Abstract

Tenggang waktu dalam peradilan Tata Usaha Negara menjadi bagian yang sangat penting untuk diperhatikan bagi pihak yang merasa kepentingannya dirugikan oleh Keputusan Badan atau Pejabat Tata Usaha Negara. Tenggang waktu menjadi hal yang sangat penting karena dalam mengajukan gugatan di Pengadilan Tata Usaha Negara persoalan tenggang waktu pengajuan seakan menjadi hal yang sering terabaikan sehingga bagi pihak-pihak yang merasa dirugikan mereka tidak memiliki kesempatan untuk mengajukan gugatan di Pengadilan Tata Usaha Negara. Oleh karena itu beberapa ketentuan dan regulasi tentang tenggang waktu pengajuan gugatan oleh pihak ketiga dalam perkara tata usaha negara diantaranya Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara, Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, Peraturan Mahkamah Agung Nomor 6 tahun 2018, serta SEMA Nomor 3 Tahun 2015 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2015 sebagai Pedoman Pelaksanaan Tugas bagi Pengadilan.

Abstract

Identity politics does not only exist in Indonesia, even in the United States, identity politics has existed and developed much earlier than in Indonesia. Talking about identity politics, of course, cannot be separated from the interests of groups which are represented as public views. The scheme created by the group changed in such a way that it could not be separated from the goal of mass mobilization. Therefore, the narrative of identity politics is closely attached and becomes the ultimate weapon for groups that have an interest in profiting from it. Politics is an ideal way for people to express their aspirations and demands for change as well as a means of realizing a social order in the life of the state.

Abstract

This paper analyzes the legal cases, namely Plessy v. Ferguson (1896) and Brown v. Board of Education of Topeka (1954), with the Rancièrian philosophical approach. Those two cases were chosen because it contains controversial legal facts, namely the issue of racial segregation. The court's decision on Brown v. Board of Education of Topeka (1954) has been an important milestone because it does not follow the precedent in Brady v. Ferguson (1896) that has legitimized racial segregation applied publicly through legal policies. This paper concludes that the subject of the political which carries equality as a axiom of politics can not only emerge from outside the police, it can also emerge from within the mechanism the police itself through the figures of the emancipated judges in the court.

Abstract

Extention of the term of office of the President and/or Vice President is considered unconstitutional. Because it is contrary to the original intent and spirit of the 1945 Constitution. However, legal political efforts can be made constitutionally to extend the term of office of the President and/or Vice President through legal changes to the constitution. In addition, it is also necessary to strengthen the parliament in order to create a balance of power between the legislature and the executive in order to achieve democratization in the future state administration

Abstract

The social security program as mandated by the Indonesia Constitution is the basic responsibility of the government in terms of providing social protection to its people, with the hope that the Indonesian people will be able to achieve a prosperous life. The goal to be achieved by the government with the establishment of a social security system is to provide certainty of social protection and welfare for all people. The research method used in this research is normative juridical which makes the rule of law a norm. The results obtained from this study are that the financial investment system at BPJS Ketenagakerjaan is based on Rule Number 24 of 2011 concerning the Social Security Administering Body which in general there are three sources of investment in BPJS Ketenagakerjaan, which is a separated state asset. and not divided into shares, the result of the transfer of assets of the State-Owned Enterprises that organize social security programs, the results of the development of BPJS assets. And until now BPJS Ketenagakerjaan also does not have a clear legal instrument to make the basis for making cut loss policies for corporate actions on shares, so so far the management of BPJS Ketenagakerjaan has never taken cut loss actions.

Abstract

The role of custom in society becomes an unwritten law, customary law is usually considered as law that arises from the community because it originates from habit, apart from that customary law is also considered (living law) but if the reality is carefully examined then from the point of view of customary law will be known. which living customary law can be observed from everyday behavior, which living customary law can be observed from everyday behavior. This research method is qualitative to explore experiences and the opinion of key informants about the customary sanction of engagement in Huta Pasir village, Simangambat sub district, North Padang Lawas district. Research study approach field using observation and interviews. The results of the research in the village of Huta Pasir, Simangambat district customary sanctions are considered as laws that apply in the community and are followed by other communities, one of which is about the customary sanctions of engagement, the sanction is that if both parties violate the customary promise, they both pay the loss of one another. twice as much as bolina , a kind of dowry given by men to women.

Abstract

Determination of Child Friendly Schools (SRA) is organized through two stages. They are the preparation and planning stages and the establishment and development stages. Based on the Child Friendly School Guidelines, at the establishment and development stage, six components were verified, one of them was the SRA policy component. According to the author, the process of determining the SRA is dynamic, so it is not enough if only the verification process is carried out. In order for the assessment of the components of the SRA policy at the establishment and development stage to obtain accountable results, the assessment must be based on values. Assessment methods that can be carried out include verification methods, analytical rubric measurements, surveys, written tests, written essays, oral questions and answers, oral or written comments, homework, self/peer assessment methods, portfolios, simulations, demonstrations, and observation method.

Abstract

This paper analyzed the use of the Universal Declaration of Human Rights in Indonesia legal system. The research conducted through examining UDHR within Indonesian legal documents such as act (undang-undang), parliament decree (Tap MPR), and the decision of Constitutional Courts. This paper found that UDHR is being used in various ways. In some practice, it is stipulated in the considerans/preamble, contained in the article, in the explanatory section, and or as the attachment of the act/decree. In the Constitutional Court decision, the UDHR is used at least in two ways: as the backbone of the argument or as the supplement of the argument. This paper concluded that while the use of UDHR in Indonesia legal system may vary, but it at least signify the existence of the UDHR which should no longer be considered as “soft law”.

Abstract

The decision of the Constitutional Court Number 22/PUU-XV/2017 has an impact on the fulfillment of the basic rights and constitutional rights of citizens, especially in terms of marriage. The logical consequence of the Constitutional Court's decision is that there is a change in the norms of Law Number 1 of 1974 concerning Marriage, which reaches the age limit for marriage. Article 7 of Law no. 1 of 1974 stipulates that the minimum age for marriage for men is 19 years and for women 16 years. The regulation was amended through Law no. 16 of 2019 which stipulates the minimum age for marriage for men and women who will marry is at least 19 years old. Changes in the minimum age for marriage have an impact on dispensation for marriage. The existence of a "marriage dispensation" whose authority is given to religious court judges is a double-edged sword which sometimes becomes a challenge in preventing early marriage
