Abstract

This study aims to discuss a review of the principles of Siyasah Dusturiyyah regarding regulations on the implementation of the People's Housing Savings Program. This study is qualitative in nature. The research design is a literature study. The results show that the problems detected in the Tapera implementation regulations indicate a discrepancy with the principles of Siyasah Dusturiyyah. Contradictions with the principles of musyawarah (syura), substantive justice (al-‘adl), public interest (maslahah), and obedience to valid law (tha‘at li al-imam) are certainly violated. This shows that the objectives of Tapera have not been achieved as expected.

Abstract

This study aims to discuss a brief review of Siyasah Syar'iyyah on public service supervision at the Bulukumba Regency Samsat office. This study is qualitative in nature. The research design is field research. The results of this study show that internal supervision is carried out routinely as a form of our commitment to maintaining integrity and ensuring that every procedure runs in accordance with applicable regulations. Meanwhile, external supervision is carried out through public reports, among other things. In addition, transparency is a form of accountability to the public. It is implemented by the Bulukumba Samsat UPTB through every transaction accompanied by official proof of payment in accordance with applicable regulations. In this way, the tax payment process can take place in a fair, professional, and accountable manner. Furthermore, one of the efforts that is considered a form of transparency is that the Bulukumba Samsat UPTB presents a list of official fees and service procedures openly through various media, such as bulletin boards, websites, and social media platforms. The purpose of this step is so that the public can easily obtain information, thereby avoiding illegal practices and illegal levies. This reality demonstrates its benefits. It is an indicator of alignment with Siyasah Syar'iyyah.

Abstract

This study aims to discuss a brief review of Siyasah Syar'iyyah on the role of the Ministry of Law and Human Rights in dealing with overcapacity of prisoners in correctional institutions class II A Sungguminasa. This study is qualitative in nature. The research design is field research. The results of this study show that the strategies implemented by the Sungguminasa Class II A Correctional Institution to deal with overcapacity include programs such as parole, conditional leave, remission, and home assimilation. Home assimilation was previously in effect but has since been discontinued. This shows that there are benefits. This is an indicator of alignment with Siyasah Syar'iyyah. One inmate complained that physical and psychological health problems could occur as a result of overcapacity. In addition, it also makes it difficult to move around and could lead to conflict. This indicates a contradiction with the benefits. It is an indicator of a lack of alignment with Siyasah Syar'iyyah. The Ministry of Law and Human Rights, in this case the Sungguminasa Class IIA Correctional Institution, must remain committed and strive to address overcapacity by proposing more effective programs while implementing legal programs. This is because the existing programs still show a contradiction with the benefits. If not, it means ignoring the benefits that indicate a lack of alignment with Siyasah Syar'iyyah.

Abstract

The increasing prominence of political popularity in Indonesian local elections raises questions about the relationship between electoral appeal and the substantive legitimacy of regional leadership. Candidates with extensive public recognition may attract greater voter support, yet popularity does not necessarily reflect integrity, competence, accountability, or leadership capacity. This study examines how political popularity shapes the construction of regional leadership legitimacy in Indonesian local elections and reconsiders this relationship from the perspective of Islamic constitutional law. The study employs a multidisciplinary qualitative approach combining statutory, sociological, and Islamic constitutional perspectives. Using library research, data were collected from electoral regulations, constitutional and legal documents, scholarly literature, and relevant previous studies. The data were analyzed through qualitative content analysis to identify the relationship between electoral popularity, political legitimacy, and the normative requirements of leadership. The findings indicate that political popularity functions as an important source of electoral support and symbolic legitimacy, particularly in an electoral environment shaped by media visibility and public recognition. However, electoral popularity alone provides an insufficient basis for substantive leadership legitimacy because it may obscure considerations of competence, integrity, accountability, and public responsibility. From the perspective of Islamic constitutional law, legitimate regional leadership requires more than electoral acceptance; it is also grounded in principles of justice, trust (amānah), accountability, public interest, and responsible exercise of political authority. The study therefore argues that the legitimacy of regional leadership should be understood as a multidimensional construct in which electoral recognition constitutes one component rather than its sole foundation. This reconceptualization contributes to contemporary discussions on democratic legitimacy and Islamic constitutional governance in Indonesia.
