Abstract

The concept of welfare state is a concept that emphasizes the state's full role in all processes towards prosperity, welfare and ensuring equitable economic access to all citizens by prioritizing programs that support the implementation of guarantees for the fulfillment of citizens' rights. Indonesia as a country has also emphasized this through the constitution and various other regulations. These efforts can be realized by maximizing public services, assistance and protection through more participatory policies that are in accordance with the needs of the community. The purpose of this study is to analyze the dynamics of the concept of welfare state in Indonesia by identifying government programs and policies that have been regulated in the constitution. The results of this study conclude that the social programs and policies formulated today are still unable to overcome the problem of economic inequality experienced by the community. Economic growth that increases only shows economic improvement among the elite, people with middle to lower class economies still have to fight hard to get out of the poverty zone. Social policies through the PKH, BPNT, BPB, and BLT Food Risk Mitigation programs have not been effective and optimal. In fact, these programs often cause horizontal conflicts between communities. The state through the government should formulate social policies based on the developmental of the well-being of the people by relying on various facilities and authorities provided to support the process towards a prosperous country.

Abstract

The right to restitution as a form of legal protection that must be given to child victims of criminal acts. The method used in studying the data is empirical legal with data collection through interviews and literature studies. This study shows the mechanism for fulfilling restitution for children with mental disabilities at the Madiun Regency District Court, and the forms of restitution rights that are entitled to be received by children with mental disabilities who are victims of sexual violence. The fulfillment mechanism at the Madiun Regency District Court has been carried out in accordance with Supreme Court Regulation (PERMA) Number 1 of 2022 concerning Procedures for Settlement of Applications and Granting of Restitution and Compensation to Victims of Criminal Acts

Abstract

This study aims to analyze the legal provisions regarding the crime of lese-majesté in Thailand with the law regarding attacks on the honor of the President in Law Number 1 of 2023 in Indonesia, as well as their implementation and impact on freedom of expression and human rights. This research employs a normative legal study (juridical-normative) with a statutory approach. Furthermore, the nature of this research is descriptive-analytical. The data sources used in this normative juridical research are secondary data, which include primary legal materials, secondary legal materials, and tertiary legal materials.. First, this study discusses the description of the legal provisions regarding the crime of lese-majesté in Thailand which has very strict criminal sanctions, with provisions for violations against the President in Indonesia which are relatively looser, but still have the potential to limit freedom. Second, the differences and similarities in the application of the law in both countries lead to the use of the law as a tool to protect the dignity of the country's leaders, although with different levels of strictness. Third, the impact of the application of this law on freedom of expression and human rights shows that although both countries aim to protect the honor of the country's leaders, the application of the law can limit freedom of speech and opinion, which has the potential to restrict human rights. Overall, despite differences in the application of the law, both in Thailand and Indonesia, both face challenges in balancing protection of the honor of state leaders with human rights, especially freedom of expression.

Abstract

Language clauses in contracts are a crucial element that is often overlooked in Indonesian legal practice. With a statute and conceptual approach, this study analyzes the Supreme Court Circular Letter Number 3 of 2023, which provides guidelines regarding the use of language in contracts. The study results show that using clear and simple language in contracts can reduce the risk of disputes and increase trust between the parties involved. In addition, this study recommends the need for the consistent implementation of language standards to support legal integration and create a more stable business environment. Thus, this research contributes to developing contract law in Indonesia and provides insights for academics and legal practitioners.

Abstract

Hadhanah in Islamic law, which are usually given to mothers, from the point of view of Maqashid as-Syari'ah according to Imam Al-Syatibi. Emphasizes that custody rights must be based on the child's benefit in accordance with the five main objectives of Maqashid as-Syari'ah. UUD No. 23 of 2002 also emphasizes the best interests of children. As a result, the proper hadhanah needs to be applied flexibly and comprehensively, balancing the duties of social support, motherhood, and fatherhood. flexible legal regulations are required to preserve children's wellbeing and strike a balance between parents' rights and responsibilities.

Abstract

Child exploitation is a significant global issue, particularly in Southeast Asia, including Indonesia and Thailand. This study aims to examine the legal regulations in Indonesia and Thailand regarding child exploitation and to understand the urgency of legal protection for child victims of sexual exploitation in both countries. A normative juridical research method is employed to analyze how these countries handle child exploitation cases, focusing on legal standards and their implementation. The study compares the laws in both nations and evaluates their application in child exploitation cases. The findings indicate that Indonesia's legal framework for addressing child exploitation refers to Article 76I in conjunction with Article 88 of the Child Protection Law (UUPA) and Article 12 in conjunction with Article 13 of the Law on Sexual Violence Crimes (UUTPKS). In Thailand, child exploitation is regulated under the Thailand Penal Code and the Child Protection Act of 2003. When applying Indonesian law to offenders of child exploitation crimes occurring in Thailand, it is essential to consider the United Nations Convention on the Rights of the Child (CRC) of September 2, 1990. Legal protection for child victims of sexual exploitation in Indonesia varies according to the provisions of the Child Protection Law. Abstract

Starting from the charm of beautiful Indonesian tourism, many foreigners not only invest but also own land that can be owned in Indonesia through a nominee loan agreement. This is certainly prohibited in the UUPA, where only Indonesian citizens can have property rights and control absolutely a land. The purpose of this study is to find out the practices, mechanisms, and impacts that occur due to the existence of a nominee loan agreement between foreigners and Indonesian citizens. This research is processed with a normative juridical approach method, namely by looking at law as a set of regulations/rules or doctrines that have a normative nature (law in book). The result of the discussion is that the practice of borrowing names (nominees) is still rampant until now, especially in tourism cities in Indonesia. The nominee loan agreement between a foreigner and an Indonesian citizen is considered to harm the UUPA and does not meet the legal requirements of the agreement, which causes the agreement to be null and void. Abstract

Cyberbullying in Indonesia with 45% of children becoming victims according to UNICEF (2022) and 49% of internet users experiencing harassment on social media according to APJII. Effective prevention requires strong policies, victim support, a safe environment, and strong law enforcement. Increasing public awareness and education about the impact of cyberbullying is also crucial. The development of technology and social media, cyberbullying has a serious impact on the mental health of victims, and can give rise to power dynamics in the form of intimidation. This research uses a normative juridical approach to analyze this problem. This research shows that cyberbullying can be categorized as a criminal act based on articles that regulate defamation and insults.

Abstract

This study examines the integration of Javanese customary values (rembuk blok and tepo seliro) in conflict resolution among inmates at Jepara Detention Center as an alternative to seclusion-based sanctions. Using critical ethnography (2023-2024) with participatory observation, interviews with inmates and prison officer, and analysis of conflict cases, findings reveal: (1) rembuk blok prevents conflict escalation through participatory dialogue; (2) tepo seliro facilitates empathy-based reconciliation; (3) adaptation of customary social sanctions (voluntary exclusion) improves social cohesion. Key barriers include philosophical gaps between state-customary law, staff resistance, and regulatory voids. Recommendations include integrating rembuk blok into conflict mediation SOPs and legal pluralism-based staff training.

Abstract

The provision of political dowries in Indonesia has been rampant for a long time, every time an election approaches, issues arise regarding cases of giving political dowries. For example, in the run-up to the simultaneous elections in 2024, every candidate who wants to run as a legislative member prepares a fantastic amount of dowry funds to win a seat in parliament. The existence of this political dowry has an impact on the weakness of democracy in Indonesia and is contrary to Islamic law. So that researchers are interested in discussing this issue from two points of view, First, What is the view of positive law and the impact of political dowries on democracy in Indonesia?; Second, What is the view of Islamic law on the practice of political dowries in Indonesia? The research method used is normative legal research using a statutory approach.
