Abstract

Abstract In the digital landscape, there is a pluralistic data governance norms or digital anarchy which can be jurisprudentially viewed as lack of order or multiple conflicting laws operating in a particular state. We attempt to investigate the jurisprudential claims of Lex Nullius in the Global South and the impact of the current Lex Digitalis by foreign private digital platform which rules emanating from the Global North, and how can this condition be theorized for the benefits of the Global South. In the context of data governance, digital anarchy is not a lack of norms; but non-state actors and digital platforms that create norms that impact sovereigns and citizens. Relying on comparative case studies, political theory, postcolonial doctrines, and policy analysis focused on the Global South countries, this paper examines the existing principles of sovereignty and jurisprudence theory to rethink the discourse on digital sovereignty. In this paper, we find that pairing Lex Digitalis with Lex Nullius provides a diagnosis of when digital governance is not just about regulatory gaps but the recolonisation of sovereigns. The paper offers a new way to think about sovereignty that sets boundaries on the power of digital platforms in the Global South. Abstrak Dalam lanskap digital, terdapat pluralisme norma tata kelola data atau anarki digital yang secara yurisprudensial dapat dipandang sebagai ketiadaan keteraturan ataupun keberadaan berbagai hukum yang saling bertentangan dan beroperasi dalam suatu negara. Artikel ini berupaya menyelidiki klaim-klaim yurisprudensial mengenai Lex Nullius di Dunia Selatan serta dampak dari Lex Digitalis yang saat ini dibentuk oleh platform digital privat asing dengan aturan yang berasal dari Dunia Utara, sekaligus menelaah bagaimana kondisi tersebut dapat diteoretisasikan demi kepentingan negara-negara Dunia Selatan. Dalam konteks tata kelola data, anarki digital bukanlah ketiadaan norma; sebaliknya, ia ditandai oleh aktor non-negara dan platform digital yang menciptakan norma-norma yang memengaruhi negara berdaulat maupun warga negaranya. Dengan bertumpu pada studi kasus komparatif, teori politik, doktrin pascakolonial, serta analisis kebijakan yang berfokus pada negara-negara Dunia Selatan, artikel ini mengkaji prinsip-prinsip kedaulatan dan teori yurisprudensi yang ada guna meninjau kembali diskursus mengenai kedaulatan digital. Artikel ini menemukan bahwa penggabungan konsep Lex Digitalis dan Lex Nullius memberikan kerangka diagnosis untuk memahami situasi ketika tata kelola digital tidak lagi sekadar berkaitan dengan kekosongan regulasi, melainkan merupakan bentuk rekolonisasi terhadap kedaulatan negara. Pada akhirnya, artikel ini menawarkan cara baru untuk memahami kedaulatan yang menetapkan batasbatas terhadap kekuasaan platform digital di negara-negara Dunia Selatan.

Abstract

Abstract This paper examines how imagination, despite its historical instrumentalization as a colonial methodology in international law as revealed in Koskenniemi’s To the Uttermost Parts of the Earth, can be repurposed as a decolonial tool. By drawing a temporal analogy, it first introduces imagination's role in the early European international legal thought by exploring Koskenniemi’s examples of bricolage alongside Anghie’s ‘dynamic of difference’ to underscore the need for disenchantment. It then looks into present-day counter-narratives emerging from Global South imaginations encapsulated in the third world approaches to international law or the TWAIL movement that challenge the colonial ever-present. Finally, it advocates for speculative thinking drawn from various sources as a means of envisaging alternative futures for international law, with particular emphasis on scientific and other types of fictions . The paper concludes by arguing for a structured yet creative decolonial imagination agenda that can help overcome the persistence of colonial legacies in international law while maintaining sufficient space for revolutionary thinking about world order. Abstract Makalah ini mengkaji bagaimana imajinasi, meskipun secara historis telah diinstrumentalisasi sebagai metodologi kolonial dalam hukum internasional sebagaimana ditunjukkan oleh Koskenniemi dalam To the Uttermost Parts of the Earth, dapat digunakan kembali sebagai alat dekolonial. Dengan menggunakan analogi temporal, makalah ini pertama-tama membahas peran imajinasi dalam pemikiran hukum internasional Eropa awal melalui contoh-contoh bricolage yang diuraikan oleh Koskenniemi serta konsep dynamic of difference dari Anghie untuk menegaskan pentingnya proses disenchantment (pembongkaran ilusi atau pesona kolonial). Selanjutnya, makalah ini menelaah narasi tandingan kontemporer yang lahir dari imajinasi Global Selatan, sebagaimana tercermin dalam gerakan Third World Approaches to International Law (TWAIL), yang menantang keberlangsungan kolonialisme dalam hukum internasional masa kini. Pada akhirnya, makalah ini mengadvokasi pemikiran spekulatif yang bersumber dari berbagai tradisi sebagai sarana untuk membayangkan masa depan alternatif bagi hukum internasional, dengan penekanan khusus pada fiksi ilmiah dan bentuk-bentuk fiksi lainnya. Makalah ini menyimpulkan bahwa agenda imajinasi dekolonial yang terstruktur namun tetap kreatif dapat membantu mengatasi keberlanjutan warisan kolonial dalam hukum internasional, sembari mempertahankan ruang yang memadai bagi pemikiran revolusioner mengenai tatanan dunia.

Abstract This paper examines how domestic courts interact with international law through the lens of the “Avoid, Align, Contest” framework, applied to two leading theories: Nollkaemper’s vision of international law as a rule of law, and Peters’ conception of it as a global constitution. Nollkaemper emphasizes judicial alignment and legal coherence, requiring strong institutional capacity to enforce international norms. Peters, by contrast, allows courts greater flexibility to contest or avoid international law when grounded in shared constitutional values. By mapping each theory onto the posture model, the paper clarifies not only expected judicial behavior, but also the institutional and normative conditions required for courts to operate effectively within these theoretical frameworks. Intisari Makalah ini mengkaji bagaimana pengadilan domestik berinteraksi dengan hukum internasional melalui kerangka ‘Menghindar, Menyesuaikan, dan Menggugat’ (Avoid, Align, Contest), yang diterapkan pada dua teori utama: pandangan Nollkaemper tentang hukum internasional sebagai suatu tata hukum (rule of law), dan gagasan Peters tentang hukum internasional sebagai konstitusi global. Model “postur” ini berasal dari pengamatan empiris terhadap banyak pengadilan domestik, sementara kedua teori tersebut berbeda secara filosofis; makalah ini menerapkan kembali model postur tersebut pada tingkat teoretis. Makalah ini menunjukkan bahwa komitmen teoretis (tata hukum vs. konstitusi global) secara implisit merumuskan ekspektasi yang berbeda terhadap postur yudisial.

Abstract

Abstract The modern legal paradigm is rooted in an anthropocentric worldview that positions humans as the sole holders of legal subjectivity, while nature is reduced to an object of regulation and exploitation. This article critically examines the construction of the right to a healthy environment within modern law, particularly under global capitalism. Using a normative juridical method with philosophical and conceptual approaches, it explores how the anthropocentric foundations of legal norms contribute to the ecological crisis. Drawing from environmental ethics, ecofeminism, bioethics, and Earth Jurisprudence, this study deconstructs the human-centered notion of environmental rights and proposes an ecocentric reformulation of legal paradigms that recognizes nature’s intrinsic value, grounded in global comparative practices and Indonesia’s indigenous wisdom. The study concludes that achieving ecological justice requires not only normative reform but also an epistemological and ontological transformation in how law conceptualizes the human–nature relationship. The novelty of this research lies in integrating environmental ethics and Earth Jurisprudence into a coherent legal-philosophical framework for reimagining environmental rights in Indonesia. Intisari Paradigma hukum modern berakar pada cara pandang antroposentris yang menempatkan manusia sebagai satu-satunya subjek hukum, sementara alam direduksi menjadi objek pengaturan dan eksploitasi. Artikel ini mengkaji secara kritis konstruksi hak atas lingkungan hidup dalam kerangka hukum modern, khususnya dalam konteks kapitalisme global. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan filsafat hukum dan konseptual, kajian ini menelaah bagaimana fondasi antroposentris dalam hukum berkontribusi pada krisis ekologis. Melalui perspektif etika lingkungan, ekofeminisme, dan bioetika, artikel ini mendekonstruksi konsep hukum tentang hak atas lingkungan yang selama ini bersifat instrumentalistik dan berpusat pada manusia. Lebih lanjut, artikel ini menawarkan reformulasi paradigma hukum menuju pendekatan ekosentris yang mengakui nilai intrinsik alam, dengan mendasarkan pada praktik komparatif global serta kearifan lokal di Indonesia. Kajian ini menyimpulkan bahwa transformasi hukum menuju keadilan ekologis tidak hanya memerlukan perubahan normatif, tetapi juga pergeseran epistemologis dan ontologis dalam cara hukum memandang relasi manusia dengan alam. Abstract

Abstract This article analyzes the paradox of implementing the right to be forgotten in Indonesia through the Lacanian psychoanalytic perspective developed by Slavoj Žižek. This study highlights the structural impossibility of completely erasing digital trace despite the existence of legal mechanisms that protect individual privacy, an issue that is increasingly relevant in the digital age. Previous studies have emphasized procedural or technical aspects, whereas this research examines the psychoanalytic and philosophical dimensions of digital forgetting. An analysis of Article 26 of the ITE Law shows that the court procedures in question produce new legal documentation, reinforcing rather than erasing digital traces. Žižek's concepts of the Real, the Symbolic, and the Imaginary show how these traces remain, creating a cycle of repetition and return of the repressed that challenges conventional legal approaches. This study concludes that the right to be forgotten cannot be fully realized through technical or procedural mechanisms, but rather through fundamental aspects of modern subjectivity, digital identity, and the limitations of law in dealing with digital reality. Abstrak Artikel ini menganalisis paradoks implementasi hak untuk dilupakan di Indonesia melalui perspektif psikoanalisis Lacanian yang dikembangkan Slavoj Žižek. Penelitian ini menyoroti ketidakmungkinan struktural untuk sepenuhnya menghapus jejak digital meskipun ada mekanisme hukum yang melindungi privasi individu, yang menjadi masalah yang semakin relevan di era digital. Studi sebelumnya lebih menekankan aspek prosedural atau teknis, sedangkan penelitian ini menelaah dimensi psikoanalitis dan filosofis dari pelupaan digital. Analisis Pasal 26 UU ITE menunjukkan bahwa prosedur pengadilan yang dimaksud justru menghasilkan dokumentasi hukum baru, yang memperkuat alih-alih menghapus jejak digital. Konsep Žižek tentang Real, Simbolik, dan Imajiner menunjukkan bagaimana jejak tersebut tetap ada, menciptakan siklus repetisi dan return of the repressed yang menantang pendekatan hukum konvensional. Penelitian ini menyimpulkan bahwa hak untuk dilupakan tidak dapat diwujudkan sepenuhnya melalui mekanisme teknis atau prosedural, melainkan melalui aspek fundamental subjektivitas modern, identitas digital, dan keterbatasan hukum dalam menghadapi realitas digital.

Abstract

Abstract Every scholar and learner of international law knows that jus cogens is the highest norm in the international legal order; therefore assume that “all other” sources of international law are supposed to become null and void if they contradict jus cogens. However, scholars and international institutions (including the International Law Commission) seem to overlook customary international law (CIL), easily assuming it to be part of the “all other” that are derogated by jus cogens. If we easily forget that there is virtually no actual case example of CIL contradicting jus cogens, we naturally do not ask why that is so. Exploring relevant scholarly literature as well as international documents, we explore the relationship between CIL and jus cogens. We find that one of the elements of both CIL and jus cogens overlaps, i.e. acceptance by the international community (albeit different wording), making conflict logically impossible and questions on the consequence of conflicts illogically fallacious. Abstrak Setiap cendikia dan pelajar hukum internasional mengetahui bahwa jus cogens adalah norma tertinggi dalam tatanan hukum internasional; oleh karena itu diasumsikan bahwa "semua sumber hukum internasional lainnya" seharusnya menjadi batal dan tidak berlaku jika bertentangan dengan jus cogens. Namun, para cendikia dan lembaga internasional (termasuk Komisi Hukum Internasional) tampaknya mengabaikan hukum kebiasaan internasional (CIL), dengan mudah menganggapnya sebagai bagian dari "semua sumber lainnya" yang dikesampingkan oleh jus cogens. Jika kita dengan mudah melupakan bahwa hampir tidak ada contoh kasus nyata CIL yang bertentangan dengan jus cogens, kita tentu tidak bertanya mengapa demikian. Dengan mengeksplorasi literatur ilmiah yang relevan serta dokumen internasional, kami mengeksplorasi hubungan antara CIL dan jus cogens. Kami menemukan bahwa salah satu elemen dari CIL dan jus cogens tumpang tindih, yaitu penerimaan oleh komunitas internasional (walaupun dengan kata-kata yang berbeda), membuat konflik secara logis tidak mungkin dan pertanyaan tentang konsekuensi konflik secara tidak logis keliru.
