Abstract

This study examines the urgent need to reformulate compensation rights for corporations acquitted (vrijspraak) in environmental criminal cases in Indonesia. Despite being proven not guilty under Law No. 32/2009, corporations still suffer massive and long-term reputational, financial, and operational losses due to protracted proceedings, public stigmatization, and irreversible damage to business opportunities—violating the presumption of innocence and legal certainty. Existing compensation mechanisms remain individual-centric and fail to address systemic corporate harm. The research proposes specific amendments to the Criminal Procedure Code (KUHAP) and related Government Regulations to provide material compensation (lost profits, stock depreciation, business opportunities) and immaterial compensation (official rehabilitation of good name through court announcements and national media), plus state liability for misuse of process, thereby achieving balanced, civilized, and constitutionally mandated justice.

Abstract

The constitutional court in Indonesia, namely the Constitutional Court of the Republic of Indonesia, does not yet have the authority to handle cases with the object of constitutional complaint, but in practice there are many applications that are actually constitutional complaint cases packaged in judicial review applications. Judicial Review in the field of the Constitution, is a review and/or test by a state power body to be able to cancel the decision of the law-making body (legislation) and/or the government body (executive). Judicial Review in this field in Indonesia is the competence of the Constitutional Court. With no authority owned by the Constitutional Court, which then became the reason for not accepting the application, of course it was felt that there was a need for an expansion of authority. So that the protection of the constitutional rights of citizens for violations committed by state administrators is true. This is in line with the Constitutional Court as the guardian of the constitution. In this study, the author uses a normative juridical research method. Normative legal research views that the study of legal norms, legal principles, legal systematics, and comparative law, is a mandatory part to be studied in relation to the authority of the constitutional court in judicial review.

Abstract

Legal discovery (rechtsvinding) is a fundamental element in the modern legal system, particularly in the context of legal developments in Indonesia, which continue to move in line with social and technological dynamics. Judges not only carry out the function of implementing laws, but also act as interpreters and developers of law when written regulations are inadequate. This article comprehensively discusses the concept of legal discovery, the factors underlying it, the methods of interpretation and construction used by judges and the role of legal discovery in bridging the gap between das sollen and das sein. The discussion is also accompanied by an analysis of court decisions and supporting scientific literature. The research method used is a normative juridical approach by examining primary legal sources such as statutory regulations. Normatively, this study confirms that judges in Indonesia not only play the role of "mouthpiece of the law" (la bouche de la loi) but also as inventors and shapers of law (judge made law) within certain limits. This is in line with the provisions in the Judicial Power Law which requires judges to explore, follow and understand the legal values and sense of justice that exist in society. Legal discovery (rechtsvinding) is an inseparable element of judicial practice in Indonesia, especially in dealing with legal vacuums, unclear norms and the dynamics of societal developments that are not always followed by the formation of laws and regulations. and jurisprudence, as well as secondary legal sources in the form of literature and legal scientific works.

Abstract

Telesurgery in Indonesia represents a tangible manifestation of the Fourth Industrial Revolution in the health sector, expanding access to surgical services while simultaneously introducing legal challenges that require urgent regulatory attention. This study aims to examine the implications of telesurgery and develop a legal framework capable of ensuring legal certainty, patient safety and professional accountability. Despite its advantages such as improved efficiency, surgical precision and equitable access to specialist care telesurgery also presents significant risks, including cybersecurity threats, unclear liability structures, the absence of standardized digital informed consent procedures and the potential leakage of sensitive medical data. To address these issues, this research employs a normative legal method using statutory, conceptual and comparative approaches, analyzing relevant legislation such as the Health Act, Medical Practice Act, Electronic Information and Transactions Act and Personal Data Protection Act, along with academic literature and international practices. The findings reveal that the current Indonesian legal framework does not specifically regulate the technical and procedural aspects of telesurgery, resulting in a normative gap. Therefore, this study recommends the establishment of a Government Regulation as a lex specialis governing operational standards, network security, medical personnel certification and data governance, supplemented by a Ministerial Regulation to ensure patient protection and legal certainty in telesurgery practices in Indonesia.

Abstract

This paper analyzes the gap between legal idealism and reality in Indonesian criminal law enforcement, which often favors retributive practices over substantive justice. Using a normative juridical approach, the study highlights the strategic shift toward restorative justice as reflected in Law No. 1 of 2023. However, fundamental obstacles regarding substance, structure, and culture persist. Consequently, legal reform must focus on harmonizing regulations and transforming law enforcers' mindsets to establish criminal law as an ultimum remedium, thereby ensuring responsive social justice.

Abstract

This study explores the Mangalehen Tuhor tradition within the Mandailing indigenous community in Siginduang Village, Sosa Julu, Padang Lawas, as a customary dowry practice in traditional marriage. The tradition reflects the Mandailing people’s social and moral values rooted in the Dalihan Na Tolu philosophy. However, its implementation often creates gender inequality, especially when women must return twice the dowry upon marriage annulment. This situation illustrates unequal roles between men and women in the customary system. The study emphasizes the need to reinterpret customary law to promote justice, equality, and women’s dignity.

Abstract

The development of e-commerce creates consumer protection challenges, particularly from misleading advertisements and illegal products, exemplified by the Marvis toothpaste case lacking a BPOM distribution permit. This study analyzes the implementation gap of the Consumer Protection Law (UUPK) and Health Law in the digital era. The findings show that the circulation of illegal products violates consumer rights (UUPK Art 4) and is subject to severe criminal sanctions (Health Law Art 435). The strategy requires strengthening collective responsibility for businesses (guaranteeing quality and compensation) and influencers (mandatory due diligence and permit verification). Synergistic enforcement (BPOM, Komdigi) and progressive sanctions (including content takedown) are necessary to ensure digital market safety.

Abstract

This study is a normative legal study supplemented by data and interviews, where the data shows that victims of drug abuse have been subjected to legal proceedings and sentenced to prison by court decisions. This approach of imposing punishment has proven ineffective in reducing drug abuse and has instead led to an increase in the number of repeat drug offenders in society. Therefore, penal mediation by law enforcement officials using a restorative justice approach is needed to achieve recovery and healing from drug addiction. This will protect victims of drug abuse and, more importantly, be accepted back their families and into society.

Abstract

Article 33 of the 1945 Constitution serves as the constitutional foundation for natural resource governance aimed at the greatest prosperity of the people. In practice, its implementation through sectoral regulations remains fragmented, marked by weak supervision and the dominance of economic interests over social justice and environmental sustainability. The analysis reveals a significant gap between constitutional mandates and actual governance practices. Therefore, legal reform emphasizing regulatory integration, strengthened governance and ecological justice principles is essential to achieve equitable and sustainable natural resource management.

Abstract

This study analyzes criminal legal protection for adolescents as victims of cybercrime in Indonesia and formulates an ideal protection concept based on victimology and the best interest of the child principle. Using a normative juridical method with statutory and conceptual approaches, the findings show that Indonesian regulation remains fragmentary and repressive toward offenders, failing to comprehensively protect adolescent victims. The proposed ideal concept integrates repressive, preventive, and restorative protection within a layered model involving family, school, state, and society. The research affirms the urgency of reconstructing criminal law that is responsive and just for adolescents in the digital era.
