Abstract

Currently, activities in outer space are commonplace for both developed and developing countries. Technological developments affect the intensity of the country's activities in space. All human activities in outer space have been regulated in the 1967 space treaty. However, many launches have been carried out by countries in outer space, outer space has begun to be filled with various celestial bodies that used to be empty space. Pollution that occurs in outer space must be avoided, because it is detrimental to the earth's environment caused by the entry of material from outer space. The purpose of writing this thesis, namely, First, The reason for space trash must be cleaned up. Second, who is responsible for space junk. The type of research used in this research is normative legal research. Normative legal research, library materials are basic data in (science) research classified as secondary data. Based on this approach, the main material to be reviewed is secondary legal material. Which focuses on positive legal norms in the form of conventions, namely the 1967 Space Treaty on activities in space related to space and objects in space. From the research results, there are two main things that can be concluded. First, the public problem that often occurs in the space environment is the safety of astronauts and the safety of artificial satellites from debris that fills space. The thing that makes space trash a problem in the future for the world is because the amount continues to grow. If this increase continues, the density in certain orbital regions will one day be too high so that it will become a collision between two objects, so that the debris that occurs will trigger another collision. Second, the party that harms other countries, then the responsibility is borne by the owner of the satellite who has harmed another country, in other words, the direct actor, unless there is an agreement from the space subjects for the responsibility owned by the satellite.

Abstract

Fundraising in Indonesia is a philanthropic activity that requires legal and sociological attention. The fundraising activity is a reflection that humans have an ethic of care for each other. In Indonesia, the implementation of the fundraising is regulated in Law Number 6 of 1961 concerning the Collection of Money and Goods. This law is the basic guideline for every platform that organizes donations, including a foundation. Along with the times, technology and digitalization have become the latest trends that are in demand by the wider community. The fundraising practice studied in this study is a crowdfunding donation system that has the potential to cause legal problems. As for the legal issue, it is about how to take civil legal responsibility for the misuse of donated funds by the Foundation/organizing platform. On the other hand, this study also wants to describe how the technical procedures for a legal entity in the form of a foundation or its derivatives are in raising funds. This study also wants to see who are legal subjects who can become fundraisers in Indonesia. Therefore, there needs to be a civil legal approach in responding to such unlawful acts. This research is a normative legal research. This is based on library research that takes quotes from reading books, or supporting books that have something to do with the problem to be studied. Add data sources Primary, secondary and tertiary data sources are the characteristics of this research. This study also uses qualitative data analysis and produces descriptive data. From the results of the research and discussion carried out, there are several conclusions obtained, namely:First, the regulation regarding donation based fundraising (crowdfunding donation system) does not yet have a clear arrangement regarding the subject who can do the fundraising, whether it is mandatory in the form of a business entity or not. This can be seen through the presence of various kinds of related laws and regulations, that there is no specific explanation regarding the procedures for raising these funds. Fundraising is mostly interpreted as a mere volunteer policy, so there needs to be normativity that regulates this fundraising. Second, fundraising through this donation system (crowdfunding system donation) is also inseparable from legal consequences when the allocation of funds is not in accordance with the mandate of the existing law. Supposedly, legal subjects suspected of misusing donated funds can be held civilly responsible through compensation or other compensation to existing donors.

Abstract

Law Number 28 of 2009 concerning Regional Taxes and Regional Levies explains that Land and Building Rights Acquisition Duty (BPHTB) is a tax on the acquisition of land and/or building rights. BPHTB levy procedures in South Solok Regency and Pariaman City, regulated based on Perbup and Perwako Number 13 of 2011 concerning the System and Procedure for Collecting Land and Building Rights Acquisition Duties, in Article 5 paragraph (1) taxpayers calculate and fill in their own BPHTB Regional Tax Deposit Letter (SSPD BPHTB). Taxpayers are required to calculate and fill in their own BPHTB SSPD. This is in line with the Self Assessment System. However, there are still many taxpayers who do not calculate and fill in the BPHTB SSPD themselves, but are more likely to submit it to PPAT, so that the mandate of Perbup and Perwako and the Self Assessment System tax collection system is not implemented. Even though it is submitted to PPAT, there are still taxpayers who commit tax fraud, by reducing the price of buying and selling transactions that actually occur with the transaction price stated in the BPHTB form requested by the taxpayer. The formulation of the problem in this study is: 1) How is the application of the levy of Land and Building Rights Acquisition Duty on the Transfer of Rights through Sale and Purchase in South Solok Regency and Pariaman City 2) How is the determination of land value as the basis for payment of Land and Building Rights Acquisition Duty on the Transfer of Rights through Sale and Purchase in South Solok Regency and Pariaman City. This research uses Empirical Juridical Research Methods, data used primary data and secondary data as well as data collection techniques in the form of interviews with parties related to this study. The implementation of BPHTB Levies in South Solok Regency and Pariaman City does not fully carry out the mandate of laws and regulations, namely Perbup and Perwako, where the regulations have stated that BPHTB management starting from filling in the BPHTB SSPD, calculations to depositing BPHTB owed is done by the taxpayer himself but it is not carried out, this happens because there is still a lack of taxpayer understanding of BPHTB management so that taxpayers look for other alternatives by submit the management of BPHTB to PPAT, and there are still taxpayers who commit tax fraud, by reducing the price of the actual sale and purchase transaction with the price stated on the requested BPHTB SSPB form, using 2 sales and purchase transaction receipts, one correct and one that has been reduced, in order to deceive the relevant SKPD and PPAT. Determination of land value, for the basis of BPHTB tax imposition is the Tax Object Acquisition Value (NPOP) and the Tax Object Acquisition Value (NPOP) is a sale and purchase transaction. However, in practice, the price of the sale and purchase transaction that has been agreed upon by the parties is not immediately granted by the relevant SKPD. However, it has other considerations, such as in South Solok based on the validation results, namely the Selling Value of Tax Objects (NJOP) and transaction prices, while in Pariaman it is carried out with considerations: 1) the value of buying and selling transactions 2) the Selling Value of Tax Objects (NJOP) 3) Market prices 4) The area or location of land 5) The economic value of the land 6) The type of soil 7) Going to the field.

Abstract

It is undeniable that one of the main causes of the globalization era, which is coming faster than all parties expected, is the rapid development of information technology. The implementation of the internet, electronic commerce, electronic data interchange, virtual office, telemedicine, intranet, and so on has broken through the physical boundaries between countries. The combination of computer technology with telecommunications has produced a revolution in the field of information systems. Data or information that in ancient times had to take days to be processed before being sent to the other side of the world, can now be done in seconds. It is no exaggeration if an IBM expert draws an analogy with automotive developments as follows: "If only the automotive world had progressed as fast as information technology, at this time a car with diesel fuel could be produced, which could be driven up to a maximum speed of 10,000 km/hour, with a purchase price of only about 1 American dollar. On a micro level, there are pretty interesting things to study, namely how the evolution of existing information technology developments significantly influences competition between companies in the world, especially those engaged in the service sector. Broadly speaking, there are four periods or eras of information system development, starting from the discovery of the first computer to the present.

Abstract

Legal developments can be seen from the legal activities of Indonesian citizens who come into contact with foreign nationals, such as marriages between Indonesian citizens and foreign nationals abroad. In Law Number 1 of 1974 Concerning Marriage Article 2 Paragraph 2 states that every marriage is recorded according to the applicable laws and regulations. What if the country where Indonesian Citizens and Foreign Citizens who are married do not organize marriages, therefore there are other laws that regulate matters related to marriage registration, namely the Population Administration Law. The type of research used is normative juridical, namely this type of research focused on examining the application of the rules or norms in positive law. Called by the term library research. It is called library research because in normative legal research it is carried out by examining library materials or secondary data only, the conclusion from this research is that marriages abroad carried out by Indonesian citizens with foreign nationals must be registered with the competent authority in the country. locally and reported to the representative of the Republic of Indonesia. If the country where the marriage is held does not organize marriage registration for foreign nationals, the marriage registration can be done at the local representative of the Republic of Indonesia and must be registered when they arrive in Indonesia. husband and wife.

Abstract

In an effort to increase the effectiveness of implementing the subsidized fertilizer distribution system policy, it is necessary to improve policies covering technical, management and regulatory aspects. Technical aspects: (a) increasing the intensity of dissemination of site-specific balanced fertilization systems and the use of organic fertilizers, (b) accelerating the development of organic fertilizers. Management Aspects: (a) closed socialization of the subsidized fertilizer distribution system to stakeholders including government officials, community leaders and farmers, (b) cross-sectoral coordination to ensure the effectiveness of subsidized fertilizer distribution and implementation of fertilization, and (c) repositioning of fertilizer distribution kiosks in Line IV by increasing the role of local governments in regulating the supply and distribution of subsidized fertilizers. Regulatory Aspects: (a) RDKK should be used as a 'node' that connects Permendag No. 21/M-DAG/PER/6/2008 and Minister of Agriculture No. 42/Permentan/OT.140/09/2008, and (b) fertilizer need allocation planning based on RDKK needs to be followed by distribution based on RDKK.
