Abstract

The transfer of land rights should ideally be carried out through a Sale and Purchase Deed (AJB) before a Land Deed Official (PPAT), however in practice it is often based solely on a Binding Sale and Purchase Agreement (PJB), giving rise to disputes. This normative juridical research examines the legal force of a court decision as the basis for registering the transfer of land rights without an AJB. The results of the study indicate that a court decision that has obtained permanent legal force can substitute an AJB as the basis for registration. A PJB holds the position of a binding preliminary agreement and serves as evidence of a sale and purchase legal relationship. This is reflected in the Lubuk Pakam District Court Decision No. 268/Pdt.G/2022/PN.Lbp, which ordered the Land Office to process the transfer of rights based on the PJB and evidence of land possession.

Abstract

This study aims to analyze the implementation of Article 9 Paragraph (3) of West Lampung Regent Regulation Number 30 of 2021 on Karang Taruna in Gedung Surian Village from the perspective of siyasah tanfidziyyah. The main issue identified is the low participation of youth and the inactivity of the Karang Taruna organization, despite the village government providing funds and supporting youth activities. This indicates that the policy has not been fully effective due to weak organizational leadership, limited communication and insufficient youth engagement. If these issues are not addressed, the potential of Karang Taruna as a platform for youth empowerment will be diminished, hindering the development of youth capacities and reducing the effectiveness of village government programs in fostering social and community participation. Supporting factors include budget availability and the commitment of the village government, while inhibiting factors include weak organizational leadership, limited communication and low youth participation.

Abstract

This research examines the tension between legal ideality and the empirical reality of implementing Restorative Justice for children who commit theft under aggravating circumstances (pencurian dengan pemberatan). Normatively, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA Law) and its derivative regulations establish Restorative Justice-based diversion as the primary approach to protect the best interests of the child and avoid stigmatization. In practice, however, the application of diversion for aggravated theft (Article 363 of the old Criminal Code or Article 477 of the new Criminal Code) is constrained by the "under seven years" imprisonment threat requirement stipulated in Article 7 paragraph (2) of the SPPA Law, despite the nature of the act often being similar to ordinary theft. This condition is exacerbated by regulatory disharmony and differing interpretations among law enforcement officers, leading to legal uncertainty and disparities in case handling. This research employs a normative legal method enriched by an empirical approach, analyzing primary legal materials (SPPA Law, Criminal Code and police, prosecutorial and Supreme Court regulations regarding Restorative Justice) and secondary legal materials (journals, scientific works and court decisions such as Bontang District Court Number 50/Pid.B/2009/PN.Btg and Semarang District Court Number 33/Pid.SusAnak/2018/PN.Smg), analyzed qualitatively. The findings demonstrate that: (1) the implementation of Restorative Justice/diversion for children in aggravated theft cases remains limited by the criminal threat provision, resulting in many children being formally processed through to sentencing despite the SPPA Law's philosophical priority on non-judicial settlement; and (2) an ideal holistic diversion model is required through the reformulation of Article 7 paragraph (2) of the SPPA Law—changing the phrase "under 7 years" to "maximum 7 years"—alongside the implementation of a graded diversion model based on objective parameters such as the value of loss and level of aggravation, as well as regulatory synchronization and inter-agency coordination through integrated technical guidelines and a unified database system.

Abstract

Domestic violence can also be experienced by husbands as victims, although it has received little social attention. This study aims to examine the forms of violence perpetrated by wives and their criminal accountability from a legal political perspective. The method used is normative legal research. The results show that Law Number 23 of 2004 is essentially gender-neutral, but in its implementation tends to place more emphasis on protecting women, thus the position of male victims has not been fully accommodated. Wives as perpetrators can still be held criminally accountable if they fulfill the elements of a crime. Therefore, more inclusive law enforcement guidelines and increased outreach are needed to ensure victim protection without gender discrimination.

Abstract

This study aims to analyze the implementation of hygiene and sanitation in the Free Nutritious Meal Program based on the Minister of Health Regulation Number 2 of 2023, as well as to examine its conformity with the perspective of Islamic law, particularly the concept of Siyasah Tanfidziyyah. This research is an empirical study employing a qualitative approach, conducted through field research methods, including interviews, observations and documentation, involving the management of the Nutritional Fulfillment Service Unit (SPPG) Sukarame 1 and the Bandar Lampung City Health Office. The findings indicate that the implementation of hygiene and sanitation has generally been carried out; however, several issues remain, such as the inconsistent use of personal protective equipment, limited supervision of hygiene standards and waste management practices that have not fully complied with applicable regulations. From the perspective of Islamic law, these conditions suggest that the principles of al-tanfidz, hifz al-nafs and maslahah have not been optimally realized in practice. Therefore, operational measures are required, including strengthening supervision and periodic evaluation, providing technical training on hygiene and sanitation for program managers and enhancing coordination between SPPG and the Health Office to ensure that policy implementation runs optimally and in accordance with the principles of Islamic law.

Abstract

The concepts of pleasure and pain are two fundamental categories in the Utilitarian Theory developed by Jeremy Bentham. This study examines the role of these two categories as benchmarks of usefulness in the context of achieving legal objectives, which include justice, certainty and legal utility. From a Normative Juridical perspective, this study shows that pleasure and pain are not merely subjective experiences, but rather objective indicators of the utility of law in social life. Law will be deemed successful if it achieves its objectives by maximizing pleasure and minimizing pain in social life. Bentham's utilitarianism has been criticized for potentially ignoring distributive justice and minority rights. The thoughts of John Stuart Mill and Robert Nozick's critique of Libertarianism represent corrective efforts that enrich the ethical framework of utilitarianism. Mill's emphasis on the quality of happiness and Nozick's affirmation of individual rights emphasize the moral limits that need to be considered in applying the principle of usefulness.

Abstract

A notary, as a public official, is authorized to draft authentic deeds, including the Preliminary Sale and Purchase Agreement (PPJB). However, problems arise when the object stipulated in the agreement is still encumbered by a mortgage (hak tanggungan) as bank credit collateral, as reflected in Supreme Court Decision Number 4541 K/Pdt/2024. This normative juridical study examines the application of the principle of prudence by notaries, their responsibilities under the Notary Profession Law (UUJN) and the legal consequences of such negligence. The findings indicate that notaries are obligated to carefully examine the legal status of the object prior to drafting a PPJB. Negligence in this regard may give rise to administrative, civil and ethical liability; therefore, the application of the principle of prudence is crucial to ensuring legal certainty and protection for all parties, particularly consumers.

Abstract

This empirical juridical research analyzes the effectiveness of the traditional sanctions Jambar and Tajuak in addressing digital defamation in Pasar Talo Village, Seluma Regency. Although national criminal law dominates the formal legal framework, the local community continues to maintain customary mechanisms for resolving disputes. The deliberation process led by traditional elders (tuha-tuha adat) at the customary hall prioritizes restoring social relationships, protecting the dignity of the injured party and achieving reconciliation. This mechanism is considered more responsive to community needs than formal litigation. Despite challenges posed by social media’s cross-regional and anonymous nature, customary values remain relevant as instruments for conflict resolution and maintaining social balance in the digital era.

Abstract

Addictive design occurs when consumers are treated as assets whose behavior can be monetized. Although this issue has begun to be regulated, particularly in the European Union, consumer protection law in Indonesia still focuses on prohibiting misleading information. This study aims to analyze whether this practice can be categorized as a violation of consumer rights under the Consumer Protection Law (UUPK). The results indicate that addictive design has the potential to cause non-material losses not covered by the UUPK and a broader understanding of the principle of good faith by business actors on platforms is needed, as well as recognition of consumer behavioral manipulation as a form of prohibited conduct to strengthen consumer protection.

Abstract

Islamic inheritance disputes often arise due to conflicting interests and ambiguity in the distribution of estate assets. A deed of settlement (van dading) serves as one legally recognized and binding dispute resolution mechanism, even carrying executorial force when ratified by a court. However, problems emerge when the deed of settlement fails to specify the distribution of inheritance rights clearly, particularly with respect to minor children. This normative legal research examines the legal standing, binding force and juridical analysis of deeds of settlement in Islamic inheritance disputes, concluding that precision in drafting such deeds is crucial to ensure legal certainty, justice and the protection of all heirs' rights.
