Journal of Legal Research is a peer-reviewed journal on legal research published quarterly (February, May, August, November) since 2019 by Departemen Legal Studies Faculty of Sharia and Law Universitas Islam Negeri Syarif Hidayatullah Jakarta in cooperation with Center for the Study of Constitution and National Legislation (POSKO-LEGNAS). Journal of Legal Research aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning Indonesian laws and legal system. Novelty and recency of issues, however, is a priority in publishing. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning Indonesian laws and legal system. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as privacy laws and public laws which include constitutional and administrative law as well as criminal law, international laws concerning Indonesia, to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed.

Abstract

Di Indonesia, era reformasi bergulir sejak 1998 yang menumbangkan era rezim Orde Baru. Analisis Huntington dan Nelson mengenai model populis tidak cocok dengan era pasca orde baru dalam melihat dampak dari peningkatan partisipasi politik rakyat. Konflik-konflik kecil memang terjadi dalam bentuk intrik-intrik politik, dan hal ini juga biasa terjadi dalam model-model lain termasuk model liberal. Pada era pasca orde baru tren yang berkembang justru pertumbuhan ekonomi yang labil dan pemerataan ekonomi yang belum berdampak luas yang mengakibatkan semacam kejenuhan rakyat dengan persoalan politik. Angka partisipasi politik dalam pemilu di atas sedikit banyaknya menunjukkan tren tersebut. Ditambah lagi dengan kecilnya angka partisipasi dalam berbagai pemilihan kepala daerah (pilkada) yang digelar di tiap provinsi dan kabupaten/kota di seluruh Indonesia.

Abstract

The widespread and systematic crime of corruption is also a violation of the social and economic rights of the community. Therefore, all corruption crimes can no longer be classified as ordinary crimes but have become extraordinary crimes. In an effort to eradicate corruption in Indonesia, the Prosecutor's Office of the Republic of Indonesia continuously works hard with all available capabilities both at the central level (AGO) and at the regional level (High Attorney, District Attorney and District Attorney's Office). In connection with efforts to confiscate and confiscate the proceeds of corruption crimes, it is the most important point in efforts to eradicate corruption in Indonesia, even this is often forgotten by law enforcement where efforts to eradicate corruption are only related to how to punish corruptors. In this paper, the author uses a descriptive qualitative methodology. This paper examines the model of returning assets resulting from corruption crimes in the law enforcement process.

Abstract

The ratification of Law No.7 of 1989 concerning the Religious Courts brought enormous changes to the position of the religious judiciary, not only in its position as a judicial institution as part of executing the same judicial power as other judicial institutions. However, the ratification of the granting of full authority which is the main task of the religious court to resolve cases of Muslims in Indonesia relating to family law. With the birth of the religious court law, the religious judiciary has become independent in Indonesia in enforcing laws based on Islamic law for those seeking justice who are Muslim in relation to civil matters in the fields of marriage, inheritance, wills, grants and endowments. Therefore, Muslims in Indonesia are required to submit their cases to the religious court which is the authority of the religious court. Jurisprudence is a fundamental need to complement various laws and regulations in the application of law because in the national legal system it plays a role as a source of law. Without jurisprudence, the function and authority of the judiciary as the executor of judicial power will cause sterility and stagnation. Jurisprudence aims to keep laws up to date and apply effectively, and can even increase the authority of the judiciary because they are able to maintain legal certainty, social justice and protection. Legal certainty will be realized if in the application of law there is a common perception. The existence of legal certainty will prevent or avoid disparities and inconsistencies in decisions because judges have applied the same legal standards to cases or cases that are the same or similar to cases that have been terminated or tried by a previous judge, so that the verdict on his case can be predicted by justice seekers. With this consistent decision, a sense of justice and legal certainty can be realized.

Abstract

Anak adalah bagian yang tidak terpisahkan dari keberlangsungan hidup manusia dan keberlangsungan sebuah bangsa dan negara. Salah satu solusi yang dapat ditempuh dalam penanganan perkara tindak pidana anak adalah pendekatan restorative juctice, yang dilaksanakan dengan cara pengalihkan (diversi). Restorative justice merupakan proses penyelesaian yang dilakukan di luar sistem peradilan pidana (Criminal Justice System) dengan melibatkan korban, pelaku, keluarga korban dan pelaku, masyarakat serta pihak-pihak yang berkepentingan dengan suatu tindak pidana yang terjadi untuk mencapai kesepakatan dan penyelesaian. Restorative justice dianggap cara berfikir/paradigma baru dalam memandang sebuah tindak kejahatan yang dilakukan oleh seorang. Substansi yang paling mendasar dalam Undang-undang Sistem Peradilan Pidana Anak adalah pengaturan secara tegas mengenai keadilan restoratif dan diversi yang dimaksudkan untuk menghindari dan menjauhkan anak dari proses peradilan sehingga dapat menghindari stigmatisasi terhadap anak yang berkonflik dengan hukum dan diharapkan anak dapat kembali ke dalam lingkungan sosial secara wajar.

Abstract

The dissatisfaction of the Bogor Regency Regent and Deputy Regent candidates caused the Jaro Ade-Inggrid Kansil pair to sue the Bogor KPUD at the Constitutional Court. After carrying out the trial by examining the evidence and listening to witnesses, the Constitutional Court issued a shocking decision. In the decision of the Constitutional Court Number 28/PHP.BUP-XVI/2018, the Constitutional Court considered that Article 158 paragraph (2) letter d of the Pilkada Law stated that the determination of the results of the vote count with the provisions of districts/cities with a population of more than 1,000,000 people, Disputes over the acquisition of votes can be made if there is a difference of at most 0.5 percent of the total valid votes from the final stage of vote counting for Regency/Municipal KPU. This study uses a literature review research method with a legal approach, namely research on legal products. After being researched, it was found that the dispute resolution process of the post-conflict local election results was in accordance with the judicial procedural law at the Constitutional Court.

Abstract

The Gig Economy facilitates job seeker to look for job quickly. Job with contract system has become interesting since 2017, and it becomes the main job. However, the development of manpower sector is not the same line with the appropriate regulation in protecting the freelance workers especially in the Event Organizer sectors. The Event Organizer company often neglect the worker’s rights & obligations, since both parties don’t make working agreement writtenly. But they apply confidence principle each other in making working agreement orally. Since from the dominant number of Event Organizer in South Jakarta legally is choosen as the research object. This research is trying to focus on the people who want to work at certain time with Event Organizer sector to understand the importance of working agreement legally. This research is using judicial research method with qualitative analysis namely the data collection technique is based on library research and interview the freelance workers randomly in the field.

Abstract

In the development of Indonesian criminal law, corporations can be burdened with criminal liability or can be said to be subject to criminal law. Plantation is one sector that is large enough to ensure the welfare of the people. The research method in this article uses qualitative research methods with a normative legal approach or what is known as legal research, which emphasizes the study of library documents related to the problems and objectives of this research. The results of the study state that criminal acts for corporations. Criminal acts can be imposed on corporations and their management and corporations are subject to a maximum fine plus a third.Keywords: Corporate Law; Plantation Law; Environmental law

Abstract

People's sovereignty in a democratic system is marked by the implementation of general elections. Elections are an embodiment of a democratic system that has received responses from various countries as an ideal means or mechanism in the framework of a peaceful and orderly power transfer process. By holding elections, it is hoped that the process of transferring power in a country will run well. Therefore, the election received serious attention from various groups, so that the idea of simultaneous elections emerged. This study uses a qualitative method with a statutory approach. The results of the study state that simultaneous national elections not only have implications for the realm of constitutional law or political administration but also have a negative impact on their implementation.

Abstract

This article discusses the conditions and situations where self-defense or self-defense is permitted when faced with a criminal act. This article discusses the terms and limits to which self-defense can be exercised. In addition, because this article discusses cases committed by children, this study will also discuss the Criminal Justice System for Children, starting from the principles to law enforcement against children who commit crimes.This research is a juridical-normative research using a case approach. The data in this study were collected using a literature study. The document that is the source of data in this study is the Decision of the Kepanjen District Court Number 1 / Pid.Sus-Anak / 2020 / PN.Kpn. The results of this study describe the qualifications of an act that is said to be forced defense that exceeds the limit (noodweer excess). In carrying out forced defending that goes beyond the limit, there must be great mental turmoil in addition to other conditions. Extreme mental shock is a condition that affects the mind, such as being very afraid, very panicked, very angry, and very confused. With these conditions, it affects the reason of a maker, so that he cannot possibly think about the consequences of his defense. Therefore, such actions cannot be punished because there are reasons or grounds for forgiveness.

Abstract

Deviations from norms that commonly occur in social life are deviations from legal norms which are called crimes. Crime as a social phenomenon takes various forms. Starting from the theft of sandals, theft of valuables, robbery, murder, acts of social violence in the family sphere, to violence that occurs among students. Fulfillment of the rights of correctional students as inmates is very important, especially when there is LPKA as an institution or place for children to serve their criminal period. Children who are in conflict with the law are the nation's next generation whose rights must still be fulfilled while they are in this Child Special Guidance Institute. This is because correctional students are also classified as legal subjects. The legal provisions discussed in this paper are only the fulfillment of children's rights at the Center for Social Rehabilitation of Children Require Special Protection Handayani Jakarta. Basically the fulfillment of the rights given has been regulated in Law Number 23 of 2002 concerning Child Protection, but in reality the fulfillment of children's rights at the Child Social Rehabilitation Center Requires Special Protection Handayani Jakarta has not been fully fulfilled.Keywords: Fulfillment of Children's Rights; Coaching and Services; Legal protection
