Abstract

Gifts (hibah) are generally irrevocable. However, Islamic law provides exceptions that allow parents to revoke gifts given to their children. In the case of West Jakarta Religious Court Decision No. 946/Pdt.G/2024/PA.JB, the plaintiff granted a gift to their child without the consent of their spouse and other children, leading to family conflict. The research shows that the gift was declared null and void as it violated Article 36 of the Marriage Law and Article 210 of the Compilation of Islamic Law, which regulate consent in the use of joint property and the maximum limit for gifts. The judge ordered the return of the gift but did not grant the request for a security seizure. This case highlights the importance of caution in the implementation of gifts and the enforcement of justice principles in resolving family disputes.

Abstract

SKT (Letter of Village Head) is an essential document supporting the land registration process, particularly in areas without formal land certificates. SKT is often used as initial evidence of land possession before proceeding with the registration process at the National Land Agency (BPN). This study examines case studies such as Decision Court No. 9/PDT.G/2010/PN.SML from the Saumlaki District Court and Decision Court No. 5/Pdt.G/2023/PN.MDL from the Mandailing Natal District Court. The findings show that SKT issued by the village head holds legal validity to strengthen claims of land ownership, provided it is issued following proper procedures and within the legal authority's scope. However, SKT cannot serve as definitive proof of ownership without being followed by a formal land registration process.

Abstract

Underage marriage is a marriage between a man and a woman or one of them either by force or certain conditions who are not yet 19 years old. There are differences regarding the minimum age at which a person can marry according to Islamic law and Indonesian positive law. Where in Islamic law it is not certain how old a person can marry, while in the national setting the minimum limit for marriage is 19 years for both men and women. The existence of these differences gives rise to legal pluralism. The data collection technique used is Library Research, namely by collecting supporting data from books, journals, articles, documents, and online media. The analysis method used is the descriptive analysis method. Because Islamic law and national law are complementary and incompatible. This is because Islam does not encourage underage marriage because it causes many consequences and consequences. The writing of this study uses a qualitative approach method with the type of library research.

Abstract

The accessoir agreement in the main credit agreement is an agreement related to collateral. The object of collateral can be Customary Land, as in Article 10 paragraph 3 of the Mortgage Law. The collateral is bound by the existence of a Power of Attorney to Charge Mortgage Rights or a Deed of Granting Mortgage Rights. In practice, there is still customary land that does not have a certificate. Customary land that does not have a certificate has a period of Power of Attorney to Charge Mortgage Rights for 3 months which must then be followed by the making of a Deed of Granting Mortgage Rights. If the Power of Attorney to Charge Mortgage Rights is not followed by the making of a Deed of Granting Mortgage Rights, it becomes null and void by law. Therefore, it is necessary to register customary land to be proof of perfect ownership.

Abstract

This research discusses the implementation of Good Corporate Governance (GCG) principles in ensuring business legal liability towards third parties in international business transactions. The discussion focuses on how the principles of Good Corporate Governance, such as transparency, accountability, and independence, play a role in maintaining the integrity of the company and protecting the interests of third parties, such as consumers and business partners. The results show that effective implementation of Good Corporate Governance principles can increase public trust and maintain the sustainability of international business relationships. In conclusion, companies must integrate Good Corporate Governance principles in every aspect of operations to ensure legal compliance and business sustainability.

Abstract

This research examines and reconstructs the concept of fast track legislation in the mechanism for forming legislation in Indonesia. This has resulted in many pros and cons regarding the laws that have been issued and ratified by the DPR and the President. It is felt that the resulting law product does not comply with the philosophy of Law No. 12 of 2011 concerning the formation of statutory regulations. This is proven by several laws that have been produced that are not appropriate and have caused conflict in society, such as the Job Creation Law, the Constitutional Court Law, the Corruption Eradication Committee Law, the Covid-19 Law, and most recently the IKN Law. The research method used is using a normative juridical research type with data sources from literature, both journals and books and a number of applicable regulatory norms..

Abstract

As a country committed to the principles of blue economy, Indonesia must implement a sustainable paradigm in coastal tourism policies. This requires incorporating the triple bottom line concept by John Elkington which includes people, planet, and profit. This study employs a normative juridical method to analyze disparities in tourism development across regions and the inadequacy of existing regulations. Recommended indicators for evaluating legal system effectiveness are based on Lawrence Friedman's legal system theory consisting of legal structure, substance, and culture which aims to optimize sustainable coastal tourism and promote economic development rooted in the Blue Economy principles in Indonesia. Abstract

Penelitian ini menganalisis penerapan prinsip Good Corporate Governance (GCG) di PT Bank KB Bukopin Syariah tahun 2022. Penelitian ini bertujuan untuk menganalisis sejauh mana implementasi GCG di PT Bank KB Bukopin Syariah pada tahun 2022, mengidentifikasi kelemahan dalam penerapan prinsip-prinsip GCG, serta mengkaji dampaknya terhadap risiko hukum dan operasional. Berdasarkan analisis hukum normatif, penerapan GCG berada pada kategori "cukup baik" (peringkat komposit 3), tetapi terdapat kelemahan signifikan, seperti kurangnya transparansi, belum selesainya sertifikasi fit and proper test, serta rangkap jabatan di Dewan Pengawas Syariah. Penelitian merekomendasikan penguatan transparansi, penyelesaian sertifikasi fit and proper test, pembatasan rangkap jabatan, dan percepatan penyelesaian sengketa hukum melalui mediasi dan arbitrase.

Abstract

Law Number 8 of 1999 concerns Consumer Protection in protecting and guaranteeing legal certainty for a business to carry out production with security, comfort, safety, good quality, and health. Maintaining health is essential for humans, especially during the COVID-19 pandemic and after the pandemic ends. The public consumes traditional medicine because of its effect, which can increase the body's immunity during the pandemic. Getting traditional medicine during the COVID-19 pandemic is very easy from online shops. This is what we used to do until the pandemic ended. The government the existence of Consumer Protection Law No. 8 of 1999 as a basis for protecting consumer safety rights and supervision of BPOM No. 8 of 2020, which monitors medicine and food distributed online. The discovery of traditional medicine preparations by BPOM Public Relations and BPOM's annual case report without a distribution permit online will violate consumer rights. The research method used is a normative juridical legal approach by examining statutory regulations, library materials, or secondary data as a basis for research accompanied by interviews related to the problems studied. The results of the research found that the provisions for the use of traditional medicines according to Law No. 8 of 1999 concerning consumer protection are linked to BPOM Regulation No. 8 of 2020 concerning the supervision of medicines and food distributed online in the current situation the COVID-19 pandemic is very necessary because in general it has been regulated in the UUPK by ensuring that the actions taken by BPOM in implementing the Law's policies are repressive and preventive. That is why the government issued a consumer protection law that benefits the population so that they have legal force against consumer losses committed by business actors. The responsibilities that consumers expect from business actors regarding UUPK No. 8 of 1999, namely being obliged to provide compensation to customers for damage, contamination, and use of products that consumers use.

Abstract

The imposition of substitute money sentences in corruption crimes is often found to differ from each defendant in the same corruption crime. This condition reflects a sense of injustice for the state, perpetrators and society/victims. This paper aims to determine the application of substitute money sentences in the practice of organizing criminal justice in Decision Number 135/Pid.Sus-TPK/2022/PN Smg and the reconstruction of substitute money sentences in corruption crimes using the ratio decidendi perspective. The results of the study show that First, the application of substitute money sentences in Decision Number 135/Pid.Sus-TPK/2022/PN Smg on behalf of Sapto Sri Winarno has different decisions from other defendants in the same case so that it has a direct impact on the return of state losses in the form of the realization of substitute money not running optimally so that legal uncertainty and does not create a deterrent effect for future corruption convicts. Second, the reconstruction of substitute money sentences in corruption crimes should be that judges in deciding to impose substitute money sentences should use the ratio decidendi perspective even though the prosecutor's demands do not include substitute money sentences.
