Abstract

Abstract This study aims to analyze the understanding of the Muslim community in Dumbo Raya District regarding marriage wakalah and how Islamic law reviews its application in the sub-district. This type of research is qualitative, while the approach used is phenomenological and empirical juridical approaches. Research data sources come from primary data sources in the form of certain informants who are considered capable with the term research object, data collection techniques in the form of observation, interviews, and documentation, while data processing and analysis techniques through editing, classification, verification, Miles and Huberman model analysis, presentation data, conclusion / verification. The results of the study show that the majority of the local community's understanding of the wakalah wali issue in marriage contracts is not based on their knowledge of this matter, but this understanding is based on how the wakalah wali practice has become a habit in society. In principle, the application of the Wakalah guardian practice in the marriage contract of the Islamic community in Dumbo Raya District is not contrary to Islamic law. Even though it is not a problem if a guardian delegates his guardianship rights to other people, what is of concern to researchers is not to have guardians from so many orderly guardians. who are actually able to become guardians but because of the habits adopted by other communities so that the urgency of the position of guardian is not much utilized. Abstract

Pre-nuptial agreement is an agreement made before the solemnization of marriage, binding both parties orally and in writing. Pre-nuptial agreements are considered as a preventive measure to address any undesirable possibilities in marriage. This study adopts a qualitative approach with a case study research design. The aim of this study is to analyze pre-nuptial agreements in the context of Maqasid al-Shariah and to understand the practice of pre-nuptial agreements in the community of Kaliwates, Jember. The research findings indicate that aspects of the Maqasid al-Shariah concept include the preservation of religion, life, intellect, progeny, and wealth. As for the community of Kaliwates, Jember, pre-nuptial agreements are predominantly verbal rather than written, where some couples adhere to the agreement while others do not. In the context of Maqasid al-Shariah, pre-nuptial agreements function to safeguard religion, life, intellect, progeny, and wealth. Keywords: Pre-nuptial Agreement, Maqasid al-Syari'ah, Marriage Law.

Abstract

In the current era of globalization, it causes rapid development and influences the process of finding someone's soul mate. This causes some people to have the mindset of taking advantage of this to look for potential partners, which is done online. Online ta'aruf via social media has become a significant contemporary phenomenon in the process of marriage. This research explores the views of Islamic law regarding the practice of online ta'aruf with a focus on halal, ethical aspects and the concept of marriage in Islam through Islamic legal analysis and literature study. The results of this research indicate that online ta'aruf can be seen as a positive tool in Islam as a means of finding a life partner and getting to know potential partners. However, halal aspects, including fulfilling marriage requirements and compliance with religious norms in the practice of online ta'aruf still need special attention within the framework of the Islamic religion. This research provides a basis for further understanding of Islamic law's view of online ta'aruf via social media in accordance with Islamic religious principles, thereby maintaining the integrity of the marriage process in a digital context

Abstract

Marriage is a perfecting act of worship that can only be undertaken by couples who love each other. There are provisions before embarking on the journey of married life. In Indonesia, both partners intending to marry must be at least 18 years old. However, many couples still marry below this minimum age limit. There are numerous factors and consequences of early marriage. This writing represents an empirical legal research or sociological legal research obtained based on primary data sources and reviewed in terms of its location, which falls under field research. Data was collected through interviews and field notes. The research location was in Karangpuri village, Wonoayu Sub-district. The research findings indicate that the most influencing factors of early marriage are economic factors, low educational attainment, and cultural factors of the local community. Nevertheless, the incidence of early marriage in Karangpuri village has significantly decreased. The decline in early marriage rates in Karangpuri village is attributed to the diligent efforts of the Wonoayu KUA officials who have provided counseling on the impacts of early marriage. Early marriage, as a form of organic solidarity in the context of Emile Durkheim's theory, encompasses aspects of role specialization, economic dependency, and the formation of social relationships. Abstract

The research aims to explain the impact of early marriage on divorce in Betet Village, Kepohbaru District, Bojonegoro. Early marriage in this study is a marriage that occours at the age of less than 19 years. The theory used in this research is the theory of social action from Max Weber (1864-1920) which is a theory that emerged because each person’s assumptions are different according to what they feel and according to what is needed for the good of themselves and others. The approach used in this research is qualitative with a descriptive design. This research aims to provide a careful description of certain individuals or groups regarding the conditions and symptoms that occur. The results of the research show views on early marriage, including several social action concepts originating from the views of teenagers, parents, elders and other communities regarding early marriages carried out in Betet Village. The reason is, because of arranged marriages, coercion, and the lack of economic factors In the family, and view the previous people in Betet Village, were eligible for early marriage because the were arranged in an arragend marriage in 2001 without any mutual liking, but as time goes by, feelings will definitely arise like. With social action weber emphasizes responding to a social problem rationally according to circumstances or needs.

Abstract

Penelitian ini menginvestigasi pengaruh kelas sosial terhadap praktik pernikahan dini dalam konteks sosial, ekonomi, dan budaya. Pernikahan dini, yang sering kali terjadi pada usia yang relatif muda, menjadi subjek penting dalam pemahaman dinamika sosial masyarakat. Dalam penelitian ini, teori kelas sosial diidentifikasi sebagai faktor utama yang mempengaruhi kecenderungan individu untuk menikah pada usia muda. Analisis menyeluruh dilakukan untuk memahami perbedaan dalam praktik pernikahan dini antara kelas sosial yang berbeda. Hasil penelitian ini menyoroti bahwa faktor-faktor seperti kondisi ekonomi, pendidikan, dan norma sosial memainkan peran penting dalam kecenderungan pernikahan dini. Temuan ini memiliki implikasi yang signifikan dalam pengembangan kebijakan dan intervensi sosial untuk mengurangi insiden pernikahan dini serta untuk meningkatkan kesadaran akan dampak sosial dan individu yang terkait dengan praktik tersebut dalam berbagai lapisan masyarakat.

Abstract

Dual roles are two or more roles performed simultaneously, in this case, the roles refer to a woman's role as a wife to her husband, a mother to her children, and a role as a woman with a career outside the home. Family harmony is the integrity of the family, the compatibility of the relationship between husband and wife, and the presence of tranquility. The Higher School of Islamic Studies (STDI) Imam Syafi'i Jember is a Private Islamic Religious Higher Education Institution (PTKIS) that provides higher education for the Islamic generation in accordance with true religious teachings based on the Qur'an and Sunnah as understood by the companions. The purpose of this research is to analyze and find the concept of family harmony in Islam, the phenomenon of the dual roles of student wives at STDI Imam Syafi'i Jember, and the implications of the dual roles of wives on family harmony. This research uses a qualitative approach with a case study design. The results of this research show: (1) The concept of family harmony in Islam is divided into three, namely: Sakinah, mawaddah, and rahmah. (2) The phenomenon of the dual roles of student wives at STDI Imam Syafi'i Jember is indicated by helping with family finances, managing work and family, husband's support for the dual roles of wives, and challenges in facing dual roles. (3) The implications of the dual roles of wives on family harmony consist of positive and negative impacts.

Abstract

Abstract This article is the result of research that discusses the process of acculturation between the traditional culture of the Ternate Sultanate community and the Islamic religion. This research aims to explore the ritual communication activities of the Jere pilgrimage by the Ternate indigenous community from an Islamic perspective. This ritual is believed by the Ternate community to be in accordance with the Islamic perspective, as Islam is the majority religion and the official religion in the Sultanate of Ternate. The research approach used is descriptive-qualitative, involving the analysis of interviews with religious and traditional figures in the Sultanate of Ternate. The results of this research explain that the Jere pilgrimage is a form of ritual communication for the indigenous community of Ternate to visit the mausoleums of saints and influential figures in the spread of Islam. This research found the construction of Islamic values in the implementation of the Zere ritual and its impact on social and religious dynamics. The integration of traditional customs and Islamic teachings forms a unique pattern of ritual communication, enriching our understanding of cultural diversity and Islam in Ternate. The research provides a profound insight into the reverence of the indigenous community of Ternate towards figures and individuals regarded as saints who have made significant contributions to the spread of Islam. Furthermore, this research also found that the interaction between Islam and culture has shaped the identity of the Ternate community. This research is expected to contribute to the understanding of the social and religious context as well as cultural dynamics within the Islamic community in Ternate.
