Abstract

National interests is a fundamental thing that is often discussed, but does not have the exact concept and parameters. Especially in investment, national interests increasingly reduced by the emergence of some problems in Bilateral Investment Treaties (BIT), and certainly, the most disadvantaged entity is the State. This paper examines the dialectic between national interests with the basic principle, as one of the principles in the WTO-TRIMs that should be applied by all the States that have ratified that convention, including Indonesia. If there is a conflict between the national interest and the basic principle, especially in BIT, then the state must remain in favor of its national interests. The underlying basis of the argument is that the State has sovereignty whose power must be maintained. This is in line with the 'calvo doctrine' and the basic essence that the state (in this case the host state) has sovereignty over all natural resources-permanent sovereignty over natural resources-such as environmental protection, health and protection of human rights.

Abstract

Food safety issues have a significant impact on the socio-economic life of this world, which is characterized by the global spread of the virus hazards, microbial pathogens and pesticide residues that cause health problems and even death. In order to protect the state from the threat of viral, microbial pathogens and pesticide residues, the developed states apply the standards for the trade barriers so that the hazardous contaminated products can be prevented to enter to their states. Islamic Epistemology describes the food security in Qur'an as Surat Al-Baqoroh paragraph 2: 168 "eat the halal and good". Halal foods is the right of Allah to justified. Good food is a food that provides peace and containts no danger. This is in line with the ideology of Pancasila and the Constitution as the basic philosophy of the establishment of laws and regulations of Indonesia. Food safety has been sought by both international organizations and countries in the world. The effort is done with a solid instrument and packaged in an international agreement which is then accessed and implemented in national legislation.

Abstract

Payment transactions with electronic money were conducted by transferring the fund electronically to merchant terminal, which would directly subtract the value of electronic money on electronic device managed by the owner. The characteristic of electronic money are as follows: to be deposited in advance to the issuer; the sum of money is electronically deposited in a particular medium, it can be card or other communication instrument; its function is as a non cash payment instrument to merchant not to the issuer of electronic money; and the sum of electronic money does not constitute saving product because it does not include in those guaranteed by Deposit Guarantor and it is not given any interest or reward. Electronic money is essentially cashless money, whose monetary value comes from the value of money deposited in advance to the publisher, then stored electronically in an electronic media such as server (hard drive) or chip card, which functions as a Non-cash payment instrument to the non-electronic issuer concerned. The monetary value of the electronic money is in electronic form (electronic value) obtained by redeeming a sum of cash or debiting his account in the bank and then stored electronically in electronic media in the form of a stored value card.

Abstract

Abstract Nowadays financial institutions based on sharia principle such as Islamic Bank is one of the signs of the rapid growth of Islamic financial institutions. Therefore, the supervisor from the aspect of compliance with sharia principles is needed to maintain the existence and quality of Sharia Bank in its operation. However, the speed dynamics of banking backfired for the Supervision of Sharia Principles Compliance. Furthermore, the method used in this paper is normative legal research. The result of the analysis shows that supervision of Sharia Principles Compliance with Islamic Banks is operated by Sharia Supervisory Board (DPS). Besides, DPS’s negligence that causes a violation of compliance with sharia principles will have legal consequences related to the accountability of DPS. In this case, the form of DPS responsibility can be administrative sanctions, criminal sanctions, to the prohibition of becoming DPS. Keywords: DPS, Sharia Compliance, Responsibility   Abstrak  Lembaga keuangan islam saat ini mulai berkembang pesat di Indonesia ditandai dengan semakin banyak kemunculan lembaga keuangan yang kegiatan operasionalnya berbasis prinsip syariah salah satunya Bank Syariah. Untuk menjaga eksistensi dan kualitas Bank Syariah dalam menjalankan operasionalnya, perlu ada pengawasan dari aspek Kepatuhan prinsip syariah. Pengawasan terhadap Kepatuhan prinsip syariah tidak mudah apabila melihat dinamika Perbankan sangat cepat sehingga menjadi problematika dan tantangan tersendiri. Metode yang digunakan dalam penulisan ini yaitu penelitian hukum normatif. Hasil dari analisa menunjukan bahwa pengawasan terhadap Kepatuhan prinsip syariah pada Bank Syariah dilakukan oleh Dewan Pengawas Syariah (DPS). Pelanggaran atau penyelewengan terhadap Kepatuhan prinsip syariah yang terjadi akibat kelalaian atau kesalahan DPS akan menimbulkan suatu akibat hukum. Akibat hukum tersebut berkaitan dengan pertanggungjawaban DPS. Bentuk tanggung jawab DPS dapat berupa sanksi administratif, sanksi pidana, hingga pelarangan menjadi DPS. Abstract

The high level of Foreign Direct Investment (FDI) is also supported by the availability of infrastructure to the remote area where the investment will be implemented. However, with limited funds from both APBN and APBD, infrastructure development can not be fully done by the government. Therefore, the government will cooperate with the investor (private) in the implementation of infrastructure development known as public private partnership. The main problem in implementing PPP is the allocation of risk to PPP projects. The different bargaining positions between the government and the private sector resulted in the fact that most of them impose risks on private parties (private). Implementation of PPP is closely related to the emergence of various risks including and not limited to regulatory risks, force majeure, etc. If there is no risk allocation arrangement proportionally based on governance principles, it weakens the pattern of PPP cooperation in Indonesia. PPP as one form of risk sharing in infrastructure investment should not release the role and government support to private parties / investors. Even in practice, PPP implementation in Indonesia only relies on BOT (Build Operate and Transfer) scheme which is expected to minimize government support in project implementation. This will ultimately lead to project failure.

Abstract

By means of its decision number 46/PUU-VIII/2010, the Constitutional Court has made a breakthrough which intend to guarantee the fulfillment of civil rights for a child born out of wedlock from his/her both parents. By the fulfillment of civil rights, justice has been materialized for the child, as viewed from the perspective of the theory of justice.

Abstract

This reseach is focused on the making argument to looking justice progress of verdict. The justice progress which is mean is justice on the law of procedure. Law of justice is need to implemented by judge into the case as well as regulated in the Act. This research using context of problems as how the judges giving arguments of law into his verdict on the case of children custody and will continue with review it those verdict as well as law and justice consideration. Research result found three judges verdicts which are related with children custody on 2010. Those verdicts give a one of legal basic for three different consideration of verdict. 1st children custody give under mother, 2nd children custody give under father, 3rd children custody give to parents, its becaus of each party did not request specifically for children custody. For the conclusion overall judges use the law logic in the term of correct as well as legal basis. Its comply all of justice value to making verdict. Thus the justice which apply by judges is procedure justice eventhough those different in decision making.

Abstract

Partnership relation as one of work relation between the farmer as the representative of micro business and main company as macro business as the owner, science and technology based on a deal is known as plasma core partnership relation. In it's implementation, many problems happened and resisted which may trigger disadvantages especially for the farmer. Therefore it is very important to pay our attention about the validaty and basics contract principle in the implementation of plasma core partnership contract. The goverments support actively or passively takes also a role in enforcing norms and regulations of the contract, so that the purpose of every side can be reached and the goals of every party could be secured as well.

Abstract

Phenomena that occur in society marriage only refers to the Islamic religious law met the requirements and harmonious marriaege, so it can be said only based on article 2, paragraph (1) of Constitution Number 1 of 1974 on Mariage, lawful religion also means lawful state, but their marriage is not based on article 2, paragraph (2) provisions on orders registration of marriage, known as a marriage under the hand. Marriage Constitution set is limited to marriages performed before the law was enacted, but the religious court based on legal considerans accept and grant approval under the hand of marriage to marriage after the Marriage Constitution enacted by basing on the Compilation of Islamic Law article 7, paragraph 3.

Abstract

In fulfillment of a contract, it must be based on good faith and based on the terms of validity of the contract that has been arranged in Burgerlijk Wetboek (BW). One of its requirements is agreed, this agreement apparently has a variety of important aspects, regarding the will. The will is an important part in the validity of a contract, when there is a defect of the will, then the contract would have to see the consequences. Defects of will shall include a compulsion, which lately appeared similar pattern type that called abuse of circumstaces and economic duress. Both of them are not set in BW. This situation is different from compulsion (dwang) in general, yet still have some similarities in their characteristics. Because it is still just a doctrine, then the solution requires prudence and foresight of the judges.
