of ethics for advocates, particularly regarding violations related to self-promotion through electronic media. The rapid development of information technology has opened up new opportunities for advocates to promote their legal services, but it often leads to ethical breaches within the legal profession. This research aims to analyze the ethical code provisions concerning advocates’ self-promotional behavior and its legal implications. The method used is normative juridical, with a statutory approach and analysis of decisions by the Honorary Council of the Indonesian Advocates Association (PERADI). The findings indicate that excessive self-promotion through electronic media can be classified as a violation of the code of ethics, as it contradicts the principles of dignity, honesty, and professional responsibility. Therefore, there is a need for strengthened supervision and updated ethical regulations to adapt to the growing use of digital communication technologies.

Abstract

The cosmetics industry, particularly skincare, in Indonesia is growing rapidly in line with advances in technology and digital media. Competition has led businesses to use aggressive advertising, but this is often misleading, as in the cases of Daviena Skincare and Dr. Richard Lee. These practices harm consumers and violate the principle of honesty. This study aims to analyze the criteria for misleading skincare advertisements based on Article 1365 of the Civil Code, BPOM Regulations No. 18/2024 and No. 32/2021, as well as the forms of legal protection for consumers. Using a normative juridical method, the results of this study show that advertisements that do not correspond to facts are classified as unlawful acts and violate BPOM regulations. Legal protection is provided preventively through regulations and distribution permits, as well as repressively through administrative, civil, and criminal sanctions. This study emphasizes the importance of synergy between the government, business actors, and consumers in creating ethical and lawful advertising.

Abstract

Various skincare products that do not have a distribution permit from the Food and Drug Supervisory Agency (BPOM), this study aims to analyze the role and effectiveness of the POM Agency in supervising and taking action against the circulation of skincare products and describing the legal protection situation for consumers. This study uses an approach that is an empirical juridical method, with primary data collection carried out through interviews with consumers and business actors. This study concludes that even though regulations related to Law No. 8 of 1999 have been enacted, there are still many obstacles and challenges in the field.

Abstract

A medical certificate (sick note) is a document often requested by patients as an administrative requirement for their absence from work or education due to illness. However, the request for this note is often misused, whether by patients, supervisors, or medical personnel. This article discusses how the request for a sick note is viewed from Indonesian civil law’s perspective, including when the note is requested with a backdated date or under pressure/intimidation. This study also compares regulations in Germany and Japan as a basis for system improvement. Through a juridical-normative approach and literature review, it is found that such actions can be classified as unlawful acts that have implications for the civil liability of various parties. This article recommends the establishment of specific regulations to regulate the issuance of sick notes within the framework of civil legal protection and medical professional ethics.

Abstract

This research examines the legal uncertainty issues in share transfer of shareholders with afwezigheid status (absent and whereabouts unknown) which requires special management by the Heritage Property Office (Balai Harta Peninggalan/BHP) as the representative custodian of assets. Through normative juridical methods with statutory and case approaches, this research analyzes the share transfer case of PT. Asri Pembangunan Catur Karya Cipta and concludes that the transfer of afwezigheid shares by BHP is legally valid despite not being directly conducted by the rightful owner (eignaar), as BHP acts as custodian (bezit) representing the afwezigheid shareholder with obligations to obtain court permission and comply with Limited Liability Company Law procedures to avoid formal defects. Legal protection is available for afwezigheid shareholders or their heirs through the right to file lawsuits if they feel BHP's actions violate their rights and obligations, however the research recommends the need for regulatory updates given the limited regulations concerning afwezigheid to provide better legal certainty and protection.

Abstract

This study analyzes consumer protection for business actors who do not record lottery minutes with authentic deeds. Using normative methods, this study examines the legal obligations of recording and liability of business actors. The results show that non-compliance with these obligations has the potential to result in legal sanctions and losses for consumers. Therefore, it is necessary to strengthen regulations to ensure transparency and accountability in organizing lottery prizes, in order to effectively protect consumer rights.
