Abstract

Changes in the menstrual period (menstrual cycle) because of changes in the cycle have an impact on the legal status of blood that comes out. According to Syafi'iyyah Fiqh when blood comes out for a longer time due to excessive bleeding caused by contraception it will become khiyar between menstrual blood or istihadhah blood, whereas in medical science there is no term istihadhah for women, only menstrual blood and puerperal blood. Researchers try to raise this issue as material that deserves to be studied in depth, with the title "Blood Women in Perspective of Fiqh Syafi’iyyah and Medical Science". The results showed that in Syafi'iyyah Fiqh there were several types of blood that came out of one of the female reproductive organs (womb), menstrual blood, puerperal blood, and istihadhah blood. While in medical science there were only 2 known types of women's blood, namely: menstrual blood (menstruation) and puerperium blood (puerperal).

Abstract

The abolition of apartheid does not necessarily mean the resolution of social, political, racial and ethnic questions prevailing in South Africa. In Disgrace (2000), John Maxwell Coetzee depicts racial politics and gender, Sexism, social marginalization and alienation in South Africa. The aim of this article is to pinpoint sexual harassment and black females’ abuse by the whites in Post-Apartheid South Africa. It shows whether sexual violence such as rape happens more in black South Africa than in the white community.

Abstract

The purpose of this article is to analyze the impact of urban requalification on municipal governance, taking as a starting point the Mozambican reality. The central argument is that the urban requalification had a positive impact on the municipal governance process and contributed to local development. Thus, the question that guides this article is what is the impact of urban requalification on municipal governance in Chamanculo "D" neighborhood? Therefore, this article concludes that requalification is one of the means by which the municipality of Maputo has served in its governance process to inculcate local development.

Abstract

In developing the Business Judgment System for State-Owned Enterprises (SOEs, Persero) in Indonesian Economic Law, it is necessary to elaborate on the theory of the role of law in economic development. According to J.D. Mrs. Hart has three elements that must be developed in the legal system so that the law plays a role in economic development, namely predictability, stability, justice (fairness). The role of the law, basically refers to the main purpose of the law, which is to create an orderly society. Order and balance in society need to be achieved, so that human interests will be protected in achieving their goals. In general, the law functions to divide rights and obligations, regulate how to solve legal problems and maintain legal certainty. The role of the law basically refers to the main objective of the law, which is to create an orderly society. Order and balance in society need to be achieved, so that human interests will be protected in achieving their goals. In general, the law functions to divide rights and obligations, regulate how to solve legal problems and maintain legal certainty. The focus of this paper is the interaction of Indonesian corporate law in the Indonesian Economic Law system in the management of state-owned enterprises, as one of the corporations with legal status to be able to compete globally, because this principle is a universal principle. Corporate law and globalization interact in the same social space and interests. With these interactions, it allows various possibilities, such as integration, incoordination (partial merging), competition (each running alone), conflict (conflicting), and avoidance (one of the laws avoids the enforcement of other laws).

Abstract

The study evaluates the determinants of female labour force participation in Rwanda. The specific objectives were to establish the determinants of female labour choice to working in different sectors in Rwanda, and investigate the factors which affect female labour force participation in Rwanda. To be able to respond to the research questions and objectives, the Rwanda labor force survey data of year 2018 data collected by National institute of statistics of Rwanda (NISR) was used. As this study, use national coverage data with a representative sample of 8936 households in the second round of august 2018, while the sample size in the first round of February 2018 was 8924 households. The validity and representatively of the sample was done and tested by NISR (2018). The documentation on administrative data was done to compare and triangulation of results from the survey. The documents targets were available annual reports that talk about female labor force participation rate in 2018. The data analysis was done by descriptive statistical method to analyze data into quantitative by showing frequency, percentages and cumulative percent, the cross tabulation was used to show the relationship between dependent and independent variables, and finally logistic regression models was used to predict the odds ratios and probability of being employed and access the main determinant of female labor force market outcome in Rwanda. The study findings were summarized in accordance with the research objectives. The survey respondent’s female in employment ages includes 40.1% of female from urban and 59.9% female in employment age are from rural areas. Among which almost 40.8% of female surveyed were married with one husband. It is evidenced that many females are single not yet married (34.5%). The findings show that to analyse the socioeconomic and demographic factors determining the factors of female employment in public institutions and the choice of employment using labor force survey data collected by NISR in the year of 2018. The multinomial and binary models provided almost the same trends in explaining the determinants of female employment in Rwanda, explained by near similar coefficients and odd ratios either in magnitude and sings. This technique helped to examine probable determinants of female employment and the estimation of these probabilities of being employed or being government employee. Hence, the findings of this study help us to confirm that the problem of the study was solved, research objectives were achieved, and research questions were answered where we confirmed that there are different determinants of female labour force participation in Rwanda. Government should develop the Soft skills which are important for both men and women, women may benefit more from soft skills training to foster self-esteem, decision-making, negotiation skills, and perseverance, for example. Acknowledging women’s time constraints, provide flexible schedules and various time options for participation in services (e.g., mornings, evenings, and weekends).

Abstract

Both Huineng and Martin Luther are religious reformers with great influence in the world. There are many similarities in their religious psychological thought, such as “equality of all beings”, “the bewilderment and the enlightenment in one’s mind”, “taking the cultivation of Xin as the most important”, “guidance”, and “rationalization”. However, because they are in different eras, cultures, religions, etc., their ideological differences are also very obvious, which are mainly manifested in: inside or outside, good or evil of human nature, turning suffering into pleasure currently or suffering in living for the happiness after death, no-grasping or grasping, for all beings or for oneself, without self or with self, etc.

Abstract

The drive for human resource planning in every single organization is to necessitate perfect use of human resource currently employed as well as, making provision for the future human resource needs regarding skills, quantities and ages. The purpose of this review is to ascertain the practices of HRP that can increase organizational performance. Consequently, the review discovered that HR planning ensures that organizations at all times have the right number of people, with the correct level of skills to do the right activities at the right time for the achievement of organizational objectives. Besides, human resource planning determines the right numerical strength of individuals that own these skills that are needed by organisations to meet the present and future business requirements. Based on this reality, organisations nowadays need to have employees that possess the right skills that could be place in the right places and at the right time they would be needed in organizations. In order to fulfill this condition, the study found out that HR planning ought to be part of any organization’s objective. Incredibly, many organizations have the tendency of overlooking the side of HR planning and more or less, organizations are even not totally conscious of it. Hence, it is essential to recognize that because of the high knowledge requirements in the global market, most organizations are determine to stimulate performance, which can engender surplus profit through the application of HRP philosophy.

Abstract

The Muarajambi area is a national cultural preserve with an area of 3,981 hectares covering 9 villages in 2 sub-districts. This area has quite promising tourism potential. Tourism activities in the Muarajambi Temple area are centered in Muara Jambi Village. This is due to the fact that most of the restored temples are in this area. around the main temple complex. The development of tourism is pursued by the community by forming associations and organizations, so that it can help in developing tourism in the Muarajambi Temple area. Community participation in developing tourism in the Muarajambi Temple Area is mostly done through tourism conscious groups; in general community participation is influenced by two factors. The first factor is an internal factor, internal factors that influence the Group includes a strong desire of the community to participate, a sense of concern for Group members towards the younger generation, the age of the members involved in these groups are in the productive age, and the level of education of the management also influences their participation under construction. The second factor is an external factor, an external factor that influences community participation in tourism development in the Muara Jambi village, including the large support from the government regarding community involvement in activities that support tourism. However, the role of the Muaro Jambi Regency Government which has full authority over the development of this region has not yet had an influence in the process of developing the Muarajambi Temple Area.

Abstract

Any person who has sufficient assets may inherit a portion of the assets as long as it does not harm the heirs and people who are forced to intend or will not intentionally in their will, the will is invalid. The person who has the will must fulfill the requirements, including adults, sensible, independent and of his own will. So it is not a will made by a minor child and a crazy person. In other cases when the testament inherits the estate and then he cancels the will, or the will inherits more than a third of the total assets but the heir cancels the will, then there will be a problem regarding the legality of the will and the status of ownership of the estate after the cancellation of the will. Based on these problems, a study is made to find a legal clarity that could be a reference for every policy maker. The results of the study and research can be concluded, al-Syafi'iyyah states that a will is only valid within a third of the inheritance as long as there is no permission from the heirs to testate to more than one third of the assets. exceeds the said level. A will also becomes nullified if a person who has a will cancels his will or inherited property no longer belongs to someone who has a will. Ownership of a will after the will is canceled depends on the reason and the person who cancels it. If the cancellation is carried out by the willor then the property is returned to the will of the testator, but if the cancellation of the will is due to a will that exceeds one third of the assets then the will is the right of the heir.

Abstract

Formalizing the Shari'a of Islam both in the realm of social and social life, in the state and nation are not infrequently debated, both socio-political and religious debates. The debate is in addition to understanding the teachings of religion and its relationship with the nation-state, as well as understanding the existing legal system within the country, especially that the country embraces a positive legal system that is more influenced by western law. The notion of enforcement of Islamic criminal law can not necessarily be carried out properly without any legislation and the establishment of a material Islamic criminal law as a positive law in force. Also, Islamic criminal law is a public law requiring state power both in law making and in law enforcement. In relation to the legislation and the formation of the law (qanun syariat Islam), the most interesting thing is how to determine the shape of the finger and its uqubat both belonging to the category of hudud, qisas and takzir as part of the Islamic Shari'a law enforcement system
