Abstract

Money laundering is a serious crime that has a major impact on the economic stability and integrity of the country's financial system. This crime is generally associated with predicate offenses, such as corruption, narcotics, and organized crime, to conceal the origin of illicit wealth. In law enforcement, the application of the reverse burden of proof principle is a crucial strategy for overcoming the difficulty of proof. This study examines the application of the reverse burden of proof principle in the Indonesian criminal justice system, particularly in money laundering cases, as outlined in Law Number 8 of 2010. The method used is normative juridical with a conceptual and statutory approach. The results of the study indicate that the application of the reverse burden of proof principle can strengthen efforts to eradicate money laundering, but must still uphold the principle of fair trial and protection of human rights, especially the presumption of innocence. Law Number 8 of 2010 has not comprehensively regulated the standards of proof, verification, and legal impact of this principle, thus creating a vacuum of norms and legal uncertainty. In practice, the accused is only burdened to explain the origin of the wealth, while the prosecutor proves the elements of the crime. However, this shifting burden of proof still raises concerns about violations of the presumption of innocence. Therefore, the application of the reverse burden of proof principle requires more detailed legal regulations and strict supervision so that it is not misused and continues to guarantee legal justice for the accused.

Abstract

This study analyzes the application of the ultimum remedium principle to corporate taxpayers in criminal acts involving fictitious tax invoices based on Decision Number: 77/Pid.Sus/2022/PT JMB. The research method uses a normative legal approach with case studies. The results show that the ultimum remedium principle was not fully applied to halt criminal proceedings, but rather considered in determining the severity of sanctions. The judge imposed house arrest sentences considering juridical and non-juridical aspects, including significant state losses and the defendant's good faith in returning part of the losses. The application of this principle reflects a balance between law enforcement and substantive justice.

Abstract

This study aims to analyze the application of restorative justice as an alternative to punishment in the Class I Labuhan Deli Detention Center and assess its effectiveness in addressing overcrowding in detention centers. The research method used is an empirical approach with data collection through interviews, document studies, and direct observation. The results show that in the 2024–2025 period, there were at least ten criminal cases, such as theft, receiving stolen goods, embezzlement, assault, domestic violence, and plantation violations, which were successfully resolved through restorative justice mechanisms. These resolutions emphasized the restoration of victims' losses, social reconciliation, and reducing the burden of overcrowding inmates. Analysis based on Soerjono Soekanto's theory of legal effectiveness shows that the implementation of restorative justice in the Labuhan Deli Detention Center is quite effective because it meets the factors of legal substance, law enforcement officers, facilities, society, and culture. However, strengthening technical regulations, increasing the capacity of mediators, and ongoing outreach to the community are still needed so that the implementation of restorative justice is truly optimal in realizing justice that is humane, efficient, and socially just.

Abstract

Legal protection for consumers harmed by standard clauses in e-commerce, particularly regarding returns, has become a crucial issue with the rise in online sales transactions. Standard clauses are often unilaterally included by businesses and often limit or eliminate consumers' right to return goods if the product received is not suitable or damaged. This contradictory practice is based on consumer protection principles stipulated in the Consumer Protection Law (UUPK), specifically Article 18, which prohibits the inclusion of standard clauses because they can eliminate consumers' right to return goods.

Abstract

This study examines the judicial considerations in Decision Number 34/G/2020/PTUN.SMD concerning the annulment of the Governor of East Kalimantan’s decree dismissing a civil servant. The analysis reveals procedural and substantive defects, as the decision failed to comply with statutory regulations and the General Principles of Good Governance. The Administrative Court declared the decree null and void, restoring the plaintiff’s rights as a civil servant. The findings highlight the role of the Administrative Court as a judicial control mechanism over public officials’ actions while reinforcing legality, accountability, and good governance in public administration.

Abstract

The right of inquiry is the right of the House of Representatives (DPR) to conduct investigations into the implementation of laws and/or government policies related to important, strategic matters that have broad impact on social, national, and state life, which are suspected to be contrary to statutory regulations. The purpose of this research is to analyze the use of the DPR's Right of Inquiry conducted against government policies related to the Implementation of the 2024 General Elections. The type of legal research used is normative legal research or library legal research, which is a type of legal research obtained from library studies, by analyzing legal problems through statutory regulations, literature, and other reference materials related to the problem. The results of this research explain that doctrinally, the governmental system is a system that explains the relationship/relations between holders of executive power and holders of legislative power, and in carrying out its constitutional functions, the DPR has the right of interpellation, the right of inquiry, and the right to express opinions. Both in Parliamentary and Presidential systems, the right of inquiry is one form of manifestation of legislative oversight authority over the executive as the holder of governmental power. This oversight is directed at holders of executive power because it is the executive that carries out day-to-day governance, both the implementation of governance that is directly derived from or constitutes a mandate of laws and the implementation of governance that constitutes the implementation of policies made by the executive itself.

Abstract

This study analyzes the implementation of Government Regulation No. 35 of 2021 regarding outsourcing employee compensation in Batam City. Despite formal regulatory provisions for compensation, field implementation demonstrates inconsistency and ineffectiveness. Primary barriers include weak institutional supervision, low legal literacy among workers, and poor employer compliance. Premature contract termination practices to avoid compensation obligations contradict Aristotelian distributive justice principles. The research concludes that fair compensation requires regulatory clarity, institutional commitment, robust supervisory mechanisms, and enhanced worker rights awareness to achieve the regulation's normative objectives. Effective implementation necessitates comprehensive reform addressing systemic weaknesses in Indonesia's industrial relations framework, particularly concerning outsourced labor protection.

Abstract

Land disputes in Indonesia reached 12,000 cases in 2024, promoting mediation as alternative resolution. This research analyzes implementation of ATR/BPN Minister Regulation No. 21/2020 in Indragiri Hilir Regency using empirical juridical method. Causal factors include administrative data inaccuracy, technical errors, low public legal awareness, and land economic value changes. Mediation process conducted through five systematic stages with Land Office as neutral facilitator. Main obstacles are parties' bad faith and institutional limitations, addressed through mediator capacity building and socialization programs. Mediation success rate reached 67% from 9 cases during 2021-2023 period.

Abstract

A therapeutic agreement serves as the legal basis binding the relationship between patients and medical personnel in the implementation of medical procedures. This agreement contains elements of mutual consent that set forth the rights and obligations of both parties, fundamentally aiming to provide legal protection for both patients and medical professionals. However, in practice, breaches of therapeutic agreements by medical personnel often occur, whether due to negligence, performing actions without informed consent, or violations of established medical service standards.This study aims to analyze the legal framework governing therapeutic agreements in Indonesia, the forms of legal liability of medical personnel for such breaches, and the legal remedies available to patients seeking compensation. The research employs a normative juridical approach, utilizing statutory and doctrinal methods, and is analyzed based on written legal norms, legal literature, and regulations related to medical practice.The findings indicate that therapeutic agreements are implicitly regulated in the Medical Practice Law, the Indonesian Civil Code, and regulations concerning consent to medical procedures (informed consent). If a medical professional is proven to have committed a breach, they may be held legally accountable in five forms: civil liability in the form of compensation, criminal liability if a criminal offense is involved, ethical liability through the Medical Ethics Honorary Council, disciplinary liability through the Indonesian Medical Discipline Honorary Council, and administrative sanctions imposed by the relevant authorities. Legal remedies for compensation may be pursued through civil lawsuits in court on the basis of breach of contract, as stipulated in Article 1243 of the Indonesian Civil Code. The enforcement of such legal responsibilities is expected to provide protection and legal certainty for patients, as well as to enhance the professionalism of medical personnel in practicing medicine in accordance with applicable ethical standards and procedures. Therefore, it is hoped that therapeutic agreements can operate in accordance with the principles of mutual trust, transparency, and shared responsibility.
