Abstract

Before the enactment of Law No. 11 of 2020 on Job Creation (Job Creation Law), provisions concerning termination of employment (PHK) were regulated under Law No. 13 of 2003 on Manpower (Manpower Law). The Manpower Law was known for its relatively strict PHK procedures and high severance pay calculations. While these regulations aimed to provide maximum protection for workers, they often faced criticism for potentially hindering investment due to a lack of flexibility in implementation. On the other hand, labor unions and activists consistently emphasized the importance of strong protection to prevent exploitation and ensure worker welfare. This delicate balance between the need for economic growth and the protection of workers' rights formed the primary background for the Job Creation Law's formation. With the enactment of Law No. 6 of 2023, which established Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation as a permanent law, significant changes have occurred in PHK regulations, particularly concerning the mechanism for unilateral terminations by companies. This research employs a normative-empirical (socio-legal) method, utilizing an analytical approach to labor laws and regulations, implementing regulations, labor law doctrines and theories, and case studies based on Supreme Court Decision No. 229K/Pdt.Sus-PHI/2022. The research findings indicate that the Job Creation Law introduces substantive changes in unilateral PHK procedures, characterized by a simplification of the process and a shift in orientation from strict worker protection towards increased corporate flexibility. The new provisions in the Job Creation Law regarding reasons for PHK and compensation significantly reduce the administrative burden on companies and expand employers' authority in making PHK decisions, thereby diminishing workers' bargaining power when facing unilateral terminations

Abstract

The role of notaries in ensuring the validity of authentic deeds in land sale transactions is crucial in Indonesia’s civil law system. Notaries are tasked with ensuring that these transactions are legally valid, comply with all requirements stipulated by the Civil Code (KUHPerdata), and possess strong evidentiary power in court. A key aspect of this role is to ensure that the parties have the legal capacity to engage in the transaction and that the land being sold has a clear legal status, such as a certificate registered with the National Land Agency (BPN). The validity of the notarial deed is also influenced by factors such as incomplete documentation, unclear legal status of the parties involved, and non-compliance with applicable regulations. To address these issues, notaries must ensure proper document verification and provide adequate explanation to the parties about their rights and obligations. Legal solutions to these problems include verifying the legal status of the land, fulfilling tax obligations, and preventing fraudulent actions in the transaction. Therefore, notaries act not only as witnesses but also as protectors of legal certainty in land sale transactions.

Abstract

Legal protection and legal certainty for landowners is also a crucial issue in the process of land acquisition. Although Law No. 2 of 2012 has set up a mechanism for indemnity, in practice, dissatisfaction often arises on the part of landowners. This is due to various factors, including the lack of transparency in the land valuation process, the mismatch of the indemnity value with the market value, as well as the lack of efforts to restore the socio-economic conditions of the affected communities. Juridically, land acquisition derived from Hak Guna Usaha (HGU) for mining activities cannot be implemented through the land acquisition mechanism based on Law No. 2 of 2012, unless the activity is qualified as public interest by the government. Therefore, the use of HGU land for mining must be based on the consent of the rights holder and set forth in a valid cooperation agreement as stipulated in Article 29 letter c and Article 30 paragraph (2) of Government Regulation Number 18 of 2021. The Joint Land Use Agreement (PPLB) scheme is a legally recognized alternative instrument to resolve the overlap between mining business licenses (IUP) and HGUS, as long as it is prepared by meeting the legal requirements of the agreement under Article 1320 of the Civil Code, based on the principle of freedom of contract, and does not conflict with laws and regulations.

Abstract

This study examines the role of the community in the psychological recovery of victims of sexual violence in incest cases in Mendo Barat District based on Law No. 12 of 2022 concerning the Crime of Sexual Violence (UU TPKS), using an empirical juridical approach through interviews, observation, and documentation. The results show that the community’s role remains limited to providing moral and material support, without addressing psychological aspects due to social stigma, the culture of silence, and limited legal understanding. Strategies for empowerment and cross-institutional collaboration are needed to realize an effective community-based recovery.

Abstract

Self-harm "Nge Barcode" is an act of intentionally hurting oneself without the intention of ending one's life. This research aims to understand the legal protection for children as victims who engage in self-harm "Nge Barcode" based on Law Number 35 of 2014 on Child Protection in Medan City, to determine the role of the Child Protection Study Center (PKPA) in providing protection for children who engage in self-harm "Nge Barcode" in Medan City, and to identify the obstacles and challenges faced by the Child Protection Study Center (PKPA) in providing protection for children who engage in self-harm "Nge Barcode". This research employs a qualitative descriptive method with an empirical legal research type, initially examining secondary data, then continuing with field research for primary data.

Abstract

The development of information technology has brought significant changes in the health sector, one of which is the practice of telemedicine that enables medical services to be provided without spatial and temporal limitations. However, the presence of telemedicine raises new issues related to legal protection for doctors as professionals who perform their duties in accordance with ethical and legal standards. This article aims to analyze the forms of legal protection for doctors in the practice of telemedicine under Law Number 17 of 2023 concerning Health and to identify the challenges encountered in its implementation. This study employs a normative juridical method with statutory and conceptual approaches, supported by the analysis of justice theory, legal certainty, and legal protection. The findings indicate that there are six main forms of legal protection: protection of professional rights and obligations, legal certainty in service standards, liability mechanisms, guarantees of patient data confidentiality, administrative protection through licensing, and ethical protection through professional organization supervision. Nevertheless, its implementation faces several obstacles, such as limited detailed technical regulations, disharmony of norms across legislations, weak digital infrastructure, low legal and technological literacy among medical professionals and patients, and challenges in law enforcement. In conclusion, legal protection for doctors in telemedicine already has a sufficiently strong normative basis, yet remains suboptimal in practice. Therefore, regulatory reconstruction, strengthening the role of professional organizations, and improving human resources and infrastructure are required to establish telemedicine that is accountable, safe, and fair for all parties.

Abstract

Dokdo/Takeshima Island remains a source of tension between South Korea and Japan. This study collects and examines international legal documents, historical maps, and diplomatic archives as primary sources. In addition, a number of relevant court decisions and state practices are compared to determine the direction of jurisprudence. Japan adheres to its interpretation of history and the dynamics of the region after World War II, while South Korea emphasizes geographical proximity, historical evidence, and the fact that it has long managed and stationed officials on the island. When viewed from the principle of effective [1]control, South Korea's claim appears more convincing, even though the country refuses to bring this issue to the International Court of Justice because it does not consider it a dispute. The findings of the study confirm the need for peaceful resolution channels such as mediation and arbitration to maintain regional stability, especially with the strengthening of geopolitical tensions and maritime security issues until 2025.

Abstract

The development of artificial intelligence (deepfake) technology has been widely misused to manipulate a person's face into that of another person, potentially leading to its misuse in crimes such as fraud, misuse of personal data, extortion, pornography, and political sabotage. Based on this, this study aims to determine how civil liability applies to the misuse of deepfake technology and what challenges and solutions exist in applying civil liability to those who misuse deepfake technology. Using a normative research approach combined with conceptual and legal frameworks, this study examines all laws and regulations related to civil liability for the misuse of deepfake technology. The results of this study indicate that both providers and users of deepfake platforms can be held liable for negligence or errors that cause harm, as per the concept of unlawful acts regulated in Articles 1365 and 1367 of the Civil Code. However, the implementation of civil liability for deepfake misuse still faces significant complexities. These challenges stem from technical aspects, such as the limitations of detection model generalization and the high realism of deepfake content driven by deep learning technology, as well as the ease of access to software. Enforcement of the law faces obstacles in identifying perpetrators, cross-border jurisdictional issues, and difficulties in quantifying immaterial losses. Additionally, there is a specific legal vacuum that explicitly regulates deepfakes, making existing legal regulations general and not yet adaptive to the characteristics of artificial intelligence-based manipulation.

Abstract

The teachings and practices of FGM/C in syariat agama Islam are considered part of the right to worship and the right to practice one’s own religion, including how to believe in and carry out religious commandments. However, the practice is no longer relevant to present-day needs and health studies. The findings indicate that regulatory improvements are needed as a strong legal umbrella applicable throughout Indonesia, despite the special authority granted to certain regions. Such regulations can take the form of Presidential Decrees (Keputusan Presiden or Kepres), Government Regulations (Peraturan Pemerintah or PP), and Ministry of Health Regulations (Peraturan Menteri Kesehatan or Permenkes). Recognition of FGM/C through symbolic ceremonies could be considered as an alternative, such as small incisions on the clitoral hood without removing any part, cleaning the female genitalia (similar to the hair-cutting ritual in aqiqah), and the abolition or elimination of FGM/C practices.

Abstract

The Indonesian notarial system, rooted in the Civil Law tradition, places notaries as public officials with broad authority in the creation of authentic deeds that have full evidentiary force. In the context of national development, strengthening the notarial system is crucial to realising the first of the Eight Goals, namely the enforcement of fair, humane and ethical law, as well as supporting the global agenda through SDG point 16 on peaceful, inclusive and accountable institutions. This study uses a literature review method by examining regulations, doctrines, and comparisons of notarial practices in civil law countries such as the Netherlands, France, and Germany. The results of the study show that although the position of notaries in Indonesia is equivalent to that in civil law countries in terms of status and the power of deeds, there are still weaknesses in the aspects of digitisation, supervision, and professional education. To that end, strengthening the notarial profession through e-notary regulations, integration with e-Government, improving professional ethics, and technology-based supervision are urgent needs. With these measures, the notarial profession can become the front line in strengthening preventive legal certainty, promoting a healthy investment climate, and building legal institutions with integrity in accordance with the first Asta Cita mandate and SDG point 16.
