Al Hikmah: Jurnal Studi Keislaman diterbitkan oleh Institut Agama Islam Al-Hikmah Tuban yang terbit sejak tahun 2011. Jurnal ini memuat kajian-kajian keislaman yang meliputi pendidikan Islam, sharî‘ah, pemikiran Islam, ekonomi, dan kajian Islam lainnya. Terbit dua kali setahun, yaitu bulan Maret dan September. Redaksi mengundang para akademisi, dosen, maupun peneliti untuk berkontribusi memasukkan artikel ilmiahnya yang belum pernah diterbitkan oleh jurnal lain. Naskah diketik dengan spasi 1,5 cm pada kertas ukuran A4 dengan panjang tulisan antara 20-25 halaman, 7000-9000 kata. Naskah yang masuk dievaluasi oleh dewan redaksi dan mitra bestari. Redaktur dapat melakukan perubahan pada tulisan yang dimuat untuk keseragaman format, tanpa mengubah substansinya. Alamat Redaksi: Jl. Abstract

This paper is a research library (library research) that will describe the formalization of Islamic criminal law in national criminal law.Formalization of Islamic criminal law in national criminal law can be done in two ways, namely the formalization of the principles of Islamic criminal law in national criminal law, and the formalization of norms of Islamic criminal law in national criminal law.Formalization Principles of Islamic criminal law in national criminal law did not experience any significant problems. Some principles of Islamic criminal law have become part of national criminal law. However, the formalization of the norms of Islamic criminal law in national criminal law experience obstacles and resistance, for example, efforts to formalize criminal offense stoning in adultery, hand amputation effort in the formalization of criminal offenses of theft and robbery, and efforts to formalize the death penalty in the murder offense.

Abstract

Privatization is the political and economic policies to boost economic growth by way of transfer of economic activities such as the management of public assets were previously managed by the State-Owned Enterprises (SOEs) to private national and foreign, as the country's efforts to improve the welfare of the people. Privatization of public assets is also a condition of the government debt to the International Monetary Fund (IMF) and the World Bank which requires each state to the borrower (debtor) to a policy of structural adjustment programs (structural adjustment programs), in line with global economic trends that wants minimal role of the state in economy was replaced by market mechanisms. Instead, it only provides opportunities privatization to a handful of the bourgeoisie to double the capital and the transfer of control of ownership of public assets from the state to international investors, the impact on the loss of public assets needs of the people, so that is not welfare but impoverishment.Islam has protected the public assets of mastering a handful of people, to ensure the welfare of the entire community, through the ban to have it. Public assets must be managed by the state to be distributed fairly to the well being of the people is not only limited to the three kinds of objects, water, grass and fire only, but includes: First, everything that is needed by the general public that, if not met, could cause divisions and disputes. Second, natural resources are abundant in number so that if controlled by a group of people, would lead to unequal distribution of wealth. Third, natural resources made it impossible nature of its formation is controlled by the individual. Fourth, strategic industries, i.e. industries that produce products/machines required by economy sectors activities such as manufacturing, agriculture, transportation, and telecommunications.

Abstract

The idea of Islamization of knowledge or rather Islamization of contemporary science the come from the premise that contemporary science is not value free and universal. M. Naquib Al-Attas which has as the originator of the concept of Sciences Islamization before the idea was popularized by Ismail al-Faruqi, explains that modern science was strongly influenced by religious views, culture, and philosophy, which reflects the awareness and experience of the West. For this reason that contemporary science can not be adopted out without sibghah with Islamic values.Islamization of knowledge tasks according to Al-Attas will include a critical test of modern scientific methods, concepts, estimates, symbols, empirical and rational aspects, and what about the values and ethics, interpretation of the origins , theory of knowledge, estimates of the external world, the uniformity of nature, and the rationality of natural processes, as well as his theory of the universe, classification of science, the limits and mutual relations between science and its relationship with other social relations.Meanwhile, according to Al-Faruqi, Islamization can be achieved through the incorporation of new science into the realm of Islam by removing, managing, analyzing, interpreting and over, and customize it according to Islamic values and views. According to the issues above, Al-Attas offers the concept of Islamization of knowledge (in Islamic education) as the accumulation of knowledge because of epistemological problem has been greatly influenced by the West. Influence Western epistemology that secularized, especially in the field of education has brought the destructive implications for the community, hence the offer that is soluteve thought to be things that are necessary.

Abstract

To improve the quality of teaching and learning processes need to use innovative strategies and methods in the learning process. It is important that teachers do not seem monotonous learning process. Empirically prove that the monotony of learning can result in saturation of students. If a student is sick and tired, it will result in lower student interest in learning that ultimately results in declining student achievement as well. Teachers in implementing the learning should select methods appropriate to students' abilities and to foster interest and creativity of students. Various alternative methods can be used by teachers in making learning in the classroom, one method of simulation. The application of simulation methods have four phases: the orientation phase, participation in training, simulation itself, and frequently asked questions. While the role of teachers in the simulation method is explained, umpiring, coaching and discussion.

Abstract

The role of the community to madrasah is important to create an qualified Islamic education that is participation in participating to develop the quality of education, participation among communities can do are (1) Community participation in management; include public participation in drafting the madrasah and public participation in appointment of school principals, school committees and others. (2) Public participation in the curriculum; include public participation, in implementing local curriculum, and community participation in the determination of the holiday. (3) Public participation in student recruitment; done by some community leaders to work together with teachers, before the New Year or before the lesson. (4) Public participation in the provision of funds, facilities and infrastructure; includes funding for the implementation costs for the provision of education facilities and infrastructure. (5) Public participation in the course of religious life in the madrasah. This participation of community leaders’ participation in religious activities in Madrasah. (6) Public participation in employment.

Abstract

Zakat is one of the ordinances of Allah in using Allah property makes property as a means of life of all mankind, and therefore should be directed to the common good. Someone who has met the terms of which are obliged to fulfill their zakat. Once the importance of worship zakat, so the set of sanctions against those who are reluctant to give charity. Zakat is also very important for increasing the economic life of the people and their welfare. Honey is one of the gift of God to His servants that contain lots of subtances of food, medicines from the juice. It means that honey bees are out of the stomach is a gift from Allah SWT. Honey is a liquid produced by bees chewy from various sources and plant juice has one function, namely as a drug for humans.According to Imam Abu Hanifah that the honey shall be issued zakat, as is obligatory for all the results that came out of the ground, provided that bees do not nest in the kharajiyah land, because the kharajiyah land already levied taxes, in accordance with the provision that the two obligations can not be both contained in one property by reason of the same one. But if the honey is in the ‘usyriyah land, then it must be taken the zakat, as well as when bees nest in the woods or mountains. Imam al-Shafi'i has a different argument with Imam Hanafi. He argues that the honey is a type of property that can not be used as an object of charity, and he further agrees that it is free of zakat of honey, because the goods are collected zakat must have strong proofs either sunnah or atsar.

Abstract

Today, Indonesia government through Education and Culture Ministry tries hard to achieve the cuccess of nation character education. The government has published National Rule of Nation Character Building 2010-2025, and the chief Design of Character Education 2010.The two foundation are used to develop culture and character education in school, and the implementation are through three ways: (1) Namely of self developmentprogram, (2)The integration in courses, and (3) School culture. This article discusses abaut how to build a good character through the development of school culture using some strategies: school routine activity, spontaneous activity, modeling, theaching, and reinforcing of school environment. School culture in the character building must be continuously built and done by the whole school stake holders; start from headmaster, teachers, officers, students, parents, society, and government. Without good school culture, it is difficult to apply character education for students.

Abstract

code of practice for a court decision in a case based on the chapter house emptying in article 1033 (Rv) and article 200 paragraph (11) HIR and article 218 paragraph (2) RBG, which in these articles provides provisions regarding how the house emptying execution that contains certain conditions including: (1) Decision that would have been executed have the force of permanent, (2) The loser still refused to run the contents of the court verdict again him eventhough voluntarily given warning (aanmaning) and the court granted a grace period has been exceeded, (3) Chief of the court where the case is decided upon has issued an order setting the execution.Step to be taken when getting resistance from a third party, basically there are 2 (two), namely: (1) Perform temporary moratorium on execution emptying wan to run, this is done if he believes the resistance/protest is submitted by third parties in the field are based legitimate property rights, or there are indication that lead the physical clashes that could ultimately lead to casualties, (2) Fixed blanking out the execution despite opposition from third parties, if the resistance is not based on legitimate property rights and is only intended to frustrate the execution of emptying, and when the execution started emptying remains no indication that lead to physical clashes can cause casualties.

Abstract

The traditions of the Prophet hadist) is the source of Islamic teachingsbesides the Quran. However, both have differences in terms of narration from theProphet. The verses of the Qur'an as a whole are narrated in mutawatir narrations.It is defrerent from hadits. Some of its narrations are mutawatir and some othersare ahad. Therefore based on its status, the Qur'an has the so-called qath'i al-wurudas a whose and is no longer in need of any research on its originality. While interms of hadist, some have zanni al-wurud (especially categorized in the ahadhadists) so to determine whether the hadist has its originality from the Prophet ornot, it is necessary to study hadist in terms the quality and quantity of the chainsof narration (sanad). A study about the hadist on the deceased person tortured dueto the cries of his family, indicates that the hadist narrated by al-Bukhari,Muslim, al-Nasa'i, al-Tirmidhi, Ibn Majah, Malik and Ahmad ibn Hanbal based onthe chains of narrators, has such qualities as thiqah, ma'mun, hujjah, saduq, hafizzli al-Hadith, and ahl 'ilm. The totality of the value of the narrators has the statusmu'asarah and liqa' and can be used as evidence that al-Tirmidhi sanad iscontinued from mukharrij to Prophet Muhammad. While in terms of the quantityof its sanad, the hadist is ahad. This is because the number of the narrators in eachtabaqah is more than two people, two people in the tabaqah of Prophet'scompanions, then continued by the number of many narrators in any tabaqah untilthe so-called mukharrij hadist.
