Abstract

The crime of rape of a child is part of a sexual crime, provided for in act No. 35 of 2014 on Amendment to act No. 23 of 2002 on Child Protection, which in the law regulates about sexual intercourse committed against children is contained in clause 81. Cases of child intercourse is one of the cases that became the scourge for the community and entered the stage of concern, because every day the crime rape involving children as victims we often hear and we know from various mass media. This happens not only in the school environment, home environment (neighbors), even in the family environment.Based on the above background, the authors formulate the problem as follows: First, how the implementation of legal protection for children victims of criminal rape in Polres Solok Kota? Second, what are the constraints faced in implementing legal protection for child victims of crime of rape and how to overcome these obstacles by Polres Solok Kota?The research that the authors do is an analytical descriptive study that describes the data as it is to then performed an analysis of the data based on relevant rules. The approach method used is the normative juridical approach that is a study that emphasizes or refers to the legal norms contained in legislation relating to diversion. This approach is also supported by an empirical juridical approach, namely by looking at how legislation is applied in field practice. The data source used is primary data and secondary data. The data obtained were analyzed qualitatively and presented in analytical descriptive form.Based on the results of research and discussion, it can be concluded that the legal protection provided by the investigators Polres Solok Kota in the form of the application of criminal provisions in accordance with the law of child protection and attention to the rights of children, providing easy access to information about the development of the case, public and safety assurance to child victims. The obstacles encountered by Solok Kota police investigators are first, from the victim's own children who feel shame, trauma and fear, overcome by providing understanding and assistance by parents / guardians / trusted people during the examination. Secondly, from uncooperative family side, so the investigator Polres Kota Solok provide legal understanding to the victim's child's family first. Thirdly, unlike the perception of law enforcement officers, regular coordination is required. Fourth, facilities and infrastructure in the area are still limited, so the government should try to equip all facilities and infrastructure needed for legal protection of children.

Abstract

Disparities in punishment are often related to the independence of judges becausethe punishment model set forth in the Criminal Code only formulates maximum criminalsanctions only, in addition because Law Number 48 Year 2009 on Judicial Power alsoprovides that: The judge must also consider the good and evil nature of the defendant. Thedisparity of the decision of this judge occurred also in the District Court of Sawahlunto onthe case of narcotic criminal acts which examine and decide the case of narcotics crimewith the same panel of judges and the indictment of the same article but the decision givento the defendant varies.

Abstract

To fight for human interests in seeking justice, environmental law provides a route toresolve problems that harmonize the economic and social interests of Citizen Lawsuit.Citizen Lawsuit is essentially a mechanism for citizens to sue state officials liable fornegligence in fulfilling the rights of citizens. Therefore, on the basis of his negligence, inthe petitum of the lawsuit, the state was punished for issuing a regulation (regeling) so thatthe negligence did not occur again in the future.

Abstract

Criminal narcotics committed by children violating the law and contrary to the values andnorms in society, protection of children is very important, considering that children are thenext generation of the nation. This requires legislation that protects children from variouscriminal acts, namely Law Number 35 of 2014 concerning Amendments to Act Number 23of 2002 concerning Child Protection and Law Number 35 of 2009 concerning Narcotics.The purpose of this law itself is to protect children's rights from all kinds of actions.Children are someone who is in a period of growing and developing, Handling of childrenwho face legal problems in this case facing the problem of distributing narcotics must bedone by prioritizing the best interests for the child. The number of cases of narcotics abusetoday is increasingly troubling our lives, narcotics which are now no longer looking atage, ranging from children, adolescents to parents can be included in this drug abuse trap.And like the case that happened in Pasaman where there were children who committednarcotics crime and sought to be given protection for the child. Based on the results of thediscussion and analysis, it can be concluded that: First, the legal protection of childrensuspected of narcotics crime in Pasaman District Police Station is carried out by the childinvestigator of Pasaman District Police, accompanied by social counselor (PK) and whenthe investigation is made, the case is adjusted accordingly, not exposing the case to themedia, in his examination accompanied by a lawyer, presenting Bapas and attempting thechild not to be arrested but obliged to report, Second Constraints encountered in the effortto provide legal protection to the child of the suspect in the Narcotics crime at thePasaman Police Station are the limitations of child investigators who have Inauguration isstill reduced and the lack of facilities and infrastructure such as child detention is notavailable, the Bapas office is far away, namely in Bukittinggi so it is difficult to presentCommunity Guidance (PK).

Abstract

Based on the results of the study concluded that First, the application of traditional nagariprisons in the enforcement of customary criminal law in Nagari Tigo Jangko there areseveral stages which consist of being caught being immoral, they are escorted to thenagari guardian's office. The male perpetrator was put into Nagari Prison which waslocated next to the Nagari guardian's office, while the female was put into the Nagariguardian's office. In Nagari Prison the perpetrators are shown to the public(approximately 3-5 hours). In the span of a few hours, Ninik Mamak the perpetrator,religious leader, adat and nagari apparatus held a meeting in adat density to determinethe customary punishment that could be imposed on the perpetrator. Then the perpetratorswere taken by the police to the Lintau Buo Sub-district Police Station located in Pangian,if there was a criminal element in it (National Criminal Law). Second, the legitimacy of theNagari Tigo Jangko customary prison against immoral crime is a strategic role inregulating the implementation of the nagari government. The customary prison in NagariTigo Jang¬ko has been regulated in the local nagari regulations and has the agreement ofthe customary and youth stakeholders, in the event that the relevant violations will first beconvened at the Nagari Indigenous Peoples Office by nagari and pucuk leaders localcustoms and if found a committed violation fined customarily and put in a customaryofficer for one day or before the hearing in KAN is finished, if the perpetrator's actionthere is an element of criminal offense, the perpetrator will be handed over to the Polsek,but the offender is not fined by custom.

Abstract

Diversion according to Article 1 number 7 of Act Number 11 of 2012 concerning the ChildCriminal Justice System is the transfer of settlement of Child cases from criminal justiceprocesses to processes outside of criminal justice. Diversion is to settle criminal casesinvolving children as perpetrators and children as victims. The implementation ofdiversion is intended to avoid negative effects and stigmatization of children so thatchildren are expected to return to the social environment fairly. The Payakumbuh DistrictAttorney also conducted a diversion of cases of criminal acts of violence against childrenthrough a process that turned out to be not as simple as expected, so that it encounteredobstacles in resolving cases of children facing the law.

Abstract

The court without trying to resolve it first at the nagari level through the Adat NagariKerapatan Institute (KAN). In addition to the problem of lack of trust in customary institutions, filing a case directly with the Court is considered to have a value of prestige and self-esteem in this case which makes it difficult for the Judge to attempt to reconcile parties who litigate in addition to the absence of strict regulations regarding peace efforts in the Court. Based on the description of the background above, the writer wants to conduct research and realize in a scientific work in the form of a thesis entitled "Mediator Role in Settling Civil Cases in the District Court". Regarding the background of the problem the authors mentioned above, the problems to be addressed are as follows, First, How is the Role of the Mediator in Settling Civil Cases in the District Court, Secondly, What are the factors that influence the Mediator's Role in resolving the Civil Code Case, Third, how is the power of law against the decision of peace in civil cases in the District Court. The mediator in resolving disputes in the court should prioritize the principles of an independent mediator, even though later the mediator is chosen by the parties as mediators from the judge, but also prioritized to provide opportunities for professional mediators not judges. The important role of a mediator in resolving disputes is very important and must be active in encouraging the parties to reconcile in resolving the dispute. The mediator should not get caught up in things that will cancel the peace, for example pressing one party to accept an offer from the other party. Because the results implemented do not get the meaning of the peace, and may even get new problems later. And this is where the important role of a mediator is to carry out its function to reconcile the parties. And if necessary to approach persuasively to each party separately to find a midpoint in the peace of the parties. The legal strength of the peaceful determination issued by the mediator is a decision that has binding and final legal force, and / or in other words has been inclined and there is no more legal effort taken from each party. And if there should be a new dispute related to the same object, then the Court must institutionally reject the dispute.

Abstract

Based on the General provisions on article 1 point (4) of the Act No. 12 Year 1995Incerning Corrections Correctional Hall explains that the institution is hereinafterreferred to as BAPAS to carry out Correctional Clients guidance. Law number 11 Year2012 about the criminal justice system of the child in article 1 point (7) explains that theDiversion was the transfer of case settlement children from criminal justice processes toprocesses outside of criminal justice. In terms of legal protection and that the rights of thechild not to be broken then legal aid in children by Bapas through Civic Mentors (PK)always accompany the child to provide reinforcement psychological againstperpetrators.Based on the above, the background can be formulated as the following issues: first, howis the legal protection given to the perpetrators of criminal acts in the process of diversionby Bapas Kelas I Desert?.Second, whether the constraints faced by the communitySupervisor Bapas Kelas I Pasture in the granting of legal protection against theperpetrators of the crime? and how the effort of overcoming these constraints?.Based onthe results of research and discussion, can be summed up as follows; First, besidesperlindungan law provided by Correctional Hall class of I Pastureagainst the perpetratorof the criminal offenceby the criminal justice system diversion Children withmentoring,doing research Viablein order for rights-the rights ofason not to be broken as well asattempting to do a versioned to provide strengthening psychologically against childabuserto face the process of law faced by child abusers. Second, constraints encountered inperforming the duties of Correctional Hall class I the field include rule of law related tothe regulation of the Minister Kemenkumham, inadequate coordination with lawenforcement related implementation legislation, SPPA the low quality of human resources,lack of facilities and infrastructure, family factors clients, and budget constraints. Effortsto address these constraints need to be issued Ministerial Regulation for the strengtheningof the position of the officer Supervising the community, maximize coordination with lawenforcement related legislation SPPA, requiring PK in socialization training or educationto improve the quality of HUMAN RESOURCES, complete infrastructure, dissemination toparents of clients, as well as the need to increase the budget.

Abstract

Tindak pidana perniagaan minyak tanah tanpa izin usaha niaga adalah perbuatan yang bertentangan dengan Pasal 53 huruf d Undang-undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi. Selama ini tindak pidana perniagaan minyak tanpa izin usaha telah ditangani oleh Direktorat Reserse Kriminal Khusus Kepolisian Daerah Sumatera Barat, namun penyidikan sebagai bagian dari penegakan hukum terhadap tindak pidana tersebut tidak optimal. Berdasarkan Laporan Polisi Nomor: LP/A/416/XII/2015/SPKT Polda Sumbar, tindak pidana perniagaan minyak tanah tanpa izin usaha niaga telah diselesaikan perkaranya melalui mekanisme sistem peradilan pidana, sehingga penegakan hukumnya sudah optimal.
