Abstract

Pawn or Rahn is possession of the borrower's property by the lender as collateral. The results of this study indicate that the implementation of gold pawning at the Munggur Sharia Pawnshop in Yogyakarta in its implementation there are things that are not appropriate, such as maintenance costs (ijarah) and administration costs that are not in accordance with the fatwa Number 25/DSN-MUI/III/2002 concerning Rahn, will but in accordance with fatwa No. 26/DSN-MUI/III/2002 concerning Gold Rahn. The implementation of gold pawning at the Munggur Syariah Pawnshop in Yogyakarta whole has been carried out properly in accordance with the two Fatwas.

Abstract

One problem that often occurs in buying and selling transactions like the transfer of land rights is land buying and selling transactions without certificates. Whereas a land certificate is valid and strong proof of land ownership. The research method used is descriptive analysis with a normative juridical approach. The results of the study show that there are still many people who buy and sell land that is not certified. This is due to a lack of understanding of the importance of land certificates even though this has risks and legal consequences, such as the absence of a transfer of land rights or the invalidity of the related transfer and the absence of guarantees for legal certainty and legal protection.

Abstract

The existence of mediation in settlement of civil cases in court is regulated by the Decision of the Supreme Court of the Republic of Indonesia Number 1 of 2016 concerning Mediation Procedures in Courts. Mediation as an Alternative Dispute Resolution (ADR) is considered a humane and fair way to resolve disputes through a win-win solution stage. However, mediation is currently considered ineffective because it is only a formality, causing a low success rate of mediation in civil cases within the Religious Courts. The results of this study indicate that the implementation of mediation in the religious court environment in West Sumatra is expected to run optimally and have high success.

Abstract

The contractual legal relationship between business actors and consumers is outlined in a form of a contract. A Standard Contract is a contract in which almost all of the clauses in it have been standardized by one of the parties so that the other party does not have the opportunity to negotiate, suggest or request changes to the clauses in the contract. Thus, consumers often have a weaker position and bargaining power than business actors, making the situation between the parties to the contract unbalanced. Therefore, the Consumers Protection Law allows things that can be regulated in a Standard Contract to protect the position of consumers.

Abstract

It is hoped that this simple lawsuit can accommodate the value of justice for all Indonesian people, bearing in mind that until now there are many civil cases in the District Court where the litigants are classified as financially disadvantaged. In the Verdict of Judgment Number: 26/Pdt.G.S/2020/PN.Mrb the Defendant submitted the argument that his child experienced psychological trauma in writing and verbally without any medical evidence, in evidentiary law it is known as the actori incumbit onus probadio principle, namely whoever argues must prove. The case is of course a contradiction where Plaintiff can prove the existence of a default, on the other hand, Defendant presented rebuttal arguments without being supported by evidence. The Defendant's argument was accommodated in the Decision which resulted in an unacceptable simple lawsuit (Niet Onvanjelijk Verlaard). The research method used is normative which means that the data used in this research uses secondary data. The results and conclusions of this study are the principle of Actori Incumbit Onus Probatio which means that whoever has a right or puts forward his argument must prove the existence of that right or argument as stipulated in Article 163 HIR. However, in the case as stated in Decision Number: 26/Pdt.G.S/2020/PN. Mrb, Defendant argued that his child had suffered psychological trauma due to Plaintiff's behavior but could not prove the existence of such psychological trauma from a medical perspective. On the other hand, the Plaintiff was able to prove his simple claim, but the examining judge accommodated the Defendant's argument so that he decided that the Plaintiff's simple claim could not be accepted (Niet Onvankelijk Verlaard) because the proof, in this case, was not simple.

Abstract

This research examines the effectiveness of the Land Bank in the legal protection of indigenous peoples over customary land in the Medan Belawan Sub-district. Using a qualitative approach and case study method, the research involved interviews and document analysis. Results show that the Land Bank is not involved in horizontal conflicts between indigenous peoples and companies, but focuses on vertical disputes between indigenous peoples and the government. Legal protection is provided by the National Land Agency (BPN) through land registration and recognition of customary land. The Land Bank manages no-man's land and acts as a conflict mediator to prevent misuse of Adat land.

Abstract

Eglash explained that restorative justice is a form of constructive, creative and self-determining action that provides support and opportunities for group participation. One form of criminal law reform in Indonesia is the structuring of criminal law from the perspective and realization of thoroughness to justify or resolve the situation after a case or criminal justice process, which is known as restorative justice. Challenges are needed to provide answers to the direction and objectives of RJ implementation as well as see whether the implementation of RJ in Indonesia has been effective, and the circumstances in which law enforcement officers can use RJ in the Indonesian judicial context. From a policy perspective, there has been no comprehensive statement describing the effectiveness and challenges of the Indonesian criminal justice system.

Abstract

Article 5 Paragraph (1) of Perja 15/2020 is a cumulative principle requirement. However, in certain criminal acts the three principle conditions can be distorted as in Article 5 Paragraph (2), Paragraph (3), and Paragraph (4). This study examines the current regulation of the implementation of deviations from Article 5 Paragraph (1) letter b and c of Perja 15/2020 and the enforcement of law deviations from Article 5 Paragraph (1) Letter b and c of Perja 15/2020 by the public prosecutor. The research method used is juridical normative in the form of an assessment of literature materials or secondary data. The statute approach and the case approach are the two approaches used in this study. To obtain information that supports this study, data collection techniques in the form of interviews were also used. The results showed that currently the implementation of the termination of prosecution deviates from Article 5 Paragraph (1) Letters b and c referring to Perja 15/2020.

Abstract

Motor vehicle hire purchase agreements with installment payments under fiduciary guarantees are an important topic in the context of civil law. Problems that often occur include violations of agreements, the debtor's lack of understanding of the contents of the agreement, and the practice of forcibly withdrawing vehicles without a valid legal process. This research method uses normative legal analysis by referring to applicable laws and regulations, literature studies, and various related sources of information. The results of the research show the legal rules that apply to parties who violate the agreement, legal protection efforts for debtors, as well as procedures for valid withdrawal of vehicles by creditors in the context of motor vehicle rental purchase agreements with installments in fiduciary guarantees.
