Abstract

This article discusses the living law which stands behind the Lubuk Larangan tradition in Jambi, Indonesia. While many academics stand on belief that Lubuk Larangan is about the conservation, the article argues there is a metaphysical belief and sacred agreement that triggers such conservation by the indigenous people. Such belief has been overlooked by academics resulting in the failure of seeing the very fundamental life of the indigenous people, as long as their legal practice is concerned. This article demonstrates that the customary law norms can be found in the customary seloko of Jambi Malay, norm which is reflected the whole lives of the indigenous people, both in private and public lives. This article found that the tradition demonstrates a communal way of living and togetherness based on the need of the community. The natural conservation is nothing but the reflection of the sacred, mystic, religious adat and law to keep the nature survive

Abstract

Penelitian ini mengkaji tentang konsekuensi hukum dalam perjanjian baku (standar) antara PT. PLN sebagai perusahaan penyedia pelayanan kepentingan umum dengan dengan konsumen. Kajian penelitian ini berfokus pada; Pertama, perlindungan hukum terhadap konsumen apabila PT. PLN sebagai perusahaan penyedia pelayanan kepentingan umum tidak memenuhi kewajibannya dalam surat perjanjian jual beli tenaga listrik. Kedua, penyelesaian sengketa antara konsumen dengan PT. PLN. Tujuan dari penelitian ini, yaitu memberikan kontribusi dalam pengembangan ilmu hukum dalam bidang Hukum Perlindungan Konsumen. Manfaat penelitian ini secara teoritis dan praktis diharapkan dapat berkontribusi terhadap pekembangan hukum kenotariatan, terutama mengenai Formulasi Perjanjian Baku Dalam Rangka Perlindungan Hukum Konsumen PT. PLN. Jenis penelitian ini adalah normatif, atau disebut juga sebagai studi kepustakaan (library research). Penelitian menyimpulkan Perlindungan hukum terhadap pelanggan listrik dalam hal kaitannya dengan surat perjanjian jual beli tenaga listrik (SPJBTL) belum dapat terlaksana sepenuhnya. Terkait penyelesaian sengketa dimungkinkan bagi konsumen untuk menyelesaikan melalui jalur hukum non litigasi, yaitu melalui Badan penyelesaian Sengketa Konsumen (BPSK), karena BPSK lebih mudah, murah, cepat, dan sederhana, dalam hal ini BPSK berperan sebagai mediator dalam menyelesaikan sengketa konsumen listrik.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk Kewenangan pemerintah daerah dalam pengelolaan pertambangan mineral dan batubara menurut UU No. 23 Tahun 2014 tentang Pemerintahan Daerah dan Pengelolaan Pertambangan Mineral dan Batu Bara dan Hubungannya dengan Tata Kelola Pemerintahan yang Baik. Mengingat tidak adanya lagi kedudukan pemerintah daerah yang mengakibatkan tidak adanya fungsi pengawasan, pembinaan dan pengendalian dari dampak-dampak negatif pascatambang seperti pengrusakan ekosistem daerah tambang. Oleh karenanya, penting bagi pemerintah daerah untuk mengetahui kewenangannya dalam pengelolaan pertambangan dan mineral untuk tata kelola pemerintahan yang lebih baik.

Abstract

The purpose of this study is to identify and understand and analyze in depth the authority of the Financial and Development Supervisory Agency in conducting investigative audits. The problems raised in this study discuss the authority of the Financial and Development Supervisory Agency in conducting investigative audits and what are the Implications of the Financial and Development Supervisory Agency's Investigation Audit on State Financial Losses in Law Enforcement. This study uses a normative method with the steps of description, systematization and explanation of the contents of positive law in depth using a concept approach, a law approach and a case approach using a systematic synchronization analysis. The results showed that the feedback from the investigative audit enabled the realization of financial management and supervision reforms including the integration between activity planning and budgeting. Thus, fiscal transparency and accountability are very urgent in reforming the management and supervision of state finances, because transparency and accountability in managing state finances can reduce state losses. As the government's internal auditor, the Financial and Development Supervisory Agency is authorized to supervise finance and development. On the other hand, the Financial and Development Supervisory Agency has the authority to conduct investigative audits to determine whether or not there has been a loss in state finances at the request of law enforcement. The implications of the investigative audit carried out by the Financial and Development Supervisory Agency in addition to imposing an obligation on financial managers to return state financial losses based on the results of the investigative audit, the results of the investigative audit also have consequences in the law enforcement process, because the results of the investigative audit are in the form of documents and information provided by auditors in court can affect the judge's confidence in the examination of the trial in court.

Abstract

Penelitian ini bertujuan untuk menganalisis dan mengkritisi substansi akta pendirian Badan Usaha Milik Desa dengan perkumpulan oleh notaris dan tanggung jawab notaris terhadap pendirian Badan Usaha Milik Desa berbadan hukum perkumpulan dalam perspektif Peraturan Perundang-undangan. Penelitian ini tergolong ke dalam penelitian yuridis normatif dengan dua pendekatan pokok yaitu pendekatan konsep (conceptual approach) dan pendekatan perundang-undangan (normative approach). Penelitian ini menggunakan teori kepastian hukum, teori badan hukum, teori kewenangan dan teori tanggung jawab. Sifat penelitiannya deskriptif analitis. Jenis penelitiannya menggunakan data sekunder yang diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Hasil penelitian menunjukkan bahwa terhadap substansi akta pendirian BUMDes dengan perkumpulan oleh notaris terdapat banyak sekali ketidaksinkronan antara substansi akta BUMDes berbadan hukum perkumpulan dengan Undang-Undang Desa dan PP BUMDes. Hal ini dapat dilihat dari pendiriannya yang tidak berpedoman pada Peraturan Desa, berbentuk perkumpulan dan secara teknis BUMDes perkumpulan memiliki tujuan yang berfokus pada sosial kemasyarakatan saja. Untuk memperoleh status badan hukum, BUMDes perkumpulan melakukan pendaftaran langsung melalui SABH dan besaran nominal penyertaan modalnya pun tidak dinyatakan secara jelas dalam anggaran dasar dan dalam hal akta pendirian BUMDes berbadan perkumpulan yang telah dibuatnya notaris bertanggung jawab memberi arahan kepada para pihak yang menghadap untuk mengaktakan BUMDes-nya dengan status badan hukum perkumpulan sebelumnya yang didaftarkan ke Kementerian Hukum dan Hak Asasi Manusia melalui SABH disesuaikan melalui SID.

Abstract

This study examines the legal consequences in the standard agreement between State Electricity Company (PT. PLN) as a public interest service provider company with consumers. This research study focuses on; First, legal protection for consumers if PT. PLN as a public interest service provider company does not fulfill its obligations in the power purchase agreement. Second, dispute resolution between consumers and PT. PLN. The purpose of this research is to contribute to the development of legal science in the field of Consumer Protection Law. The theoretical and practical benefits of this research are expected to contribute to the development of notarial law, especially regarding the formulation of standard agreements in the context of consumer legal protection of PT. PLN. This type of research is normative, or also known as library research. The study concludes that the legal protection of electricity customers in relation to the power purchase agreement letter (SPJBTL) has not been fully implemented. Regarding dispute resolution, it is possible for consumers to resolve through non-litigation legal channels, namely through the Consumer Dispute Resolution Agency (BPSK), because BPSK is easier, cheaper, faster, and simpler, in this case BPSK acts as a mediator in resolving electricity consumer disputes.

Abstract

This study aims to analyze the arrangements and procedures for providing credit facilities using the Personal Guarantee as collateral and the efforts of Bank Riau Kepri Tembilahan Branch as a creditor if there are debtors who fail to fulfill their obligations (default). The type of this research is juridical empirical. The results of the research and discussion found that the Arrangements and Procedures for the Provision of Credit Facilities were carried out by taking into account the applicable laws and regulations, especially those relating to the Civil Code and the Mortgage Law, which are related toPersonal guarantee is applied to debtors whose loan value exceeds the authority of the head of the Riau Kepri branch of the Tembilahan Branch. Personal Guaranty Guarantee is carried out by taking into account the legality of the guarantor itself. Efforts made by PT. Bank Riau Kepri against creditors who fail to fulfill their obligations is carried out first with internal efforts, namely credit rescue with Credit Restructuring efforts, if internal efforts fail then external efforts are carried out by involving the Indragiri Hilir District Attorney on the basis of the MoU between Bank Riau Kepri Tembilahan Branch with the District Attorney of Indragiri Hilir, and if the efforts of deliberation and consensus by involving the prosecutor's office still fail, then Bank Riau Kepri then submits the collection to the Directorate General of State Assets/Office of State Assets and Auction Services (DJKN/KPKNL). Then the KPKNL issued a warrant for the sale of the confiscated goods. The letter is notified in writing to the debtor or guarantor as a last resort. The sale of the confiscated goods can be done by way of auction, sale not through auction or redemption.

Abstract

There have been differing views on the administrative court’s absolute competence in reviewing abuse of authority cases under Law No. 30/2014 on Government Administration (Government Administration Law). This article seeks to uncover the legal politics and principles underlying the grant of absolute competence to the administrative court in reviewing abuse of authority cases. The uncovered legal politics and principles will then be used to analyze the regulation of objects, subjects, and the limits of the administrative court’s authority under Supreme Court Regulation No. 4/2015. The study’s findings concluded that the underlying idea behind the grant of authority to the administrative court in reviewing abuse of authority cases is to ensure legal certainty and protection for government officials in the exercise of their duties and authorities as stated under Art. 17 to Art. 21 of the Government Administration Law. The legislators shifted their anti-corruption law approach from a criminal-based approach to an administrative-based approach that prioritizes the recovery of state funds and enforcing administrative sanctions. Conceptually, this new model of anti-corruption law enforcement is founded on three principles: the presumption of legality, the presumption of administrative violation, and the ultimum remedium principle. Finally, Supreme Court Regulation No. 4/2015’s regulation of objects, subjects, and limits on administrative court authority contradicts the legal-philosophical idea underlying Art. 17 to Art. 21 of the Government Administration Law. Abtrak Sampai saat ini, masih beragam pandangan mengenai eksistensi kompetensi absolut peradilan tata usaha negara (peratun) dalam pengujian penyalahgunaan wewenang dalam UU No. 30/2014 tentang Administrasi Pemerintahan (UU AP). Artikel ini bertujuan untuk menemukan gagasan filosofis politik hukum dan prinsip-prinsip dalam pemberian kompetensi absolut kepada peratun dalam pengujian penyalahgunaan wewenang dalam UU AP sekaligus sebagai pisau untuk menganalisis pengaturan objek, subjek, dan pembatasan kewenangan PTUN dalam Perma No. 4/2015. Hasil kajian menyimpulkan, pertama, gagasan filosofis politik hukum pemberian kompetensi absolut kepada PTUN dalam pengujian penyalahgunaan wewenang bertujuan untuk memberikan kepastian hukum dan perlindungan hukum kepada pejabat pemerintahan dalam melaksanakan tugas dan wewenangnya sebagaimana diatur dalam Pasal 17 s.d. Pasal 21 UU AP. Pembentuk UU mengubah cara pandang hukum pemberantasan korupsi yang sebelumnya mengutamakan ‘pendekatan penindakan pidana’ menjadi ‘pendekatan administratif’; dari pendekatan yang ‘mengutamakan penghukuman pidana penjara’ menjadi ‘mengutamakan pengembalian uang negara’ dan ‘penegakan sanksi administratif’. Secara konseptual, model baru penegakan hukum tersebut memiliki basis teoretis yaitu asas praduga rechtmatige, asas praduga pelanggaran administratif, dan asas ultimum remedium. Kedua, pengaturan objek, subjek, dan pembatasan kewenangan PTUN dalam Perma No. 4/2015 tidak sesuai dengan gagasan filosofis politik hukum dan bertentangan dengan prinsip-prinsip dalam Pasal 17 s.d. Pasal 21 UU AP.

Abstract

In juvenile criminal cases, the age limit of children is of great importance, since this obligation to determine whether a suspect belongs to the category of children or not is related to the criminal liability of children. In discussing the extent to which a person can meaningfully be prosecuted as a child, it appears that many laws are inconsistent in their boundaries because they are motivated by the goals of each law. itself. In order to examine the purpose of this study, the purpose of this study is to examine the regulations for determining the age of consent for criminal responsibility of children in the current Indonesian criminal law. This research method uses normative legal research methods, a legal approach, a conceptual approach, a comparative approach and a case approach. The results of this study show that from the minimum age at which children can become important as adults, any legal act of a legal entity can become possible once they reach this legal capacity of adulthood. Aspects of legal protection in determining the age of consent in Indonesian criminal law are related to the criminal liability of children. The measure of a species' ability to assume responsibility can be derived from several factors, ranging from the age to the psychology of the perpetrator. After examining the facts, one can come to the conclusion that the age limit for adulthood, which is pluralism, may lead to ambiguity in determining when a person is declared of adulthood and held responsible for the crimes committed by him becomes

Abstract

This study aims to analyze the substance of the Covid-19 vaccine certificate policy as an administrative requirement in Jambi City and the regional government’s authority in enforcing the Covid-19 vaccine certificate policy in Jambi City. This study uses an empirical legal approach with a descriptive research type. Data collection techniques using interviews, observation, and documentation. Source of data used in the form of primary data and secondary data. The data that has been obtained is analyzed systematically. The results of the study show that the Covid-19 vaccine certificate policy as an administrative requirement for entering public places regulated through the Mayor of Jambi Circular Letter Number PW.01/441/DPK/2021 must be pursued into a Regional Regulation so that the substance has strong binding power. The Regional Government of Jambi City in enforcing the Covid-19 vaccine certificate policy has the authority to disseminate information to the community and carry out a real monitoring function as a means to evaluate the performance of implementing the Covid-19 vaccine certificate in public places or public spaces.
