Abstract

Legal protection of civil servants (PNS) in a dispute over staffing has undergone a paradigm shift with the enactment of Law No. 30 of 2014 on Government Administration (UUAP). The paradigm change then has implications for the authority of the Civil Service Advisory Board (BAPEK). This study aims to analyze how UUAP provide legal protection to the Civil Servant who was dismissed not because of disciplinary punishment of civil servants and what are the implications of the legal protection against BAPEK authority.This research is normative legal research with qualitative analysis through conceptual approach and legal approach to legal issue which become subject matter in research. Conclusions are drawn deductively through a coherent and systematic description. To support this research, the authors conducted interviews with some of the top officials at BAPEK in Jakarta as complementary data supporting the research analysis.Based on the results of the study, the enactment of the UUAP which has established the regulation of administrative efforts in Articles 75 to 78, carries the legal consequence that the dismissed civil servant which not due to disciplinary punishment may undertake dispute resolution through administrative measures even though the relevant rules governing it, do not provide a dispute resolution through Administrative effort. This then implies the widespread authority of BAPEK, which before the enactment of UUAP is only authorized to handle administrative appeals of personnel disputes caused by the dismissal of civil servants due to disciplinary punishment.

Abstract

Studi ini dimaksudkan untuk mengkaji Strategi Keamanan dan Pertahanan di Selat Sunda, Hal ini dilakukan berdasarkan analisa dan evaluasi penanganan berbagai gangguan keamanan laut seperti perompakan, illegal fishing, illegal logging, penyelundupan, kecelakaan laut, pencurian harta karun dan lain-lain di perairan selat sunda. Selain itu, aparat penegak hukum juga wajib menjalankan kewajiban untuk melakukan pengamanan dan melaksanakan amanah Pasal 44 Konvensi Hukum Laut tahun 1982Penelitian ini menggunakan metode yuridis normatif dan bersifat deskriptif analitis, yaitu menganalisis identifikasi masalah dengan menggunakan data sekunder, kemudian dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa Solusi dalam memelihara keamanan di perairan selat sunda adalah Pengembangan Terobosan Kreatif berupa singkonisasi dan koordinasi dengan Dinas Maritim Provinsi Banten dalam hal pengukuran Kapal, Perumusan Peraturan Daerah terkait dengan pelayanan terhadap nelayan dan rencana pembuatan samsat perairan; Selain itu, Strategi dalam meminimalisir kejahatan di perairan selat sunda adalah mengoptimalisasi dukungan Pemda, Akademisi guna mengatasi situasi, kebutuhan dan pengimplementasian terobosan kreatif dalam rangka melindungi, mengayomi, melayani masyarakat, serta penegakkan hukum di wilayah perairan dapat di wujudkan melalui tindakan Preemtif, Preventif dan Edukatif serta kerjasama yang berkelanjutan Strategi dalam meminimalisir kejahatan di perairan selat sunda adalah mengoptimalisasi dukungan Pemda, Akademisi guna mengatasi situasi, kebutuhan dan pengimplementasian terobosan kreatif dalam rangka melindungi, mengayomi, melayani masyarakat, serta penegakkan hukum di wilayah perairan dapat di wujudkan melalui tindakan Preemtif, Preventif dan Edukatif serta kerjasama yang berkelanjutanStrategi dalam meminimalisir kejahatan di perairan selat sunda adalah mengoptimalisasi dukungan Pemda, Akademisi guna mengatasi situasi, kebutuhan dan pengimplementasian terobosan kreatif dalam rangka melindungi, mengayomi, melayani masyarakat, serta penegakkan hukum di wilayah perairan dapat di wujudkan melalui tindakan Preemtif, Preventif dan Edukatif serta kerjasama yang berkelanjutan.

Abstract

Everyone has the right to live physical and spiritual prosperity (UUD 1945, Article 28 H paragraph (1)). Everyone has the right to health (Health Act 2009 Section 4); Maternal health efforts should be aimed at maintaining the health of mothers and reduce maternal mortality, maternal health services regulated by Permenkes No. 1464/Menkes /Per/X/2010 (the Health Act of 2009 Section 126). This research is qualitative sociological juridical approach (Socio Legal Approach), retrieval of data through observation and interviews, the twenty midwives, and twenty patients, as well as a five-person team informant who is a manager and supervisor of midwives practice.The results showed that: The implementation of Permenkes No. 1464/Menkes/Per/X/2010 on Permit and Implementation of midwife is able to support in the welfare of the mother, by virtue of the licensing requirements fulfilled 90%, organizing practice standards compliance services 78%, guidance and supervision is done by the health center level, and the rights of mothers in Public Health Center include: Respect the rights of the mother; Giving the mother's health information; Requesting approval of the action; Keep a secret; and service standards are fulfilled, to get health care safety and quality, the mother is able to give birth to a quality  and healthy generation, and to avoid the complications which allows the maternal mortality as an indicator of welfare of the mother.Keywords: Permenkes number 1464 of 2010, Welfare mothers.

Abstract

ABSTRACTCorruption is the cause of the onset of the economic crisis, undermine the legal system and inhibit the operations of a Government that is clean and democratic. In other words, corruption is already in the pivotal joints and country life. Therefore, corruption can no longer be classified as ordinary crimes but is already a tremendous crime.Methods of Juridical Normative approach is used, with discriptif analytical research specifications. The data source is secondary, and data were analyzed qualitatively.Strategic leadership of the national police in it, that the eradication of criminal acts of Corruption is a priority for the Police. The role of the Police here to be very important, because Police spearheading in law enforcement, though in its development in addition to Police and prosecutors, the State formed the other agencies specifically addressing criminal acts of Corruption eradication Commission i.e. Corruption (KPK). This is because the criminal offence of corruption is a crime which is an extra ordinary crime and have very large implications for lates the progress of countries, also most of the perpetrators of corruption are on the red tape that holds the power so in need of institutions superbodi in order to get past the existing regulation.Keywords: Police, corruption, law enforcement

Abstract

Beberapa waktu belakangan ini para nasabah perbankan di tanah air cukupdiresahkan dengan maraknya tindakan pencurian data dan pemalsuan data nasabah yang dalam beberapa kasus banyak merugikan nasabah. Salah satunya dilakukan dengan cara penggesekan ganda (Double swipe) pada kartu kredit. Oleh karena itu Bank Indonesia melarangnya melalui Pasal 34 huruf b Peraturan Bank Indonesia No.18/40/PBI/2016 tentang penyelenggaraan pemrosesan transaksi pembayaran. Pasal 34 Huruf b Peraturan Bank Indonesia No.18/40/PBI/2016 tentang Penyelenggaraan pemrosesan transaksi pembayaran, melalui kartu kredit di Kabupaten Banyumas belum efektif, karena tujuan hukum dari Pasal 34 huruf b dan PBI tersebut tidak tercapai. Dilihat dari tingkat efektivitasnya juga kurang efektif, karena tingkat efektivitas terkait dengan ketaatan dan kepatuhan hukum. Beberapa subyek hukum ada yang belum taat dan patuh terhadap larangan Pasal 34 Huruf b PBI tersebut. Faktorfaktor yang menghambat berlakunya Pasal 34 huruf b Peraturan Bank Indonesia No.18/40/PBI/2016 tentang penyelenggaraan pemrosesan transaksi pembayaran, melalui kartu kredit di Kabupaten Banyumas. yaitu, faktor penegakan hukum, yaitu Bank Indonesia, sistem pengawasan tidak langsung yang hanya berdasarkan laporan dari masyarakat. Faktor fasilitas, sosialisasi baik melalui media cetak maupun elektronik dan penyuluhan kepada Acquirer, yang belum optimal dan kurang terarah. Faktor masyarakat, tingkat disiplin, dan kurangnya kesadaran hukum masyarakat. Faktor budaya, kurangnya budaya publik, tidak peduli risiko dan pentingnya melarang aktivitas kartu gesek ganda pada mesin EDC (Electronic Data Capture).

Abstract

This election is a representation of people's representatives who have goodqualifications and background so that through the role of independent institutions the KPU has the authority to make KPU Regulation Number 20 of 2018 concerning Nominations of Members of the House of Representatives (DPR), the Regional Representative Council (DPRD) of the Province, and Regency/City DPRD which limits the political rights of ex-convicts of corruption. The limitation of freedom to contribute to elections is contrary to the basic principles of the rule of law in Indonesia which upholds human rights which later gave birth to the Supreme Court Decision Number 46 P/HUM/2018 and has implications for the implementation of Good Governance in Indonesia. The approach method used in this research is normative juridical research. The sources of legal material contained in this study come from primary, secondary and tertiary legal materials with data collection techniques based on literature studies and data analysis techniques using deductive methods. Based on the results of this study that the legal considerations of judges in the MA Decision 46 P / HUM / 2018 that the Petitioner is a former convict of corruption and political rights have never been revoked due to the entry into force of Article 4 paragraph  (3), Article 11 paragraph (1) letter d and Appendix Model B .3 PKPU Number 20 Year 2018 Concerning Nominations for Members of the House of Representatives, Provincial Regional House of Representatives and Regency/City People's Representative Council which becomes a necessity that legislative nominations come from clean figures and never have a track record of integrity flaws. The validity of the Supreme Court's Decree has implications for the implementation of good governance in the principle of participation, namely the people's involvement in the process of governing the government in an election even though a person is a former convict of corruption, as the resulting decisions have in common the concept of the rule of law and good governance in creating a perspective of Human Rights that is upheld high in the regulations as if implying that ex-convicts cannot be restricted in their political rights.

Abstract

Labor is the main capital Pancasila community development  because the purpose of manpower development is the people's welfare, therefore the rights of workers must be guaranteed.  The Government of Republic of Indonesia has a commitment to be responsible in the implementation of Social Security. It was realized its implementation by the government based on Law No. 24 of 2011 through the Social Security Agency ( BPJS ) which is a statutory body established to administer social security program. BPJS consists of Workers Social Agency and Healthcare and Social Security Agency.  Social insurance programs provided by the Government aimed at protecting the rights of Indonesian workers , but on the other hand there are employers who do not carry out its obligations.  Of course this provides a problem for workers whose position has not been balanced with employers. The government is not only responsible for the management of social security but also protection relating to administrative sanctions that may be granted to employers who neglect their obligations so that with the imposition of administrative sanctions is expected to lead to harmonious industrial relations.Keywords : administrative sanctions , employers , social security

Abstract

This study aims to know and analyze the effectiveness of the regulation of the Regent of Brebes No. 026 the year 2015 and to know and analyze the factors that impede the implementation of the regulations of the Regent of Brebes No. 026 the year 2015.This research includes juridical sociological research categories. The data obtained are presented in narrative form. Based on the research results and discussion conclusion to be drawn as follows: first, Bupati of Brebes Regulations. No. 026 the year 2015 About community empowerment In Decreasing maternal mortality and infant mortality Through Baby Shaman Information seen from the theory of goal attainment, integration, adaptation is already effective in lowering maternal mortality in Brebes Regency. Abstract

The community has the authority to regulate and resolve the matter themselves according to local aspirations. It is clear that the position of trying to reassert the community is the subject of autonomy is not the object of autonomy. The decentralization policy explicitly also uncover the essence of autonomy as authorities set up and take care of his household. The aim’s to analyze the against public participation in rulemaking. The method of the research is socio legal approach, the data sources used are primary data and secondary data, with analysis in quantitative diskriptif.Results of the research as follows: the participation of youth in the formation of Regulatory Region of Pilkades 50% of respondents indicate a very high participation,. Participation of mothers PKK/dawis high participation 43.54 and the general public towards 35.51% showed very high participation, 60.98% of respondents participated in height and 2.91% of respondents indicating participation is quite high. The participation of notable clerics against Perda Pilkades 42.4% of respondents indicate a very high participation, 46.40% of respondents indicate high participation and 7% of respondents indicating participation is quite high.

Abstract

Era globalisasi membuat para pelaku usaha bersaing untuk mendapatkan keuntungan yang lebih besar untuk bertahan dalam berbisnis pelaku usaha kerap melakukan persaingan usaha tidak sehat. Undang-Undang Nomor 5 Tahun 1999 dan Perma Nomor 3 Tahun 2005 telah dijelaskan jenjang dalam penyelesaian larangan praktek monopoli dan persaingan usaha tidak sehat, mulai dari tahap di KPPU dan upaya hukum berupa keberatan di Pengadilan Negeri dan kasasi di Mahkamah Agung. Analisis terhadap Putusan I terjadi antara KPPU dengan PT Angkasa Pura Logistik dan Putusan II terjadi antara KPPU dengan PT Angkasa Pura II (Persero). Putusan I, KPPU memeriksa dugaan pelanggaran Pasal 17 Undang-Undang Nomor 5 Tahun 1999 oleh PT Angkasa Pura Logistik. Atas putusan tersebut PT Angkasa Pura Logistik  mengajukan keberatan di Pengadilan Negeri Jakarta Pusat yang menyatakan PT Angkasa Pura Logistik tidak berbukti melanggar Pasal 17, kemudian KPPU mengajukan keberatan terhadap putusan tersebut dan mengajukan kasasi ke Mahkamah Agung yang dalam amar putusannya membatalkan Putusan Pengadilan Negeri tersebut. Berbanding terbalik dengan putusan II oleh PT Angkasa Pura II (Persero). Atas putusan KPPU, PT Angkasa Pura II (Persero) mengajukan keberatan di Pengadilan Negeri Tangerang yang menyatakan PT Angkasa Pura II (Persero) tidak berbukti melanggar Pasal 17, kemudian KPPU mengajukan keberatan terhadap putusan tersebut dan mengajukan kasasi ke Mahkamah Agung dalam amar tidak dapat dibuktikan PT Angkasa Pura II (Persero) melakukan praktek monopoli dan atau persaingan usaha tidak sehat. Kedua putusan tersebut dianalisis karena amar putusan akhir yang berbeda dan sudah berkekuatan hukum tetap (inkrah).Tujuan penelitian ini adalah untuk mengetahui penerapan pasal 17 Undang-Undang Nomor 5 Tahun 1999 dan mengetahui pendekatan oleh KPPU, Pengadilan Negeri dan Mahkamah Agung dalam Putusan I dan Putusan II. Penggunanan metode yuridis normatif dalam penelitian ini  didapatkan dua kesimpulan yaitu pertama; penerapan Putusan I terpenuhi unsur-unsur Pasal 17 Undang-Undang Nomor 5 Tahun 1999 karena pelaku usaha tidak termasuk pengecualian dalam Pasal 51 Undang-Undang Nomor 5 Tahun 1999 dengan klasifikasi BUMN, tetapi terdapat peraturan dan izin yang tumpang tindih antara peraturan yang satu dengan yang lainnya. Sementara pada penerapan Putusan II tidak terpenuhi unsur-unsur Pasal 17 Undang-Undang Nomor 5 Tahun 1999 karena termasuk dalam pengecualian Pasal 50 huruf (a) dan Pasal 51 Undang-Undang Nomot 5 Tahun 1999. Kesimpulan yang kedua yaitu penerapan pendekatan dan penerapan pada Putusan I dan Putusan II oleh KPPU menggunakan pendekatan rule of reason. Berdasarkan Pasal 5 ayat (4) Perma Nomor 3 Tahun 2005 pemeriksaaan keberatan dilakukan hanya atas dasar putusan KPPU dan berkas perkaranya, sehingga tidak dimungkinkan pembuktian mendalam seperti KPPU atas perintah dari Pengadilan Negeri. Sebaiknya dilakukan sinkronisasi antara undang-undang dan peraturan menteri dalam pelaksanaannya, agar tidak terjadi tumpang tindih peraturan yang satu dengan yang lain
