Abstract

The hit-and-run case that killed Selvi Amalia Nuraeni by Kevin Meikacandra has attracted public attention. This research aims to analyze the judge's decision in this case (Decision Number 386/Pid.Sus/2023/PN.Smg.) and provide its implications for law enforcement and public safety. This research uses a normative method with a statutory approach and a case approach. Secondary data consisting of primary and secondary legal materials is analyzed using a deductive mindset. The judge's decision in the Kevin Meikacandra case shows that the judge considered various factors, including elements of negligence, intentionality and the community's sense of justice. The judge sentenced Kevin Meikacandra to 4 years in prison, which was considered a light sentence by some in the community. The judge's ruling in this case has important implications for law enforcement and public safety. On the one hand, this decision shows that the judge is trying to provide justice for all parties. On the other hand, this decision also shows that there are still gaps in the legal system that allow hit-and-run perpetrators to receive light sentences.

Abstract

The construction of the National Capital City (IKN) of the Archipelago in East Kalimantan has significant implications for the customary law communities who inhabit the region. This research examines the implications of IKN development for the rights and lives of indigenous peoples based on Law Number 3 of 2022 concerning National Capital. This research uses qualitative methods with a normative juridical approach. Data was collected through document study and analysis of statutory regulations, especially Law No. 3 of 2022. The research results show that IKN development has potential positive and negative implications for customary law communities. On the one hand, IKN development can open up opportunities for access to education, health and the economy for indigenous communities. On the other hand, IKN development can also result in marginalization and deprivation of indigenous peoples' rights to customary lands and territories. Protection of the rights and lives of customary law communities in the development of IKN needs to be the government's main concern. Concrete efforts such as recognizing and establishing customary territories, involving indigenous communities in the development process, and providing fair access to resources need to be made to ensure equitable and sustainable IKN development.

Abstract

Humans as social creatures cannot be separated from interaction and potential conflict. Law enforcement is important to regulate people's lives. This research aims to determine the chronology and impact of the 2022 Kanjuruhan tragedy, examine related legal regulations, and review legal and societal aspects. This research is normative juridical research with secondary data and literature study techniques. The study results stated that the Kanjuruhan tragedy which occurred on October 1st, 2022, resulted in many fatalities and injuries. This tragedy left deep wounds and trauma as well as a negative impact on Indonesian football. The Kanjuruhan tragedy is related to law and society. Law Number 11 of 2002 concerning Sports is allegedly one of the factors causing this tragedy. In conclusion, The Kanjuruhan tragedy is a complex human tragedy with far-reaching impacts. There needs to be a revision of regulations, improvements to the governance of football matches, and education for supporters and security forces to prevent similar tragedies.

Abstract

Semarang City, as one of the metropolitan cities in Indonesia, is often hit by floods. This is caused by various factors, including regional spatial planning that is not well planned. Regional Regulation (Perda) No. 14 of 2011 concerning Semarang City Regional Spatial Planning (RTRW) is expected to be a solution to overcoming flooding problems. This research aims to analyze the effectiveness of Regional Regulation No. 14 of 2011 in dealing with floods in Semarang City. This research uses qualitative methods with data collection techniques through interviews, observation and documentation studies. The data obtained was analyzed using qualitative data analysis techniques. The research results show that Regional Regulation No. 14 of 2011 has several weaknesses in dealing with floods in Semarang City. These weaknesses include: Lack of community involvement in the preparation of the RTRW: The community was not actively involved in the process of preparing the RTRW, so that their aspirations were not properly accommodated. Lack of synchronization between RTRW and other policies: RTRW is not synchronized with other policies related to flood management, such as coastal area spatial planning policies and drainage policies. Lack of law enforcement: Law enforcement regarding RTRW violations is still weak, resulting in many land conversions occurring which exacerbate flooding problems. In conclusion, Regional Regulation No. 14 of 2011 concerning Semarang City RTRW has several weaknesses in dealing with floods. These weaknesses make this policy ineffective in achieving its goals. To increase the effectiveness of this policy, several steps need to be taken, such as increasing community involvement, increasing synchronization between policies, and increasing law enforcement.

Abstract

Kendal is located on a strategic route between Semarang and Surabaya, the two largest metropolitan cities in Central Java. Kendal has a large working age population and is relatively cheap compared to other areas in Central Java. The district minimum wage (UMK) in Kendal is low compared to other areas in Central Java. Disnakerind has an important role in enforcing regulations and protecting workers' rights. This research aims to analyze the role of the Kendal Regency Manpower and Industry Service (Disnakerind) in protecting workers' wage rights in accordance with Kendal Regency Regulation Number 101 of 2021. This research is important to carry out because wages are a fundamental right of workers which is protected by regional laws and regulations. This research uses a qualitative method with a case study approach. Data collection techniques were carried out through in-depth interviews with key informants at the Kendal Regency Manpower and Industry Office, workers and entrepreneurs in Kendal Regency. Data were analyzed using thematic analysis techniques. The research results show that the Kendal Regency Manpower Office has an important role in protecting workers' wage rights in accordance with Kendal Regency Regulation Number 101 of 2021. This role is carried out through various activities: Socialization of regulations: Kendal Regency Manpower Office carries out socialization of regulations regarding district minimum wages (UMK) and rights. other labor rights to workers and employers; Wage inspection: Kendal Regency Manpower and Industry Office carries out wage inspections in companies to ensure that employers pay wages to workers in accordance with the UMK and other laws and regulations; Handling complaints: Kendal Regency Manpower and Industry Office receives and handles complaints from workers who feel their wage rights have been violated by employers; Worker empowerment: Kendal Regency Manpower and Industry Office provides training and assistance to workers about their rights, including wage rights. In conclusion, the Kendal Regency Manpower Office has an important role in protecting workers' wage rights in accordance with Kendal Regency Regulation Number 101 of 2021. However, there are still several challenges that the Kendal Regency Manpower Office needs to overcome so that it can carry out its role optimally.

Abstract

Law No. 6 of 2023 concerning Job Creation (Job Creation Law) brings significant changes to employment policy in Indonesia, including labor protection. This research aims to analyze the implementation of the Job Creation Law regarding worker protection in Semarang City through a qualitative study. This research uses a qualitative approach with a case study method. Data was collected through in-depth interviews with 20 workers in Semarang City from various industrial sectors, as well as analysis of related documents. Data analysis was carried out thematically to identify the main themes related to the implementation of the Job Creation Law. The research results show that the implementation of the Job Creation Law regarding worker protection in Semarang City still faces challenges. Some of the main findings include: (1) A lack of understanding regarding regulatory changes among the workforce, (2) Inadequate socialization and education regarding the Job Creation Law, (3) Concerns regarding the potential negative impact of the Job Creation Law on workers' rights, and (4) the need to increase capacity and supervision on the part of the government and trade unions. Implementation of the Job Creation Law regarding worker protection in Semarang City requires further efforts from various parties. Increasing understanding, socialization, and education regarding the Job Creation Law is crucial. In addition, it is important to strengthen supervision and law enforcement to ensure the protection of workers' rights in accordance with the mandate of the Job Creation Law.

Abstract

The free visit visa (BVK) policy for foreign nationals (WNA) in Bali, Indonesia, has become an important instrument in encouraging tourism. However, this policy also gives rise to complex dynamics of social norms. This research aims to analyze existing studies regarding social norms related to BVK in Bali through a meta-analysis approach. This research uses a meta-analysis method by collecting data from various relevant empirical studies, both qualitative and quantitative, published between 2018-2024. Keywords used in the search included "social norms," "visa-free policy," "Bali," "tourism," and "Indonesia." Selected studies were then systematically analyzed to identify key themes and emerging patterns. The meta-analysis results show that there are various social norms related to BVK in Bali. Several norms support this policy, such as norms of friendliness and openness towards foreigners. However, there are also norms that have the potential to cause conflict, such as norms relating to politeness, customs and public order. This research provides a deeper understanding of the complexity of social norms related to BVK in Bali. These findings have important implications for stakeholders in formulating more effective and sustainable policies, as well as for the Balinese people in facing social changes that occur as a result of tourism.

Abstract

Demolition is a criminal act that not only violates the human rights of victims, but also has a serious impact on the community's sense of security. This study aims to examine the legal protection provided to victims of demolition in Judge Decision Number 399/Pid.B/2020/PN Dps and its implications for public safety. This study uses a normative juridical method with a case study approach. Primary data is obtained from judges' decisions, while secondary data is collected from laws and regulations, legal literature, and previous research. Data analysis is carried out qualitatively with legal interpretation and argumentation techniques. The decision of Judge Number 399/Pid.B/2020/PN Dps shows that there are efforts to protect the law for victims of demolition through the provision of compensation and rehabilitation. However, this ruling has not fully reflected the more comprehensive aspect of restorative justice. The implication of this decision on public security is that there is still potential vulnerability and public distrust of law enforcement. Legal protection for victims of demolition needs to be strengthened with a more comprehensive restorative justice approach, involving the active participation of victims, perpetrators, and the community. The strengthening of legal protection is expected to increase public security and prevent similar crimes from occurring in the future.

Abstract

Students' self-confidence and learning achievement are two important aspects of education. This research aims to examine the role of peers in increasing students' self-confidence and learning achievement in Jambi City, Indonesia. This research uses a quantitative approach with a cross-sectional design. The research sample consisted of 350 senior high school students in Jambi City who were selected by random sampling. Data was collected through questionnaires and analyzed using structural equation modeling partial least squares (SEM-PLS). The results of SEM-PLS analysis show that peers have a positive and significant influence on students' self-confidence (β = 0.45, p < 0.001). Apart from that, self-confidence also has a positive and significant effect on student learning achievement (β = 0.38, p < 0.001). Peers also have an indirect influence on learning achievement through self-confidence. Peers play an important role in increasing students' self-confidence and learning achievement in Jambi City. Interventions involving peers can be an effective strategy to improve both aspects.

Abstract

The Merdeka Belajar Kampus Merdeka (MBKM) program was launched by the Indonesian government with the aim of improving the quality of higher education and preparing graduates who are competent in the world of work. One important aspect that is expected to be improved through this program is student soft skills. This research aims to examine in depth the role of MBKM in the development of student soft skills in Jambi City, Indonesia. This research used an observational approach involving 350 students from various universities in Jambi City who participated in the MBKM program. Data was collected through participant observation, in-depth interviews, and questionnaires. Data analysis was carried out qualitatively and quantitatively to explore a comprehensive understanding of the impact of MBKM on student soft skills. The research results show that MBKM has a significant role in improving the soft skills of students in Jambi City. Participation in various MBKM activities, such as internships, humanitarian projects, and student exchanges, provides opportunities for students to develop communication skills, leadership, teamwork, problem-solving, and creativity. Apart from that, MBKM also helps students increase their self-confidence, independence, and ability to adapt to new environments. The MBKM program has proven effective in improving the soft skills of students in Jambi City. These findings provide empirical evidence that supports the importance of the MBKM program in preparing graduates who not only have academic competencies, but also the soft skills needed in the world of work. The implications of this research can be used as a basis for developing higher education policies that are more effective in improving the quality of graduates.
