Abstract

Political parties have a position and role is very important in any democratic system. Restrictions on both parties and the electoral threshold parlimentary threshold is one element in a multi party system and the proportional representation system (proportional) with a certain percentage of the total national vote, it is certainly a clash of democracy on the one hand saying, but on the other hand is limited. This study aimed to identify and analyze the setting restrictions on political parties participating in the elections in the perspective of democracy. In addition, to analyze the restrictions on political parties participating in setting the general election in Act No. 8 of 2012 on the Election of the constitutional rights in the Constitution of 1945, also used normative juridical research method.The study states that, setting restrictions on political parties participating in the elections in the perspective of democracy in Law No. 8 of 2012 on the Election of Members of DPR, DPD and DPRD stipulated in Article 8 paragraph (1), Article 8 (2) and Article 208 of Law No. 8 of 2012 on the Election of Members of DPR, DPD and DPRD. Settings must meet the threshold of votes of at least 3.5% (three point five percent) of the total valid votes nationally to be included in the determination of the number of seats for the DPR, Provincial DPRD and regency / city violated the rights of democracy. Thus after the Constitutional Court Decision No. 52 / PUU-X / 2012, Article 208 which regulates the whole phrase "Provincial DPRD and regency / city" does not have binding legal force, thus only bind the Parliament alone. Restrictions on participants in the elections through a system of thresholds in Law No. 8 of 2012 on General Election violate constitutional rights that exist in part in Article 28, Article 28C paragraph (2), Article 28D paragraph (1), Article 28E paragraph (3), Article 28H (2) and Article 281 paragraph (2) of the 1945 Provisions of Article 208 of Law 8/2012 and the explanation is aimed at simplifying party naturally. Abstract

This research aims to analyze the implementation of restorative justice  principle in accomplishing  the criminal act of sexual abuse that was conducted by children actors and to analyze the  obstacles  that  were  faced  in implementing  the restorative justice principle to accomplish the criminal act  of  sexual abuse  that was  conducted by children actors. Method in this research used the method of sociological juridical approach with type of sociological law research or  empirical which its research location in the law area of Polres Banjarnegara and Purbalingga. In this research, source of data involved primary data source and secondary data source which the collection method of its data was conducted by interview, observation, and  literature study and presented by using the  narrative  text form and then analyzed qualitatively.               The result of research  stated that Polres Banjarnegara and Purbalingga in the implementation of restorative justice principle in accomplishing   the  criminal act of sexual abuse  that was conducted  by  children actor it  was known as the  process of case  accomplishment  with  penal mediation way that was  the part of Alternative Dispute Resolution or ADR. The implementation of restorative justice principle through the mediation that conducted by Polres Banjarnegara and Purbalingga that was the process of peace, stopping the  investigation because  the achievement  of  agreement, gave the school cost  aid for the  victim in the rape case, didn’t jail the children actor,  conducted the  implementation of suspect, considered  the  certain  aspect  to mediate, married the  victim  with the  suspect (married  especially in the  sexual intercourse case, that was if the victim got pregnant), concerned for the compensation for victim, conducted the law process but kept the children  protection, case accomplishment by relative custom mediation.            Beside that, the obstacle that was experienced by Polres Banjarnegara  and Purbalingga in accomplishing the criminal act of sexual  abuse that was conducted by children actor related with the law formulation or substance, institution problem and its structure, and cultural problem that lived and  developed in the  society. It was related with the knowledge that owned by the law officers and society knowledge about the implementation of restorative justice principle. These obstacle were such as  the number of female police  still very minimum, understanding of gender that was not appropriate enough, lacked of understanding of  law  and its regulation about the sexual abuse  that  was conducted by children actor, understanding of  restorative  justice principle was  not deep enough,  many  of  regulation about  the children  still  ambiguity with other  rule, there was  not  norm  which  guaranteed the similar in act,  implementation of restorative justice  was  considered did not make the suspect aware its act and  it was possible for them to do again, and it had  not  all the case  could be accomplished with the restorative justice  because there was the  perception that wrong man had to be punished. Key words: restorative justice, criminal act of sexual abuse, children actors

Abstract

The problem in this study is that it starts with the execution of coffee beans which are fiduciary collateral objects that belong to PT. Cideng Makmur Pratama held by Deutsche Bank by Bank Rakyat Indonesia. Deutsche Bank filed a resistance to the execution because it felt the seed was his property, Deutsche Bank also filed a PMH lawsuit against BRI through a Jakarta district court and was won by Deutsche Bank, then BRI filed an appeal and won so that Deutsche Bank filed a Cassation and produced a decision No. 2654 K / PDT / 2011. This study aims to analyze whether the judge's legal considerations regarding fiduciary collateral holders of inventory items in decision No. 2654 K / PDT / 2011 is in accordance with the laws and regulations and also to know the legal protection of Deutsche Bank as a creditor against the transfer of collateral objects for fiduciary supplies.This study uses normative juridical research methods, so that in this study the authors analyzed using secondary data sources. From the analysis carried out, it was found that the judge's legal considerations regarding the fiduciary collateral holder in the Decision Number 2654 K/PDT/2011 had not been in accordance with Law Number 42 of 1999 concerning Fiduciary Guarantees and Law No. 9 of 2006 concerning the Warehouse Receipt System and not in accordance with the petitum submitted by the applicant. Legal protection for Deutsche Bank is in the form of replacement of items that have been sold with the same or equivalent object and if the debtor does not replace the item with an equivalent value, Deutsche Bank has the right to pay from the sale of the collateral. This is based on the provisions of Article 21 paragraph (3) and (4) of Law Number 42 of 1999 concerning Fiduciary Guarantees. If the money from the sale is no longer available and there are still inventory items left, the creditor can execute in three ways, namely the executorial title, execution parate, and underhand execution.

Abstract

Seiring dengan berkembangnya waktu pada pemeriksaan di peradilan, dalamtindak pidana korupsi diberlakukan aturan khusus yang mengatur bahwa tanpa kehadiran terdakwa yang telah dipanggil secara sah di sidang pengadilan, persidangan tetap dapat dilanjutkan (in absentia), hal ini dipertegas dalam Pasal 38 ayat (1) Undang-undang Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (UU PTPK) sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001. Ketentuan ini merupakan penyimpangan dari KUHAP yang mewajibkan terdakwa hadir di persidangan. Berdasarkan rumusan Pasal 38 ayat (1) Undang-Undang nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, maksud tanpa kehadirannya itu adalah ketika berstatus sebagai terdakwa atau sudah masuk pada tahap persidangan. Ketentuan tersebut tidak merumuskan dan mengatur jika ia masih berstatus sebagai tersangka atau ketika masih dalam proses penyidikan, kemudian penyidik melakukan proses penyidikan secara in absentia. Hal ini tentu menjadi problematika hukum terkait peradilan in absentia dalam tahap penyidikan, mengingat diberlakukannya peradilan in absentia dalam perumusan Pasal 38 ayat (1) Undang-Undang nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi terkandung suatu keinginan kuat (political wiil) dari negara untuk memberantas tindak pidana korupsi di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif.Sumber bahan hukum yang terdapat dalam penelitian ini berasal dari bahan hukum primer, sekunder, dan tersier dengan teknik pengumpulan data berdasarkan studi kepustakaan dan teknik analisis data yang menggunakan metode deduktif. Berdasarkan hasil penelitian ini diketahui bahwa Penyidik dalam penyidikan tindak pidana korupsi dapat melakukan penyidikan secara in absentia apabila tersangka setelah dipanggil secara sah dan patut, namun ketidakhadiran tersangka itu tanpa suatu alasan yang sah. Ketentuan Pasal 38 ayat (1) UU PTPK harus ditafsirkan secara ekstensif mengenai makna perumusannya, karena ketentuan tersebut semangatnyaadalah menempatkan kejahatan korupsi sebagai kejahatan luar biasa yang penegakan hukumnya pun perlu di luar kebiasaan sebagaimana diatur dalam KUHAP dengan tujuan untuk menyelamatkan kekayaan negara, oleh sebab itu dalam peradilan in absentia dapat berlaku pula pada tahap penyidikan, tidak hanya pada tahap persidangan. Penyidikan in absentia dalam perkara tindak pidana korupsi dapat dilaksanakan tanpa melanggar HAM apabila negara melalui aparat penegak hukum telah menjalankan keharusan mengemukakan alasan-alasan atas ketidakmampuannya menghadirkan tersangka. Ketidakmampuannya itu dikemukakan dan dibuktikan di depan pengadilan sebagai suatu alasan yang obyektif.

Abstract

The implementation of regional autonomy with the principle of decentralization have a positive impact in the context of equity and increased development in the area which is a means to enable local people to be able to optimize the ability to prosper in their lives. This research used normative methode which used law statute approach and analutycal approach. Based on the results of research are Implementation of good governance in local government activity in Bukittinggi run quite effectively in Parliament as an institution as well as the local legislative offices as the technical implementation unit area. Constraints that affect the implementation of good governance in local government activity in Bukittinggi are: In offices, constraints experienced such quality and quantity of human resources, facilities and infrastructure, local regulations are not yet on the whole set of public service performance; In parliament that institutional constraints, human resource constraints, budget constraints, and constraint rules which all the constraints associated with the function of Parliament itself that not enough achievement of the performance by legislators.Keyword: Implementation, Good Governance, Bukittinggi Government

Abstract

Human Traficking is the worst violation of human rights. This study aims to analyze the loss and/or the suffering of victims of human trafficking, criminal law policy governing the legal protection of victims of human trafficking and its implementation in the process of criminal justice at the Polda Metro Jaya’s jurisdiction. The method used in thi research is the juridical sociological conducted by interviewing respondents, an inventory and study the legislation, as well as literature study. Losses and/or the suffering experienced by the victims of human traficking include loss of material, psychological, physical and social. The legal protection given to victims of human trafficking in the criminal justice process based regulated in various legislations. Implementation of legal protection for victims of human trafficking in the criminal justice process at Polda Metro Jaya’s jurisdiction during the criminal justice process is always given and is not always given.

Abstract

This thesis is motivated by the problem of Children who are the assets of the nation, as part of the young generation of children plays a very strategic role as a successor of a nation. Therefore, the state must provide protection for children if the child becomes a criminal offender. One of the solutions that can be taken in handling the case of crime of theft committed by the Child is through Restorative Justice approach, which is implemented by diversion as regulated in Law Number 11 Year 2012 on Child Criminal Justice System. Banjarnegara Resort Police has implemented a version for handling of criminal cases of theft committed by the Child as an effort to settle the case. Based on this, the issue raised in this thesis is how the implementation of the diversion in the settlement of criminal acts of theft committed by the Children in the Legal District of Banjarnegara Police as a form of Restorative Justice approach and constraints in the implementation of such diversions.

Abstract

Midwives as one ofthe health workers in the organized practice of compulsory kebidanannya has permission from the Government in the form of License the practice of Midwives. One of midwives ties Indonesia. Recommendation IBI in Brebes Regency can be obtained if the Member already has a certificate of Contraception technology updates. CTU is not aligned with the the conditions to get the SIPB i.e. the recommendations of professional organizations of authority contained in the regulation of midwives, the Minister of health no. 1464/Menkes/Per/X/2010 about permitsand Conducting the practice of Midwives.This research aims to analyze the petition Passes the practice of midwives and to analyze the constraints that hinder the application based Regulations SIPB Minister of health no. 1464/Menkes/Per/X/2010 about permits and Conducting the practice of Midwives. This research is qualitative research with the juridical sociological approach.The results show that the petition SIPB in Brebes Regency have not fully in accordance with Permenkes No. 1464/Menkes/Per/X/2010 about permits and Conducting the practice of Midwives. Resistance to get recommendations from IBI members must attend training CTU,compliance requirement application in collecting Member SIPB vary resulting in a filing process lasts a long time as well as the policies of the health service and IBI Brebes Regency that enforces two Ante Natal Care SIPB authority and Post Natal Care and the SIPB ANC, INC. and Intra Natal Care. Keyword: health, permited, midwive

Abstract

Victims as the injured party as a result of a criminal act shall receive compensation, one form of restitution. Awarded restitution to victims to reduce the suffering of the victims as a result of criminal offenses committed by offenders, especially to the victims of criminal acts. This restitution was arranged in Law No. 31 of 2014 on The Protection of Witnesses and Victims. Related effectiveness restitution for victims of crime also a form of state responsibility in an effort to protect its citizens. This research aims to analyze the effectiveness of giving restitution for victim of crime and analyze those obstacles facing witness and victim protection agencies (LPSK) in the implementation of the provision of restitution based on Law Number 31 of 2014 about witness and victim protection. Based on the result of study, it is known that giving restitution for victims of this crime it is said to be effective, until the process of granting restitution for the offender to the victim, but about how gifted as well monitoring conducted by LPSK to the victim after receiving restitution, it is said to be less effective, because there is no data associated with it. Then, associated with those obstacles faced with LPSK in facilitating, the provision of assistance for victims the crime is lack of human resources and the lack of budged in the process of the facilitating the provision of restitution.

Abstract

Penelitian ini membahas efektivitas penegakan hukum tindak pidana fidusia dalam proses penyidikan (studi di Polres Banyumas). Penelitian ini bertujuan untuk menganalisis efektif atau tidak efektif penegakkan hukum tindak pidana fidusia dan menganalisis kendala yang dihadapi oleh Penyidik Kepolisian dalam penegakkan hukum tindak pidana fidusia di Polres Banyumas. Metode pendekatan penelitian ini adalah yuridis sosiologis, spesifikasi penelitian deskriptif analisis. Penelitian dilakukan di Polres Banyumas, sumber data primer dari penelitian ini adalah wawancara kepada personil Satuan Reskrim PolresBanyumas, pihak pelapor dan terlapor kasus tindak pidana fidusia. Sumber datasekunder meliputi peraturan perundang-undangan, literatur, hasil penelitian pakar hukum, jurnal dan kamus. Data diperoleh dengan menggunakan studi kepustakaan, disajikan dalam bentuk teks naratif yang disusun secara sistematis, dan dianalisis dengan kualitatif. Berdasarkan hasil penelitian dan pembahasan bahwa penegakan hukum tindak pidana fidusia dalam proses penyidikan di Polres Banyumas terlaksana namun belum efektif hal ini disebakan: (1) Penerapan sanksi pidana dalam mengalihkan objek jaminan fidusia tidak menimbulkan efek takut untuk melakukan tindak pidana fidusia, (2) Kurangnya pemahaman masyarakat terhadap peraturan perundang-undangan fidusia, (3) Belum optimal pelaksanaan manajemen penyidikan dan pengawasan terhadap perkara tindak pidana fidusia, (4) Beban perkara yang tidak seimbang dengan jumlah personil penyidik. Proses penyidikan terkendala karena regulasi hukum yang belum tegas terkait eksekusi objek jaminan fidusia dan perkembangan modus tindak pidana fidusia, beban perkara yang ditangani penyidik terlalu banyak, kurangnya sarana pendukung dalam proses penyidikan serta meningkatnya kebutuhan masyarakat. Efektivitas penegakan hukum dapat diwujudkan dalam proses penyidikan dengan meningkatkan kemampuan penyidik, pemenuhan sarana pendukung, peningkatan pengawasan proses penyidikan dan penyuluhan hukum kepada masyarakat serta pembentukan unit fidusia ditingkat Polres.
