Abstract

Abstract

This research examines the mobility and survival strategies of the informal sector in urban areas, particularly chicken noodle and meatball vendors, amidst the pandemic. The research method employed a survey with 158 respondents in the outskirts of Surakarta city. The results indicate that the high economic growth influences the consumption patterns of society and the growth of the informal sector, such as meatball and chicken noodle vendors. The Covid-19 pandemic imposes significant pressure on the informal sector, yet most vendors continue to operate with different strategies. The mobility of informal sector workers is not only from the surrounding areas of Surakarta but also from outside the province, driven by the attractiveness of the destination city, good accessibility, and adequate road conditions. Almost 27% of vendors stopped operating during the pandemic, but the majority persevered with adaptive strategies depending on their situation and creativity.

Abstract

Due to rapidly growing prosperity and the development of traffic technology, the traffic of passengers and goods by motorized vehicles is increasing. This has resulted in an increasing number of traffic accident victims, both drivers and road users. Accidents are caused by three main factors, namely first the human factor, second the vehicle factor, and finally the road factor. Starting from this road factor, the author discusses the causes of traffic accidents. Article 273 of the Road Traffic and Transportation Law Number 22 of 2009 states that the state is responsible for accidents caused by damaged roads. In order to use legal theory as an analytical tool in the research, theories such as the theory of responsibility and the theory of police are used in the handling of events or legal issues raised in the work. The author uses empirical or sociological research methods. The factor that limits the implementation of Article 273 of the Government Transportation Law No. 22 of 2009 is the absence of government regulations that regulate the provisions of Article 273 in more detail. The road administration is responsible for this problem. This uncertainty may affect the application of Article 273 by police authorities. People who do not report accidents due to damaged roads or potholes. Some do not know for various reasons and some do not want to engage with law enforcement officials who treat accidents as accidents. In this case, the police institution itself and the laws made by the government are not implemented because they are related to the government's responsibility.

The Indonesian Criminal Code strictly prohibits all forms of abortion. Whereas Law Number 36 of 2009 concerning Health provides confirmation of legal abortion arrangements, namely the result of medical emergencies and pregnancy as a result of rape. The perpetrator of the abortion as a result of rape is included in the category of unlawful acts or strictly regulated in Article 48 of the Criminal Code that no one can be punished by anyone who commits an act because he was forced by an urgent condition (overmacht). Human rights which are more specific to women's reproductive rights as part of women's human rights are guaranteed to be fulfilled in the Constitution of the Republic of Indonesia jo. Article 49 paragraph (3) of Law Number 39 of 1999 concerning Human Rights states that the special rights attached to women due to their reproductive function are guaranteed and protected by law. Children as victims of rape as well as perpetrators of abortion who are charged with imprisonment will have a negative impact on the mental growth and soul of the child. Based on criminal responsibility explained in the doctrine that the elements seen are the ability to be responsible, there is an element of error, there is no excuse for forgiveness. Rape victims as well as abortion perpetrators, who are clearly victims, instead receive unfair treatment when seeking justice. Children should receive guarantees for normal physical, mental and mental development. Settlement of cases against child victims of rape as well as perpetrators of abortion through the judicial process, the results will give a negative stamp to children as convicts who can adversely affect the community environment.
