Abstract

The Constitutional Court as mandated in the constitution has a function as a guardian of the constitution, therefore, if there are norms in the Act that against to the 1945 Constitution of the Republic of Indonesia can be done by a trial. The decision of the Constitutional Court in the trial of the Act is related to the formal and material aspects, then the verdict that has been fulfilled the legal considerations by the judge, it will become the basis of a decision. Therefore, the verdict can not revoked arbitrarily unless in making decision due to coercion or negligence. The thesis deals and focuses on two aspects: First, showing and analyzing the considerations of the Constitutional Court in deciding the case No.012-016-019 / PUU-IV / 2006, No.19 / PUU-V / 2017, No.37-39 / PUU-VIII / 2010, No.5 / PUU-IX / 2011, No.36 / PUU-XV / 2017. Second, explains why the Constitutional Court inconsistency in determining the status and legal position of the KPK (Corruption Eradication Commision) through its verdict. From the new latest verdict of the Constitutional Court said that the KPK is an independent state institution under the executive authority , it is different from the previous four Constitutional Court decisions which said KPK as an independent state institution.

Abstract

The excess housing in the Indonesian Correctional Institution does not abate. This condition is faced with criminal efforts which should be a final diversion related to the effort to include convicted persons in Corrections Institutions. The aim is to analyze whether the mediation of penal as the application of Restorative Justice can be an alternative effort to minimize excess occupancy inmates in correctional institutions. The use of this research as a recommendation for law enforcement officials in the handling of criminal acts by promoting penal mediation. The research uses normative legal research methods with literature studies. Mediation Penal is considered able to be an intermediary process of mediation or peace between perpetrators of criminal acts with victims of criminal acts as minimizing the excess occupancy that starts from handling the police and prosecutors stage.

Abstract

President of the Republic of Indonesia, Joko Widodo said that, based on a number of calculations, Indonesia would perch as one of the five countries with the strongest economy in the world in 2045, when it entered Indonesia 100 years with millennial generation at the peak age of 40-51 years, and this is a productive age. Indonesia has the potential to be shared. 263 million population, who live on more than 17,000 islands consisting of 34 provinces and 514 cities / districts. This community is plural and part of 714 tribes with 1,100 more local languages. Although the majority of the population adheres to Islam, there are many residents of other religions too. No less important to note, that the implementation of decentralization in Indonesia shows the fate and quality of 2/3 (two thirds) of the citizens’ lives, in practice, is largely determined by local government performance of services, ranging from environmental sanitationissues, such as waste management, school quality and health services. Everything depends on the high-low of public services quality in the area. The economic development in Indonesia, especially the legal matters, there is something that needs to be considered, that the law in Indonesia moretowards criminal sanctions against companies, thus carrying the image that, if you want to be an entrepreneur, be prepared to be in prison. And this give opportunities for the officials trap in the abusement of power. A series of datas, regional officials arrested, 24 governors and 115 regents /mayors by the Corruption Eradication Commission (KPK) in 2004-2019. The majority of cases are related to bribery and gratification.

Abstract

PANDI (Indonesian Internet Domain Manager) Special authority is given to manage Indonesian domain names on the basis of law and their authority is stipulated in Law No. 23 of 2013 concerning Domain Name Management. PANDI's failure has been considered since the domain dispute between (bmw.co.id) and (bmw.id). There is no synchronization between domian (.co.id and .id) under the authority of PANDI. This research uses descriptive qualitative method.Qualitative method is a research method which in nature provides an explanation using analysis. In practice, this method is subjective in that the research process is more visible and tends to focus more on the theoretical foundation, with research methods aimed at explaining an event that is happening now and in the past. Domain is, the address on the internet that contains electronic data information, which can be accessed anywhere with an internet network on the website, the domain is needed to accelerate the development of information and communication and also in material and non-material transactions, there are many things that must be addressed regarding supervision Several Indone domains between: There is a need for firmer supervision by PANDI in terms of synchronization between dominance (.co.id) and (.id). There needs to be a synchronization between Government Regulation on Communication andInformation number 23 of 2013 concerning the management of Indonesian domain names, with law no. 20 of 2016 on Trademarks and Act No. 19 of 2016 amending the Law No. 11 of 2018 on Information and Electronic Transactions There needs to be a revision of Law No. 23 of 2013 concerning Management of the name Domaian Indonesia. The need for new legal policies that can provide a deterrent effect on crime in the field of cyber-specific domains. To avoid the many problems that will arise in the future about the Indonesian Domain some of the above need to be executed more quickly.

Abstract

Penyelesaian tindak pidana biasa bermotif ringan dengan model restorative justice, dapat dilakukan jika syarat -syarat restorative justce telah terpenuhi antara lain pelaku telah mengakui perbuatannya dan menunjukkan rasa penyesalan yang mendalam, korban dan atau keluarga korban berkeinginan untuk memaafkan pelaku. Selain itu kelompok masyarakat mendukung dilakukannya musyawarah, terutama perbuatan itu memenuhi kualifikasi tindakpidana ringan. Jika hal tersebut terpenuhi maka aparat penegak hukum seperti Kepolisian dapat melakukan pendekatan restorative justice melalui forum mediasi penal diruang mediasi selama berlangsungnya proses pemeriksaan. Tujuan kesemuanya dilakukan adalah untuk diperolehnya asas keseimbangan di dalam masyarakat. Pengoptimalan lembaga adat yangdimiliki beberapa daerah, sangat mendukung untuk dilakukannya restorative Justice. Modelini dirasakan keadilannya, hal itu disebabkan di dalam masyarakat Indonesia telah terinternalisasi dan diakui eksistensinya.

Abstract

To eliminate or at least minimize the misuse of village funds, paralegal participation is needed. Paralegals are people who can optimize various opportunities to overcome the legal problems that exist in the village. Law Number 16 of 2011 concerning Legal Aid has given juridical legitimacy to the existence of a Paralegal as part of the legal aid provider. What is meant by legal aid is legal services provided by legal aid providers for free to legal aid recipients. Legal aid is provided by legal aid organizations or community organizations that provide legal aid services, which include exercising power of attorney, assisting, representing, defending, and / or carrying out other legal actions for the legal benefit of the recipient of legal aid. In its implementation, the legal aid provider is given the right to recruit lawyers, paralegal, lecturers, and students of the Faculty of Law. In the Judicial Review Decision, it was stated that the Paralegal did not carry out the advocate function but carried out the function of assisting lawyers. So the ability between Paralegals and Advocates is judged to be indeed far different and cannot be aligned. Paralegals should be grateful to Advocates and the Supreme Court for creating legal certainty over the functions of the Paralegal so that they do not collide with the functions of the Advocate profession and still maintain the position of the Paralegal in law in Indonesia. This Supreme Court ruling should be appreciated by all groups because it has achieved three legal objectives namely justice (gerechtigheit), expediency (zwechmaerten), and certainty (rechtssicherkeit.) As stated by a legal expert named Gustav Radburch.

Abstract

Currently, registration and registration of intellectual property in Indonesia are still deficient compared to other countries. Therefore, it is necessary to research the registration and recording of intellectual property that is still low and efforts to improve the registration and recording of intellectual property in Indonesia. This study wants to find out the cause of registration and recording of intellectual property so that the required data is secondary data and primary data. Therefore, this research used normative and sociological legal research methods together to be able to complement each other. Based on the results of the study can be concluded as follows. Registration and recording of intellectual property in Indonesia are still low because the public does not know much about registration and recording. Also, the public feels free to do registration and recording because the enforcement of intellectual property law is still low as law enforcement is still not firm in the event of piracy of intellectual property. Various efforts have been made to increase the registration and recording of intellectual property in Indonesia, among others, through the enforcement of intellectual property laws that are getting better and registration and recording of intellectual property that is getting easier and cheaper.

Abstract

During the trial, witnesses were often found retracting the testimony of witnesses given during the investigation (Police) in court. There are many reasons that the revocation is given by the witness to revoke the witness's BAP that has been given before the investigator. The problem studied is how the consequences of the revocation of the BAP in front of the trial affect the judge's decision in Decision No. 201/Pid.Sus/2018/PN Simalungun. The research method uses a normative juridical approach, which is an approach based on the main legal material by examining theories, concepts, legal principles and legislation. In Decision No. 201/Pid.Sus/2018/PN Sim that the strength of the evidence of the witness's BAP becomes an integral part of the investigation file and is finally transferred to the District Court for trial, it has become evidence of affidavits. That the consequence of the revocation of the witness's BAP before the trial in Decision No. 201/Pid.Sus/2018/PN.Sim did not affect the judge's decision to convict the defendant, because the Panel of Judges considered that the revocation of the witness's BAP did not have a strong reason and the defendant's actions were also categorized as extraordinary crime.

Abstract

In accordance with the decision of the Constitutional Court Number 97 / PUU-XI / 2013, the Constitutional Court is no longer authorized to resolve disputes on direct election results, because the provisions of Article 236C of Law Number 12 Year 2008 NRI are against the Constitution of 1945. Article 157 paragraph (1) Law No. 8 Year 2015 determines that the dispute settlement on direct election results become the authority of specialized judiciary. But before a specialized judiciary is formed, then the Constitutional Court is authorized to resolve disputes on direct election results. The authority of the Constitutional Court is the constitutional authority to fulfill temporary legal vacuum (rechtvakum). Therefore legislators should immediately establish a specialized judiciary which has the authority to resolve the disputes on direct election results.
