Abstract

Freedom of religion constitutes a non-derogable human right guaranteed under the 1945 Constitution of the Republic of Indonesia and international human rights instruments. Nevertheless, within the practice of regional autonomy, various local regulations and executive regional policies continue to impose restrictions upon the exercise of religious freedom through discriminatory and disproportionate norms. This study aims to analyze the role of judicial review as an instrument for the protection of human rights against local regulations that potentially restrict freedom of religion in Indonesia. The research employs a normative juridical method through statutory and conceptual approaches by examining constitutional provisions, legislation, judicial decisions, and relevant academic literature. The findings demonstrate that judicial review has not been fully effective in providing substantive protection for freedom of religion, as judicial assessment remains predominantly oriented toward formal legality review. Furthermore, the application of the principles of proportionality, legitimate limitation, and nondiscrimination within judicial reasoning has not been implemented consistently. This study proposes a human rights–based model of judicial review integrating both formal and substantive examination simultaneously in order to strengthen the constitutional protection of freedom of religion in Indonesia.

Abstract

This study examines the integration of restorative justice under Law Number 1 of 2023 on the Criminal Code, as amended by Law Number 1 of 2026 and Law Number 20 of 2025 on Criminal Procedure. Using normative legal research, it analyzes sentencing purposes, sentencing guidelines, eligibility, procedural stages, exclusions and judicial oversight. The Criminal Code provides the substantive foundation, while the Criminal Procedure Code establishes an integrated mechanism from investigation to trial. Opportunities include victim restoration, legal certainty and reduced imprisonment. Challenges concern harmonizing sectoral rules, law-enforcement capacity, unequal bargaining positions and consistent judicial supervision.

Abstract

The capital market requires institutional integrity, information disclosure and legal certainty to enable investors to make rational investment decisions. Alleged bribery-indicated gratification in the Initial Public Offering (IPO) process involving five Indonesia Stock Exchange employees reveals legal risks in the assessment and listing of prospective issuers. This study examines two issues. First, the regulation of the IPO process for companies seeking to list shares on the Indonesia Stock Exchange. Second, the legal protection mechanisms for investors who may suffer losses due to violations in the IPO process. This study applies normative juridical research with statutory, conceptual and case approaches. The findings show that the Indonesian IPO legal framework regulates registration statements, prospectuses, share listing and capital market supervision. However, the case involving five IDX employees shows that investor protection cannot rely only on disclosure documents. Protection must cover the integrity of exchange personnel, internal supervision, audit trails of decisions, conflict-of-interest prohibitions, whistleblowing systems and administrative, civil and criminal enforcement. OJK and IDX must strengthen integrity-based supervision to keep the IPO process objective and maintain public confidence in the capital market.

Abstract

In recent years Cybercrime, including social engineering techniques, has become a serious threat in the digital era, requiring comprehensive handling. This discussion outlines the basic concepts of cybercrime, social engineering techniques, and the urgency from legal, regulatory, technological, and public awareness perspectives. Regulations such as Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) are deemed insufficient to address the evolving complexity of cybercrime. Challenges in law enforcement, such as the transnational nature of crimes and limited resources, necessitate stronger regulations and enhanced capacity of law enforcement agencies. On the other hand, the development of advanced cybersecurity technologies, user education, and increased public awareness are crucial steps to prevent cyberattacks. Collaboration between government, private sector, and society is considered key to creating a secure digital environment. Recommendations include strengthening regulations, investing in security technologies, training IT professionals, and conducting public awareness campaigns. Through a holistic approach, it is hoped that the threat of cybercrime can be effectively minimized.

Abstract

Supervisory and Observing Judges (Wasmat) play an important role in ensuring that criminal sentence implementation runs fairly and respects human rights. However, the current manual supervision system is often ineffective, poorly coordinated and lacks accountability. Limited human resources and infrastructure also make it difficult to carry out transparent supervision. Therefore, digitalizing the supervision process is needed to make it more efficient and aligned with developments in legal technology. This study uses a normative juridical method by reviewing regulations such as the Criminal Procedure Code (KUHAP), the Correctional Law and Supreme Court Regulations, as well as related legal literature. The analysis was conducted qualitatively to find solutions for strengthening the supervision system through digital technology. The results show that digitalization is essential to improve the effectiveness and accountability of supervision. A digital system can make the process more measurable and transparent, although challenges remain in legal frameworks, technological infrastructure and officials’ digital literacy. Regulatory reforms, stronger information systems and enhanced digital skills are needed to ensure that supervision becomes more effective and fair.

Abstract

This study aims to determine the legal protection of Health and safety of employees of PT PLN ULTG Kudus in terms of employee rights, especially the right to protection of Occupational Safety and health. Legal protection of Occupational Safety and health of PT PLN ULTG Kudus employees is going well, especially through efforts such as the provision of personal protective equipment in the form of personal protective equipment, health insurance and labor. In addition, there are also consulting services, professional training and employee supervision supervision. Some of the obstacles identified include inconsistencies in the use of personal protective equipment by employees during work. Hospital facilities registered by the company are still limited. The company's efforts include periodic monitoring of work performance and sending requests to customer hospitals in the region.

Abstract

This study examines the legal implications arising from the absence of appropriate technical instruments in supervising the practice of diploma withholding by companies, a matter that has long been mistakenly framed as a "Standard Operating Procedure" (SOP) issue, whereas what is conceptually required is a set of Norms, Standards, Procedures, and Criteria (Norma, Standar, Prosedur, dan Kriteria/NSPK) as a legitimate legal instrument within Indonesia's hierarchy of legislation. Employing a normative juridical method that integrates statutory and conceptual approaches, this research analyzes labor regulations, human rights provisions, and institutional supervisory authority in Indonesia. The findings reveal that this terminological misconception produces layered legal implications, ranging from conceptual ambiguity to unclear institutional authority, ultimately weakening legal certainty and the protection of workers' normative rights. This study proposes an ideal regulatory model in the form of a Ministerial Regulation establishing NSPK, explicitly delineating tiered authority between the Ministry of Manpower and regional Manpower Offices to effectively prevent and address diploma-withholding practices.

Abstract

Force majeure, such as the 2018 Palu earthquake, triggers non-performing loans due to the loss of livelihoods, although payment obligations are not automatically extinguished. This research employs a socio-legal method with statutory and conceptual approaches, analyzed through the principle of the welfare state. The results indicate that the credit restructuring policy issued by the Financial Services Authority (OJK) provides legal protection that balances the interests of both creditors and debtors, while simultaneously reflecting the implementation of the welfare state principle in maintaining justice and legal certainty.

Abstract

This research analyzes the effectiveness of litigation legal aid funding in Indonesia in ensuring equal access to justice, particularly for the poor and vulnerable. Findings show that real needs on the ground exceed the legal aid funding provided by the state. The gap between funding and actual legal aid costs may affect the quality of assistance delivered. In line with international human rights standards, this study emphasizes the urgency of reforming the funding scheme to be more adaptive and needs-based, ensuring that legal aid is delivered effectively, professionally, and equitably.

Abstract

The Indonesian government's policy of nickel downstreaming aims to increase the added value of mineral commodities, particularly nickel, which is one of the strategic natural resources in Indonesia. As part of this effort, Indonesia imposed a ban on the export of nickel ore with a content below 1.7% starting from January 1, 2020, in order to encourage the development of smelters and enhance domestic industry capacity. This policy has contributed to an increase in the export of higher value-added nickel products, which significantly contributes to the national economy. However, the policy has led to a dispute with the European Union (EU), which filed a complaint at the World Trade Organization (WTO), arguing that the policy violated international trade rules under the General Agreement on Tariffs and Trade (GATT) 1994. The dispute process went through consultation, panel formation, and hearings, with the panel ultimately ruling that Indonesia was in violation of the GATT 1994 provisions. Indonesia filed an appeal, but the process has been delayed due to the lack of a functioning Appellate Body, which has yet to be established due to the United States' objections. This dispute illustrates the dynamics of international trade policy, testing whether Indonesia’s downstreaming policy can withstand international legal pressures and its impact on the domestic economy. This study aims to analyze the implications of Indonesia’s nickel downstreaming policy within the context of the WTO dispute and evaluate the challenges and opportunities faced by Indonesia in achieving national industrialization through mining downstreaming.
