This study examines legal protection for children acting as narcotics couriers in Indonesia, focusing on the application of the best interest of the child principle. Although Law No. 11/2012 on the Juvenile Criminal Justice System and Law No. 35/2014 on Child Protection prioritize diversion, rehabilitation and restorative justice over imprisonment, enforcement practice often applies prison sentences due to tension with the repressive provisions of Law No. 35/2009 on Narcotics. Children are frequently treated as perpetrators despite being exploited by adult networks. The proposed ideal protection model emphasizes preventive, protection-oriented repressive, rehabilitative approaches and cross-institutional collaboration to ensure optimal recovery and social reintegration of the child.

The practice of under-hand land sale and purchase using a receipt (kuitansi) as evidence remains common in Indonesian society, despite the normative requirement that the transfer of land rights must be conducted before a Land Deed Official (PPAT) pursuant to Government Regulation Number 24 of 1997 on Land Registration. This study employs a normative legal approach with a case study method, examining the validity of a receipt as proof of land sale and purchase and analyzing the judge's considerations in deciding the case based on Decision Number 217/Pdt.G/2022/PN.Pbr. The findings indicate that a land sale and purchase evidenced solely by a receipt may be declared legally valid provided it fulfills the requirements under Article 1320 of the Indonesian Civil Code and the principles of cash payment, publicity, and real transaction, as considered by the judge on the basis of the plaintiff's good faith.

This study examines civil liability for losses arising during the pre-contractual stage in Indonesian contract law. The pre-contractual stage is the initial phase preceding the formation of a contract, encompassing the processes of negotiation, offer, and exchange of information between the parties. Although it does not yet give rise to a legally binding relationship, interactions during this stage have the potential to cause losses if one of the parties fails to act in good faith. The resulting losses may include negotiation costs, lost business opportunities, or losses resulting from misleading information (reliance loss). This study employs a normative approach by examining provisions in the Civil Code and relevant legal doctrines. The findings indicate that civil liability during the pre-contractual stage can be grounded in the concept of tort as stipulated in Article 1365 of the Civil Code and supported by the doctrine of culpa in contrahendo. Thus, the law provides protection not only after the contract is formed but also from the negotiation stage onwards

The 1945 Constitution of the Republic of Indonesia establishes a state based on the rule of law, mandating strict legal certainty under Article 28D. However, the administration of the Regional Head Elections revealed a critical systemic vulnerability characterized by conflicting judicial interpretations regarding candidate eligibility between the Supreme Court and the Constitutional Court. This study aims to analyze the systemic legal uncertainty generated by Supreme Court Decision No. 23/P/HUM/2024, which retroactively altered the gubernatorial age benchmark to the time of inauguration and to comprehensively examine the remedial role of Constitutional Court Decision No. 70/PUU-XXII/2024. Employing a normative juridical research design, this study utilizes a statutory approach to analyze the hierarchy of electoral norms alongside a conceptual approach to dissect the jurisprudential coherence of both decisions against the doctrine of Lex Certa and Open Legal Policy. The research demonstrates that the Supreme Court's expansive interpretation created a severe "Validation Paradox," rendering candidacy eligibility conditional on variable administrative scheduling rather than fixed statutory criteria. By isolating temporal indeterminacy as a unique threat, this study distinguishes itself from general structural critiques, concluding that the Constitutional Court's restoration of the initial registration benchmark was a constitutional imperative to preserve the logical sequence of the democratic process.

Public nutritional fulfillment is a crucial aspect of improving health quality and human resource development. Article 131 of Law Number 17 of 2023 establishes the state’s responsibility in organizing nutritional fulfillment, including through free nutritious meal programs. This study employs a qualitative descriptiveanalytical approach to examine the implementation of this article in Gedong Tataan District through the Nutritional Fulfillment Service Unit. The results indicate that the program has increased public access to nutritious food but faces obstacles such as limited budgets, human resources, and inter-agency coordination. From the perspective of fiqh Siyasah Tanfidziyah, the program reflects the leader’s duty to ensure the welfare of the people (hifz al-nafs), while also highlighting the gap between legal norms (das sollen) and practical implementation (das sein), providing valuable lessons for the formulation of effective and sustainable nutrition policies.

ATV operation in Gianyar Regency frequently takes place on public roads. This study aims to analyze legal violations and the effectiveness of law enforcement. The method used is empirical research through observation and interviews. The results of the study indicate violations of Law No. 22 of 2009 on Road Traffic and Transportation, particularly regarding vehicle technical compliance, registration, and the use of vehicles on public roads, as well as Government Regulation No. 55 of 2012 on Vehicles concerning technical requirements and roadworthiness. Law enforcement is considered fairly effective, with periodic joint raids and the requirement for business operators to use dedicated lanes.

Confucianism is a legally recognized religion in Indonesia pursuant to Presidential Decree Number 6 of 2000 concerning the Revocation of Presidential Instruction Number 14 of 1967 on Religion, Beliefs, and Chinese Customs. This condition gives rise to legal issues when an individual who is administratively registered as a Muslim, but in fact commits riddah by reverting to Confucian teachings. The legal issues concern the validity of marriage and the authority of a marriage guardian (wali nikah) over a daughter from the perspective of Islamic law and Indonesian positive law. The findings indicate that, under Islamic law, riddah results in the dissolution of marriage and the loss of the father’s authority as a marriage guardian due to the failure to meet the requirement of being Muslim. However, under Indonesian positive law, the marriage remains legally valid insofar as there has been no final and binding court decision. This discrepancy reflects a lack of harmonization between Islamic legal norms and national law, which may lead to legal uncertainty in practice.

The development of Indonesia’s criminal justice system positions the Public Prosecutor as dominus litis, holding exclusive authority to control prosecution, including filing for dismissal (ontslag van alle rechtsvervolging) to achieve substantive justice. This study examines the legal impact and decision-making mechanism of the Public Prosecutor in assault cases, particularly in educational contexts. Drawing on theories of substantive justice, law enforcement, utility, and Pancasila principles along with the 1945 Constitution, the research concludes that dominus litis authority enables responsible dismissal of cases (as in Decision No. 104/Pid.Sus/2024/PN Adl), preventing over-criminalization of teachers, saving judicial resources, and realizing a humane and proportional restorative justice.

Education is a constitutional right of citizens guaranteed by the 1945 Constitution of the Republic of Indonesia, particularly Article 31 which affirms the state's obligation to provide a national education system. This provision is further elaborated in Law Number 20 of 2003 on the National Education System, which positions education as an integrated system in its implementation. Furthermore, the regulation of higher education is specifically governed by Law Number 12 of 2012 on Higher Education. However, in institutional practice, the administration of higher education in Indonesia demonstrates a dualistic management structure between general higher education institutions under the ministry responsible for education and religious higher education institutions under the ministry responsible for religious affairs. This condition raises juridical issues regarding the consistency of the national education system and its implications for the principle of constitutional justice in the fulfillment of the right to education. This study aims to analyze the regulation of the dualism in the management of higher education within the Indonesian legal system and to assess its implications for the principle of constitutional justice in the national education system. This research employs a normative legal research method using statutory and conceptual approaches. Legal materials were obtained through library research on legislation, books and relevant academic journals, which were then analyzed qualitatively using normative analysis. The results of this study indicate that the dualism in the management of higher education potentially leads to institutional fragmentation, regulatory disharmony and policy inconsistency in higher education governance, which may affect the integration of the national education system. Such conditions have implications for the consistency in the implementation of the principle of constitutional justice in the administration of higher education. Therefore, strengthening policy integration and harmonizing higher education regulations are necessary to ensure that the administration of education is more consistent, equitable and aligned with the constitutional mandate.

The enactment of Law Number 1 of 2023 concerning the Criminal Code (KUHP) has introduced a new legal paradigm by formally recognizing corporations as subjects of criminal liability. In order to enforce this substantive law, comprehensive formal legal frameworks are imperative to provide law enforcement agencies with clear guidelines and directives in prosecuting corporate entities. Furthermore, criminal offenses attributed to corporations are frequently characterized as whitecollar crimes, inherently involving highly trained individuals and seasoned professionals; this is particularly evident in capital market violations. The objective of this research is to examine the paradigms of corporate liability set forth in the 2023 Criminal Code, the 2025 Criminal Procedure Code and Law Number 4 of 2023 regarding the Development and Strengthening of the Financial Sector (UUP2SK). Employing a normative juridical research methodology, this study conducts a rigorous examination by utilizing statutory regulations, legal theories, principles and doctrines as its primary analytical framework. The findings of this study elucidate the distinct characteristics of corporate criminal liability, including the determination of who shall stand trial as the defendant in the event that a corporation is indicted for a criminal offense.
