Abstract

Service at IGD many find difficult, such as the State of the patient is not conscious and there is no family that takes, so the doctor IGD should get legal protection in the conduct of medical action. The problem occurs because the doctor IGD in conditions like this should serve patients in the shortest – in short with the doctor in the service of the response time of the IGD is less than 5 (five) minutes, in order to save lives and more disability prevention further, while the doctor IGD that is in the RS are currently limited in number.The purpose of research to analyse the implementation of the responsibility of the doctor in dealing with patients at IGD hospital. This type of research is descriptive, the juridical sociological approach is the method. The primary data source as the primary data collected from the field, and secondary data as supporting data. The data obtained were analyzed using qualitative methods, with the constant comparison analysis models and techniques of analysis done with the method of Theoretical Interpretation.Aspects of the implementation of the responsibility of the doctor IGD-positive, however there are doctor IGD substitute that does not have SIP for lack of doctor IGD especially when holiday Lebaran. Doctor who practise without having a SIP don't get legal protection, from the beginning of the Administration had broken the law and may be subject to disciplinary action from the City/County Health Department in addition to criminal sanctions as set forth in Article 76 of ACT No. 29 of the year 2004 about the practice of medicine

Abstract

The phenomenon of child sexual Purbalingga either categorized as criminal offenses in the category of sexual or violate public decency value, must be addressed. Based on the facts presented and the author of an influential hypothesis, of course, needs to be studied scientifically. Therefore, the authors consider it necessary to examine the etiology of criminal sexual crime in the region hokum Kepolisian Resort Purbalingga. This study aimed to identify and analyze the factors that influence the occurrence of sexual criminal offense in the jurisdiction of Police Purbalingga, and also to know and analyze the response of law enforcement authorities against criminal acts of sexual symptoms in the jurisdiction of Police Purbalingga. Based on this writer uses juridical methods sociological answer the problem formulation.The study states that, the factors that influence the occurrence of sexual crimes in the jurisdiction of Police Purbalingga is a factor of personal, social and cultural. In the context of individual factors or personal, encouragement of individuals who are affected by stimulus negatives that go through the learning process of self-offender among others viewed video porn, the needs of sexual desire, drinking, promiscuity negative, as well as social media that support the modus operandi , In the social construction of gender occurs reversibility, besides the cultural factors relating primarily to the culture of sexuality in any jurisdiction in Purbalingga with sexual criminal act, but its influence is very low, just as the foundation of modernity and lifestyle patterns in Kabupatren Purbalingga. The response of law enforcement authorities against criminal acts of sexual symptoms in Purbalingga among others by conducting preventive and repressive measures. Based on these facts then, should be done legal counseling, sex education counseling, legal protection of children, legal sanctions have sex with children by law enforcement officials, namely the police and prosecution. Abstract

ABSTRACTThis study aims to 1) to describe, identify and analyze physicians' authority in opening medical records of HIV / AIDS patients; and 2) to analyze and solve legal protection problems for physicians in opening medical records on HIV / AIDS patients. This study uses the legislation approach. The data obtained from interviews with Director of RSUD Majenang, Counselor of HIV / AIDS and doctors responsible for poly / AIDS RSUD Majenang. The data of the research are analyzed using deductive method. Based on the results of research and discussion, the conclusions are as follows: First, the authority of doctors in opening medical records of HIV / AIDS patients is set in Permenkes RI number 269 / MENKES / PER / III / 2008 and number 36 of 2012 on the Secret of Medicine that is only for the sake of health patient, fulfilling the request of the law enforcement apparatus in the context of law enforcement on the order of the court which must be requested in writing to the leader of the health service facility, the request and / or consent of the patient himself, the request of the institution / institution based on the provisions of the legislation as well as for the interest of research, education and medical audit as long as it does not mention the identity of the patient, as well as a condition that threatens the safety of others individually and society. Individuals in question is the person most potentially infected HIV / AIDS ie wife or husband of HIV / AIDS. Secondly, legal protection in opening medical records in HIV / AIDS patients is administered by the government in a preventive manner aimed at preventing the occurrence of disputes, leading to prudent action in the presence of various provisions set forth in the medical practice, health and health minister regulations . Protection of repressive legal protection in the event of a violation in the practice of medical services aimed at handling a particular dispute which is also regulated in the Criminal Code and legislation to ensure that physicians and patients obtain their rights and obligations in accordance with applicable laws and regulations.Keywords: Legal protection, HIV / AIDS

Abstract

Pasal 4 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menegaskan bahwa Presiden Republik Indonesia memegang kekuasaan pemerintahan menurut UndangUndang Dasar. Dalam menjalankan kekuasaan pemerintahan, Presiden dibantu oleh menteri-menteri negara yang diangkat dan diberhentikan oleh Presiden. Transformasi Unit Kerja Presiden Pembinaan Ideologi Pancasilan (UKP-PIP) menjadi Badan Pembinaan Ideologi Pancasila setingkat menteri tentunya menjadi suatu kajian yang menarik. Oleh karena itu eksistensi Badan Pembinaan Ideologi Pancasila perlu dikaji secara mendalam. Metode Pendekatan Yuridis Normatif, dengan Tipe Penelitian Preskripsi. Sumber data yang digunakan Data sekunder yang terbagi atas bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Eksistensi Badan Pembinaan Ideologi Pancasila dapat dilihat berdasarkan eksistensi statis dan eksistensi dinamis. Dilihat berdasarkan eksistensi statis Badan Pembinaan Ideologi Pancasila memiliki ide dasar yang cukup baik ditengah isu radikalisme dan terorisme. Bentuk lembaga Badan Pembinaan Ideologi Pancasila juga memiliki posisi yang strategis yaitu Badan setingkat Kementrian. Badan Pembinaan Ideologi Pancasila bertanggungjawab kepada Presiden. Sebagai lembaga negara keuangan/ budgeting Badan Pembinaan Ideologi Pancasila diatur sesuai Peraturan Presiden No 42 Tahun 2018 tentang Hak Keuangan Dan Fasilitas Lainnya Bagi Pimpinan, Pejabat, Dan Pegawai Badan Pembinaan Ideologi Pancasila, mendapatkan hak keuangan dan biaya perjalanan dinas.

Abstract

The development of fintech lending in Indonesia has increased quite significantly.The number of registered fintech lending is 136 and licensed 25, bringing the total to 161.The existence of fintech lending in addition to providing benefits, also has the potential to bring risks to lenders and borrowers. Potential risks regarding the security and confidentiality of fintech lending user data and potential risk of non-performing financing (wanprestasi). This study is a normative legal research / doctrinal legal research using the statute and conceptual approach. This study material was obtained through library research (library research), then analyzed analytically for prescriptive examination and discussion. The results of the analysis are interpreted using systematic, grammatical and teleological interpretation methods. The results of the study concluded that, legal protection to avoid potential risks for users (lenders or borrowers) fintech lending can be done through preventive, persuasive and repressive steps. To support this step, legal instruments formed by the OJK include legal substance, legal structure and legal culture.

Abstract

Under the provisions of Article 31 paragraph (1) of Law Number 32 Year 2004 on Regional Government states that, in the head region and/or deputy regional head suspended by the President without going through Parliament because the proposal was convicted of corruption, terrorism, treason, and/or a crime against state security. The article 31 paragraph (2) of Law Number 32 Year 2004 on Regional Head if found guilty by the court decision, the Regents may be dismissed. However, the anti-corruption gives another reason that, Regent who has been declared a suspect is not good to hold office, so it is polemical. This study aimed to analyze the determination of the status of the suspect for the Regent elected as a condition. In addition it also aimed to analyze the implications of determining the status of a suspect for the Regent elected in the general election of regional heads in the constitutional system of the Republic of Indonesia, with reaserch method of yuridis normatif.Determination of the status of the suspect for the regents elected is not a limiting factor for someone to be sworn in as regent. There are two factors that hinder a person inducted into the Regional Head, which is being accused of corruption, terrorism, treason, and/or a crime against state security or convicted of treason and/or other actions that may divide the Republic of Indonesia declared by a court decision that has obtained permanent legal force. Implications for the determination of the status of a suspect in the Elected Regent regional head elections in the constitutional system of the Republic of Indonesia is divided into three implications are the implications of Ethics and Social namely the determination of the status of suspects for Elected Regent cause public distrust of the government. Political implications that gave birth to the other party the opportunity to become head of the region, as well as the legal implications of determining the status of a suspect for Regent ie not inhibit a person to induct regent elected as regent, since the Local Government Act only regulates the dismissal of the Regent, Regent's selected instead.Key Word: regent, implementation, and prinsons status

Abstract

Evidence of narcotics is forbidden and the goods that are harmful, deprivation of evidence of narcotics within the provisions of Article 101 paragraph (1) of Law No. 35 of 2009 on Narcotics is the thing that is right. Reason or rationale for the seizure of narcotics evidence to the State have legitimate reasons or technical reasons or practical. For legitimate reasons set forth in the provisions of Article 101 paragraph (1) of Law No. 35 of 2009 on Narcotics whereas technical or practical reasons provide facilities for research institutions and the pharmaceutical industry to obtain narcotics. Abstract

The issuance of Law No. 2 of 2012 on land acquisition (land procurement law) as a legal basis for the government to be doing activities that require land development is expected to ensure legal certainty in land acquisition and sense of fairness to the parties affected by land acquisition. This study aims to analyze the provision of land for the construction of the public interest in Cilacap district and analyze the normative constraints encountered in land acquisition in Cilacap district by Act No. 2 of 2012. The method used is a normative juridical approach uses the method legisme legal positivism, which argues identical with the norms made written and promulgated by agencies or officials of the state. The acquisition of land for public purposes under Law No. 2 of 2012 in Cilacap district includes four (4) phases: Procurement Planning soil; Preparation of the Land Acquisition; Implementation of the Land Acquisition; Submission of Results. Form of compensation in land acquisition is in the form of money, in land, resettlement, ownership or other form approved by both parties. Normative constraints faced is the lack of synchronization and harmonization seen in the regulations implementing the land acquisition law is under preparation that implementation is set in Central Java governor regulation number 18 of 2013 which is about the team and the preparation of the study team. The existence of disharmony in the BAL procurement law is seen also at the time of submission of proof of rights to land at the disposal of land rights can not be contested in the future (Land Acquisition Act article 42 paragraph (2) and (3)), is not exactly.
