Abstract

Domestic Violence (DV) remains a serious social and legal problem in Indonesia, with impacts that not only physically and psychologically injure victims, but also damage the foundations of family life and threaten social stability. Although there is a legal umbrella in the form of Law Number 23 of 2004 concerning the Elimination of Domestic Violence, its implementation still faces obstacles, such as a weak response from law enforcement officials, a complicated evidentiary process, and formal justice that often adds to victims' trauma. This condition indicates the urgency of an alternative approach that is more humane, participatory, and recovery-oriented, one of which is through the implementation of Restorative Justice. This study aims to analyze the urgency of implementing Restorative Justice in resolving domestic violence cases in Indonesia and examine its relevance to the theory of Maqashid al-Syari'ah Jamaluddin al-'Athiyyah as an effort to protect families and maintain social welfare. The method used is normative juridical research with a conceptual and legislative approach. The research findings demonstrate that Restorative Justice has significant urgency as a legal instrument capable of delivering substantive justice for victims of domestic violence, maintaining family integrity, and preventing social harm, provided it is implemented carefully, with the principles of victim protection, voluntary action, and non-discrimination. From a maqasid perspective, Restorative Justice aligns with the objectives of sharia (Islamic law) in safeguarding life, honor, posterity, and the welfare of the community, making it a strategic alternative in realizing a more just and sustainable system for resolving domestic violence.

Abstract

Up-selling marketing strategies encourage consumers to purchase higher-value products or services but risk harming consumers due to unclear information. This study aims to analyze legal protection under Law No. 8 of 1999 on Consumer Protection, which guarantees consumers’ rights to accurate, clear, and honest information. Using a normative juridical method, the study finds that non- transparent up-selling practices create information asymmetry and potential consumer losses. Therefore, businesses are obliged to provide complete and transparent information so that consumers can make fair and informed purchasing decisions.

Abstract

This study analyzes the implementation of Regional Regulation (Perda) No. 3 of 2016 on the Spatial Planning (RTRW) of Labuhanbatu Regency in regulating land-use conformity. The main problems identified include the operation of factories outside designated industrial zones and the existence of electricity towers without permits in accordance with the regulation. The aim of this research is to examine the implementation of Perda No. 3 of 2016 and to analyze the mechanisms of legal responsibility as well as the role of the government in addressing spatial planning violations. The study employs a normative juridical method with statutory and conceptual approaches. Data were collected through library research and analyzed descriptively and qualitatively, using primary legal materials in the form of legislation and secondary legal materials such as legal journals and books. The findings reveal that the implementation of Perda No. 3 of 2016 has not been optimal. Systemic violations were discovered, including the operation of a palm oil factory in Rantau Utara District, which should have been located in the designated industrial area of Rantau Selatan District, as well as the construction of electricity towers without permits. Regarding legal responsibility, the study found inconsistencies in law enforcement, where the local government showed strict responses to violations concerning electricity towers but remained passive in addressing violations by the palm oil factory. The study concludes that the success of RTRW implementation requires strong political will, consistent law enforcement, and the commitment of all stakeholders to realize sustainable and equitable spatial planning in Labuhanbatu Regency.

Abstract

Law enforcement against perpetrators who create websites containing obscene content and child pornography has become a major challenge in the digital era. The ease of internet access is exploited to spread illegal content that damages morality and threatens children, with 108,508 complaints reported to Komdigi throughout 2024. This research aims to analyze the implementation and obstacles of law enforcement in the East Java Regional Police, covering the effectiveness of enforcement and strategies to overcome barriers such as limited human resources, inadequate facilities, and the complexity of criminal methods. Although law enforcement has been carried out in accordance with existing regulations, it remains largely repressive. Therefore, preventive measures are needed through regulatory updates, enhanced digital forensic capacity, public education, and international cooperation.

Abstract

A limited liability company (PT) as a legal entity has the principle of limited liability. Through the Job Creation Law, the concept of a sole proprietorship has emerged, allowing one person to establish a PT. However, the principle of separation of liability and the potential for ultra vires actions pose legal challenges for the directors' accountability. The purpose of this study is to examine the application of the ultra vires principle in determining director liability in a sole proprietorship and the legal implications for the personal liability of directors in a sole proprietorship that engages in ultra vires actions under the Limited Liability Company Law and the Job Creation Law. The research method used is normative legal analysis with descriptive analytical techniques. The ultra vires principle in sole proprietorship companies, although not explicitly regulated, applies through the interpretation of the authority of the board of directors based on the Limited Liability Company Law and the Job Creation Law. The board of directors, who are also the sole shareholders, are required to act in accordance with the articles of association and the law. Actions exceeding their authority are classified as ultra vires, invalid, and not binding on the company, thereby shifting liability to the individual. As a result, the principle of limited liability is nullified, becoming unlimited liability through the doctrine of piercing the corporate veil, with liability for losses and potential criminal penalties if accompanied by bad faith or gross negligence.

Abstract

Land ownership disputes between local governments and heirs become increasingly complex when involving land that originally came from a loan arrangement. The case of Lapangan Akso Dano in Supreme Court Decision No. 3580 K/Pdt/2023. The research problems include: first, the legal certainty of land possession status by the local government; second, the legal Construction for protecting regional assets originating from loaned land that has been physically possessed for an extended period; and third, the legal analysis of the judges’ considerations in Supreme Court Decision No. 3580 K/Pdt/2023 regarding land ownership disputes involving loaned land to the local government. This research employs a normative juridical method. The study reveals that legal certainty over land possession by local government is comprehensively regulated through a legal hierarchy from the 1945 Constitution to Government Regulation No. 24/1997, reinforced by customary law recognition of long-term physical possession.

Abstract

There are still major challenges in its implementation, such as lack of public awareness of the importance of land registration, lack of socialization from the authorities, and administrative barriers faced by the community, especially in rural areas. The existence of this time limitation also raises new concerns regarding land disputes, especially if there is a conflict between the owner of the girik and the owner of the valid certificate. Therefore, this study is very important to dig deeper into the issue of the deadline for registration of customary land after the entry into force of government regulation number 18 of 2021. This study aims to understand how the policy is implemented, its impact on the renewal of the land system, as well as its relevance in providing legal certainty to citizens. Therefore, this research is expected to provide real contributions and benefits in encouraging fairer and more effective land reform in Indonesia. Legal protection for owners of girik land who have not registered their land after the deadline for land registration according to PP number 18 of 2021 ends, they still get legal protection from the state, because the owner of girik land is still given the opportunity to register his girik land, but the basis for registering his land is not with written evidence in the form of girik, but with a mechanism for applying for recognition of land rights provided that the land has been physically controlled by the person concerned for 20 (twenty) years or more continuously, without any objection from any party (the land is not in dispute).

Abstract

A notary is very likely to be exposed to legal entanglements, not only internal factors that come from oneself, such as carelessness, non-compliance with procedures, or violations of Professional Ethics, an example is when the notary exercises his authority during the leave period. This study is a normative study that studies the purpose of law, the values of justice, the validity of the rule of law, legal concepts, and legal norms. Normative legal research can also be regarded as a process to find the rule of law, legal principles, and legal doctrines in order to answer the legal issues faced. It can also be said that legal research is carried out to produce arguments, theories, or concepts as prescriptions or answers to the problems faced. In this provision, the Notary who is on leave is obliged to appoint a replacement notary to carry out his authority and responsibility, so that the notary concerned is no longer authorized to carry out the duties of his position until the leave period ends. If the notary continues to exercise this authority, the resulting deed does not meet the formal requirements of the authentic deed as stipulated in the UUJN, and therefore loses its authenticity value. This situation not only violates the normative provisions, but also damages the joints of professional ethics which requires the integrity and obedience of notaries to the law and code of ethics.

Abstract

This study addresses the complex issue of sexual violence against women and children as a public health and legal concern, highlighting the crucial role of Visum et Repertum (VeR) as evidence. Challenges arise regarding the authority of Puskesmas (Community Health Center) doctors in issuing VeR and its validity in court, often due to limited medicolegal understanding in primary healthcare facilities. Through a literature review, this normative legal research analyzes the scope of Puskesmas doctors' authority in preparing VeR for sexual violence cases and evaluates its legal validity as admissible evidence. The findings indicate that VeR issued by Puskesmas doctors is valid and recognized by judges, supported by legal regulations and judicial practice. Nevertheless, standardization and capacity building for Puskesmas doctors are essential to optimize VeR's effectiveness as evidence.

Abstract

Before the enactment of Law No. 11 of 2020 on Job Creation (Job Creation Law), provisions concerning termination of employment (PHK) were regulated under Law No. 13 of 2003 on Manpower (Manpower Law). The Manpower Law was known for its relatively strict PHK procedures and high severance pay calculations. While these regulations aimed to provide maximum protection for workers, they often faced criticism for potentially hindering investment due to a lack of flexibility in implementation. On the other hand, labor unions and activists consistently emphasized the importance of strong protection to prevent exploitation and ensure worker welfare. This delicate balance between the need for economic growth and the protection of workers' rights formed the primary background for the Job Creation Law's formation. With the enactment of Law No. 6 of 2023, which established Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation as a permanent law, significant changes have occurred in PHK regulations, particularly concerning the mechanism for unilateral terminations by companies. This research employs a normative-empirical (socio-legal) method, utilizing an analytical approach to labor laws and regulations, implementing regulations, labor law doctrines and theories, and case studies based on Supreme Court Decision No. 229K/Pdt.Sus-PHI/2022. The research findings indicate that the Job Creation Law introduces substantive changes in unilateral PHK procedures, characterized by a simplification of the process and a shift in orientation from strict worker protection towards increased corporate flexibility. The new provisions in the Job Creation Law regarding reasons for PHK and compensation significantly reduce the administrative burden on companies and expand employers' authority in making PHK decisions, thereby diminishing workers' bargaining power when facing unilateral terminations
