Abstract

This article discusses the Enforcement of State Administrative Law Against Hazardous Waste Treatment in the Crumb Rubber Industry in Jambi City. The purpose of this study was to determine the proper and proper mechanism for processing hazardous waste in the rubber smoking industry, in addition to knowing the government's legal actions against perpetrators of violations of hazardous waste processing in Jambi City. The research method used is empirical juridical, namely research that emphasizes in terms of observation, which seeks to observe legal facts that apply in society, where it requires knowledge to be observed and proven openly. The results of the study indicate that there is a conflict between das sollen and das sein regarding the treatment of B3 waste from the Rubber Smoking Industry in Jambi City in accordance with Jambi City regulations Number 7 of 2017 which states that the location for storing B3 waste is required to be free from flooding and not prone to natural disasters. there are buildings that are rusty, emitting noise, vibration and also the smell produced by the B3 waste. Therefore, it is necessary for the government's role in the B3 waste treatment mechanism in accordance with applicable regulations and the government's role in providing administrative law enforcement against perpetrators of B3 Waste Treatment violations.

Abstract

The Implementation of Social welfare is a part of regional government authority based on desentralitation principle. The social walfare Act number 11 on 2009 has various aim to reach peoples well beeing for all the people including Komunitas Adat Terpencil with Suku Anak dalam is a part of it. As far as we know there is no legal policy from Jambi Province government yet, revers to social welfare implementation for Suku Anak Dalam. A courding to article 18 verse 6 of 1945 indonesian constitution and based on local authonomy sistem, jambi province government must determine a policy that will give the benefit of SAD cummunity as legal protection for there social problem. The aims of this legal research is to analyze the authority and function of jambi province government relate to social welfare implementation for SAD society. As legal research use the primair, secondair and tertier legal materials that would be analyzed by interpretation and evaluation those legal materials based on relevan legal theoris to made conclutian as the answer of the problem.

Abstract

This study aims to determine and analyze the Mechanism of Transfer of Building Use Rights into Ownership Rights at the Land Agency Office of Muaro Jambi Regency and the factors that hinder the implementation of the transfer of these rights. This study uses the Juridical Empirical research method. The result of the research show that the transfer of building use rights to ownership rights can be seen in the Decree of the State Minister of Agrarian Affairs/Head of the National Land Agency Number 9 of 1997 concerning the Granting of Land Ownership Rights for Simple Houses and Very Simple Houses, the community or homeowners with the status of Building Use Rights can improve the status of their land rights into Ownership Rights through the transfer of land rights in order to obtain guaranteed protection and legal certainty. the aspects that become obstacles in the implementation of the transfer of land rights from building use rights to property rights, namely in making the transfer of land rights, the community often does not complete the file requirements and the community lacks understanding of the procedures or procedures for the transfer of land rights from building use rights become property rights. In addition, the competent authority, namely the Land Agency Office, has not yet fully implemented the transfer of land rights properly. This research is expected to be input for the Government, in this case the National Land Agency to improve performance in public services, disseminate information to the public about the importance of transferring land rights and improve the implementation of land rights transfers that have not been optimal.

Abstract

The purpose of this research is to determine the authority of the Kerinci Regency Government in managing the tourism sector of Lake Kerinci and to find out whether the Kerinci Regency Government has prepared a master plan for tourism development. The formulation of the problem studied is about how the authority of the Kerinci Regency Government in managing the tourism sector of Lake Kerinci? and whether the development of the Master plan has been in accordance with tourism?. This research is empirical juridical, based on the results of the study it can be concluded that the tourism management carried out by the Kerinci Regency Government has not been running well. This is due to the lack of coordination between regional apparatus and the inconsistency from the government, as well as the lack of human resources according to the field of work, as well as the lack of coordination and cooperation as well as follow-up from the Jambi Provincial Government in tourism development and management. The Kerinci Regency Government already has a Tourism Master Plan and in tourism development it is also guided by the tourism master plan. However, in its implementation, several gaps were found in setting targets in the management of tourism development.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis sistem penyelesaian maladministrasi di Indonesia dalam perspektif peraturan perundang-undangan yang berlaku dengan adanya dua lembaga yang memiliki kewenangan dalam penyelesaian tindakan maladministrasi yakni antara Pengadilan Tata Usaha Negara dan Lembaga Ombudsman Republik Indonesia. Penelitian ini merupakan penelitian yuris normatif dengan menggunakan pendekatan perundang-undangan dan konseptual yang selanjutnya disusun secara deskriptif agar menghasilkan solusi atas permasalahan yang dikaji. Adapun hasil penelitian ini bahwa penyelesaian tindakan maladministrasi di indonesia dapat ditempuh dengan 2 (dua) sistem yakni sitem litigasi dan sistem non-litigasi, yang mana sistem litigasi berada di Pengadilan Tata Usaha Negara  berdasarkan pasal 51, 52 ayat (2) Undang-Undang Nomor. 25 Tahun. 2009 tentang Pelayanan Publik Jo Pasal 1 angka 4 Undang-Undang Nomor 5 Tahun 1986 tentang Pengadilan Tata Usaha Negara Jo Pasal 87 Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan. Sedangkan sitem penyelesaian non-litigasi diselesaikan oleh Ombudsman sebagaimana yang diatur dalam Pasal 1 angka 1 Undang-Undang, Nomor 37 Tahun 2008 tentang Ombudsman Jo Pasal 46 Undang-Undang Nomor 25 Tahun 2009 Tentang Pelayanan Publik. Dengan perbedaan penyelesaian maladministrasi di Pengadilan Tata Usaha Negara lebih pasif karena hanya menerima gugatan dari penggugat, sedangkan lembaga Ombudsman dapat melakukan penyelesaian secara aktif meskipun tidak terdapat laporan dengan terjun langsung dalam mencari dan menemukan alat bukti.
