Abstract

The guidance of prisoners conducted under the Correctional system aims to getinmates prepared according to reunite with the community, so as to te-act as to be afreeman and have responsibility as member of society. To make the purpose happen, one ofthe efforts that have been made is assimilation. Based on the introduction and to get thesolution, the author formulate some of the problems such as follows: 1. How is theimplementation of guidance of convicts in the stage of Assimilation in Class IIA StatePenitentiary of Padang that has been applied so far? 2. What are the problems inimplementing the assimilation of prisoners in the Class IIA Penitentiary of Padang andhow to overcome these obstacles? 3. How good is the prospect of implementing theassimilation as an effort to foster prisoners based on the Correctional Law? The methodused in the thesis is analytical descriptive with normative juridical approach. Alsosupported by an empirical juridical approach. The data source that author use issecondary data and primary data. The data obtained were analyzed qualitatively andpresented in analytical descriptive form. Based on the results of research and discussion, itcan be concluded that the Implementation of Prisoners Assimilation Stage in Class IIAState Penitentiary of Padang has been implemented in accordance with applicableprocedures, but actually the implementation of it, constraints and obstacles has been foundwhich experienced by warden and prisoner itself, the lack of socialization of officers toprisoners, Family visiting can not run well due to overcapacity, there is still unenthusiasticattitude from some inmates in following assimilation activities, guarantors that are not inaccordance with the rules, the absence of family as a guarantor, out of town guarantor, theJustice Collaborator (JC) processing difficulties, the lack of budget within theCorrectional Institution.

Abstract

Act No. 12/1995 on Corrections mandates that prisons are not only places to serve punishment for criminals, but also places for coaching while also educating prisoners. Child prisoners also need to be given special attention so that they have the ability to adapt and obey the rule of law applicable after serving time in the penitentiary. However, in practice because the pattern of guidance for child prisoners is similar to the pattern of guidance applied by adult inmates and overcapacity, so that the guidance given does not match what is expected, consequently the child returns to the penitentiary for the second time.

Abstract

The human rights of the suspect in the case of detention as provided for in Articles 58, 59, 60, 61, 62 and 68 of the Criminal Procedure Code. At Pasaman Barat Police resort often violations when arrested. Issues discussed about the implementation of the protection of suspects' rights in detention at the investigation level at the Police of West Pasaman and the Investigator's Accountability at Pasaman Barat Police resort on violation of suspect's right in the case of detention. The research specification is analytical descriptive research with Normative juridical approach as the main approach and supported by juridical approach empirical. Based on the results of the first study, the protection provided by investigators at the Pasaman Barat Police Resort on suspects in the case of detention is the health care for the sick suspects, performing worship, contacting and receiving visits from relatives, sending and receiving letters to his legal counsel and his family. Another protection is the provision of suspension and transfer of forms of detention. Second; The responsibility of the investigator for violation The suspect's right to detention is the provision of compensation and rehabilitation. The accountability of the investigator by code of ethics is in the form of demotion / position and even dismissal when carrying out a strenuous act contrary to the code of ethics of the Police.

Abstract

The implementation of intelligence tasks within the Police is regulated in Article 39 of theRegulation of the Chief of Police of the Republic of Indonesia Number 23 of 2010. Thefunction of the Intelligence and Security Unit of Solok Selatan Police Resort has been tocarry out early detection and investigation of alleged mining crime. Seen from 2012 until2014 has been completed investigation followed up with the investigation of mining crime.The problem is optimizing the function of Satintelkam Polres Solok Selatan in theinvestigation of mining crime and obstacles encountered in the investigation. Specificationof this research is an analytical descriptive research with sociological juridical approach.The results show: first, optimization is done by conducting special and advancedintelligence education, conducting intelligence training in the field of mining crime, andestablish cooperation with related parties and communities. Both obstacles in theinvestigation of mining crime are lack of personnel capability and personnel behavior thatoften cooperate with the perpetrator as well as lack of supervision and control. Externally,the obstacles faced are most people are not providing information about the existence ofmining crime.

Abstract

Article 50 of Law Number 8 Year 1981 regarding the Criminal Procedure Code provides for the protection of the human rights of suspects for immediate investigation. the strict conception of the Criminal Procedure Code concerning the deadline of investigation resulted in legal certainty. The problem is the concept of setting the deadline for the investigation of current and future criminal acts. Specification of this research is analytical descriptive research with normative juridical approach. The result of the study states that the deadline for investigation is not determined in a limited manner in the Criminal Procedure Code. Article clause which implies the deadline of investigation is Article 24, Article 106 on the obligation of the investigator to immediately conduct investigative action. Article 109 paragraph (1) concerning notification of implementation and termination of investigation to the prosecutor. The deadline for investigation can be found in Kapolri Regulation no. 12 Year 2009 on Supervision and Control of Criminal Case Handling in Police Environment. Secondly on the draft Criminal Procedure Code has been confirmed by the deadline of investigation. The Judge of the Preliminary Examiner is authorized to assess the course of the handling of the case. In Article 12 of the Criminal Procedural Laws the transfer of investigation to the public prosecutor shall not be responded to by the investigator. Furthermore, in Article 13 paragraph (1), Article 15 and Article 88 paragraph (1) s / d paragraph (4).

Abstract

The investigation was carried out to gather sufficient evidence that a crime had indeedtaken place. In the Mentawai area there are cases of decency crime with child victimsresolved by giving customary sanctions to the perpetrators. This research is legal researchwith analytical descriptive specifications. Investigation of decency crime by SatreskrimMentawai Islands Resort Police is carried out by receiving reports from victims and / ortheir families, victims placed in Special Service Rooms (RPK), then inspected, cooperatedwith psychiatrists, and providing shelter for victims Regarding the case of decency towardsthe child that has been reported and the investigation begins if it has been resolved bycustom, the parties will ask the investigator to stop the investigation. The obstacles ininvestigating the Mentawai Islands geographical factors which consist of many islands andthe difficulty of inter-island transportation have led to investigations sometimes having tobe carried out for a long time. was stopped because it had been resolved by custom andrequested by the local government to be stopped by the investigation process.

Abstract

One of the efforts to apply restorative justice by the police in the settlement of trafficaccidents cases is to use penal mediation mechanism as part of the application ofdiscretion as regulated in Article 18 of Law Number 2 Year 2002 concerning Police of theRepublic of Indonesia. The use of discretion by means of penal mediation is possible inminor traffic accidents that the victim usually suffers only material loss. With theincreasing number of traffic accidents, where many accidents cause injuries, both minorinjuries and serious injuries, it can actually be resolved using the peace efforts between theperpetrator and the victim in the mediation of penal based on the authority of the Policefrom the legal settlement through mechanism of criminal justice system.

Abstract

Article 1 paragraph (1) Emergency Law Number 12 of 1951 describes ownership and use of firearms and sanctions that can be obtained when taking actions that contradict these rules. One of the important roles carried out by the West Sumatra Regional Police Headquarters, destroyed as many as 816 illegal illegal firearms (senpi), the result of Operation Sapu Jagad. This illegal weapon, commonly called Balansa or Gobok, is used by the community to hunt pigs or other disturbing pests. But there are also used by the community for criminal acts that cause victims. This research is an analytical descriptive study, the role of the Directorate of Security Intelligence at the West Sumatra Regional Police in investigating the abuse of illegal weapons in the West Sumatra Regional Police jurisdiction plays a role in repressive actions by conducting a series of preventive investigations and actions, namely conducting patrols and illegal firearms raids , through these actions the Directorate of Security Intelligence throughout 2013 to 2018 received 4 (four) Police Reports related to ownership of firearms by the public. The obstacles faced by the West Sumatra Regional Police Security Intelligence Directorate in investigating illegal weapons abuse, can be seen from internal constraints related to human resources, the budget is still not optimal, inadequate infrastructure and facilities, information coordination, and legislative constraints, while external constraints: lack of community roles, geographical constraints, lack of coordination with local government and nongovernmental organizations. Efforts to overcome these obstacles have been carried out by the Directorate of Security Intelligence by providing training, socializing and cooperating with local governments and non-governmental organizations.

Abstract

One of the objectives of the enactment of Law Number 23 Year 2004 on the Elimination ofDomestic Violence (PKDRT) is to maintain the integrity of harmonious and prosperoushouseholds. The police have the authority to enforce the law and ensure the security andorder of the people. The task can not be done only to rely on the legislation, therefore thepolice are given the authority to do the discretion of the police. In the writing of this thesisthe author discusses about the analysis of police discretion conducted by policeinvestigators in Polresta Padang in order to investigate the crime of violence in thehousehold . Related to this the type of research specification used is descriptive analytical.Based on the result of research that discretion act by the investigator in the settlement ofCriminal Act of Domestic Violence in Padang Polresta law area consist of: mediationeffort which initiated and done by Polri, termination of case and case waiver of case ofkekerasn in that household. There are two factors that can drive the discretion action are:internal factors and external factors. This internal factor is based on the legal basisapplicable to the exercise of discretionary authority by the police as well as the ordersfrom superiors to settle criminal cases which can be resolved through the ADR mechanismand for external factors namely the support of the community, and the goodwill of the thelitigant to solve his case in the best possible way. The obstacles faced in theimplementation of police discretion in the investigation of Domestic Violence Crime byPPA Unit Sat Reskrim Poresta Padang is the absence of a rule of law that specifically andfirmly regulate the police discretion itself applicable in the legal system in Indonesia atthis time, so that in the existing rules currently requires investigators to follow up onincoming cases. In other words investigators are required to process all incoming cases inaccordance with applicable legal procedures.
