Abstract

Fanaticism towards high football in Indonesia has essentially been embedded in people's lives. The adverse impact of the phenomenon on his travels has evolved into hooliganism. The purpose of this article is to find out the responsibility of the parties to the tragedy of the match at the Kanjuruhan Stadium in Indonesia. The research methods used are Normative Juridical and Socio Phenomena to reveal cases that do not yet have permanent legal force (In Kracht) so that they are classified into a phenomenon, the approaches used are Statue Approach and the case approach. The results of the study revealed first, the organizing committee violated the provisions of Article 19 letter b of the FIFA Legal Handbook which states "firearms or mass control gas must not be carried or used and Article 21 letter c the organizing committee is required to ensure that no door or gate is locked under any circumstances. Second, the Executive Committee of the Police element is indicated to have violated the Regulation of the Chief of Police of the Republic of Indonesia Number 1 of 2009 concerning the Use of Force in Police Actions which regulates the stages that must be carried out when wanting to use force. Third, the Indonesian Football Association (PSSI) is assumed to be responsible in accordance with 50 paragraphs (1) of Law Number 11 of 2022 concerning Sports.

Abstract

The Implementation of functions and journalistic works in Indonesia is not only carried out by the press as a legal entity, but also by so many student press organizations in Indonesia. The student press is one of the platforms for carrying out the functions of the press, which is often referred to as the fourth pillar of democracy. Unfortunately, the position of the student press in Indonesia is in a dilemma. First, there is no recognition in Law No. 40 of 1999 concerning the press, which makes it impossible to reach legal protection. Second, even though the recognition and provisions for journalistic activities are recognized as human rights and academic freedom, these provisions are not really able to guarantee their protection. Third, the dynamics of the problems faced by the student press are no doubt different from those with legal entities, such as threats of criminalization and attempts to ban them. This situation raises the urgency to revise the statutory provisions on the press or make a new regulation that specifically regulates the recognition and protection of the student press.

Abstract

The right to decent work is a fundamental human right that applies to everyone without exception, including children. This is clearly stated in several Indonesian laws, such as Law No. 39 of 1999 concerning Human Rights, Law No. 13 of 2003 concerning Manpower, and Law No. 23 of 2002 in conjunction with Law No. 35 of 2014 concerning Children. Although many legal provisions aim to protect children from exploitation in the workplace, the situation still needs improvement due to a lack of effective implementation. The labour inspectorate is responsible for enforcing these laws, but the number of inspectors is limited, and their authority often needs to be fully implemented. As a result, many children are still working in dangerous or exploitative conditions, which is unacceptable. Therefore, it is crucial to strengthen the labour inspectorate's role by increasing the number of implementing personnel and improving their authority's effectiveness to ensure child labours’ protection.

Abstract

Masa pemerintahan pada Perdana Menteri Prayuth Chan-ocha dirasa banyak pihak membuat kekuatan militer mendominasi Thailand. Publik merasa kebebasan sipil semakin tergerus dengan adanya ketentuan Lese Majeste yang mengatur mengenai tindak pidana untuk melindungi raja, ratu, pewaris dan orang yang diberikan kekuasaan terkait berpotensi disalahgunakan dan dapat mengkriminalisasi suara kritis. Ketidakjelasan batasan mengenai pencemaran nama baik dan penghinaan yang ditujukan kepada pihak kerajaan dan penguasa dianggap kerap kali disalahgunakan. Selain itu juga situasi tergerusnya ruang sipil juga terlihat dengan pembubaran partai politik Future Forward Party sebagai partai oposisi yang banyak dicurigai terjadi kesewenang – wenangan dalam prosesnya. Situasi tersebut memunculkan gerakan resistensi dari kelompok pro demokrasi yang banyak datang dari kalangan muda. Gerakan resistensi tersebut merupakan hak asasi manusia (HAM) yang dijamin dalam berbagai instrumen HAM internasional serta konstitusi hingga ketentuan hukum nasional Thailand. Oleh karena itu negara harus mengupayakan hal terbaik untuk memastikan dijaminnya HAM dan harus menegakan hukum bagi para pelaku walaupun datang dari pemerintahan berkuasa.

Abstract

Historically, Ukraine's conflict with Russia dates back to 1991 when the Soviet Union collapsed and its member states seceded. In 2021, Ukraine joined NATO. Russia then felt its national security had been threatened. Russian military operations were then interpreted by Ukraine and several countries in the world as a genocide convention. The International Court of Justice then issued the International Court of Justice Preliminary in Ukraine v Russia (2022). The purpose of the research is to comprehensively and deeply examine the legal force of the jurisdiction of the International Court of Justice based on the International of Justice Preliminary decision in Ukraine v Russia (2022). The research method used is a literature study based on reliable sources as a reference for research, such as accredited scientific research journals, research articles with relevant topics, and international law regulations. The result of the research is that the International Court of Justice Preliminary Decision in Ukraine V Russia (2022) has legal force that must be obeyed by the parties involved in the dispute.

Abstract

Every Indonesian citizen has the right to get a decent job, as mandated in Article 27 of the 1945 Constitution. The right to get a job belongs to every Indonesian citizen, including citizens with disabilities. However, discrimination and difficulties often occur in accessing the supporting facilities needed by workers with disabilities. This research aims to socialize the quality of implementation of law enforcement towards fulfilling the rights of workers with disabilities regarding access and supporting facilities in the workplace, and how the optimization of the law can improve the fulfillment of the rights of workers with disabilities regarding access and supporting facilities in the workplace, especially in Indramayu Regency area. This research uses a normative method complemented by interviews with a statutory and conceptual approach and uses descriptive and qualitative analysis techniques. The results of the research show that: First, the Indramayu Regency Government has not met the 2% requirement for employing people with disabilities in the government sector by Law Number 8 of 2016 concerning People with Disabilities. Second, based on literature studies and comparisons of regional regulations in the last 3 years, there have been many regulations that specifically regulate the empowerment and protection of people with disabilities to get decent work, so it would be best for the Indramayu Regency Government to immediately prepare and ratify related Regional Regulations regarding the empowerment and protection of people with disabilities.

Abstract

Penelitian ini mencoba untuk membedah problematika yuridis pelaksanaan pemberian layanan hukum secara pro bono oleh Advokat di Indonesia. Sebagaimana telah diketahui bahwa eksistensi pro bono oleh Advokat diakui dan diatur pada Undang – Undang No. 18 Tahun 2003 Tentang Advokat, lalu pelaksanaan teknisnya diatur pada Peraturan Pemerintah No. 83 Tahun 2008 Tentang Persyaratan dan Tata Cara Pemberian Bantuan Secara Cuma – Cuma. Selain itu juga ketentuan tersebut diatur lebih spesifik melalui Peraturan Perhimpunan Advokat Indonesia Nomor 1 Tahun 2010 Tentang Petunjuk Pelaksanaan Pemberian Bantuan Hukum Secara Cuma – Cuma. Kendati demikian terdapat permasalahan pada regulasi mengenai pelaksanaan mekanisme pemberian layanan hukum secara pro bono. Pertama, praktik pro bono pada ketentuan tersebut hanya membatasi bahwa batasan pencari keadilan terbebas dari pembayaran honorarium adalah “hanya sebatas” pemberian layanan hukum saja sehingga terbuka potensi adanya biaya di luar hal tersebut seperti uang transportasi atau uang untuk makan. Kedua, mengenai cakupannya yang belum menyentuh pelaksanaan advokasi kebijakan seperti melakukan judicial review di MK. Ketiga, penerapan sanksi bagi Advokat yang melakukan pelanggaran terkait praktik pro bono. Keempat, terkait implementasi pemberian sanksi bagi Advokat yang tidak melakukan pelaporan.

Abstract

Pergeseran perilaku manusia yang banyak bertransformasi dari analog ke digital banyak mempengaruhi berbagai elemen kehidupan baik pada bidang bisnis, hiburan hingga berjalannya roda pemerintahan. Digitalisasi pada pemerintahan ini tentunya memiliki sebuah kesempatan khususnya untuk mengurangi berbagai maladministrasi, tindak pidana korupsi dan berbagai bentuk kesewenang – wenangan. Kendati demikian terdapat berbagai tantangan dan potensi permasalahan akibat dari digitalisasi ini yaitu terkait perlindungan atas privasi dan data pribadi. Terdapat beberapa kasus terjadi terkait pelanggaran hak atas privasi dan perlindungan data pribadi seperti pencurian data, jual beli data secara illegal, peretasan, serangan malware, hingga manipulasi psikologis melalui social engineering. Dalam sudut pandang hak asasi manusia, hak atas privasi dan perlindungan data pribadi adalah salah satu bentuk perwujudannya. Hal tersebut sebagaimana diatur dalam berbagai pandangan ahli, instrumen HAM internasional, dan instrumen HAM nasional. Posisi negara sebagai pemangku kewajiban (duty bearer) membuatnya harus melakukan berbagai upaya untuk memastikan penghormatan, perlindungan dan pemenuhan hak setiap orang sebagai pemegang hak (rights holder) atas privasi dan perlindungan data pribadi. Oleh karenanya negara bertanggung jawab ketika terdapat pelanggaran baik itu ketika negara sebagai pelaku langsung atau ketika melakukan pembiaran.

Abstract

This research discusses the problems of vulnerable groups who often face various problems accessing justice. The stigma attached to them and various discriminatory treatments from the public and law enforcement officers are two forms of the problems they face. These factors contribute to negative perceptions and a growing reluctance among these groups to seek justice for their legal troubles. Based on the 2022 Legal Needs Survey report for Vulnerable Groups regarding the behavior patterns of vulnerable groups in resolving legal problems, it was found that vulnerable groups in resolving legal problems indicate that there is a problem. The form of problem portrayed is victim blaming, a perception that tends to be pessimistic when accessing justice, misunderstanding regarding informal mechanisms, and a perception that their efforts to resolve legal problems will not maket he situation getting better.

Abstract

Domestic workers are very vulnerable to various violations of labour rights, such as exploitation, low wages, unclear working hours, and uncertainty about work eligibility. This problem can be confirmed by data submitted by several institutions focusing on domestic workers' rights. According to the Indonesian Migrant Workers Union (SBMI), there are approximately 4 million domestic workers in the country, with 2.7 million facing labour rights violations and experiencing physical and sexual violence. Additionally, the National Domestic Workers Advocacy Network (Jala PRT) reported 2,148 cases of economic, physical, and psychological violence from 2015 to 2019. Komnas Perempuan recorded 2,344 cases of violence against domestic workers from 2005 to 2022, and received 29 direct complaints between 2017 and 2022, including reports of physical violence and unpaid salaries. Although the Republic of Indonesia Minister of Manpower Regulation No. 2 of 2015 addresses domestic worker protection, it lacks specific safeguards for their rights. Consequently, domestic workers are exceedingly vulnerable to various forms of discrimination and rights violations. Establishing legal protections at the statutory level is imperative to address these issues. Abstrak Pekerja rumah tangga sangat rentan terhadap berbagai pelanggaran hak-hak buruh, seperti eksploitasi, upah rendah, jam kerja yang tidak jelas, dan ketidakpastian kelayakan kerja. Permasalahan ini dapat dibuktikan melalui data yang disampaikan oleh beberapa lembaga yang fokus pada hak-hak pekerja rumah tangga. Menurut Serikat Pekerja Migran Indonesia (SBMI), terdapat sekitar 4 juta pekerja rumah tangga di negara ini, dengan 2,7 juta diantaranya menghadapi pelanggaran hak-hak buruh dan mengalami kekerasan fisik dan seksual. Selain itu, Jaringan Nasional Advokasi Pekerja Rumah Tangga (Jala PRT) melaporkan 2.148 kasus kekerasan ekonomi, fisik, dan psikis pada tahun 2015 hingga 2019. Komnas Perempuan mencatat 2.344 kasus kekerasan terhadap PRT pada tahun 2005 hingga 2022, dan menerima 29 pengaduan langsung pada tahun 2017. dan tahun 2022, termasuk laporan kekerasan fisik dan gaji yang belum dibayar. Meskipun Peraturan Menteri Ketenagakerjaan Republik Indonesia No. 2 Tahun 2015 mengatur tentang perlindungan pekerja rumah tangga, peraturan tersebut tidak memberikan perlindungan khusus terhadap hak-hak mereka. Akibatnya, pekerja rumah tangga sangat rentan terhadap berbagai bentuk diskriminasi dan pelanggaran hak asasi manusia. Membangun perlindungan hukum di tingkat undang-undang sangat penting untuk mengatasi permasalahan ini.
