Abstract

One of the officers who served as a supporter of the implementation of the administration was Civil Service Police Unit (municipal police). Civil Service Police Unit (municipal police) was a device that assisted local governments in the implementation of regional heads running of the government and as a guard or vanguard in the field of public peace and order. Abstract

Law enforcement officials who have an important role to run the enforcement of criminal procedural law, one of which is the Police. Police of the Republic of Indonesia (hereinafter referred to INP) has the task, purpose, authority and responsibility which further entails also the emergence of various demands and expectations of society towards increasing INP task and oriented to the community it serves. Drug abuse among the general public is widespread especially in Batam as transit traffic of international trade.Based on this, we propose two (2) formulation of the problem addressed in this study: first, how the steps are the Indonesian National Police as investigators in tackling the problem of drug abuse and revealed in Police Barelang Batam ?, second, how the application of legal principles ultimium remedium in Law - Law Number 35 Year 2009 on Narcotics?.This study uses a conceptual foundation, juridical and theory. Juridical basis in the form of Law - Law Number 35 Year 2009 on Narcotics. Then, the theoretical basis in adoption is Theory of Law as a tool of social engineering by Roscoe Pound. This study uses normative legal research. The object of this research is in the area of Police Barelang. Therefore, methods of data analysis in this study is called qualitative descriptive.Based on this research, Steps As the Indonesian National Police and Investigators In Tackling Drug Abuse In Barelang Batam Police carried out in three parts, namely pre-emptive, preventive and repressive. The investigation process in revealing criminal cases of drug by the Drug Unit Police Barelang start of observation (review), surveillance (shadowing), undercover agents (infiltration agent), undercover buy (purchase veiled), controlled planning (submission controlled), and raid planning execution (Execution plan raids). Application of the principle of ultimum Remedium to the victims of drug abuse is not sentenced to imprisonment but rehabilitation.

Abstract

Staf khusus merupakan jabatan tambahan yang ada di Kementerian dan kepresiden yang ada untuk mendukung kelancaran tugas Presiden dan Menteri. Sejak pengangkatan staf khusus milenial presiden, jabatan staf khusus yang telah ada sebelumnya, menjadi perhatian publik. Selain karena umur yang masih muda, staf khusus presiden menjadi perhatian karena latar belakangnya yang menjadi pendiri ataupun CEO perusahaan swasta. Hal tersebut memunculkan adanya dugaan konflik kepentingan. Penelitian ini merupakan penelitian hukum normatif, jenis dan sumber data yang dipakai adalah data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Sifat penelitian yang digunakan adalah penelitian deskriptif dengan menggunakan pendekatan undang-undang, pendekatan kasus, dan pendekatan perbandingan antara Staf Khusus dengan jabatan tambahan lain. Hasil penelitian untuk mengetahui tugas dan fungsinya Staf Khusus berdasarkan peraturan perundang-undangan serta akan menunjukkan kedudukan Staf Khusus struktur organisasi pemerintahan dan dalam pelaksanaan kegiatan pemerintahan.

Abstract

The purpose of this study is to carefully study the occurring haze incidents that had happened for decades in Southeast Asia yet no real resolution regarding the consequences of the State that causing the haze resulting from slash and burn method in clearing the forest. Indonesia is the country where the haze formed must held liable for its negligence to control the burning causing other countries to suffer the impacts in form of haze pollution. The Researcher interested to study about the term of state liability regarding this incident as ASEAN has its own treaty called the ASEAN Agreement on Transboundary Haze Pollution. This research adapted the normative law study by using the method of clinical law research. Secondary data sources used in this study and the data mining is done with literature study (library research). After all the data collected, the data is then processed and analyzed. To classify aspects of data studied the Researcher used the qualitative analysis. Furthermore, the conclusion of the research associated is drawn and described descriptively. This research showed the history of haze in Southeast Asia and how it formed as the resulted of uncontrolled slash and burn by the private companies located in Indonesia causing the haze that transported to other countries which in this case describe as transboundary. The final result of this research showed that Indonesia cannot be held liable as not one sanctions or fees mentioned in the agreement and imputability theory caused Indonesia could not held liable as it was the private companies act that caused the haze incidents throughout Southeast Asia.

Abstract

Since money play a vital role in every person’s living, they are willing to try anything to gain as much money as they can even by doing crimes and they will surely try to hide their crime footsteps in order to avoid from being found out, so they will do an act called money laundering. There is an unit that plays an important role in every country which is called INTRAC (Indonesian Financial Transaction Reports and Analysis Centre) in Indonesia and is called FinCEN (Financial Crimes Enforcement Network) in United States of America. The purpose of this study is to describe clearly and carefully about the similarities and differences of INTRAC (Indonesian Financial Transaction Reports and Analysis Centre) in Indonesia and FinCEN (Financial Crimes Enforcement Network) in United States of America reviewed from preventive action, to know about their obstacles, and the strengths and weaknesses of both institutions in doing the preventive action, then to decide which FIU (Financial Intelligence Unit) is better in fighting against money laundering. This research uses normative research and then comparative method. Secondary data is collected using the library research. As all datas are collected, those datas are then being processed and analyzed qualitatively which means to group data and compile systematically. Further conclusions drawn related to this study, then decribed descriptively. Based on the results of this study showed that by reviewing from the main tasks and functions and competency related to the preventive action, INTRAC in Indonesia and FinCEN in United States of America have most significant similarity in being FIU that they have the same main task in fighting against the money laundering. Besides that, they also have differences and have very own obstacles, strengths, and weaknesses. According to the comparation between INTRAC and FinCEN, we can then know that FinCEN which was built in 1990 turns out to the better than INTRAC which was then built in 2002 in preventing and combating money laundering because FinCEN’s role is better in fighting against money laundering.

Abstract

The rise of industry by utilizing natural resources has risks the impact on environmental pollution. This research will answer two legal issue, first concerning the application of civil penalties on corporations that pollute the environment with wastewater in environmental disputes; sedondy, regarding accountability corporations in environmental disputes. The special purpose of this studyis to analyze the judicial verdict and spesificly remedy after environmental pollution. This is a normative legal research. The source data is secondary data which collect from the literature (library research). After all the data has been collected, then processed and analyzed by descriptive-qualitative approach. The result drawn from the study conclude that the application of civil penalties suffered by the victim is materially own right but has not been effective because the perpetrators of environmental pollution shall perform certain actions whose nature is to improve the ecosystem and environmental sustainability life so that it can be used accordingly.

Abstract

Negara Indonesia adalah negara hukum sebagai perwujudan dari suatu negara hukum ini perlu memberikan jaminan perlindungan kepada warga negaranya dan juga harus memaksimalkan penanganan perkara pelanggaran HAM yang hingga saat ini belum terselesaikan dimana Kejaksaan mempunyai kendala yuridis dalam menyelesaikan pelanggaran HAM berat. Kendala yuridis yang dihadapi oleh Lembaga Kejaksaan dalam upaya penanganan pelanggaran HAM berat, yaitu a) Kesulitan Lembaga Kejaksaan Dalam Mencari Alat Bukti Pelanggaran HAM Yang Terjadi Di Masa Lalu; b) Pelanggaran HAM Yang Terjadi Di Indonesia Pada Masa Lalu Sebelum Undang-Undang Nomor 26 Tahun 2000 Tentang Pengadilan HAM Diberlakukan.

Abstract

The responsibility of electricity management in Batam, starting from generation, transmission, distribution to customer care lies on the hand of PT Pelayanan Listrik Nasional Batam (PLN Batam). However, these responsibilities do not include the constant supply of electricity and power outage which keeps occurring. Power outage occurrences resulted in inconveniences and monetary losses to consumer. The law regulates consumer protection but, has not been necessarily wellimplemented. Therefore, it is vital to investigate the legal protection of consumers on the unilateral power outage by PLN Batam that occurs in the field. The type of research used is empirical juridical. Primary data comes from interviews with PLN Batam, Yayasan Lembaga Konsumen Batam, as well as direct consumers; residents of Batam. Secondary data is derived from currently existing consumer protection law, alongside electricity law. From this research, it has been proven that power outage violated some consumer rights. Regarding this issue, more attention needs to be paid towards the implementation of consumers’ legal protection. Furthermore, preventive legal protection needs proper regulation and utilization. Also, there are obstacles that need to be addressed and overcome. This optimization can be achieved with awareness, coordination, and good faith by all parties involved in the relationship between PLN Batam and its customers.

Abstract

Law No. 32 of 2004 on Local Government and Government Regulation No. 6 of 2010 on the Civil Service Police Unit has mandated that Public Protection is obligatory under the authority of both the Provincial and Local Government District and the City. On Government Regulation No. 6 of 2010 on the Civil Service Police Unit that requirements to be appointed as Municipal Police are civil servants, but in the province of Riau Islands Civil Service Police Unit number is still much that is not civil servant status. On Government Regulation No. 6 of 2010 on the Civil Service Police Unit that Article 16 point a that the requirements to be appointed as Municipal Police are civil servants, which Civil Service Police Unit has the task of enforcing local laws, organizing public order and peace and the protection of society, but to carry out this task Municipal Police Units are often contradictory and conflicted with the community. Civil Service Police Unit has the task of helping the head area as Regional Regulatory enforcement to create a serene area conditions, and orderly. Legal remedy solving problems where the Civil Service Police Unit of the police human resources of the Civil Service has had Permendagri 38 of 2010 on the Civil Service Training police, merging function that refers Satlinmas Regulation No. 6 of 2010 on the civil service and police force Regional Government only raised police members of the Civil Service only for the status of Civil Servants.

Abstract

Trademarks means any sign which is capable of distinguishing goods or services dealt with or provided in the course of trade that must be protected to prevent unfair competition, justice, public order and legal certainty. Registered trademarks has full rights to use the trademarks. Therefore considering the importance of trademark registration in the constitutive system, it is expected to trademarks user to register its marks in the Intellectual Property office in order to avoid lawsuits either criminal claims or compensation from another party. This study describes clearly and carefully about the similarities and differences of the provisions of trademarks in Indonesia and United States, how the protection of the law and the provisions of the state know which one is better in providing legal protection to trademarks holder.This research is a normative law by using the method of comparative law. The data used are secondary data. Performed with data mining literature (library research). Once all the data is collected, the data is then processed and analyzed, the qualitative analysis was used to group the data point by the studies aspects. Further conclusions drawn related to this study, then described descriptively.Based on the results of this study showed that there are some similarities and differences between Indonesia’s and United States’ provisions. But, judging from the legal protection to trademarks holder, United States’ trademarks law provides more protection instead of Indonesia’s, based on the further protection measures to protect the rights of its trademarks.
